First, a correction to last week’s show: Ken and Josh talked about Attorney General Bill Barr’s House committee testimony in which he said federal prosecutors had brought charges he didn’t think any current US attorney would bring and that this prosecution was for “some esoteric, made-up crime,” not a “meat and potatoes crime.” Well, we mixed up which prosecution Barr was referring to. Barr was first asked about Roger Stone, but he was referring there to the Michael Flynn prosecution. So, we’ll take that one this week. Was Michael Flynn prosecuted for an esoteric, made-up crime for lying to the FBI about his contact with Russian Ambassador Sergey Kislyak during the transition? Ken White says he would prefer it if charging people for lying to federal investigators wasn’t routine for the Justice Department, but it is. It is very routine, and the Justice Department routinely rejects exactly this argument that Barr made. So, those charges against Michael Flynn — they still haven’t been dropped. Next week, all of the judges on the DC Circuit Court of Appeals will consider whether Long Suffering Federal Judge Emmet Sullivan should be forced to grant the government’s motion to dismiss the charges against Flynn. Meanwhile, President Trump is fighting a subpoena for his financial records from Manhattan District Attorney Cy Vance pursuant to a grand jury investigation. The Supreme Court ruled that President Trump doesn’t have some special right to fight this subpoena but he still has the normal rights any person would have to fight a subpoena. As part of the court filings around that fight, there’s some indication about what the DA might be looking into. Even though the president is fighting the subpoena with tools available to everyone, there’s still something unique about it. But that might not last when Trump is no longer president. The US Centers for Disease Control and Prevention now says the coronavirus “does not spread easily” through touching surfaces or objects. In early March, the federal health agency was warning that it “may be possible” to pass on the virus from contaminated surfaces, according to Fox News. Its guidelines now include a section on ways the virus doesn’t easily spread — including from touching surfaces or objects. “It may be possible that a person can get COVID-19 by touching a surface or object that has the virus on it and then touching their own mouth, nose, or possibly their eyes,” the CDC webpage states. “This is not thought to be the main way the virus spreads, but we are still learning more about this virus.” Other ways the virus doesn’t easily spread is from animals to people or people to animals, the CDC’s updated webpage states. As temperatures inch upward and Memorial Day quickly approaches, pools across the country remain closed due to coronavirus restrictions. Many are likely concerned about going for a swim, citing the possibility that coronavirus could be spread. The Centers for Disease Control and Prevention (CDC), however, says that there is “no evidence” that the virus can be spread to people through pool water, hot tubs, spas, or water play areas, as long as social-distancing measures are taken. “Proper operation and maintenance (including disinfection with chlorine and bromine) of these facilities should inactivate the virus in the water,” the CDC online guideline says. An FBI offer to pay former British spy Christopher Steele to collect intelligence on Michael Flynn in the weeks before the 2016 election has been one of the more overlooked revelations in a Justice Department inspector general’s report released in December. The reference to the FBI proposal, which was made in an Oct. 3, 2016, meeting in an unidentified European city, has received virtually no press attention. But it might have new significance following the recent release of government documents that show that Steele peddled an unfounded rumor that Flynn had an extramarital affair with a Russian woman in the United Kingdom. The court’s order, concerning a request by the House Judiciary Committee for grand jury materials that the Justice Department had blacked out from the report provided to Congress, could mean that the full report would not be made available before the 2020 election. The Supreme Court’s brief order gave no reasons for blocking an appeals court ruling ordering the release of the full report while the justices considered whether to hear the case. It ordered the Justice Department to file a petition seeking review by June 1. There were no noted dissents. The House told the justices that it sought information about whether President Trump had obstructed justice, a topic on which Mr. Mueller failed to reach a conclusion. He later backed away somewhat from that threat but stuck with his claim that widespread voting by mail promotes "a lot of illegality." Trump targeted Michigan and Nevada on Wednesday. At first he claimed Michigan was sending out more than 7 million mail-in ballots, but after criticism he corrected that to say mail-in ballot "applications." Federal judge rules in favor of mail-in ballots in Texas, says 'lack of immunity' for COVID-19 a physical condition. Ken Paxton, the Texas attorney general, said Tuesday that his office would appeal a federal court’s preliminary injunction that allows all registered voters in the state to apply to vote by mail while the country fights the coronavirus pandemic. “The district court’s opinion ignores the evidence and disregards well-established law,” the Texas Republican said in a statement, according to the Texas Tribune. "We will seek an immediate review by the Fifth Circuit Court of Appeals." The paper pointed out that the Lone Star State’s current election law only grants permission for those over 65, who have a disability or plan to be abroad at the time of the vote to apply for a mail-in ballot. Democrats are largely in favor of the voting alternative while Republicans have been critical of the option due to the risk of voter fraud. Judge Fred Biery, a district court judge in San Antonio, sided Tuesday with the state’s Democratic party. "The Court finds such fear and anxiety is inextricably intertwined with voters' physical health. Such apprehension will limit citizens' rights to cast their votes in person. The Court also finds that lack of immunity from COVID-19 is indeed a physical condition," he wrote. Many registered voters in Montgomery County have reported that they have not received their ballots and have reached out to the Council to voice their concerns. All Councilmembers signed the letter. “It is extremely concerning, this close to the June 2nd Maryland primary election, that there are widespread issues in delivering the appropriate absentee ballot to voters,” said Council Vice President Tom Hucker. “This is unacceptable and is increasing public anxiety and eroding confidence in our elections. The State Board of Elections needs to act immediately to ensure voters a fair and timely primary and general election. A couple of months ago, the media, almost as one, decided that Governor Ron DeSantis was a public menace who was going to get Floridians killed with his lax response to the coronavirus crisis. In an interview with National Review, DeSantis says he was surprised at “how knee-jerk” the hostile coverage was, but he “also knew that none of these people knew anything about Florida at all, so I didn’t care what they were saying.” The conventional wisdom has begun to change about Florida, as the disaster so widely predicted hasn’t materialized. It’s worth delving into the state’s response — as described by DeSantis and a couple of members of his team — because it is the opposite of the media narrative of a Trump-friendly governor disregarding the facts to pursue a reckless agenda. DeSantis and his team have followed the science closely from the beginning, which is why they forged a nuanced approach, but one that focused like a laser on the most vulnerable population, those in nursing homes. But it's nonetheless a telling snapshot of American politics in 2020. "You've got a president who's talking about putting the previous one in legal jeopardy, to put it nicely. We have not seen a situation like that in history," presidential historian Michael Beschloss said. "It takes antipathy of a new president for a predecessor to a new level." Mnuchin said that companies receiving benefits under the Payroll Protection Program who are inviting employees who had been laid off or furloughed due to the coronavirus crisis to return to work should plan to notify state unemployment offices of their offers. If the employee, in turn, turns down the job, they would then be considered ineligible to receive expanded unemployment benefits. “If you offer a person a job..and that person does not take the job..then that person would not be allowed to get unemployment,” Mnuchin said Tuesday. Mnuchin’s comments come as Republican lawmakers have ramped up warnings that the recent boost in jobless benefits amid COVID-19 will “push unemployment higher,” as many individuals are able to collect more money through the unemployment programs than they made while on the job. President Trump announced an executive order Tuesday that aims to make hundreds of deregulations in the age of coronavirus permanent, something that would amount to a massive overhaul of regulatory policy. "We've done far more regulation cutting than any president in history," Trump said at a Cabinet meeting ahead of signing the order. Fox News is told the executive order tells regulatory agencies to look at more than 600 regulatory actions -- mostly deregulations, but also regulations and guidance -- taken during the coronavirus pandemic and tell the White House which ones should be made permanent. "We had cases where it would take 20 years to build a highway, you had to go through various agencies to get the same permit," the president said. On Tuesday, the U.S. government declassified a suspicious email from Obama national security adviser Susan Rice dated on the day of President Donald Trump’s inauguration that memorialized a January 5 meeting that Rice and other top Obama officials had in the Oval Office about incoming national security adviser Michael Flynn. The email revealed that disgraced former FBI Director James Comey allegedly suggested to then-President Barack Obama that he should “potentially” not give “sensitive information related to Russia” to Flynn because of his communications with Russian Ambassador Sergey Kislyak. Comey said that he had no indication that Flynn had passed any classified information to Kislyak but claimed that “the level of communication is unusual.” Acting Director of National Intelligence Richard Grenell declassified the document and sent it to the Department of Justice. Herridge was the first to report the declassified email. One thing in the email that stuck out to top lawmakers and journalists was Rice’s insistence that everything was done “by the book,” a phrase she mentioned three times in the short email. Michael Flynn's attorney Sidney Powell on Tuesday filed an emergency writ of mandamus to the D.C. Circuit Court of Appeals seeking the immediate removal of Judge Emmet Sullivan from the case -- and saying that under appellate precedent set by the "Fokker Services" case, Sullivan or his replacement must dismiss the prosecution, as the Justice Department has requested. Writs of mandamus are extraordinary remedies, which are appropriate when there has been a "usurpation of judicial power" that is "clear and indisputable" -- and, Powell argued, Sullivan's behavior fits the bill. Powell pointed in particular to Sullivan's bizarre suggestion in December 2018 that Flynn had "sold out his country" and could have been prosecuted for "treason," as well as Sullivan's misstatements on the facts of the case. Powell also demanded the appellate court vacate Sullivan's order appointing an "amicus curiae," or "friend of the court," to argue in favor of preserving Flynn's guilty plea on one count of making false statements to the FBI during an unusual January 24, 2017 White House interview. Oral arguments are set for July 16. The amicus appointed by Sullivan, retired federal judge John Gleeson, has openly criticized the Trump administration's handling of Flynn's case, raising concerns that he was selected to improperly bolster Sullivan's efforts to keep the Flynn case alive even though both the government and defendant want it dismissed. (Potomac Local) Virginia Delegate Elizabeth Guzman (D-31, Dale City, Fauquier) has a new seat on the Prince William County Jail Board. Guzman opposes the county’s 287(g) program and has vowed to have it abolished. As the jail board oversees the program, now she may have her chance. The program checks the legal presence of those who have been arrested and charged with a crime after they are brought to the county jail in Manassas. If the inmate is found to be in the U.S. illegally, they are transferred into the custody of federal immigration and customs officials (ICE). Guzman told the Prince William Times in 2017, when she was seeking her first term as a Richmond legislator, Prince William police stopped her while she was driving her car “at least once every two weeks because I was living in a neighborhood the police officers probably did not think I could afford,” Guzman said. “And it didn’t happen only to me. It happened to other minorities then, people from the Middle East, Muslims … anybody who didn’t look white.” Now with more than 465,000 residents, Prince William is the second-largest jurisdiction in Virginia, and more than half of the county’s population is either African American, Hispanic, Asian or some other racial/ethnic background, which is substantially higher compared to the state of Virginia and U.S., according to the county’s economic development office. Guzman went onto say in the 2017 interview that programs like 287(g) are unnecessary because jails in Virginia already check immigration status. Lt. General Michael Flynn was the National Security Advisor to the incoming President. Russian Ambassador Sergey Kislyak wanted answers as to what the new administration was going to do regarding the new sanctions that President Obama had placed on Russia. Flynn indicates to Kislyak that he will look into it. Up to this point, nothing unusual. It is customary for top administrative officials from the new administration to meet with officials from other countries. The fine line is that they cannot indicate that they represent the U.S. Government, officially that is, or they risk being charged with the Logan Act. This is where things start to get a little bit dicey. Lt. General Michael Flynn had initially pleaded guilty to making false statements to the FBI on Jan. 24, 2017. Why did Flynn plead guilty, if he was indeed innocent? The questions are many - the answers are few - until now. They were looking for a narrative. A narrative that they would press and spin again and again in the national media. There was never any evidence because there was never any Russian Collusion. Some would argue there was never to be Russian Collusion; the collusion was to be the DoJ, President Obama and the media elites. Newly unsealed documents indicate that FBI senior officials discussing ways to ensnare General Flynn in a “perjury trap” before an interview.The four pages of documents were unsealed by US District Court Judge Emmet Sullivan on Wednesday, revealing in handwritten notes and emails that the FBI’s goal in investigating Flynn may have been “to get him to lie so we can prosecute him or get him fired.” The FBI — or at least the person who wrote the handwritten note most people are focusing on — seemed to be debating approaching Flynn with a several-pronged attack during a Jan. 24, 2017 interview: (1) to seek a prosecution on the merits of his contacts with Russian Ambassador Sergey Kislyak; (2) to catch him in a lie; and/or (3) to get him fired. Handwritten notes: “What’s our goal? Truth/Admission or get him to lie, so we can prosecute him or get him fired?”Quotes: The notes further suggest the FBI was concerned about political repercussions from newly-elected President Trump. “If we’re seen as playing games, WH will be furious,” the notes state. “Protect our institution by not playing games.”The FBI, controversially, even floated targeting Flynn for violating the Logan Act. The law first hit the books in 1799 but was updated in 1948 and 1994. “The suggested use of a flagrantly unconstitutional law, the Logan Act, to bag Flynn was particularly troubling. No one has ever been prosecuted under the Act for a simple reason: it is widely viewed as unconstitutional and unenforceable,” he said. “The email from Lisa Page on 18 U.S.C. 1001 is equally troubling where she suggests to Strzok that they set up Flynn for a charge under that statute since ‘it would be an easy way to just casually slip that in.'”“Finally, the handwritten notes reveal high-level uncertainty as to the real purpose behind the interview in whether they want ‘to prosecute him or get him fired.’ That is a dangerous uncertainty and becomes quite chilling when you consider that Flynn committed no crime in speaking with the Russians about sanctions as the incoming National Security Adviser,” Turley said. “The clear impression is that that the Justice Department sought to bag a Top Trump official in the legal version of a canned hunt.”“This new information magnifies long-standing doubts over the Flynn case. Mueller decided to pressure him into a plea despite the fact that the investigators indicated that they did not believe that he intentionally lied about this one aspect of the conversation with the Russian ambassador,” Turley continued. “In the meantime, various FBI figures lied and acted in arguably criminal or unethical ways … but all escaped without a charge. It is a record as a whole truly shocks the conscience. While rare, it is still possible for the district court to right this wrong since Flynn is not sentenced.”But many other lawyers told Law&Crime that there was no such proof of a “set up.” On the contrary, these tactics by the FBI, especially in 18 U.S. Code § 1001 (false statements) cases, are quite common. They also invariably said that this will more than likely not affect the outcome of the Flynn case.National security lawyer Bradley P. Moss, a partner at Zaid’s firm, said that the FBI’s tactics were “largely consistent” with what’s been going on for the last five decades.“These tactics, while maybe unseemly to the public, are largely consistent with the very type of deceptive interrogation techniques law enforcement has been permitted to use for at least 50 years,” he said. “This isn’t a legal bombshell that is likely to save Flynn in court: it’s simply more political fodder to justify the imminent pardon from the president.”Re Flynn: Yes, federal law enforcement routinely interviews people hoping they will confess (and get prosecuted) or lie (and get prosecuted). April 11, 2017: In an interview with Fox News, Trump says "it's not too late" for him to fire Comey, but that he has confidence in him. Trump goes on to criticize Comey for clearing Hillary Clinton. May 2, 2017: Trump attacks Comey on Twitter, saying he gave Clinton a "free pass." Trump also says that the Russia story is "phony" and an excuse used by the Democrats to justify their election loss. May 8, 2017: Trump meets with Attorney General Jeff Sessions, who recused himself from the Russia investigation, and Deputy Attorney General Rod Rosenstein. They discuss firing Comey. May 9, 2017: After receiving a recommendation from Rosenstein, Sessions sends a letter to Trump recommending that he dismiss Comey. Later that day, Trump fires Comey. In his letter of dismissal, Trump says he was acting on the recommendation of Sessions and Rosenstein, whose decision was based on Comey's mishandling of the Clinton email investigation in 2016. Trump also says, "I greatly appreciate you informing me, on three separate occasions, that I am not under investigation." May 9-10, 2017: In interviews, top White House officials including Mike Pence, Kellyanne Conway, Sean Spicer, and Sarah Sanders, insist that Trump only decided to fire Comey after receiving Rosenstein's recommendation and that Comey's firing had nothing to do with the Russia investigation. May 10, 2017: During an Oval Office meeting with Russian Foreign Minister Sergey Lavrov and Russian Ambassador Sergey Kislyak, Trump says Comey was "crazy" and "a real nutjob." He also tells them, "I faced great pressure because of Russia. That's taken off," according to The New York Times.
Jefferson Beauregard Sessions III (born December 24, 1946) is an American politician and lawyer who is the 84th Attorney General of the United States. Sessions served as the junior United States Senator from Alabama from 1997 until 2017, and is a member of the Republican Party. From 1981 to 1993, he served as U.S. Attorney for the Southern District of Alabama. Sessions was nominated in 1986 to be a judge of the U.S. District Court for the Southern District of Alabama, but his contentious nomination failed. Sessions was elected Attorney General of Alabama in 1994, and to the U.S. Senate in 1996, being re-elected in 2002, 2008, and 2014. During his time in Congress, Sessions was considered one of the most conservative members of the U.S. Senate. An early supporter of Donald Trump's 2016 presidential campaign, Sessions was considered as a possible Vice Presidential nominee, but Indiana governor Mike Pence was ultimately selected for the ticket. In November 2016, then-President-elect Donald Trump nominated Sessions for US Attorney General. He was confirmed on February 8, 2017, with a 52–47 vote in the Senate, and was sworn in on February 9. In his Attorney General confirmation hearings, Sessions said that he did not have contact with Russian officials during the 2016 U.S. presidential campaign. In March 2017, news reports revealed that Sessions had twice met with Russian Ambassador Sergey Kislyak in 2016. Sessions subsequently recused himself from any investigations into Russian interference in the 2016 presidential election while some Democratic lawmakers called for his resignation.
