It's been 21 months since then-Las Vegas Raiders head coach Jon Gruden announced his resignation. Gruden had faced mounting criticism after the Wall Street Journal and New York Times obtained emails he had written between 2011 and 2018, while Gruden was working at ESPN. Several messages contained racist, homophobic, and misogynistic language directed towards several people, including NFL Commissioner Roger Goodell and NFLPA Executive Director DeMaurice Smith. The scandal ended Gruden's coaching career, likely for good. But to this day, a puzzling curiosity has remained: how did such an obscure set of emails get in the hands of the media? Don Van Natta, Jr. and Seth Wickersham have spent the last several months trying to answer that question, and now have an exclusive new report out for ESPN. As Gruden pursues a lawsuit against the NFL, Van Natta joins the show to help us pull at the threads of this mystery. Back from a mini-sabbatical as I write my NMSU Basketball book to get it out ASAP. I discuss Bank of America's role in Don Van Natta's AWESOME story about the turmoil with the Washington Commanders team and the beef minority owners had with the main owner, Dan Snyder. At the center is a $55 Million Loan that Snyder took out with the NFL's backing without informing his partners, which is leading to an even bigger beef, and also has the feds looking into Snyder for falsifying information. Don can handle the NFL side of things, but I wanted to give my two cents worth on BofAs role, and how they likely felt pressured to do the loan without proper paperwork justifying the loan as to not lose trust in Snyder, his team or the NFL as a whole. I explain why the paperwork matters. I give an example of how an LLC signer can theoretically steal from his partners by creating another LLC and move money elsewhere, and the bank would not be on the hook for it. Plus, I talk about a lawsuit that alleges BofA gave incorrect information to business owners who applied for PPP Loans in 2020. American Banker has the story. (Paywalled, but you can read it for free with an email address) It was said in the complaint that the business owners were told 1099 employees were included in the calculating of PPP Loans, when they are not, leading to people not getting their whole loan forgiven as a result of information. I explain why businesses have an uphill battle to fight on this one, although I explain how BofA used branch employees working from home during COVID to test PPP Loans, when that was not their field of expertise. I also explain how goals/high sales pressure tactics likely had a hand in it as well. The Dans are joined by ESPN's Don Van Natta, Jr. (@DVNJr) to break down the latest on the Dan Snyder investigations. Don recently wrote an article on ESPN that was a great investigative report into the financial misconduct investigations by federal prosecutors in Virginia. A new area of focus is that Dan Snyder allegedly took out a secret $55 million loan from Bank of America without the minority owners' knowledge or approval. Don writes that this loan was taken out 16 months before Snyder bought out the three other minority stakeholders shares in the Washington Commanders. Such a loan would have required approval and sign-off from the three minority shareholders. During the confidential arbitration, the three minority owners began asking questions related to the teams' finances and books and legitimacy of the loan. However, when the three owners pushed the arbitrator for the source and legality of the loan the NFL shut down the arbitration, and shifted to mediation where the three owners then agreed to sell their shares. Further, documents show that for the loan to be approved the six-person board of the Commanders needed to approve the loan (three of which were the minority owners) and Bank of America never received that approval, however NFL Commissioner Roger Goodell's signature is on the approval by the league for the Commanders to take on the loan. The three minority owners, who are billionaires as well, all claimed that Snyder was using the Commanders organization as his own personal piggy-bank, even citing a $4.5 million payment for the teams' logo to be placed on his private plane. A potential conflict could arise from this investigation into the $55 million loan, provided by Bank of America, because Bank of America is leading the current sale of the Commanders organization. Don Van Natta is a senior writer for ESPN Digital and Print media. He was recently named a finalist — along with his reporting and writing partner Seth Wickersham — for a National Magazine Award in reporting for three stories: “Sin City or Bust,” “Standing Down,” and “Roger Goodell has a Jerry Jones problem.” Van Natta has had quite the illustrious career. He’s been on three Pulitzer Prize winning reporting teams — two at the New York Times and one at the Miami Herald. He joined ESPN in 2012, and has since produced many features and investigative pieces centered around the NFL. His profile of Dallas Cowboys owner Jerry Jones in August 2014 is particularly amazing because of the access he got from a subject who initially did not want to participate. In 2014, Van Natta started the Sunday Long Read newsletter with Jacob Feldman, a reporter for Sports Illustrated. The two launched the Sunday Long Read podcast in August of last year, and so far has produced more than a dozen episodes featuring some amazing reporters and writers. Van Natta is currently working on a book with Wickersham. The book, tentatively titled Powerball,” will be published by Crown Archetype in 2020.
