Today's discussion leads to the question: How can God still be good, even when bad things happen? Author Jess Kayhart shares her personal story of loss and how she was able to turn towards God and not away from Him during the most painful point of her life. Jess shares key moments of her traumatic childhood, including being involved in a tragic accident that took the life of Penny, her stepmom. Then in response to that lost, her father committed suicide 6 weeks later. She believed the following lies: “If you can know everything and you can help during a crisis, that can be where your value comes from. If you know enough and are good enough, it will all be fine.” This was a lie placed in Jess's heart that led her to a life of perfectionism. The turnaround for her happened at a conference/church service where she devoted her life to Christ and received His deep healing. He healed all her wounds. From there Jess was able to fully heal and surrender to her situation. She then talks about her posture for the Lord. How she changed her posture and slowly turned towards Him. Jess shares how she met the love of her life, how she was set up and mortified to be set up with Ken, her future husband. They met at a youth conference and had a whirlwind romance. They met and married within 6 months. However, trust was still difficult for Jess to acquire and she talks about how that is normal for people who go through trauma. She talks about the importance of honesty and open communication. She says, “Do not ask questions you don't want the answer to!” How good is that?! Panic attacks became a regular thing in Jess' life. It taught her that she still had parts of her that were trying to get control. And there were still things Jess needed to deal with. The panic attacks went on for 6 months straight and they came out of nowhere! They were relentless. Her mind went racing and she felt a tremendous amount of heat in her body and she was unable to breathe. So all she could think to do was walk outside. Ultimately, she found a therapist to help her work through the anxiety. How you can be compassionate towards yourself. The topic of this episode is, “What role should Congress have in foreign affairs?” My guest is Alissa Ardito, the author of the book Machiavelli and the Modern State: The Prince, the Discourses on Livy, and the Extended Territorial Republic (Cambridge University Press, 2015). She has had a rich and varied career in governance, and she has thought deeply about legislatures and policymaking. Dr. Ardito has served as a general counsel at the Congressional Budget Office, and as an attorney advisor with the Administrative Conference of the United States. She received a Ph.D. in political science from Yale University, a J.D. from the University of Virginia School of Law, and a B.A. from the University of Virginia—all of which makes her wise in the ways of statecraft. Kevin Kosar: Welcome to Understanding Congress, a podcast about the first branch of government. Congress is a notoriously complex institution, and few Americans think well of it, but Congress is essential to our republic. It's a place where our pluralistic society is supposed to work out its differences and come to agreement about what our laws should be. And that is why we are here: to discuss our national legislature and to think about ways to upgrade it so it can better serve our nation. I'm your host, Kevin Kosar, and I'm a resident scholar at the American Enterprise Institute, a think tank in Washington, DC. Welcome to the podcast. Alissa Ardito: Thank you, Kevin. It's great to be here. Kevin Kosar: Let's start our inquiry with the Constitution, the foundation for our system of national self-governance. What constitutional powers does Congress have over foreign affairs? Alissa Ardito: Well, actually, if you look at the text of the Constitution, Congress has quite a lot of power over foreign affairs. The issue is that they are littered in various different parts of Section 8 and Section 10 of Article 1. I'll just mention a few. Actually, the first is Clause 1 of Section [8], tax and spend—the “Power To lay and collect Taxes…pay the Debts, and provide for the common Defence.” Congress also has the power to regulate commerce with foreign nations; establish uniform rule of naturalization; define and punish piracies on the high seas; the great war power of Section 8, Clause 11, “To declare War, grant Letters of Marque and Reprisal, and make Rules concerning Captures on Land and Water.” And then it even moves in, arguably, to everything about raise and support armies, provide and maintain a navy, regulate and call forth the militia. And then you get into—I think [it's] fascinating—I would argue that Section 9, Clause 7, “No Money shall be drawn from the Treasury, but in Consequence of Appropriations made by Law,” also constitutes a foreign affairs power. Then you get into all the limitations in Section 10 on states. The real concern was at the time of the Framing that they were exercising foreign relations independently. And then you can even move into Article 2 and the powers in the Senate, the treaty power and advise and consent on nominations as well. So, taken together, that's actually a pretty robust set of powers. Kevin Kosar: Yes, and these powers were, as you alluded to, scraped away from executive authority and scraped away from state authority and centered in the first branch: Congress. Now, Congress's authorities, we should probably also mention, go beyond those explicitly enumerated in the Constitution. Obviously there are a whole number of statutes that assign powers to Congress over foreign affairs, such as the War Powers Resolution, but additional legislative powers exist beyond that. For example, senators and members of the House can use their positions to raise the salience of issues, such as when Congress allows leaders of foreign nations to address it, or when legislators engage in legislative diplomacy and make trips abroad to meet with heads of state. There seems to be so much that Congress can do in foreign affairs. Is that right?...

This week in the final episode of Series Three of Energy Transition Now , David Linden speaks with Libbe Skovgaard-Petersen, Vice President at Copenhagen Infrastructure Partners, CIP, a renewable energy investment fund. Libbe speaks to CIP's goal of being a €100 billion fund by 2030 and the importance and focus on P2X - Power to X - particularly in reaching hard to abate sectors.
The Taxing and Spending Clause (which contains provisions known as the General Welfare Clause and the Uniformity Clause), Article 1, Section 8, Clause 1 of the United States Constitution, grants the federal government of the United States its power of taxation. While authorizing Congress to levy taxes, this clause permits the levying of taxes for two purposes only: to pay the debts of the United States, and to provide for the common defense and general welfare of the United States. Taken together, these purposes have traditionally been held to imply and to constitute the federal government's taxing and spending power. Constitutional text. The Congress shall have Power To lay and collect Taxes, Duties, Imposts and Excises, to pay the Debts and provide for the common Defense and general Welfare of the United States; but all Duties, Imposts and Excises shall be uniform throughout the United States; Background. One of the most often claimed defects of the Articles of Confederation was its lack of a grant to the central government of the power to lay and collect taxes. Under the Articles, Congress was forced to rely on requisitions upon the governments of its member states. Without the power to independently raise its own revenues, the Articles left Congress vulnerable to the discretion of the several State governments—each State made its own decision as to whether it would pay the requisition or not. Some states were not giving Congress the funds for which it asked by either paying only in part, or by altogether ignoring the request from Congress. Without the revenue to enforce its laws and treaties, or pay its debts, and without an enforcement mechanism to compel the States to pay, the Confederation was practically rendered impotent and was in danger of falling apart. The Congress recognized this limitation and proposed amendments to the Articles in an effort to supersede it. However, nothing ever came of those proposals until the Philadelphia Convention. Powers granted. The power to tax is a concurrent power of the federal government and the individual states. The taxation power has been perceived over time to be very broad, but has also, on occasion, been curtailed by the courts. The Congress shall have Power To regulate Commerce with foreign Nations, and among the several States, and with the Indian Tribes. The Supreme Court has seldom restrained the use of the commerce clause for widely varying purposes. The first important decision related to the commerce clause was Gibbons v Ogden, decided by a unanimous Court in 1824. The case involved conflicting federal and state laws: Thomas Gibbons had a federal permit to navigate steamboats in the Hudson River, while the other, Aaron Ogden, had a monopoly to do the same granted by the state of New York. Ogden contended that "commerce" included only buying and selling of goods and not their transportation. Chief Justice John Marshall rejected this notion. Marshall suggested that "commerce" includes navigation of goods, and that it "must have been contemplated" by the Framers. Marshall added that Congress's power over commerce "is complete in itself, may be exercised to its utmost extent, and acknowledges no limitations other than are prescribed in the Constitution". The expansive interpretation of the Commerce Clause was restrained during the late nineteenth and early twentieth centuries, when a laissez-faire attitude dominated the Court. In United States v E C Knight Company (1895), the Supreme Court limited the newly enacted Sherman Antitrust Act, which had sought to break up the monopolies dominating the nation's economy. The Court ruled that Congress could not regulate the manufacture of goods, even if they were later shipped to other states. Chief Justice Melville Fuller wrote, "commerce succeeds to manufacture, and is not a part of it." The U.S. Supreme Court sometimes ruled New Deal programs unconstitutional because they stretched the meaning of the commerce clause. In Schechter Poultry Corp. v United States, (1935) the Court unanimously struck down industrial codes regulating the slaughter of poultry, declaring that Congress could not regulate commerce relating to the poultry, which had "come to a permanent rest within the State." As Chief Justice Charles Evans Hughes put it, "so far as the poultry here in question is concerned, the flow of interstate commerce has ceased." This program will continue to discuss the events surrounding the mostly peaceful demonstration against the fraudulent 2020 election that occurred at the US Capitol on January 6, 2021. Tucker Carlson of Fox News has produced a documentary video entitled “Patriot Purge” to expose the criminal behavior of government officials towards the citizens who demonstrated at the US Capitol Building on January 6, 2021. I'm glad this issue is finally getting the attention that it deserves. I have covered this issue many times (programs 252, 253, 254, 255, 256, 257, 258, 260, and 261) and will continue to cover it. I have also contacted Senators Cantwell and Murray and Representative Newhouse; they don't seem interested. I am continuing to discuss the events surrounding the January 6 demonstration because this situation vividly illustrates the destruction of our Constitutional Republic. Numerous citizens who exercised their First Amendment rights of freedom of speech, freedom to peaceably assemble, and freedom to petition for a redress of grievances because of the blatant fraud that occurred during the 2020 election have been incarcerated and tortured without a trial, thus violating the Fifth (deprived of liberty without due process), Sixth (deprived of a right to a speedy trial), and Eighth Amendment (deprived of reasonable bail and subject to cruel and unusual punishment) rights of these citizens. This outrageous criminal action by our government against law-abiding citizens is indicative of what the ruling class wants to do to any who question them or obstruct them in any way and is a message from our Deep State rulers to us to cower us into submission by giving us vivid examples of how cruel, sadistic, and criminal their behavior can be towards those who oppose them. As I said in a previous program, you are guaranteed to have friendly relations with liberals if you hand over your possessions, hand over your children, hand over your liberty, and keep your mouth shut. According to the US Constitution, Article I, Section: “The Congress shall have Power … To exercise exclusive Legislation in all Cases whatsoever, over such District (not exceeding ten Miles square) as may, by Cession of particular States, and the Acceptance of Congress, become the Seat of the Government of the United States.” Congress may have passed legislation to delegate authority of the government of Washington, DC, to local officials, but “you can delegate authority, but not responsibility.” Thus, the US Congress, specifically the Speaker of the House of Representatives, Nancy Pelosi, is responsible for the criminal and inhumane treatment of citizens who were peacefully exercising their First Amendment rights of freedom of speech, freedom to peaceably assemble, and freedom to petition for a redress of grievances because of the blatant fraud that occurred during the 2020 election. Nancy Pelosi needs to be held accountable for her criminal actions, and inaction, in relation to the illegal and unconstitutional incarceration of the peaceful participants in the January 6, 2021 demonstration at the US Capitol, and her unwillingness to hold accountable the FBI informants and other provocateurs for their violence and incitement during that demonstration. Five people died during the January 6, 2021 demonstration at the US Capitol, but the only death by violence was that of Ashli Babbitt, callously shot by a Capitol Police Officer. Never forget Ashli Babbitt. The program title, Liberty and Posterity, comes from the US Constitution, the preamble of which states that one of the reasons for writing and ratifying the Constitution was to “secure the blessings of liberty to ourselves and our posterity,” our posterity being our children and descendants not yet born. The first clause of Article I, Section 8, reads, "The Congress shall have Power to lay and collect Taxes, Duties, Imposts and Excises, to pay the Debts and provide for the common Defence and general Welfare of the United States." This clause, called the General Welfare Clause or the Spending Power Clause, does not grant Congress the power to legislate for the general welfare of the country; that is a power reserved to the states through the Tenth Amendment. Rather, it merely allows Congress to spend federal money for the general welfare. The principle underlying this distinction—the limitation of federal power—eventually inspired the only important disagreement over the meaning of the clause. A man living in Oklahoma has a girlfriend who has an ex-boyfriend who gets into it with the man. In a gruesome crime, the ex-boyfriend is murdered, his genitals left on his chest on the side of the road. Not being a criminal mastermind, the man, Murphy, is caught. As there is little doubt and much evidence that he did it, he is tried and convicted of capital murder. The sentenced is death. Not so fast... The crime was committed by a member of the Creek nation. The victim was also a Creek. And it appears that the crime was committed on Creek land. That being the case, the State of Oklahoma would have no jurisdiction, it would be a Federal case, requiring a Federal (not State) prosecution. Because of the laws and agreements with the Tribes, such a crime cannot have a death penalty unless the tribe agrees to it, which they almost never do. Not so fast... was it on Creek land? The Treaty of 1831 says that it is, but subsequent treaties (1866) make it less than clear. Did Congress intend to take the land where the crime occurred away? Did they actually do it? Did somebody make a big mistake and forget a sentence in a document more than a century ago? And if it is Creek Land, what does that mean to the State of Oklahoma? What if the State of Oklahoma, as we've known and loved it since 1907, isn't the State of Oklahoma? What if it's only half the size it is today? Absurd, you say? That's not what the 10th Circuit Court says. And depending on how the Supreme Court rules, it might not be so crazy. Charles Ortleb, the author of Truth to Power, discusses the arguments of the Perth Group, the Australian scientists who have been under attack from the AIDS establishment for many years for insisting that HIV was never properly isolated and that all the diagnostic tools and treatments for AIDS are based on a major scientific error. Ortleb argues that that the Perth Group has not received the credit for their major contribution because their idea about what does cause AIDS is a kind of homophobic scapegoating theory that AIDS is caused by the oxidative stress resulting from gay lifestyle issues. While they deserve credit for calling AIDS a disease that involves oxidative stress, they fail to recognize that a pandemic of virally-caused oxidative stress is being caused by the family of HHV-6 viruses which Ortleb refers to as "The Fifty Shades of AIDS Viruses." The work of French scientist Etienne de Harven is also discussed. De Harven argues that HIV is being confused with harmless endogenous retroviruses in AIDS patients. Ortleb argues that recent work shows that the other AIDS virus, HHV-6, reactivates a very harmful endogenous retrovirus called HERV-K18 which acts like a "superantigen" that can dysregulate the immune system. HERV-K18 may show that all of these scientists were on the right track but didn't see that HHV-6 was causing a much bigger epidemic than AIDS (which includes Chronic Fatigue Syndrome) and was creating confusion by introducing confounding endogenous retroviral issues. Ortleb also suggests that Dr. Jose Montoya, who hinted in a prior show that he is looking at the role of reactivated and harmful endogenous retroviruses in Chronic Fatigue Syndrome, may finally sort all of this out if he can show that a destructive endogenous retrovirus is part of the puzzle of Chronic Fatigue Syndrome. That finding could finally show that Chronic Fatigue Syndrome and AIDS are actually one variable and multisystemic epidemic of immune dysfunction. The Doctor Who Blew the Whistle on Chronic Fatigue Syndrome In the April 29, 1991 issue of New York Native, there was a long interview, conducted by Neenyah Ostrom, with a very honest and outspoken doctor named Paul Lavinger. He was an internist who developed chronic fatigue syndrome in December 1989. His wife had contracted it in 1987. Ostrom reported, “In his extended household, five people now have been diagnosed with or are starting to develop symptoms of CFS. The Lavingers also have a five-year-old dog that ‘collapses for three hours’ after being taken for a walk.” Lavinger told Ostrom, “From 25 years’ experience of practicing medicine and seeing how government agencies deal with outbreaks of illnesses, [he] believes that a ‘conspiracy of dunces’ is keeping the truth about chronic fatigue syndrome from the American public. . . . It’s absolutely ironic that the patients who have this illness, who are often turned away by physicians, are sicker than most patients in any doctor’s practice.” He also said, “The government doesn’t want to let the public know that they might be at risk, because if the public knew that they were at risk, then the public would demand certain things of the government. . . . But the government doesn’t want a public outcry. I think the government really wants to keep this quiet.” He also believed, “The insurance companies are glad that the government doesn’t want to admit that this thing is real, because the insurance companies don’t want to have to pay.” He also told Ostrom, “Families are in this conspiracy because they don’t want to feel guilty for not taking care of the sick family member—it’s easier to say that it’s your own damn fault. Can you imagine walking up to someone in an iron lung and saying ‘It’s your own damn fault you’re in this iron lung?’ So families absolve themselves of guilt. I know this story of a young girl with this illness: She had a typical story, there were lots of things she couldn’t do. So the family put her in a mental institution. I mean, they do this in Russia, but . . . the family doesn’t want to admit that the CFS patient is so sick that they might have to care for him or her. It’s easier to get rid of the sick person.” Lavinger had an apocalyptic view of CFS and warned, “If you think the infrastructure of this country is the bridges, tunnels, and highways, you’re wrong—it’s the people. And I’m telling you that everybody could get sick—well, not everybody because there are people who are naturally immune to different kinds of illnesses. But it’s possible that half this country could get sick and that would be a disaster.” In the May 6 issue of New York Native, published the second installment of the interview with Dr. Lavinger. When Ostrom asked him about the transmissibility of CFS, he said, “First of all, this disease is probably caused by a virus. Why do I say that? You know the story about the duck: If it walks like a duck, if it quacks like a duck, it’s a duck? Well if this disease isn’t a virus, it’s a duck. . . . The sheer number of people who are estimated to have CFS, as much as two to five percent of the population—maybe five to twelve million people—speaks to the issue of transmissibility. Too many people are getting the illness.” Lavinger told her, “Practically all the people who got this disease, chronic fatigue syndrome, got it after 1980. . . . I spoke to a doctor who has been sick with CFS for six years but continues to work. In addition to his regular gastroenterology practice, out of the kindness of his heart, he takes care of 100 CFS patients. He told me that, among these 100 patients, he has 10 families. Eight of the ten families have two family members who had CFS; two of the ten families have three sick family members.” Even though most of the evidence pointed to CFS being transmissible, he told Ostrom, “If you call the hotline at the CDC and press the right buttons on your touch-tone phone, they’ll tell you that CFS cannot be transmitted from person to person, period.
