In 2008, Australia and New Zealand ratified the United Nations Convention on the Rights of Persons with Disabilities (CRPD). The CRPD challenges traditional mental health legislation by emphasising the respect for inherent dignity, legal capacity, liberty and physical and mental integrity of persons with disabilities on an equal basis with others. The application of CRPD in mental health care requires a realistic and balanced interpretation of the CRPD as well as education and training of clinical staff in human rights framework.Prof Neeraj Gill and Dr Ava Carter will outline the contemporary human rights framework. They examine civil and political rights, including involuntary psychiatric treatment and coercive interventions, along with economic, social and cultural rights. The discussion will also cover the application of the UN CRPD in mental health care in Australia as well as social determinants to health, social justice and public mental health.Prof Neeraj Gill is a psychiatrist at Gold Coast Health. He is a Professor of Adult Psychiatry at Griffith University and Professor of Public Mental Health at the University of Canberra. He is the Regional Vice-President, Oceania of the World Federation for Mental Health and the Secretary of the World Psychiatric Association Section on Psychiatry, Law and Ethics. He served as an elected Director on the Board of the Royal Australian and New Zealand College of Psychiatrists (RANZCP) from 2020-2023.Neeraj was awarded his Doctor of Public Health degree from the University of New South Wales (UNSW) based on his doctoral thesis on 'human rights of people with mental disabilities'. He has published many papers on human rights, mental health law, and Aboriginal and Torres Strait Islander social and emotional wellbeing.Dr Ava Carter is a dental surgeon and medical doctor, currently specialising in consultation liaison psychiatry and developing her skills in medical administration and management. She is passionate about collaborating to improve outcomes and drive system change in organisations in the healthcare sector, and is driven to elevate the voices of others, particularly in healthcare education and lived experience. Clinically, Ava has worked in public health services, in allied health, and in the private health sector, and currently holds an operational role as Senior Registrar at Canberra Health Services. 8月12日,台南成功大學校區外發生一起嚴重車禍,54歲林姓女職員疑因癲癇發作導致車輛失控,接連撞擊7輛車,釀成1死4傷的悲劇。事發當時,林女駕駛銀色休旅車突然失控,從校區內高速衝出,撞上黃姓男子的自小客車後,又波及6輛機車。42歲的蔡姓女騎士不幸當場身亡,其他4人則受傷,其中包括林女自己。 警方經調查後表示,林女未酒駕,疑似因癲癇發作導致意外。林女供稱自己確實有癲癇病史,警方將調閱其醫療紀錄,並依《過失致死罪》進行偵辦。 台灣曾嚴格禁止癲癇患者考取駕照,但因聯合國身心障礙者權利公約(CRPD)認定是歧視身心障礙者,2020年起放寬規定,允許可控制病情的癲癇患者考照。然而,這次事故再次引發對該政策的關注。癲癇患者考照需符合嚴格條件,包括病情穩定2年以上,每次換照時都需提交神經專科醫師的診斷證明。如果癲癇發作或交通事故,駕照將立即被收回。 #超人行銷 想要學習更多? 1. 請造訪超人行銷免費索取十堂網路行銷課程:https://www.isuperman.tw 2. 加LINE官方帳號好友:https://line.me/R/ti/p/%40gyx7886l

– Vi har enorm pågang av mennesker som blir tvangsinnlagt og "medisinert" med psykofarmaka mot sin vilje. Det er grove maktovergrep, sier advokat Erlend Efskind. Nå har  han startet et advokatfirma som skal  hjelpe dem. – Enda verre er det når en vet hvilken makt legemiddelindustrien har ved å manipulere og lyve om effekten av nevroleptika. Herunder deres enorme inntjening. – I tillegg til å stadig tilføre nye diagnoser for å selge enda mer. – Gruppen av individer med "nedsatt funksjonsevne" (CRPD) er den største minoritetsgruppen i verden som fortsatt grovt diskrimineres.  – Bruk av tvang og nevroleptika kan sammenlignes med middelalderens heksejakt. Mye skyldes at vi ikke har  et holistisk, men et snevert biomedisinsk syn på helse. Formålet med Logos-advokatene er et firma som virkelig bryr seg om klientene og taler deres sak. Ledarhundens dag Det är den 24 april och ledarhundens dag! Det firar vi genom att Isabelle Ulfsdotter tar oss med till äventyrliga Hasse Börjesson, som bland annat reser till Nordnorge och fiskar tillsammans med sin ledarhund Jara. Hasse har rest mer sedan han förlorade synen än tidigare och han älskar vildmarken i Lofoten, där han har spelat in de fantastiska naturljud som vi får höra i reportaget. Diskrimineringsombudsmannen DO har i allt fler fall satt ner foten och påvisat diskriminering av ledarhundsförare. Nu har DO uttalat sig i fallet då Isabelle Ulfsdotter blev nekad studentboende med sin ledarhund. Vi får en pratstund med Isabelle och Niklas Mattsson, som kommenterar DO:s allt tydligare hållning. Ledsagning på agendan i riksdagen Den 11 april bjöd Synskadades Riksförbund tillsammans med Christofer Bergenblock (C) och Dan Hovskär (KD) in till ett lunchseminarium på ämnet ledsagning. Anna Quarnström, förbundsjurist, samt Cecilia Ekstrand, intressepolitisk handläggare på Synskadades Riksförbund, var på plats i Genéve. För Synpodden berättar de om granskningen och hur Sverige brister i sitt rättighetsarbete. Universell utformning Isabelle Ulfsdotter har träffat Emil Erdtman under hans disputation, då han lade fram sin avhandling ”Universell utformning i praktiken – förståelse, genomförande och samskapande”. Vi får höra vad universell utformning handlar om och hur det kan användas för att göra samhället mer tillgängligt. Techpepp I Techpepp kör vi denna gång Windows och pratar om spännande nyheter i skärmläsaren Jaws 2024. Vi börjar med funktionen Picture smart som genom kraften i AI nu också kan tolka bilder. Notera dock att denna funktion fortfarande är i betastadiet och behöver därför aktiveras via alternativet ”Kommande funktioner” under Inställningsmenyn i Jaws. I 2023 kom utredningen «På høy tid – realisering av funksjonshindredes rettigheter». Den slo fast at folk med funksjonsnedsettelser ikke får oppfylt sine rettigheter. Hvor trykker skoen – og hva kan vi gjøre? Og skal FNs konvensjon om rettigheter til mennesker med funksjonsnedsettelser (CRPD) bli norsk lov til slutt? I januar kommer anbefalingen fra ekspertutvalg om hvordan denne rettighetskonvensjonen for Norges største minoritet bør innføres som norsk lov. Likestillings- og diskrimineringsombud Bjørn Erik Thon forteller om rettighetsutfordringer, hvilke konsekvenser dette har og hva som bør skje fremover. This is Stephen Schmidt from the Gazette Digital News Desk, and I'm here with your update for November 6, 2023.According to the National Weather Service Monday will likely be the warmest day of the week. The prediction is for 68 degrees in the Cedar Rapids area, with mostly sunny skies. On Monday evening it will be mostly cloudy, with a low of around 41 degrees.According to reporting from the Associated Press, Iowa Governor Kim Reynolds is expected to endorse Florida Governor Ron DeSantis in his bid to secure the Republican nomination for president. DeSantis has been struggling to maintain his claim to be the solid 2nd place alternative to former President Donald Trump, and an endorsement from Gov. Reynolds could give his campaign a boost in momentum as the Iowa Caucuses are rapidly approaching.The Trump campaign was quick to criticize the news that Gov. Reynolds could endorse a political rival.“Kim Reynolds apparently has begun her retirement tour early as she clearly does not have any ambition for higher office,” the Trump campaign said in an emailed statement. “Earlier this year, she promised her constituents that she would remain neutral in the race, yet she has completely gone back on that promise. Regardless, her endorsement will not make any difference in this race.”Trump is the heavy favorite to win in Iowa. DeSantis is competing with former U.N. Ambassador Nikki Haley to emerge as the second place choice in Iowa and on to New Hampshire.But we've got our local elections to focus on this week.Tuesday is Election Day in cities and school districts across Iowa. Voters will choose representatives on their city councils and school boards, and they'll weigh in on ballot issues that could raise property taxes to pay for new schools and community facilities.But early voting numbers reported in two Eastern Iowa counties show early interest in weighing in on those choices is lagging compared to the last city and school elections in 2021.As of Thursday, Linn County Auditor Joel Miller said turnout was down about 50 percent from early voting in 2021, totaling 4,785 ballots cast.Miller said he thinks there are too many other distractions and voter apathy all contributing to a lack of turnout for this election. He estimated 75 to 80 percent of Linn County's registered voters will opt not to vote.In Johnson County, election technician John Deeth said the county finished the 2021 election with 3,898 absentee ballot requests. Deeth said he did not anticipate turnout climbing as high as 2021, when, like in Linn County, there had been more contested elections.A 17-year-old faces a felony charge after authorities determined he posted an Oct. 27 social media threat against Metro High School, Cedar Rapids police said Saturday.The arrest marks the second time in a month that police have detained a teen for posting threats on social media against Cedar Rapids schools.In the latest arrest, the threat against Metro quickly was determined by police to be unfounded and classes in the district went on uninterrupted. But the threat was then shared by others on social media, police said.On Friday, a 17-year-old boy “was located by CRPD officers and taken to detention,” according to a police news release. Police said the teen, who they did not name, is not a student in the Cedar Rapids Community School District but they did not say where he is from or where he was located.Police said the teen will be charged with intimidation with a weapon, a Class D felony. The case, once the teen is charged, will proceed through juvenile court, according to Linn County Attorney Nick Maybanks.

This July marks 33 years since the Americans with Disabilities Act (ADA) was signed — a landmark law that prohibits discrimination against people with disabilities in several areas, including employment, transportation, communications, and government resources. The ADA is meant to protect people with disabilities from discrimination in everyday life, and the law's signing made the US the first country in the world to adopt a declaration of equality for persons with disabilities. The legacy of the ADA has included increased activism and policy gains for persons with disabilities worldwide. In this episode of Big World, SIS and Kogod professor Derrick Cogburn joins us to discuss the ongoing legacy of the ADA (2:12), noting that disability policy was once a bipartisan issue in the United States but is no longer. He also describes disability policy as emanating from three imperatives: moral, economic, and legal (4:37). Cogburn explains the importance of the United Nations Convention on the Rights of Persons with Disabilities (CRPD) (6:28), explaining that the US is not among the more than 180 countries who have ratified the convention, despite then-President Barack Obama signing the CRPD (8:28). He also describes global disability movements (9:42) and discusses frameworks like the New Urban Agenda, the UN Sustainable Development Goals, and the Sendai Framework, all of which incorporate disability policy. What are some policy shifts in the realm of online accessibility over the last decade (20:23)? What are the ramifications of untapped potential when spaces, either physical or online, are not accessible to people with disabilities (29:32)? Cogburn answers these questions and discusses shifts in activists' approach to creating disability policy goals in recent years. The podcast concludes with Cogburn's comments about how the inclusion of persons with disabilities can have many positive impacts on our world (33:29). During our “Take Five” segment, Cogburn shares the five disability policies he would want to see instituted globally (16:39).

Denne rapporten handler om utfordringer for funksjonshemmedes ytringsfrihet.https://www.nhri.no/2022/funksjonshemmedes-ytringsfrihet/Ytringsfriheten er en grunnleggende menneskerettighet. Den er også en forutsetning for mange andre menneskerettigheter. Funksjonshemmede har, på lik linje med alle andre, ytrings- og informasjonsfrihet etter Grunnloven og Den europeiske menneskerettskonvensjon. I tillegg har funksjonshemmede et viktig menneskerettslig vern gjennom FNs konvensjon om rettighetene til mennesker med nedsatt funksjonsevne (CRPD). CRPD inneholder bestemmelser om ytringsfrihet og tilgang på informasjon. Konvensjonen gir også blant annet rett til å ta del i det politiske og offentlige liv, rett til å leve frie og selvstendige liv og til å være en del av samfunnet. I tillegg til å være selvstendige rettigheter, er disse bestemmelsene også viktige for ytringsfriheten til funksjonshemmede.I denne rapporten presenteres det funn fra en undersøkelse om funksjonshemmedes ytringsfrihet som NIM gjennomførte i 2021. Gjennom dybdeintervjuer søkte vi å få kunnskap om hvilke utfordringer personer med ulike funksjonshemminger møter når de ønsker å tilegne seg informasjon og å ytre seg. Rapporten gjennomgår også det menneskerettslige rammeverket for funksjonshemmedes ytringsfrihet etter Grunnloven, EMK og CRPD, samt eksisterende forskning på feltet.Med denne rapporten ønsker NIM å løfte fram noen av ytringsfrihetsutfordringene funksjonshemmede møter. I tillegg vil NIM skape bevissthet om betydningen av Norges menneskerettslige forpliktelser på dette området.På bakgrunn av funnene i undersøkelsen fremmer NIM også et knippe anbefalinger.Rapporten er lest inn av KABB - det er Ella Gyri Groven som leser.

This week on the Center of Everywhere hear researchers Phil Jensen and Kelly Asche discuss the topic of Phil's newest report, "Why Grandma May Stay at Home: Property taxes and home ownership in rural Minnesota." Attracting workers to more rural parts of the state is a complex problem, but housing plays a major role. Encouraging workers to relocate to Greater Minnesota depends on the availability of housing. That availability is a product of turnover, or “churn,” where residents transition through different types of housing at different points in their lives. The rate of housing churn can be different in rural communities than in metropolitan areas. Previous work from CRPD has shown that rural housing stock is more likely to be occupied by older residents who are less likely to move. The result is slower churn, which leaves fewer single-family homes for new workers and their families. Here we identify factors that may contribute to rural areas' slower housing churn. These factors vary significantly across the rural-urban spectrum in Minnesota and may influence residents' economic incentives regarding housing:  Property taxes Non-tax ownership costs Higher rates of outright home ownership

This book cuts new ground by applying a human rights lens of analysis to domestic mental health laws. It makes a timely contribution into the discourse regarding mental health, supported decision-making and disability rights in the post CRPD era. In A New Era for Mental Health Law and Policy: Supported Decision-Making and the UN Convention on the Rights of Persons with Disabilities (Cambridge University Press, 2017) Research Fellow Dr Piers Gooding challenges law makers to bring domestic laws into compliance with the CRPD. At the same time, Gooding confronts the pragmatic concerns which continue to shape these same laws, such as the case where a person's mental impairment is perceived as a risk to self or others.   I had a great chat with Dr. Gooding in this hour; we spoke about arguments for and against coercive interventions, the right to and meaning of autonomy, tensions between rights based legalism and clinical governance, and more. We spoke about how domestic mental health laws have evolved since the 1980s, and especially since the introduction of the CRPD, and where to go from here.  Some of the scholarship mentioned in our conversation included that of Tina Minkowitz, John Fanning, and the collaborative work of Piers himself with Bernadette McSherry, Cath Roper, and Flick Grey.     Dr Piers Gooding is a Research Fellow at the Melbourne Social Equity Institute and Melbourne Law School, and is currently an Open Science Fellow at the Mozilla Foundation. His work focuses on the law and politics of disability and mental health, with a special interest in issues of legal capacity, decision-making, technology, and human rights. This book cuts new ground by applying a human rights lens of analysis to domestic mental health laws. It makes a timely contribution into the discourse regarding mental health, supported decision-making and disability rights in the post CRPD era. In A New Era for Mental Health Law and Policy: Supported Decision-Making and the UN Convention on the Rights of Persons with Disabilities (Cambridge University Press, 2017) Research Fellow Dr Piers Gooding challenges law makers to bring domestic laws into compliance with the CRPD. At the same time, Gooding confronts the pragmatic concerns which continue to shape these same laws, such as the case where a person's mental impairment is perceived as a risk to self or others.   I had a great chat with Dr. Gooding in this hour; we spoke about arguments for and against coercive interventions, the right to and meaning of autonomy, tensions between rights based legalism and clinical governance, and more. We spoke about how domestic mental health laws have evolved since the 1980s, and especially since the introduction of the CRPD, and where to go from here.  Some of the scholarship mentioned in our conversation included that of Tina Minkowitz, John Fanning, and the collaborative work of Piers himself with Bernadette McSherry, Cath Roper, and Flick Grey.     Dr Piers Gooding is a Research Fellow at the Melbourne Social Equity Institute and Melbourne Law School, and is currently an Open Science Fellow at the Mozilla Foundation. She was named 2017 Australian Of The Year in South Australia, and the 2018 Global Leader, 100 Women Of Influence in Australia, and won the Emerging Leader in Disability award in Australia in 2015. Kate is also an Ambassador for the Australia Day Council (SA) and for Step Up For Dementia Research in Australia. She has a Master of Science in Dementia Care, a Bachelor of Psychology, and a Bachelor of Arts in Communication, all which were completed after being diagnosed with younger onset dementia. She also has a graduate Diploma in grief counselling and is a retired nurse and retired chef. Swaffer is a co-founder, and the CEO and past Chair of Dementia Alliance International, and an elected board member for Alzheimer's Disease International. She is an Honorary Associate Fellow, Faculty of Science, Medicine & Health, University of Wollongong, International Fellow, Impact Research Group, University of East Anglia, and has played a key role in campaigning for the human and legal rights for people with dementia including equal access to the CRPD. She has been tireless in her work on reframing dementia as a disability, for rehabilitation for dementia, and is the first person in the world with dementia, diagnosed herself at the age of 49, to be a keynote speaker at the WHO. Swaffer has contributed to key national and global policy documents including work for the Australian Aged Care Quality Agency, the World Health Organisation (WHO) Quality Rights initiative, and the International Consortium for Health Outcomes Measurement (ICHOM) for dementia. With two honorary university positions, has been very active as a researcher, and is a highly published author and poet. With a focus on the court diversion of disabled people, Disability, Criminal Justice and Law: Reconsidering Court Diversion (Routledge 2020) undertakes a theoretical and empirical examination of how law is complicit in debilitating disabled people. In our post-institutionalisation era, diversion of disabled people from the court process is often assumed to be humane, therapeutic and socially just. However, in this work, Dr. Linda Steele draws on Foucauldian theory of biopolitics, critical legal and political theory, and critical disability theory to show that court diversion perpetuates oppression against disabled people. She shows how criminal law and mental health systems are complicit in the coercion and control of disabled bodies, of whom may not even be convicted. The normative function of court diversion is to reinforce boundaries which are at the core of jurisdiction, legal personhood and sovereignty. Steele critiques the United Nations Convention on the Rights of Persons with Disabilities to show that it does not deal with the complexities of court diversion, suggesting that the CRPD is of limited use in its abilities to challenge carceral control and legal and settler colonial violence.  Dr. Linda Steele is a Senior Lecturer in Law at the University of Technology, Sydney.
