Spine Health Researcher, Clinician, and Professor, Dr. Christine Goertz shares her life's work in her new book Take Your Back Back. RESEARCH & HEALTH POLICY CAREER I'm Christine Goertz, D.C., Ph.D. I have spent 35 years working with multi-disciplinary teams to conduct research studies and implement best practices designed to optimize care for patients with low back pain. CURRENT ROLE I am a Professor in Musculoskeletal Research at the Duke Clinical Research Institute and Vice Chair for the Implementation of Spine Health Innovation in the Department of Orthopaedic Surgery at Duke University. I am also an Adjunct Professor in the Department of Epidemiology, College of Public Health at the University of Iowa. WHERE IT ALL BEGAN I received my Doctor of Chiropractic (D.C.) degree from Northwestern Health Sciences University in 1991 and a Ph.D. in Health Services Research, Policy and Administration from the School of Public Health at the University of Minnesota in 1999. ACCOMPLISHMENTS I have extensive experience in the administration of Federal grants, both as a PI and as a program official at the National Institutes of Health (NIH). I have received nearly $45 million in federal funding, as the principal investigator or co-principal investigator, primarily from NIH and the Department of Defense. I have also co-authored more than 135 peer-reviewed scientific papers. MAKING A GLOBAL IMPACT I am honored to have delivered invited lectures, keynote talks, clinical grand rounds, and plenary presentations worldwide. In this case, the court considered this issue: Does a Texas death-row inmate have standing to sue the state over its refusal to grant access to DNA testing under a law that allows such testing only when the person can demonstrate that exculpatory results would have prevented their conviction?The case was decided on June 26, 2025. The Supreme Court held that Petitioner Ruben Gutierrez has standing to bring his 42 U.S.C. § 1983 claim challenging Texas's postconviction DNA testing procedures under the Due Process Clause. Justice Sonia Sotomayor authored the majority opinion of the Court.Prisoners convicted in state court have a liberty interest in demonstrating their innocence with new evidence under state law. When states create postconviction procedures, they can create rights to other procedures essential to realizing those rights. Under Skinner v Switzer, a prisoner may bring a § 1983 due process claim alleging that a state's DNA testing statute unconstitutionally prevents him from obtaining testing, even though he cannot directly challenge state court denials of his testing motions. To bring such a suit, the prisoner must demonstrate judicial standing to sue.The standing analysis follows Reed v Goertz, which requires three elements. First, Gutierrez adequately alleged an injury: the prosecutor's denial of access to DNA evidence. Second, prosecutor Saenz caused this injury by refusing to release evidence in his custody for testing. Third, if a federal court declares Texas's procedures unconstitutional, that judgment would eliminate Saenz's justification for denying testing, thereby removing the barrier between Gutierrez and the evidence. The declaratory judgment would change the parties' legal status and redress Gutierrez's injury by eliminating the allegedly unlawful basis for the denial.The Fifth Circuit erred in two fundamental ways. First, it improperly focused on the limited declaratory judgment the District Court ultimately issued rather than on Gutierrez's broader complaint. Gutierrez's complaint challenged not just Article 64's limitation to actual innocence claims, but multiple barriers the statute creates—including its virtually insurmountable standard for parties to crimes, its refusal to consider new evidence, and its prohibition on testing solely to challenge death eligibility. Standing depends on the allegations in the complaint, not on the particular relief a district court later grants.Second, the Fifth Circuit wrongly transformed the redressability inquiry into speculation about whether the prosecutor would ultimately provide the evidence. Under Reed, a declaratory judgment need only eliminate the prosecutor's reliance on the challenged provision as a justification for denying testing. The Court rejected the notion that redressability requires certainty about the ultimate outcome. That a prosecutor might find other reasons to deny testing—just as the prosecutor in Reed had multiple grounds for denial—does not defeat standing to challenge specific reasons as unconstitutional. Courts regularly allow plaintiffs to challenge improper legal grounds for discretionary decisions even when the decision-maker might reach the same result for different reasons.

Der BMW 507 (1955-1959) – Die bayerische Roadster-Legende Für viele Autofans ist der BMW 507 das schönste Modell der Münchner Autobauer. Als er 1955 auf den Markt kam, sollte er dem Mercedes 300SL Roadster Konkurrenz machen und den US-Markt erobern. Beide Ziele erreichte er trotz der aufregenden Linien nicht und hätte um ein Haar BMW in den Abgrund gerissen. Dabei ist aus heutiger Sicht der BMW 507 genauso schillernd wie die Persönlichkeiten, die ihn erschaffen haben. Auf der einen Seite Max Hoffmann, der seinerzeit geschäftstüchtigste Importeur für deutsche Automobile in den USA und auf der anderen Seite Albrecht Graf von Goertz, ein umtriebiger Tausendsassa und autodidaktisches Designgenie. Hoffmann wollte einen spektakulären BMW-Sportwagen für die USA. Den amerikanischen Geschmack sollte Graf von Goertz treffen, der 1936 in die USA ausgewandert war. Die aufregende Form wurde dann auf das bekannte Fahrgestell des BMW 502, dem von einem V8 befeuerten „Barock-Engel“ montiert. Und weil das so gut passte, übernahm er den Motor mit ein paar Modifikationen gleich mit. So war der 507 zwar betörend schön, unter seiner von Hand gefertigten Aluminiumkarosse technisch aber doch sehr bieder geraten und mit 150 PS ein bisschen schmalbrüstig für die Preisklasse. Es reichte jedenfalls nicht, um für den 300SL Roadster von Mercedes ein echter Gegner zu sein. Trotzdem gab es eine ganze Reihe von Reichen und Schönen, die den 507 fuhren, Elvis Presley hatte sogar zwei. Heute ist der BMW 507 eine der Ikonen des Automobil-Designs und auch deutlich teurer als ein Mercedes 300SL Roadster. Das liegt daran, dass sehr viel weniger 507 gebaut wurden. Ron und Frederic finden beide den BMW 507 toll, sind sich aber im Klaren darüber, dass dieser Roadster finanziell weit außerhalb ihrer Möglichkeiten liegt. Zwar träumt Ron nach wie vor von einem Scheunenfund, aber große Chancen werden ihm von Frederic natürlich nicht eingeräumt. Welcome to Supreme Court Opinions. In this episode, you'll hear the Court's opinion in Reed v Goertz. In this case, the court considered this issue: When does the statute of limitations for a 42 U-S-C § 1983 claim seeking DNA testing of crime-scene evidence begin to run? The case was decided on Apr 18, 2023. The Supreme Court held that when a prisoner pursues state post-conviction DNA testing through the state-provided litigation process, the statute of limitations a procedural due process claim under 42 U.S.C. § 1983 begins to run when the state litigation ends. Justice Brett Kavanaugh authored the 6-3 majority opinion holding that, in Reed's case, the statute of limitations on his § 1983 claim began when the Texas Court of Criminal Appeals denied his motion for rehearing, not when the state trial court denied DNA testing. A statute of limitations begins to run when a plaintiff has “a complete and present cause of action.” When that occurs depends on the cause of action. The violation of procedural due process rights, as Reed alleged in this case, requires two elements: (1) deprivation by state action of a protected interest in life, liberty, or property, and (2) inadequate state process. Thus, a plaintiff has “a complete and present cause of action” for a procedural due process violation not at the time of deprivation, but at the time the state fails to provide due process. In Reed's case, the State's alleged failure to provide him with a fundamentally fair process was complete when the state litigation ended and deprived Reed of his asserted liberty interest in DNA testing. Justice Clarence Thomas dissented, arguing that the district court lacked jurisdiction to hear the case for lack of standing. Justice Thomas would dismiss the case on the finding that Reed's action presents no original Article III case or controversy between him and the district attorney. Justice Samuel Alito authored a dissenting opinion, in which Justice Neil Gorsuch joined, arguing that there are a number of points in the case at which the statute of limitations could begin to run—all before the denial by the Criminal Court of Appeals, and all leading to the conclusion that Reed's claim is time-barred. Rodney Reed was found guilty of murder and sentenced to death in Texas. He filed a motion under Texas's post-conviction DNA testing law, requesting DNA testing on certain evidence, which he believed would help identify the true perpetrator. The state trial court denied Reed's motion, citing an inadequate chain of custody for the evidence he sought to test. Reed then sued in federal court, arguing that Texas's post-conviction DNA testing law violated procedural due process. The Fifth Circuit dismissed Reed's claim as time-barred, but the Supreme Court held that the statute of limitations for a procedural due process claim begins to run when the state litigation ends, in this case when the Texas Court of Criminal Appeals denied Reed's motion for rehearing. The Court ultimately reversed the Fifth Circuit's decision and remanded the case for further proceedings.Support the show

In Skinner v. Switzer, 562 U.S. 521, 524-25 (2011), this Court held that state prisoners may pursue post-conviction claims for DNA testing of crime-scene evidence in a civil rights action under 42 U.S.C.§ 1983. The Court made clear that a prisoner bringing such a § 1983 claim may seek "to show that the governing state law denies him procedural due process" after he has unsuccessfully sought DNA testing under available state procedures. Id. at 525, 530. Die EU-Kommission will die hohen Energiepreise bekämpfen. Dazu hat Präsidentin von der Leyen konkrete Vorschläge gemacht. Der russische Angriffskrieg auf die Ukraine und die daraus resultierende Energiekrise bildeten den Kern der Rede von EU-Kommissionspräsidentin Ursula von der Leyen zur Lage der Europäischen Union. Zwar wirkten die Sanktionen auf Russland, doch Brennstoffe aus Russland machten nur noch neun Prozent der EU-Energieimporte aus, so die Kommissionschefin. Nun fürchten Europas Politiker einen teuren Winter. Um Bürger und Bürgerinnen finanziell zu entlasten, schlägt von der Leyen konkrete Maßnahmen vor. So will die EU-Kommissionschefin etwa Übergewinne von Energiekonzernen einkassieren und an Haushalte und Firmen umverteilen. Das betreffe die Unternehmen, „die zum Beispiel Öl und Kohle fördern und aktuell enorme Gewinne mit ihren Produkten erzielen“, sagt der Brüssel-Korrespondent Christoph Herwartz. Shawn Goertz is a 49-year-old recovering addict and cancer survivor. After a 20-year addiction he has been sober since 2007. On any given Thursday in the spring and fall you can find Shawn and his girlfriend, Andrea marking the trails of Three Creeks Conservation Area near Columbia, Missouri for that evening's trail run. Trail running has been a lifesaver for him. To his local community, Shawn is an inspiration. His kindness, understanding, motivation, and ability to bring people together has helped many find their love of the trails. Shawn supports others in their efforts and has improved the lives of those around him. Shawn currently lives in Missouri with his dog Opie and spends time hitting the trails with his ultra-runner girlfriend, Andrea. This was such an open, honest conversation about the struggles of addiction and much more. Shawn's story is one of hope and giving back. We talk about how he made his way from prison to trail running. We also talk about how giving back to the trail running community has impacted Shawn's life. He shares the struggles of dealing with injuries and slowing down on the trails. Shawn shares the touching story of his emotional Lake Tahoe Ultra where he spread his Mother's ashes, it was a full circle moment for him. I wrote down many things he said but one thing I can't stop thinking about is “we can only keep what we have by giving it away”. We will be cheering Shawn on in everything he does. I think you will be too!
