Comment on the Show by Sending Mark a Text Message. This episode is part of my initiative to provide access to important court decisions impacting employees in an easy to understand conversational format using AI. The speakers in the episode are AI generated and frankly sound great to listen to. Enjoy! What if the future of workplace dynamics hinges on a single legal battle? This episode unpacks the groundbreaking case of former NFL player Teyo Johnson's lawsuit against EveryRealm and its CEO, Janine Yorio, centered around allegations of sexual harassment and a controversial "KYP game." As we navigate this complex legal landscape, we highlight the transformative Ending Forced Arbitration of Sexual Assault and Sexual Harassment Act (EFAA), which empowers employees to sidestep mandatory arbitration and take their claims to court. This pivotal shift could redefine how companies address workplace harassment, ushering in a new era of accountability and employee empowerment. We explore the significance of understanding employment contracts and the invaluable role of meticulous documentation when facing harassment or discrimination. Johnson's experience serves as a crucial reminder of the enduring importance of respect, fairness, and accountability, even in the rapidly evolving metaverse work environment. By examining how laws like Title VII and the New York City Human Rights Law are applied, this conversation sheds light on the evolving legal system that supports employees more than ever. Join us as we discuss how Johnson's case could reshape power dynamics in workplaces and encourage companies to take proactive steps against harassment.Click here to read the case decision in Teyo v. Everyrealm 22 civ 6669 (SDNY Oct. 6 2022).This episode involves the Johnson v. Everyrealm, Inc. case, where a former employee sued his employer and executives for race and pay discrimination, sexual harassment, and retaliation. The employer sought to compel arbitration based on an employment agreement, but the employee argued that the Ending Forced Arbitration of Sexual Assault and Sexual Harassment Act (EFAA) of 2021 prevented this. The court ruled that the employee's sexual harassment claims, plausibly alleging unwanted gender-based conduct in New York City, were sufficient to invoke the EFAA. Consequently, the court denied the employer's motion to compel arbitration, allowing the entire case to proceed. The court's decision hinged on interpreting the EFAA's scope to encompass the entire case, not just the sexual harassment claims. Today's episode is about "Grace Jones: Bloodlight and Bami", a doc about legendary Jamaican singer and style icon Grace Jones, directed by Sophie Fiennes. The movie was selected by our guest, Kyp Malone, who you probably know from the seminal 2000's Brooklyn indie-rock band TV on the Radio. Bloodlight and Bami and is a verite portrait of Grace Jones' life, over the course of a few years in the 2010s. If you're looking for a Wikipedia-style run through Grace Jones' career and the backstory of how she got there, this ain't it. You are just right there with her, living her life. Fortunately, she is a compelling enough figure to carry a movie without a lot of hand-holding by the filmmakers. The movie features many stunning performances (what a voice! she's still got it!), a trip back to Jamaica to reunite with family, scenes of Grace dealing with record companies and TV producers and chewing out Sly & Robbie, and some genuinely touching moments. Kyp absolutely brought the goods and we were honored and thrilled to have him on. Check out his solo stuff & go see him when he comes to your town. Kyp & Dana are back with the 2nd installment celebrating Black History Month. Dana picked this 1974 blaxploitation film Sugar Hill (aka the Zombies of Sugar Hill) because of their big, googly, shiny eyes. More ASMR brought to you by Jarritos & Stacy's pita chips. Our new mascot, Ellie- Dana's new foster fail, makes her 1st appearance. Dana talks about the passing of her 16 yr old 1st born pup Mala & how she unexpectedly became a new mom 3 days later. Kyp teaches Dana how to not pay ridiculous medical bills (DISCLAIMER: this is Kypria's opinion, follow at your own risk), that The Academy Awards are the same as the Oscars & Kyp finally excels in this movie's accents. Copious cringy amounts of the N word ensue but the zombie slaves get their revenge!
Kyp & Mark discuss the Oscar nominations and, instead of going through them in any sort of logical order, like by category or individual film, they just sort of stumble from one to another with no real discernible logic associated with their choices. But hey, you're the idiot listening to them. So who's the real villain here?

This week the Queen is officially dead & the gals review Allegoria 2022. This fresh new movie was written & directed by Spider One, the frontman of Powerman 5000. It's a Shudder original that got not only mixed reviews from Kyp & Dana but also got them all mixed up & out of sorts. Kyp gets triggered by Dana calling out all the narcissists. Lots of artsy fartsy talk. A regrettable Costco wine purchase & why did Van Gogh really cut his ear off?
Kyp & Mark discuss Better Call Saul and how nothing is black and white. Except for a panda.
Kyp and Mark discuss World Building and The Brendan Fraser-isaunce.
The gals are back reviewing Panos Cosmatos' psychedelic thriller: Mandy. Nicolas Cage puts on a dramatic madman performance on his trippy journey to avenge his girlfriend Mandy's death. Before the recording Kyp almost dies from the tiniest sip of Dana's peanut butter whiskey. Kyp also gets roasted for her raisin food choices. They discuss whether or not there is a blade dick in the movie & if Jared Leto is actually a cult leader now.
In today's episode, we're talking about becoming a better leader with KYP practices. KYP is what I lovingly refer to as know your people. If you're looking to be an effective leader, and if you want to lead in a work environment where people have high psychological safety, it starts with knowing your people. How well do you know your employees and boss? Your teams? Your work community? Join me as I share and discuss the three most powerful practices for building KYP.

This episode we kick off Asian & Pacific Islander History month! Kyp & Dana cover one of the top rated Korean films: The Wailing (2016). They drudge through the very long plot, argue plenty over misinterpretations and touch on Dana's acupuncture experience. We learn that Kyp's mom thought she was bringing evil into her house as a horror fan. Many bad Korean pronunciations are heard & the ladies are so sorry about it. Kyp gets real mad about children not being tried as adults for murder & Dana's racist grandpa would've fit in well in this movie. Was Amber Heard responsible for the village murders? Can Kyp & Dana salvage their friendship after watching this movie? Did you fall asleep watching this?
