Plany ogólne, WZ i działki  – co naprawdę się zmieni? W ostatnim odcinku podcastu rozmawialiśmy o reformie planowania przestrzennego i o tym, jak nowe przepisy mogą wpłynąć na osoby szukające działki pod budowę domu. Temat jest ważny, bo zmiany mogą realnie zdecydować o tym, czy na danej działce będzie można wybudować dom, czy nie. Po nagraniu odcinka uporządkowałem jeszcze najważniejsze informacje na podstawie aktualnych przepisów. Poniżej znajdziesz najważniejsze fakty oraz dwa ważne sprostowania. Najważniejsze terminy 31 sierpnia 2026 r. — to aktualny termin, do którego gminy mają czas na uchwalenie planów ogólnych. Od 1 września 2026 r. brak planu ogólnego może oznaczać poważny problem: gmina co do zasady nie będzie mogła wydawać nowych decyzji o warunkach zabudowy (WZ) ani uchwalać nowych planów miejscowych – do czasu przyjęcia planu ogólnego. 1 stycznia 2026 r. — od tej daty nowe decyzje WZ co do zasady są już decyzjami terminowymi. Wygasają po 5 latach od dnia, w którym stały się prawomocne. Bezterminowe pozostają jednak decyzje, które uprawomocniły się przed 1 stycznia 2026 r., a także decyzje wydane w sprawach wszczętych przed 16 października 2025 r. Dotychczas wiele osób traktowało decyzję o warunkach zabudowy jako sposób na trwałe potwierdzenie, że działka nadaje się pod budowę. Teraz trzeba na to uważać. 2. Czym jest plan ogólny? Plan ogólny to nowy dokument planistyczny, który zastąpi dotychczasowe studium uwarunkowań i kierunków zagospodarowania przestrzennego gminy. Różnica jest jednak bardzo ważna. Studium było dokumentem wewnętrznym gminy. Miało znaczenie przy uchwalaniu planów miejscowych (MPZP), ale samo w sobie nie było aktem prawa miejscowego i nie było bezpośrednią podstawą do wydawania decyzji o warunkach zabudowy. Plan ogólny będzie miał większe znaczenie, bo będzie aktem prawa miejscowego. To oznacza, że będzie wiążący przy sporządzaniu miejscowych planów zagospodarowania przestrzennego oraz przy wydawaniu decyzji o warunkach zabudowy. W praktyce plan ogólny odpowie na pytanie: w jakich częściach gminy rozwój zabudowy będzie możliwy, a gdzie gmina nie będzie chciała albo nie będzie mogła dopuszczać nowych inwestycji. Plan ogólny nie będzie jednak działał tak samo jak MPZP. Nie będzie tak szczegółowy. Nie wskaże inwestorowi dokładnie, jaki dom może postawić na konkretnej działce, jaką ma mieć wysokość, dach czy maksymalną powierzchnię. Szczegóły nadal będą wynikały z planu miejscowego albo – jeżeli brak MPZP – z WZ. Plan ogólny będzie natomiast dokumentem nadrzędnym. To on wyznaczy ogólne ramy: m.in. strefy planistyczne oraz obszary uzupełnienia zabudowy. I to kluczowa informacja. Po wejściu w życie planu ogólnego decyzje o warunkach zabudowy będą mogły być wydawane TYLKO dla terenów położonych w tzw. obszarze uzupełnienia zabudowy. Jeżeli działka znajdzie się poza takim obszarem, to mimo że wokół mogą być domy, uzyskanie WZ może być niemożliwe! 3. Kto będzie mógł złożyć wniosek o WZ? W podcaście stwierdziłem, że po uchwaleniu planu ogólnego wniosek o wydanie warunków zabudowy będzie mógł złożyć wyłącznie właściciel albo osoba mająca prawo do dysponowania nieruchomością na cele budowlane. To wymaga doprecyzowania. To ograniczenie ma wejść w życie 1 stycznia 2027 r., a nie automatycznie z chwilą uchwalenia przez gminę planu ogólnego. Dopiero od tej daty wniosek o WZ będzie mógł złożyć wyłącznie podmiot posiadający prawo do dysponowania nieruchomością na cele budowlane, czyli na przykład właściciel, użytkownik wieczysty albo inna osoba mająca odpowiednie uprawnienie do nieruchomości. To szczególnie ważne dla osób, które chcą sprawdzać potencjał działki przed zakupem. Po wejściu tego ograniczenia uzyskanie WZ „na cudzą działkę” może nie być już możliwe. 4. Co jeśli gmina nie uchwali planu ogólnego? To jeden z największych problemów całej reformy. Jeżeli gmina nie uchwali planu ogólnego w terminie, może dojść do czasowego paraliżu inwestycyjnego. W uproszczeniu: do czasu uchwalenia planu ogólnego gmina nie będzie mogła wydawać nowych WZ ani uchwalać nowych planów miejscowych. Dla inwestora oznacza to jedno: przed zakupem działki trzeba sprawdzać nie tylko obecny stan prawny, ale też to, na jakim etapie jest plan ogólny w danej gminie. Najprościej zacząć od BIP-u gminy. Tam powinny pojawiać się uchwały, ogłoszenia, projekty dokumentów i informacje o konsultacjach. Można to także sprawdzić na geoportalu lub e-mapie. O tym, jak to zrobić, pokazuję w 10 minucie nagrania: 5. Grunty rolne klas I–III Grunty rolne mają różne klasy bonitacyjne, czyli klasy jakości gleby. W uproszczeniu: im niższy numer klasy, tym lepsza ziemia pod uprawę. Najlepsze grunty to klasy I, II i III. Są one szczególnie chronione, ponieważ mają największą wartość rolniczą. Obecnie przeznaczenie takich gruntów na cele nierolnicze co do zasady wymaga zgody ministra właściwego do spraw rozwoju wsi. W praktyce oznacza to, że jeżeli działka jest gruntem rolnym klasy I, II albo III i nie ma dla niej planu miejscowego przeznaczającego teren pod zabudowę, uzyskanie WZ może być niemożliwe. Po wejściu w życie planu ogólnego pojawi się ważny wyjątek. Jeżeli grunt rolny klasy I–III znajdzie się w obszarze uzupełnienia zabudowy wyznaczonym w planie ogólnym, jego przeznaczenie na cele nierolnicze nie będzie wymagało zgody ministra. To w wielu przypadkach ułatwi uzyskanie WZ. Ale trzeba uważać: samo położenie działki w obszarze uzupełnienia zabudowy nie oznacza jeszcze automatycznie, że można budować. Nadal trzeba będzie spełnić pozostałe warunki zawarte w WZ, a później uzyskać pozwolenie na budowę. Najważniejszy wniosek? Po reformie nie wystarczy już sprawdzić, czy obok działki stoją domy. Trzeba sprawdzić, czy gmina ma plan ogólny, czy działka znajduje się w obszarze uzupełnienia zabudowy, jaka jest klasa gruntu i czy w ogóle będzie można uzyskać WZ. A to nadal tylko część formalno-administracyjna. Przed zakupem działki trzeba sprawdzić także m.in. warunki gruntowe, dostęp do drogi publicznej, media, ukształtowanie terenu, ograniczenia wynikające z sąsiedztwa, przebieg sieci, meliorację, strefy ochronne i wiele innych rzeczy, które mogą utrudnić albo nawet uniemożliwić budowę. Dlatego jeżeli jesteś na etapie szukania działki, zachęcam Cię do zakupu kursu „Wybór i zakup działki” na stronie www.jaksiewybudowac.pl. W kursie pokazuję krok po kroku, jak sprawdzić działkę przed zakupem, żeby nie kupić terenu, na którym później nie da się zbudować domu albo budowa okaże się dużo trudniejsza i droższa, niż zakładałeś.
