Cattle & Agriculture Industry News Former USDA Counsel Named Deputy Ag Secretary A veteran of the first Trump administration's agriculture team has been named to be deputy secretary of the USDA. President-elect Donald Trump announced his nomination of Stephen Vaden to be deputy under Brooke Rollins, a former think tank executive already tapped to head the USDA. A Yale law graduate, Vaden served as USDA general counsel from 2018-2020, when he was confirmed to a judicial appointment on the U.S. Court of International Trade. He has served as a board member of the Commodity Credit Corp. CDC Confirms Nations First Severe H5N1 Infection Of Human A patient in Louisiana was hospitalized with a severe case of avian influenza (H5N1), marking the first instance in the United States of severe illness linked to the virus, the Centers for Disease Control and Prevention (CDC) announced today in a news release and press call. CDC said the Louisiana patient, one of 61 human cases to occur in the United States since April, was infected with a D1.1 virus recently detected in wild birds and poultry in the U.S. and in recent human cases in British Columbia, Canada, and in the state of Washington. Officials noted the D1.1 strain of H5N1 is different from the B3.13 genotype detected in dairy cows, sporadic human cases in multiple states, and some poultry outbreaks in the U.S.  No person-to-person spread of H5 bird flu has been detected. California State Of Emergency, New Human Infections, Canadian Struggles all due to H5N1 Gov. Gavin Newsom issued a state of emergency in an effort to streamline the Golden State's response to highly pathogenic avian influenza (HPAI). Several California agencies have developed coordinated responses to address and minimize farm worker exposures, lower raw dairy product contamination and mitigate the spread of the virus, the governor said in a statement: He said “This proclamation is a targeted action to ensure government agencies have the resources and flexibility they need to respond quickly to this outbreak.” About 680 dairy farms are under quarantine from HPAI outbreaks, while 6.2 million birds have been hit and 36 people infected across California. A commercial poultry worker in northwest Iowa is now the first confirmed human case of HPAI in the Hawkeye State, according to the Iowa Department of Health and Human Services (Iowa HHS). An estimated 6.7 million birds have been affected in more than a dozen counties across Iowa, according to USDA's Animal and Plant Health Inspection Service (APHIS). The Canadian Food Inspection Agency (CFIA) announced that more than 13.9 million birds have been impacted by HPAI in the most recent tally of the spread of H5N1 infections across nine provinces. British Columbia is reporting the highest number of HPAI cases among 8.3 million birds. New Brunswick has the lowest number of birds affected by avian influenza with fewer than 100 birds at two locations being confirmed with the virus. Beef Processor Fined For Odor Violations The Texas Commission on Environmental Quality (TCEQ) fined STX Beef Company $200,000 for violations linked to foul odors coming from its Corpus Christi facility, according to a local report. The penalty follows years of complaints about smells traced to cattle processing and wastewater management issues. TCEQ also cited equipment failures, inadequate scrubber systems and poor recordkeeping. Of the fine, $2,000 is already paid, with $40,000 due soon. Over $80,000 will support Texas A&M University-Corpus Christi's AutoCheck program, addressing regional vehicle emissions. The company has 30 days to submit an odor control plan, including equipment repairs and new systems, and must comply with air quality rules for five years. Corporate Transparency Act Reporting Requirement Will Return Due to Court Ruling Producers pay attention now.  The Corporate Transparency Act filing requirements are back in effect following a court decision that reverses the injunction that previously halted this mandate.  NCBA Executive Director of Government Affairs Kent Bacus said that The Corporate Transparency Act requires millions of family farmers and ranchers to file complex paperwork and disclose beneficial ownership information with the federal government under penalty of severe fines and jail time. Earlier last week, the Fifth Circuit Court of Appeals lifted a nationwide preliminary injunction on the enforcement of the Corporate Transparency Act, holding that the government is likely to prevail in a constitutional challenge. Environmental regulators are beginning to clamp down on Starbase. The big question is: Do these enforcement actions have enough significance to force the FAA to delay launch activities at Boca Chica? Some troubling headlines  appeared on CNBC.com on Monday, August 12, 2024 concerning SpaceX's alleged issues regarding compliance with environmental regulations that govern their activities at the Starbase facility in Boca Chica, Texas.  The story by Lora Kolodny alleges that “Elon Musk's SpaceX violated environmental regulations by repeatedly releasing pollutants into or near bodies of water in Texas, a state agency said in a notice of violation focused on the company's water deluge system at its Starbase launch facility. “The notice from the Texas Commission on Environmental Quality (TCEQ) last week came five months after the Environmental Protection Agency Region 6 office, which covers Texas and surrounding states, had also informed SpaceX that it violated the Clean Water Act with the same type of activity.” SpaceX finally submitted an application for an Industrial Wastewater Individual Permit on July 1, 2024. It was later revised, and the revised application was  submitted August 14, 2024. Beginning at 45:20 of this episode we discuss the following: SpaceX posted a response on X in the afternoon of August 12. It dubbed the CNBC story “factually inaccurate,” and revealed additional interesting information that was previously unknown to us. So Many Questions… We're devoting this looonng episode (sorry!) to an analysis of these developments, and Eric Roesch is back with us to help give it all the once-over. And you know that wherever Eric is, a controversial, SpaceX-related environmental issue can't be far behind. Among the topics we'll discuss: What exactly happened here? The classic question: What did SpaceX know, and when did they know it? Do these enforcement actions have enough significance to force the FAA to delay launch activities at Boca Chica? The Wilson County Collection Facility has begun accepting brush again, after having to stop accepting it in late September. The facility, located at 549 C.R. 310 south of Sutherland Springs, stopped accepting brush due to a complaint made to the Texas Commission on Environmental Quality (TCEQ) about burning brush at the facility. The Wilson County Collection Facility is accepting only household waste until further notice. County Emergency Management Coordinator Cindy Stafford, who oversees the facility, told the Wilson County News Oct. 2 that that the temporary restriction resulted from a complaint received by the Texas Commission on Environmental Quality (TCEQ) that there was burning at the site. “It's my understanding that any time TCEQ investigates a complaint, they [must] do a complete site inspection,” she said, adding that until the inspection is completed, the facility can accept only household waste. On Tuesday's show: The saga over the fate of Fairfield Lake State Park took a dramatic turn this weekend. Texas Parks and Wildlife commissioners voted unanimously to condemn the park and pursue eminent domain in order to take over the 5,000-acre plot of land southeast of Dallas, so it can remain open for public use. We get an update on that story and on some rules state regulators are considering over where concrete batch plants are built.  Also this hour: Trains stopped on tracks has made traffic a nightmare at times in Houston's East End. A plan to build underpasses aims to help. We discuss why such transportation improvements often take so long and are so complicated. Then, on the heels of a a mayoral candidate forum on arts and culture, we talk with a couple of the folks behind it about what they heard from the candidates and what their priorities are for arts and culture in Houston in the years to come. The amoeba, known as naegleria fowleri, prompted the advisory Friday, which initially impacted customers of the Brazosport Water Authority. TCEQ later said that Brazosport's water was safe. The advisory continued for Lake Jackson residents and means they should not use water for anything but flushing toilets, including drinking, bathing or cooking. We talked about some of the latest issues regarding electric vehicles; a new non-profit initiative to promote them, and the Drive Electric Week plans in September. Our guests were: Janis Bookout - she is the incoming Executive Director for Earth Day Austin. Janis has helped produce the Earth Day ATX festival since 2016. She also leads climate events locally and is a founding member of 2020 or Bust, a growing global initiative on individual climate action, and recently joined the board of TxETRA (Texas Electric Transportation Resources Alliance), a new advocacy group focused on paving the way for electric transportation in Texas. Jennifer Lasseter – she is a Sustainability and Solar Consultant based in Austin, Texas. She has been involved personally and professionally for at least 18 years in sustainability issues mostly focusing on pollution prevention/zero waste and energy issues. She moved to Austin from Kansas to accept her first real job with TCEQ (state environmental agency) in 2001. Jennifer has been an EV owner for 10 years and City Captain for Austin’s National Drive Electric Week event for 3 years. Drive Electric Week will take place Sept 15th on Electric Drive. Today we continue in our water law series by focusing on surface water. If you missed the episode focused on groundwater, click here. I'm joined by Carlos Rubenstein.  His experience in Texas water is vast, including former Rio Grande Water Master, to a Commissioner on the Texas Commission on Environmental Quality to Chair of the Texas Water Development Board.  Water is certainly a passion of Carlos' and he has had really interesting experiences. We walk through the definition of surface water in Texas, the legal concept of prior appropriation that governs the vast majority of surface water in Texas, the TCEQ permitting process, and how people can go about obtaining rights to use surface water.  We also talk a bit about the role of watermasters in Texas. We then talk about a number of disputes and cases including the LCRA curtailing water rights for rice farmers, Texas Farm Bureau v. TCEQ, The Aransas Project v. TCEQ, Texas v. New Mexico, the 1944 Texas-Mexico Treaty on the Rio Grande, and issues on the San Saba River. When asked about a law he would like to see changed, Carlos said he would like to modify the current rules regarding interbasin transfers of surface water.  In Texas, a person who utilizes an interbasin transfer (moving water from one basin for use in another) does not maintain seniority of right from the original basin.  Instead, the user in the new basin is deemed junior. Water law is an important issue in Texas.  Today, we will be discussing Texas groundwater law with Austin-based water attorney, Doug Caroom.   Doug and I walk through the Rule of Capture, the approach to groundwater in Texas.  We discuss regulation by local groundwater conservation districts and considerations that go along with this approach to managing groundwater. Additionally, we talk through several key and recent groundwater cases including Day v. Edwards Aquifer Authority, Bragg v. Edwards Aquifer Authority, City of Lubbock v. Coyote Lake Ranch.  Finally, we discuss the law and impact of some pending water pipeline projects and some pointers for folks to keep in mind when purchasing or selling property with regard to groundwater severances. When asked for a law he would like to see changed, Doug says that it is too difficult to amend surface water rights at TCEQ, which prevents there from being an effective water rights market in Texas.  He believes we could use surface water more efficiently if there was a viable market system for water rights. In case there is a soil contamination, a tank leakage or a tank replacement need, the landlord will have to take care of that. However, I would face a business interruption. Is it normal to include in the lease with the landlord that, in case such things happen, I will not pay rent during the time period when I can't operate my business? Even more, would the landlord indemnify me? How far can I push it in the contract normally?" The second question came from Tina and she wrote: The land is owned. The business is owned. But the tanks are leased. So...who insures the leased tanks? What kind of insurance? If the tanks are not double lined...can the leased tanks be replaced through the company which is leasing them? What should be reviewed for UST through the TCEQ website? Who registers the tanks? How much does registration cost? The third one came from Michel, he wrote: "Hello, I enjoy your podcast very much. Great information and useful tips. Could you do a podcast on how you manage inventory effectively? Also, what do you think is the best way to handle, record and comply with UST regulations and compliance. Thank you."   Last one came from Rakesh, and he wrote: "I am getting complaints from customers time to time that my gas has water/dirt in it, I called a local repair company and they told me to call a tank company to wash my tanks!!! The Environmental Protection Agency's carbon regulation push continues, but apprently abusing the clean-air laws of the 1970s to achieve goals Congress rejected isn't enough. Late last week, teh EPA made an unprecedented move to punish Texas for being the one state with the temerity to challenge its methods. Kathleen Hartnett White is Distinguished Senior Fellow-in-Residence and Director, Armstrong Center for Energy & the Environment She joined the Texas Public Policy Foundation in January 2008. She is a Distinguished Senior Fellow-in-Residence and Director of the Armstrong Center for Energy & the Environment. Prior to joining the Foundation, White served a six-year term as Chairman and Commissioner of the Texas Commission on Environmental Quality (TCEQ). With regulatory jurisdiction over air quality, water quality, water rights & utilities, storage and disposal of waste, TCEQ’s staff of 3000, annual budget of over $600 million and 16 regional offices make it the second largest environmental regulatory agency in the world after the U.S. Environmental Protection Agency.
