Constitutionally, North Carolina's governor has little power compared to other states. Recently, the Republican-controlled General Assembly has made moves to take away even more power. While legal questions about these moves remain, we look at what these attempts mean for the future of how our state government operates.
A steamroller levels most anything that gets in its way. This is a good analogy for big government and the deep-state as it doesn't care about private property, individual freedom or independence. It only cares about forging ahead to get rid of anything that might get in its way. This has been the case for many landowners that have been in the way of the carbon capture pipeline steamroller. Returning to Crosstalk to discuss this issue was Tom DeWeese. Tom is president of American Policy Center. He is one of the nation's leading advocates of individual liberty, free enterprise, private property rights, personal privacy, back-to-basics education and American sovereignty and independence and protecting our Constitutionally-guaranteed rights.Tom has written that the carbon capture pipeline is one of the worst environmental scams ever. The idea is to take carbon dioxide (which is basically plant food) out of the atmosphere and bury it underground. He believes this doesn't help the environment, it's damaging to it but that shouldn't surprise anyone when you realize that this is about controlling farmers and private property.Which states are seeing efforts to place a carbon capture pipeline? What problems are associated with this process for both landowners and the environment? Tom answers these and other important questions for you to consider, on this edition of Crosstalk.

So, in the head-to-head fight between the executive and judicial branches, constitutionally, who is stronger? What happens when they oppose the elected Executive of the United States?

Nick Cohen talks with Guardian political columnist and author Rafael Behr, @rafelbehr, a Lowdown regular, about Sir Keir Starmer, and asks Raf can the prime minister face down an erratic and increasingly unhinged US president?Labour's Comms issues and a hazardous future aheadRafael says Sir Keir Starmer needs to communicate properly with the British public about how it negotiates the dangerous future ahead, "They seem completely unable just to narrate what they're doing and why they're doing it in a way that would lead people to accept. and get on board with and be patient with ... Tom DeWeese is the president of the American Policy Center. Tom is one of the nation's leading advocates of individual liberty, free enterprise, private property rights, personal privacy, back-to-basics education and American sovereignty and independence and protecting our Constitutionally-guaranteed rights. In January of 2024, the World Economic Forum held their meeting to push global governance. One of the panel discussions concerned how they could "Trump-proof" their countries and advance their agenda should he be elected. They met again this past January in Davos and we aired the message delivered to them by President Trump and one of the attendees said, "We lost and he won!"In the past, we've warned listeners that the global forces may delay or put aside their agenda for a time, but ultimately they will carry out their plan. This same scenario is playing out within the U.S. as well as the deep state continues to carry out their agenda, in spite of President Trump's attempts to stop them at the federal level. Their plan is called, "America 2050—New Strategies for Regional Economic Development."The driving force behind America 2050 is a non-governmental organization (NGO) out of New York called the Regional Plan Association (RPA). Their partner is the Lincoln Institute of Land Policy. Their plan involves 11 mega-regions. These involve regional councils filled with non-elected, appointed individuals. These councils may represent 15 different counties. They set up what Tom described as a one-size-fits-all policy in all those counties while applying for grants from Housing and Urban Development, the EPA, the Transportation Department, etc.

There are pleasantly surprising lessons about Second Amendment jurisprudence throughout this section as we continue our study of Justice Scalia's great dissent in Morrison v. That was the question Caleb Reese and others wanted asked, when they filed a lawsuit against the Bureau of Alcohol, Tobacco, Firearms, and Explosives regarding 18 USC §§922(b)(1) and (c)(1), which prohibit the selling of handguns to 18-20 year old adults.

“Is Trump interested in being Constitutionally faithful?” (Mark Labberton, from this episode) “What we're watching here is the operation of the will of an individual on the system, and the system is really meant to answer to the negotiated will of a plural body.” (Yuval Levin, from this episode) “ I think character is destiny, especially in the American presidency, because the presidency really is one person.” (Yuval Levin, from this episode) The transition of power from one presidential administration to another always has the potential for turbulence—often a surreal, perplexing, or disorienting process. But is there anything peculiar or problematic about the opening days of Donald Trump's second term in office? Is there anything unconstitutional? In this episode, Mark Labberton welcomes back Yuval Levin for a conversation about the political and social impact of Donald Trump's first month in office in light of Constitutional law and the Separation of Powers. Yuval Levin is the director of Social, Cultural, and Constitutional Studies at the American Enterprise Institute, where he also holds the Beth and Ravenel Currie Chair in Public Policy. His latest book is American Covenant: How the Constitution Unified Our Nation—and Could Again. He's founder of National Affairs, senior editor at The New Atlantis, a contributing editor of National Review, and contributing opinion writer at the New York Times. Together they discuss: The authority of the Constitution over the presidency The importance of character in the office of the president The separation of powers and the threat of presidential overreach What American citizens should be genuinely worried about right now The importance of cross-partisan policymaking and a variety of political voices Why we should worry, but not panic About Yuval Levin Yuval Levin is the director of Social, Cultural, and Constitutional Studies at the American Enterprise Institute (AEI), where he also holds the Beth and Ravenel Curry Chair in Public Policy. The founder and editor of National Affairs, he is also a senior editor at The New Atlantis, a contributing editor at National Review, and a contributing opinion writer at the New York Times. At AEI, Levin and scholars in the Social, Cultural, and Constitutional Studies research division study the foundations of self-government and the future of law, regulation, and constitutionalism. They also explore the state of American social, political, and civic life, focusing on the preconditions necessary for family, community, and country to flourish. Levin served as a member of the White House domestic policy staff under President George W. Bush. He was also executive director of the President's Council on Bioethics and a congressional staffer at the member, committee, and leadership levels. In addition to being interviewed frequently on radio and television, Levin has published essays and articles in numerous publications, including Wall Street Journal, Washington Post, The Atlantic, and Commentary. He is the author of several books on political theory and public policy, most recently American Covenant: How the Constitution Unified Our Nation – and Could Again (Basic Books, 2024). He holds an MA and PhD from the Committee on Social Thought at the University of Chicago. Show Notes A time of “presidential gigantism” “Is Trump interested in being Constitutionally faithful?” Pluralism and vigorous debate Swamping a weak, divided Congress Separation of Powers Legislature vs Executive Branch “ Nobody really ever expected the president to be representative. Presidents are elected to be accountable. Congress is elected to be representative.” “What we're watching here is the operation of the will of an individual on the system, and the system is really meant to answer to the negotiated will of a plural body.” Performative nature of political roles “Random grab-bag of power plays.” Fear of a “lawless president” “The beginning of a new administration is unavoidably a little surreal.” “ It's important not to over-read the strength that's evident at the outset here because we don't really know how much of this will play out.” Elon Musk as Pseudo-President “ The president does command the executive branch. On the other hand, the president does not command the federal government.” “ When the question is, does the president have to follow the law, the answer to that is going to be yes.” Is the Supreme Court going to keep Trump in check? Overturning Chevron deference “Character is destiny.” “ I think character is destiny, especially in the American presidency, because the presidency really is one person.” “ The fact that character's destiny in the presidency is not good news for Donald Trump and is not good news for the country while he is president because the biggest problem with Trump is his character, is the lack of a sense of personal responsibility and self restraint, the lack of a respect for the need for stability and coherence in leadership, And to have an administration that has that character is going to challenge our system and I think just create problems for the country in some important ways.” ”In moments of decision and crisis, it's the president's character that determines how things go.” “ My biggest worry about Trump is not one policy or another. There's some I like and some I don't. But it's that ultimately the presidency is one person, and this one person is just not a good fit for that office.” Presidential overreach Loyalty tests and punishment “ What the president really does is make hard decisions.” Having room for opposition “Administration is impossible when people on the ground are afraid to tell you what's going on.” Alarm Bells First: “The possibility of the administration just willfully ignoring a court order.” Second: “Ignoring signals of trouble, ignoring dissent, ignoring opposing voices, a sense that they're ignoring reality and pretending things are happening that aren't. That's very dangerous in the presidency.” Third: “It's also worth worrying about the tendency for vengeance and for personal vendettas for using the power of prosecution and of law enforcement for political purposes, even for personal purposes.” Character and mindset Congress has 535 people. The presidency comes down to one person. Dangers on the horizon Checks and balances Laying the groundwork for a third Trump term? “On the whole our institutions have proven fairly strong.” “It is better to worry than to panic. Worry lets you make distinctions …” Yuval Levin's American Covenant: How the Constitution Unified Our Nation—and Could Again What is the voice of citizenship right now? Appropriations “Governors are some of the sanest people in our politics in this moment.” “I don't think that the lesson of Trump's first term should be that people who oppose him should just sit it out and wait. I think the lesson on the contrary is that the Trump administration does respond to pressure.” “Policy change should happen through cross partisan negotiation in Congress.” “President Trump has said, for example, that in his first month in office, he wants to have met every house Republican.” A variety of voices “In a way, the mindset of what's the thing we would do if we could magically do anything is the problem, not the solution. And it's how Donald Trump is thinking, what would I do if I were the emperor? I think the most important thing in this moment is for him to realize that he is not the emperor, and that our system never lets us do that thing we would want to do. That's the beauty of the system.” “The other great political question. What can I get done that I also want to achieve?” “God Bless America.” Production Credits Conversing is produced and distributed in partnership with Comment Magazine and Fuller Seminary.
“Until war is Constitutionally declared, the nation and all its members must observe and preserve peace.” That was John Jay, the first Chief Justice of the United States. But today, few people even understand what this means - or how Founders like Washington, Adams, Jefferson, and Madison put it into practice. In this episode, we're shattering three of the biggest modern myths about war powers and the Constitution. What did the Founders actually say? How did they act when faced with war? The answers might surprise you. The post 3 War Powers Myths That Totally Misrepresent the Constitution first appeared on Tenth Amendment Center.
In this episode of the Them Before Us podcast, we sit down with Phil Kerpen, one of our authors in Pro-Child Politics, to unpack the hidden cost of national debt—a burden that overwhelmingly falls on the next generation. Phil breaks down how government overspending and skyrocketing debt undermine children's future, creating an economy where they inherit financial instability, fewer opportunities, and a weakened nation. This conversation was recorded before the election, and while we're hopeful for positive policy changes with the Trump Administration, the reality is that national debt remains a critical issue no matter when you're tuning in. Understanding the long-term impact of debt will help you make informed, pro-child political choices moving forward. https://www.americancommitment.org Author Bio: Phil Kerpen is the president of American Commitment and the Committee to Unleash Prosperity.American Commitment is a 501(c)(4) advocacy group dedicated to restoring and protecting America's core commitment to free markets, economic growth, Constitutionally-limited government, property rights, and individual freedom. The Committee to Unleash Prosperity is a 501(c)(3) educational charity founded by supply-side icons Stephen Moore, Steve Forbes, and Art Laffer to promote faster economic growth through the key building blocks of low taxes, limited spending, less regulation, sound money, and free trade.Mr. Kerpen has previously served as vice president for policy at Americans for Prosperity and as an analyst and researcher for the Free Enterprise Fund, the Club for Growth, and the Cato Institute. Join us in the Messy Times studios for a riveting discussion about abusive government overreach which should scare the daylights out of every American.Chris Kuehne served his country as a Marine for 22 years. Wounded seriously, he was eventually honorably discharged.Have a listen to his story, including how he found himself at a Constitutionally protected First Amendment demonstration on January 6th 2021, and the insane lengths to which "his" government went to entrap him and then so badly stress him out for four years to that he finally capitulated to a plea deal for a Class C Felony, even though all he did was stand around for 30 minutes inside a small part of the Capitol building after an FBI informant prodded him to do so.He served time in a Federal prison, got out and just last week was granted the first #J6 #pardon from President #Trump.Tyranny wins when good men and women stay silent.I will never understand the insane Leftist #tyranny of the #Biden Years and all the crazy damage the Democrats did to our country.Pay attention to Capt. Kuehne's story. If you think that this could never happen to you, you're living in a dream world. We must make sure that tighter restraints are put on the government, to prevent this happening to another good American.Oh, and it goes without saying that this is one more piece of evidence that we need to abolish the #FBI.

Tom is one of the nation's leading advocates of individual liberty, free enterprise, private property rights, personal privacy, back-to-basics education and American sovereignty and independence and protecting our Constitutionally-guaranteed rights. After his inauguration as 47th president yesterday, Donald Trump wasted no time in signing numerous executive orders. Some that were dealt with on this broadcast included the U.S. departure from the Paris Climate Treaty, declaring a national energy emergency, termination of the electrical vehicle mandate, reopening the Arctic National Wildlife Refuge, separation from the World Health Organization and securing our borders. Outside of those executive orders, Tom also commented on other issues that require vigilance by citizens, our elected officials, as well as the need for a clear vision by our president. After all, the global 'left' continues to use various tactics to subvert our president. For example, Tom commented on who's advising the president, the California wildfires, a controversial plan to cut sunlight in order to combat global warming, a convention of states to amend the Constitution and more.

What if you could spend an entire year living as if your actions could change the world? How would that shape your perspective on life, purpose, and the people around you? It is easy to feel like we are too small to make a real difference, but sometimes it just takes one person with the right mindset to start a ripple effect. When we shift our focus to living with intention and connecting deeply with the people around us, even the smallest actions can lead to something bigger. AJ Jacobs, bestselling author, journalist, and master of personal experiments, joins us to share stories from his fascinating life experiments. Known for his books “The Year of Living Biblically” and “The Year of Living Constitutionally,” AJ dives into experiments that challenge his worldview and reveal how gratitude, curiosity, and small acts of kindness can make a profound impact–not just on our own lives, but on the world at large. In this episode of The Greatness Machine, AJ Jacobs joins Darius to talk about his fascinating journey exploring the Bible for his book “The Year of Living Biblically.” AJ emphasizes the importance of thorough research, collaboration, and fully immersing oneself in a belief system to truly understand it. He reflects on how cherry-picking information can lead to a skewed perspective and discusses the power of gratitude in shifting our mindset. AJ also shares insights from his “Year of Living Constitutionally” and the lessons he learned from both projects, highlighting how they transformed his thinking and approach to life. Topics include: AJ reflects on exploring the Bible for his book The Year of Living Biblically The importance of research and collaboration in bookwriting process The need for immersion in understanding beliefs and systems The dangers of cherry-picking information to support one's argument How gratitude can counteract negative bias and enhance one's perspective on life The lessons AJ learned during his “Year of Living Constitutionally” And other topics… Connect with AJ: Website: https://ajjacobs.com/ Substack: https://substack.com/@experimentalliving Instagram: https://www.instagram.com/ajjacobsinc/ Twitter: https://twitter.com/ajjacobs/ Podcast: https://podcasts.apple.com/us/podcast/the-puzzler-with-a-j-jacobs/id1709071922 Connect with Darius: Website: https://therealdarius.com/ Linkedin: https://www.linkedin.com/in/dariusmirshahzadeh/ Instagram: https://www.instagram.com/imthedarius/ YouTube: https://therealdarius.com/youtube Book: The Core Value Equation https://www.amazon.com/Core-Value-Equation-Framework-Limitless/dp/1544506708 Sponsored by: Constant Contact: Go to ConstantContact.com and start your FREE trial today. There have been few changes and additions to the United States Constitution since it was ratified in 1788, despite life being wildly different now a few centuries later. To really put the document into a modern perspective, author AJ Jacobs decided to literally live by the Constitution for a full year and documented the experience in his new book The Year of Living Constitutionally. In today's episode, AJ spoke with Ryan about his inspiration for the book, the contradictions of the Founding Fathers, and the evolution of Presidential power. Today we open with a reporter from the BBC having to report that Hezbollah has been digging terror tunnels right in front of the noses of the United Nations, leading the IDF to conclude there is no way the UN wasn't aware. Once again, the little dictators club is on the side of the terrorists and not on the side of people yearning to be free. I then take a moment to address the story that opened yesterday's show quoting a Sheriff in California. I specifically said there wasn't an actual attempt, but that the police believe they thwarted an attempted plot to harm Donald Trump. The next big item is the revelation that Kamala Harris plagiarized several sections of her 2009 book. Investigative journalist Christopher Rufo shows us how much she cut/pasted from other without sourcing the material. Unsurprisingly, the NYTimes was the first paper to try to make Rufo the villain and Harris the victim. But, CNN and other are making that propaganda stick. Which leads to the newest mantra I have been using to describe the Harris-Walz campaign. Everything they do falls into one of three categories: fakery, photo-ops and fiction. That's all they have as manufactured candidates. There is no real substance to them, or, what is real, they want to keep hidden. CBS News is caught once again selectively editing pieces, this time to hurt Speaker of the House Mike Johnson. Thankfully, Johnson recorded himself and was able to show what he really said versus the version CBS News aired. So, when CBS claims they have found 230 medical professionals who say Trump needs to release his medical records, I suggest they take a flying leap off of a tall building. In fact, Scott Jennings of CNN said basically the same thing. In desperation to gain the black male vote, Harris-Walz released a series of enticements to win back their support. Not only is her list unconstitutional, but also smacks of some of the worst condescension and pandering I have seen in a long time. For many younger black male voters, it's not working. In many, it's actually making them even more sure they are not going to support Harris. Gov. Glenn Youngkin (R-VA) explained he is Constitutionally mandated to remove non-citizens from the voting roles. Yet, this DOJ is suing him 25 days from the election to keep the illegals on the voting roles. Remember, Alejandro Mayorkas said it is preposterous to suggest their open border policy is all about getting them to vote. So, to close out this topic, I turn to my good buddy Jim Gossett for a song about “Dead people” voting, sung to the tune of “Short People” by Randy Newman. Former President Bill Clinton stepped in it when he was on the Harris-Walz trail in Georgia. It was so bad, Donald Trump has already turned it into a campaign ad. Tim Walz just told an audience that we cannot have four more years. Yes, you heard that correctly. He said we cannot allow four more years of this to happen. I agree! Finally, ABC News had to fact-check social media and the Harris campaign over a Trump Town Hall. It's sad to see what desperation leads so many who are emotionally unhinged to do. The First Amendment guarantees religious freedom and the separation of Church and State, basic tenets of American democracy which conservative think-tank the Heritage Foundation is intent on undermining. Mikey Weinstein, founder of the Military Religious Freedom Foundation, describes how the Heritage Foundation's Project 2025 would upend military protocols to eliminate civilian oversight. He believes a dystopian future in which the rights of racialized and marginalized groups are denied would be in store under a second Trump presidency. TranscriptListenDonateSubscribeGuestMusic Talia BaroncelliHi, I'm Talia Baroncelli, and you're watching theAnalysis.news. Project 2025 is a lengthy policy agenda authored by the Heritage Foundation, a conservative and Christian nationalist think tank. Investigative outlet ProPublica recently obtained Project 2025 private training videos, which involve several former Trump officials. This corroborates the connection between former President Trump and the Heritage Foundation. One of the videos features Bethany Kozma, a former Deputy Chief of Staff at USAID during the Trump administration. In this video, she discusses Project 2025's opposition to legislation trying to mitigate the effects of climate change. She reads from page 364 of Project 2025's Mandate for Leadership, which states that "In the name of combating climate change, policies have been used to create an artificial energy scarcity that will require trillions of dollars in new investment, supported with taxpayer subsidies, to address a problem that government and special interests themselves created." They don't perceive climate change or carbon-intensive industries as posing a threat to society or to the environment but as a set of policies meant to create energy scarcity and benefit a certain segment of the elite. Joining me to discuss these issues is Mikey Weinstein. He is the founder of the Military Religious Freedom Foundation, which is a nonprofit organization dedicated to ensuring the constitutional right of religious freedom for the U.S. Armed Forces. He is also a lawyer and a former Air Force officer and served as White House Legal Counsel to the Reagan Administration. In this episode we sit down with A.J. Jacobs, a journalist who noticed some striking similarities between Biblical fundamentalism and constitutional originalism, and since he once wrote a NYT bestselling book about titled The Year of Living Biblically in which he tried to live for a year as a fundamentalist, he tried to do something similar by living for a year following the Constitution's original meaning as if he were an originalist and then writing a book about it. He soon learned that donning a tricorne hat and marching around Manhattan with a 1700s musket, though fully within one's constitutional rights, will quickly lead to some difficult encounters and altogether strange circumstances. The Year of Living ConstitutionallyAJ Jacobs' WebsiteAJ Jacobs' TwitterHow Minds ChangeDavid McRaney's TwitterYANSS TwitterKitted ShopThe Story of KittedShow NotesNewsletterPatreon
When A.J. Jacobs decided to immerse himself in early Americana, he didn't think about the fact that the required wool stockings wouldn't have elastic. “They would fall down to my ankles,” he laughs. “I had to put on little sock belts every morning. I'll never get back that time.”But no matter. He was committed to getting into the headspace of the Founding Fathers, because he wanted to better understand the reasoning and the intentionality of America's foundational documentThe result is his new book, “The Year of Living Constitutionally.” It's part performative art — “I went method,” he says — and part intellectual adventure. While writing with a quill pen, lighting his house with beeswax candles and wearing a tricorn, Jacobs researched and talked to dozens of scholars about how to best interpret the Constitution.“We see it as etched in stone,” he tells host Kerri Miller on this week's Big Books and Bold Ideas. “But it was really deeply fluid. If we recapture that mindset, maybe we will be more flexible in our thinking today.”Guest:A.J. Jacobs is a journalist and an author. A.J. Jacobs is a journalist and author. His most recent book is The Year of Living Constitutionally: One Man's Humble Quest to Follow the Constitution's Original Meaning. We discuss how the Founding Fathers prized humility, experimentation, and a willingness to change their own minds. The heart of our democracy is for the community to come together and cooperate. One example is to advocate for democratic reforms, which are nonpartisan. Being apathetic or cynical helps the slide into autocracy. Resisting the allure of quick, hot takes and practicing slower thinking are also crucial to democracy. The founding fathers were deeply invested in balance, especially when it comes to the power of a president being balanced by Congress. A.J. reminds us that everyday citizens can control whether the sun is rising or setting on democracy. //The Wire//1830Z July 11, 2024////ROUTINE////BLUF: CHINESE ACTIVITY INCREASES SUBSTANTIALLY IN THE TAIWAN STRAIT. CONTROVERSIAL ARMY TRAINING PRODUCT HIGHLIGHTS GROWING CONCERNS.// -----BEGIN TEARLINE------International Events-France: A fire broke out in the spire of Rouen Cathedral in Normandy yesterday evening. The cause of the fire within this 12th century cathedral remains unknown.Far East: Chinese activity in the Taiwan Strait substantially increased overnight. 66x PLA aircraft and 7x PLAN vessels were reported to be operating in the area by Taiwanese forces. AC: This is a significant increase in one day's observed PLA activity, with some sources claiming it's a new record for the number of PLA aircraft observed in single day.South Pacific: Conflict and civil unrest reignites in New Caledonia as demonstrations against French forces increase. Riots have increased over the past few days in response to a police shooting on the outskirts of the capitol of Noumea.-HomeFront-North Carolina: Controversy has erupted following a training event at Fort Bragg (currently named Fort Liberty, due to the revisionist name-change DoD policy). Leaked images of Powerpoint slides used during the training event indicate that units are labeling peaceful pro-life groups as terrorists, not just “extremists” as they were previously categorized. The leaked training product makes many false claims, and is directly hostile towards Constitutionally protected activities such as peaceful protests, picketing, etc.Following this controversy, an official statement by the XVIII Airborne Corps (posted on the Fort Liberty Facebook page) has disavowed the training product and the ideology contained on the slides. However, as these slides came from the unit responsible for installation access and security, it is not clear as to if gate guards were using this guidance to conduct unlawful, ideologically-motivated searches, flag certain license plates in their databases, or otherwise commit other Constitutional violations. It is also not clear as to if military law enforcement were using this guidance in the gathering of intelligence on US Persons as defined by EO 12333 or DoD Regulation 5240.01, which specifically states that Defense personnel “may not investigate U.S. persons or collect or maintain information about them solely for the purpose of monitoring activities protected by the First Amendment or the lawful exercise of other rights secured by the Constitution or laws of the United States.”-----END TEARLINE-----Analyst Comments: Many may not see the value in the significance of a Powerpoint presentation that was prepared by a random soldier, and already disavowed by higher leadership. However, this scandal is par for the course with regards to the recent ideological indoctrination that has run rampant through the military over the past few years. As the election creeps closer, and the inevitable militarization of our nation's Capitol comes to fruition during this time, it would be wise to consider the atmospherics of how soldiers in some units view Constitutionally protected rights.Though this specific situation is a somewhat minor case study and must be treated as such, in a larger sense this is not an isolated incident. In all likelihood these highly controversial Powerpoint slides are probably a holdover recycled from the “Extremism Standdown” that swept through the DoD a couple of years ago. As a reminder, this was an 8-10 month training campaign to push the one-sided idea that most conservative ideas are extremist in nature. Whether this latest anti-conservative, anti-American scandal is representative of an escalation of official DoD policy remains to be seen, but this indoctrination would hardly be surprising at this point….the jump from labeling peaceful American citizens as “extremists” to labeling them as “terrorists” seems to have occurred

EITM interviews A.J. Jacobs
A.J. Jacobs learned the hard way that donning a tricorne hat and marching around Manhattan with a 1700s musket will earn you a lot of strange looks. In the wake of several controversial rulings by the Supreme Court and the ongoing debate about how the Constitution should be interpreted, Jacobs set out to understand what it means to live by the Constitution. In The Year of Living Constitutionally, A.J. Jacobs tries to get inside the minds of the Founding Fathers by living as closely as possible to the original meaning of the Constitution. He asserts his right to free speech by writing his opinions on parchment with a quill and handing them out to strangers in Times Square. He consents to quartering a soldier, as is his Third Amendment right. He turns his home into a traditional 1790s household by lighting candles instead of using electricity, boiling mutton, and—because women were not allowed to sign contracts—feebly attempting to take over his wife's day job, which involves a lot of contract negotiations. The book blends unforgettable adventures—delivering a handwritten petition to Congress, applying for a Letter of Marque to become a legal pirate for the government, and battling redcoats as part of a Revolutionary War reenactment group—with dozens of interviews from constitutional experts from both sides. Jacobs dives deep into originalism and living constitutionalism, the two rival ways of interpreting the document. Much like he did with the Bible in The Year of Living Biblically, Jacobs provides a crash course on our Constitution as he experiences the benefits and perils of living like it's the 1790s. He relishes, for instance, the slow thinking of the era, free from social media alerts. But also discovers the progress we've made since 1789 when married women couldn't own property. Now more than ever, Americans need to understand the meaning and value of the Constitution. As politicians and Supreme Court Justices wage a high-stakes battle over how literally we should interpret the Constitution, A.J. Jacobs provides an entertaining yet illuminating look into how this storied document fits into our democracy today. A.J. Jacobs is a journalist, lecturer, and human guinea pig whose books include Drop Dead Healthy, The Year of Living Biblically, and The Puzzler. A contributor to NPR, The New York Times, and Esquire, among other media outlets, Jacobs lives in New York City with his family. His new book is The Year of Living Constitutionally: One Man's Humble Quest to Follow the Constitution's Original Meaning. Shermer and Jacobs discuss: what possessed him to spend a year living constitutionally and biblically • what the Constitution really says and means • the Supreme Court's rulings on guns, religion, women's rights and more • what happens if you become an ultimate originalist and follow the Constitution using the mindset and tools of the Founders • why originalism is not the best approach • what happened when he carried a musket on the streets of NYC • an 18th century view of rights • election cakes • epistemic humility • democracy • how that Founders would be shocked at today's government, and how the president is far too powerful.
On Friday's Mark Levin Show, Bush v. Gore was a case that took place after the campaign was over and counting the votes that were cast. However, the problem with Trump v New York is that we are still in the middle of an ongoing election and they have violated federal election law. A state court cannot regulate Congress or federal campaign law because it does not have the power, and a state court cannot usurp Constitutionally established laws or rights. Bush v Gore demonstrates that the Supreme Court will step in if it believes the federal election process is being damaged, usurped, or tainted by a rogue authority. This is a power grab like we've never seen before by an acting state judge and a Soros prosecutor, and it is an ongoing Constitutional crisis. Also, the full-throated antisemitism is on display by Democrats like Nancy Pelosi calling the idea of Benjamin Netanyahu speaking before Congress horrendous. The Democrat Marxists target and character assassinate just like Stalin, which is exactly what they did to Trump and Netanyahu and it is sickening. Finally, Mark talks with Senator Tim Scott (R-SC) about the media suppressing free speech and acting as an arm for the Democrat elite, and the American people rallying behind Donald Trump to fight against their tyranny. Read our USA TODAY Best-Selling Book, The Score That Matters https://amzn.to/4bNbVcO Full show notes at www.LearningLeader.com Notes: John Quincy Adams once said, “Gratitude… when it takes possession of the bosom, fills the soul to overflowing and scarce leaves room for any other sentiment or thought.” Ask yourself the question, “What good shall I do today?” When you're upset that your social media post didn't get as many likes as you thought it would stop and think, ‘What good shall I do today?” It can reframe how you approach others and be more servant-based (which is a mark of a great leader) The fox mindset versus the hedgehog mindset. A hedgehog has a single lens. It's more rigid thinking. A fox sees the world through many different lenses. It's more flexible and adaptive. That is a theme of this conversation. Be open, be less judgemental, and be more curious about the way others view the world. “The older I get, the less certain I get of my opinions.” “It's easier to act your way into a new way of thinking than think your way into a new way of acting.” AJ shared that when he was dedicated to the thank you project even on a bad day when he was focused on saying thank you, his mind eventually caught up to his body. Change Your Mind – the founding fathers did this a lot. Daniel Kahneman said, “No one enjoys being wrong, but I do enjoy having been wrong because it means I am now less wrong than I was before.” Be Humble In Your Opinions – Ben Franklin told a short parable. He said, there was a “French lady, who, in a dispute with her sister said, I don't know how it happens, sister, but I meet nobody but myself that is always in the right. The point is that we are all that French lady. We all believe we have a monopoly on the truth. (Remind yourself that you're wrong sometimes) Flexibility of mind: Many of the Founding Fathers were open to the idea that they might be wrong, and more willing to change their minds than leaders are today. At the Constitutional Convention, Benjamin Franklin summed up this open-mindedness: “The older I grow the more apt I am to doubt my own judgment.” Think Slow – There are parts of modern life that would benefit from an enforced speed limit. We need fewer hot takes and more cold takes. We need more slow thinking. Writing in depth letters by hand forced ideas to be more nuanced. Thumb-texting acronyms have the opposite effect. Slow down consumption. Forced self to read the news just once a day. The value of slow thinking: For the year, AJ wrote a letter with a quill instead of using social media or texts. It was a revelation. It led to a less impulsive, slower style of thinking – a waiting period for his thoughts. Embrace Virtue – In the founding era, virtue was a cherished ideal (now it's often used in the phrase virtue signaling which is not a compliment). “A virtuous person puts the interests of others before their one. They focus on those two key words in the Constitution's Preamble, “General Welfare.” We Control the Sun – The sun carved on the back of George Washington's wooden chair at the Constitutional Convention. The sun was cut in half by the horizon. Was it rising or setting? At the end of the convention, Ben Franklin said he was convinced it was rising. America had a bright future (the world is built by optimists) Whether the sun sets or rises on democracy, that's up to us, we the people. In The Autobiography of Benjamin Franklin, Benjamin Franklin tells a story about his father criticizing his writing."About this time I met with an odd volume of the Spectator," Franklin wrote, "I thought the writing excellent, and wished, if possible, to imitate it." AJ's goal was to try to understand the Constitution by adopting the mindset and lifestyle of the Founders for a full year. He committed to living as the original originalist as a new way of searching for answers to one of the most pressing questions of our time: How should we interpret America's foundational document today?

What can a year of following the US Constitution per the founding fathers' intentions teach us about the future of democracy? A.J. Jacobs has answers here! What We Discuss with A.J. Jacobs: The founding fathers were not entirely in favor of pure democracy. They feared mob rule and wanted checks and balances to prevent a tyranny of the majority. The Constitution was a big step forward for democracy at the time, but still had elements of elitism. The original meaning and interpretation of parts of the Constitution, such as the Second Amendment and free speech rights, are quite different from how they are viewed today. Both liberal and conservative perspectives would likely disapprove of some of the original 18th century understandings. The founding fathers seemed more open to changing minds and flexible thinking compared to the intransigent political positions common today. Examples like Ben Franklin and James Madison illustrate their willingness to admit uncertainty and change opinions based on reason and evidence. American democracy is fragile and must be actively maintained and protected. A.J. Jacobs remains optimistic that reforms and hard work can help save the American democratic system, but it requires dedication and the American people deciding to "lift the sun up" on the country's future. We can help revive an appreciation for democracy by making it fun and celebratory again, like it was back in the early days of America. Baking "election cakes" to share and enjoy while voting, or hosting festivities at polling places, can inject some much-needed positivity and help encourage participation. Simple acts like this are a good starting point to begin strengthening our civic society and democratic institutions. And much more... What does it mean to live Constitutionally in the year 2024? For a start, it means getting off social media. It also means swapping a quill pen for your keyboard, and candlelight for electricity. And don't forget the tricorn hat and musket--though maybe skip the boiled mutton. Join author A.J. Jacobs as he deep-dives with EconTalk's Russ Roberts into the centuries-old principles of the U.S. Constitution and tries to apply them to the current day. Topics include the original conceptions of our most cherished amendments, the office of the President, and the Supreme Court, and an explanation of how one can be an originalist and still believe in gender equity. Jacobs also shares his family's experience writing its own constitution, and explains why his research made him more optimistic about the future of American democracy.
