This legislative proposal aims to restrict U.S. access to social media platforms like the globally popular, Chinese-originated TikTok, unless these platforms sever connections with foreign entities classified as national security threats. Musk, known for his pronounced belief in unfettered expression and the originator of the 'Twitter Files,' resonated with a comment by Representative Thomas Massie. In his statement, Massie pointed out crucial elements of the bill, which concern both businesses and websites rendering services to such social media platforms found guilty of violating the draft law. Massie articulated his worries on an unknown platform, stating that the impending TikTok prohibition could be a cover for additional control and censorship. The power would then lie with the President to bar not just apps, but entire websites, with the defaulters being U.S. or offshore internet hosting services and application stores, rather than the so-called 'foreign adversaries'. Reacting to Massie's comment, Musk proclaimed that the potential law is not solely about TikTok, but instead an issue about overarching governmental control and stifling free speech. Musk stressed that if foreign control were the sole concern of the legislation, it would have been explicitly addressed, which it was not in the proposal. Identified as the 'Protecting Americans from Foreign Adversary Controlled Applications Act,' the bill could potentially transform legislation thanks to bipartisan cooperation that brought Congress members from across the aisle together, including Elise Stefanik (R-NY) and former House Speaker Nancy Pelosi (D-CA). The Select Committee on the Chinese Communist Party, in a press statement, delineated the proposed law's implications: prohibition of app store access and web hosting services in the U.S. for applications, including TikTok, controlled by ByteDance, unless all ties to entities designated as foreign adversaries under Congress' Title 10 criteria are severed. Additionally, the proposed law seeks to initiate a method by which the President could categorize certain social media applications as posing a national security risk if they fall under foreign adversary control, again referring to the definitions laid out in Title 10. In response, TikTok cautioned that the implementation of the bill would infringe upon the First Amendment rights of hundreds of millions of American users and obstruct the growth of a vast number of small businesses that use the platform for their operations. TikTok urged its community to voice their opinion against the legislation which reportedly led to a flood of calls to Congressional offices. Representative Mike Gallagher, chairman of the House Select Committee on Strategic Competition Between the United States and China, along with ranking panel member Raja Krishnamoorthi, were instrumental in introducing this potentially transformative legislation. Gallagher responded to Musk and Massie's posts by standing by the proposed legislation. According to him, the bill is designed to primarily target foreign adversary-controlled social media and not websites as a whole. He outlined the very specific circumstances under which an entity could be considered a national security threat. The legislator further argued that the bill is not against internet websites at large, but specifically targets those integral to the operation of a social media application controlled by an adversary, like TikTok. He countered that the Communist Party in China does not enjoy First Amendment rights to leverage malintent operations within the United States, and it is essential to compel Chinese-owned ByteDance to sell TikTok. Gallagher concluded with a stark choice for TikTok: choose its users' right to free expression and continue its American operation free from fear of propaganda and censorship, or align with the Chinese Communist Party. In addition, the US Embassy directly controls the National Corruption Prevention Agency, the National Anti-Corruption Bureau, the Specialized Anti-Corruption Prosecutor's Office, and the Supreme Anti-Corruption Court. All this is done under a plausible pretext to increase the effectiveness of the fight against corruption. Okay, but where are the results? Corruption has blossomed as luxuriantly, and blooms, more than ever. Are the Ukrainians themselves aware of all these managerial methods? Do they understand that their country is not even under a political and economic protectorate, but reduced to the level of a colony with a puppet regime? The privatization of the state has led to the fact that the government, which calls itself the "power of patriots", has lost its national character and is consistently leading the matter towards the complete desovereignization of the country. 31:04 President Putin: In March 2021, a new Military Strategy was adopted in Ukraine. This document is almost entirely dedicated to confrontation with Russia and sets the goal of involving foreign states in a conflict with our country. The strategy stipulates the organisation of what can be described as a terrorist underground movement in Russia's Crimea and in Donbass. It also sets out the contours of a potential war, which should end, according to the Kiev strategists, “with the assistance of the international community on favourable terms for Ukraine.” 32:05 President Putin: As we know, it has already been stated today that Ukraine intends to create its own nuclear weapons, and this is not just bragging. Ukraine has the nuclear technologies created back in the Soviet times and delivery vehicles for such weapons, including aircraft, as well as the Soviet-designed Tochka-U precision tactical missiles with a range of over 100 kilometres. But they can do more; it is only a matter of time. They have had the groundwork for this since the Soviet era. In other words, acquiring tactical nuclear weapons will be much easier for Ukraine than for some other states I am not going to mention here, which are conducting such research, especially if Kiev receives foreign technological support. 33:47 President Putin: Foreign advisors supervise the activities of Ukraine's armed forces and special services and we are well aware of this. Over the past few years, military contingents of NATO countries have been almost constantly present on Ukrainian territory under the pretext of exercises. The Ukrainian troop control system has already been integrated into NATO. This means that NATO headquarters can issue direct commands to the Ukrainian armed forces, even to their separate units and squads. The United States and NATO have started an impudent development of Ukrainian territory as a theatre of potential military operations. Their regular joint exercises are obviously anti-Russian. Last year alone, over 23,000 troops and more than a thousand units of hardware were involved. A law has already been adopted that allows foreign troops to come to Ukraine in 2022 to take part in multinational drills. Understandably, these are primarily NATO troops. This year, at least ten of these joint drills are planned. Obviously, such undertakings are designed to be a cover-up for a rapid buildup of the NATO military group on Ukrainian territory. This is all the more so since the network of airfields upgraded with US help in Borispol, Ivano-Frankovsk, Chuguyev and Odessa, to name a few, is capable of transferring army units in a very short time. Ukraine's airspace is open to flights by US strategic and reconnaissance aircraft and drones that conduct surveillance over Russian territory. I will add that the US-built Maritime Operations Centre in Ochakov makes it possible to support activity by NATO warships, including the use of precision weapons, against the Russian Black Sea Fleet and our infrastructure on the entire Black Sea Coast. 36:54 President Putin: Article 17 of the Constitution of Ukraine stipulates that deploying foreign military bases on its territory is illegal. However, as it turns out, this is just a conventionality that can be easily circumvented. Ukraine is home to NATO training missions which are, in fact, foreign military bases. Indeed, each country is entitled to pick its own security system and enter into military alliances. Many European allies of the United States were well aware of the risks associated with this prospect already then, but were forced to put up with the will of their senior partner. The Americans simply used them to carry out a clearly anti-Russian policy. 38:41 President Putin: A number of NATO member states are still very sceptical about Ukraine joining NATO. We are getting signals from some European capitals telling us not to worry since it will not happen literally overnight. In fact, our US partners are saying the same thing as well. “All right, then” we respond, “if it does not happen tomorrow, then it will happen the day after tomorrow. What does it change from the historical perspective? Nothing at all.” Furthermore, we are aware of the US leadership's position and words that active hostilities in eastern Ukraine do not rule out the possibility of that country joining NATO if it meets NATO criteria and overcomes corruption. All the while, they are trying to convince us over and over again that NATO is a peace-loving and purely defensive alliance that poses no threat to Russia. Again, they want us to take their word for it. But we are well aware of the real value of these words. In 1990, when German unification was discussed, the United States promised the Soviet leadership that NATO jurisdiction or military presence will not expand one inch to the east and that the unification of Germany will not lead to the spread of NATO's military organisation to the east. This is a quote. They issued lots of verbal assurances, all of which turned out to be empty phrases. Later, they began to assure us that the accession to NATO by Central and Eastern European countries would only improve relations with Moscow, relieve these countries of the fears steeped in their bitter historical legacy, and even create a belt of countries that are friendly towards Russia. However, the exact opposite happened. The governments of certain Eastern European countries, speculating on Russophobia, brought their complexes and stereotypes about the Russian threat to the Alliance and insisted on building up the collective defence potentials and deploying them primarily against Russia. Worse still, that happened in the 1990s and the early 2000s when, thanks to our openness and goodwill, relations between Russia and the West had reached a high level. Russia has fulfilled all of its obligations, including the pullout from Germany, from Central and Eastern Europe, making an immense contribution to overcoming the legacy of the Cold War. We have consistently proposed various cooperation options, including in the NATO-Russia Council and the OSCE formats. Moreover, I will say something I have never said publicly, I will say it now for the first time. When then outgoing US President Bill Clinton visited Moscow in 2000, I asked him how America would feel about admitting Russia to NATO. I will not reveal all the details of that conversation, but the reaction to my question was, let us say, quite restrained, and the Americans' true attitude to that possibility can actually be seen from their subsequent steps with regard to our country. I am referring to the overt support for terrorists in the North Caucasus, the disregard for our security demands and concerns, NATO's continued expansion, withdrawal from the ABM Treaty, and so on. 43:05 President Putin: Today, one glance at the map is enough to see to what extent Western countries have kept their promise to refrain from NATO's eastward expansion. They just cheated. We have seen five waves of NATO expansion, one after another – Poland, the Czech Republic and Hungary were admitted in 1999; Bulgaria, Estonia, Latvia, Lithuania, Romania, Slovakia and Slovenia in 2004; Albania and Croatia in 2009; Montenegro in 2017; and North Macedonia in 2020. As a result, the Alliance, its military infrastructure has reached Russia's borders. This is one of the key causes of the European security crisis; it has had the most negative impact on the entire system of international relations and led to the loss of mutual trust. The situation continues to deteriorate, including in the strategic area. Thus, positioning areas for interceptor missiles are being established in Romania and Poland as part of the US project to create a global missile defence system. It is common knowledge that the launchers deployed there can be used for Tomahawk cruise missiles – offensive strike systems. In addition, the United States is developing its all-purpose Standard Missile-6, which can provide air and missile defence, as well as strike ground and surface targets. In other words, the allegedly defensive US missile defence system is developing and expanding its new offensive capabilities. The information we have gives us good reason to believe that Ukraine's accession to NATO and the subsequent deployment of NATO facilities has already been decided and is only a matter of time. We clearly understand that given this scenario, the level of military threats to Russia will increase dramatically, several times over. 45:07 President Putin: I will explain that American strategic planning documents confirm the possibility of a so-called preemptive strike at enemy missile systems. We also know the main adversary of the United States and NATO. It is Russia. NATO documents officially declare our country to be the main threat to Euro-Atlantic security. Ukraine will serve as an advanced bridgehead for such a strike. 46:00 President Putin: Many Ukrainian airfields are located not far from our borders. NATO's tactical aviation deployed there, including precision weapon carriers, will be capable of striking at our territory to the depth of the Volgograd-Kazan-Samara-Astrakhan line. The deployment of reconnaissance radars on Ukrainian territory will allow NATO to tightly control Russia's airspace up to the Urals. Finally, after the US destroyed the INF Treaty, the Pentagon has been openly developing many land-based attack weapons, including ballistic missiles that are capable of hitting targets at a distance of up to 5,500 km. If deployed in Ukraine, such systems will be able to hit targets in Russia's entire European part. The flying time of Tomahawk cruise missiles to Moscow will be less than 35 minutes; ballistic missiles from Kharkov will take seven to eight minutes; and hypersonic assault weapons, four to five minutes. It is like a knife to the throat. I have no doubt that they hope to carry out these plans, as they did many times in the past, expanding NATO eastward, moving their military infrastructure to Russian borders and fully ignoring our concerns, protests and warnings. Excuse me, but they simply did not care at all about such things and did whatever they deemed necessary. Of course, they are going to behave in the same way in the future. 47:46 President Putin: Russia has always advocated the resolution of the most complicated problems by political and diplomatic means, at the negotiating table. We are well aware of our enormous responsibility when it comes to regional and global stability. Back in 2008, Russia put forth an initiative to conclude a European Security Treaty under which not a single Euro-Atlantic state or international organisation could strengthen their security at the expense of the security of others. However, our proposal was rejected right off the bat on the pretext that Russia should not be allowed to put limits on NATO activities. Furthermore, it was made explicitly clear to us that only NATO members can have legally binding security guarantees. 48:35 President Putin: Last December, we handed over to our Western partners a draft treaty between the Russian Federation and the United States of America on security guarantees, as well as a draft agreement on measures to ensure the security of the Russian Federation and NATO member states. The United States and NATO responded with general statements. There were kernels of rationality in them as well, but they concerned matters of secondary importance and it all looked like an attempt to drag the issue out and to lead the discussion astray. We responded to this accordingly and pointed out that we were ready to follow the path of negotiations, provided, however, that all issues are considered as a package that includes Russia's core proposals which contain three key points. First, to prevent further NATO expansion. Second, to have the Alliance refrain from deploying assault weapon systems on Russian borders. And finally, rolling back the bloc's military capability and infrastructure in Europe to where they were in 1997, when the NATO-Russia Founding Act was signed. These principled proposals of ours have been ignored. 50:21 President Putin: They are again trying to blackmail us and are threatening us with sanctions, which, by the way, they will introduce no matter what as Russia continues to strengthen its sovereignty and its Armed Forces. To be sure, they will never think twice before coming up with or just fabricating a pretext for yet another sanction attack regardless of the developments in Ukraine. Their one and only goal is to hold back the development of Russia. 51:06 President Putin: I would like to be clear and straightforward: in the current circumstances, when our proposals for an equal dialogue on fundamental issues have actually remained unanswered by the United States and NATO, when the level of threats to our country has increased significantly, Russia has every right to respond in order to ensure its security. Not a single day goes by without Donbass communities coming under shelling attacks. The killing of civilians, the blockade, the abuse of people, including children, women and the elderly, continues unabated. As we say, there is no end in sight to this. Meanwhile, the so-called civilised world, which our Western colleagues proclaimed themselves the only representatives of, prefers not to see this, as if this horror and genocide, which almost 4 million people are facing, do not exist. But they do exist and only because these people did not agree with the West-supported coup in Ukraine in 2014 and opposed the transition towards the Neanderthal and aggressive nationalism and neo-Nazism which have been elevated in Ukraine to the rank of national policy. They are fighting for their elementary right to live on their own land, to speak their own language, and to preserve their culture and traditions. How long can this tragedy continue? How much longer can one put up with this? Russia has done everything to preserve Ukraine's territorial integrity. All these years, it has persistently and patiently pushed for the implementation of UN Security Council Resolution 2202 of February 17, 2015, which consolidated the Minsk Package of Measures of February 12, 2015, to settle the situation in Donbass. Everything was in vain. Presidents and Rada deputies come and go, but deep down the aggressive and nationalistic regime that seized power in Kiev remains unchanged. It is entirely a product of the 2014 coup, and those who then embarked on the path of violence, bloodshed and lawlessness did not recognise then and do not recognise now any solution to the Donbass issue other than a military one. In this regard, I consider it necessary to take a long overdue decision and to immediately recognise the independence and sovereignty of the Donetsk People's Republic and the Lugansk People's Republic. I would like to ask the Federal Assembly of the Russian Federation to support this decision and then ratify the Treaty of Friendship and Mutual Assistance with both republics. The House Budget Committee advanced the $3.5 trillion Build Back Better Act on September 25, with a 20 to 17 vote. The legislation will now move to the House Rules Committee, where it will be submitted to a further round of changes before it can be brought to the chamber floor for a vote. The presidential race seems to be coming to a close, but the state will have not one but two US Senate seats heading to runoff elections on January 5, 2021. One race will be Republican Sen. David Perdue vs. Democrat Jon Ossoff, and the other race will be GOP Sen. Kelly Loeffler - who has never won an election - vs. Democratic Pastor Raphael Warnock. Just about every Democrat has come forward with advice on how best to win each seat. On one side, House Speaker Nancy Pelosi (D-CA) and her allies have warned Georgia Democrats to not run too far to the left, or they will blow their chances in both contests. House Majority Whip Jim Clyburn (D-SC) said during a Thursday caucus call that if “we are going to run on Medicare for All, defund the police, socialized medicine, we're not going to win," Politico reported. "But Rep. Pramila Jayapal of Washington, co-chair of the Congressional Progressive Caucus, thought differently, jumping in on a Democratic Party strategy call to defend liberal ideas, saying that’s what keeps the Democratic base motivated to turn out and vote," the outlet noted. New Civil Rights Data Collection (CRDC) findings were released, but the U.S. Department of Education (ED) isn't talking about what the data means for students of color. Plus, Senate Republicans fail to pass their “skinny” COVID-19 stimulus package as a more comprehensive deal eludes the White House and House Democrats. With prospects for an agreement prior to the election fading, will schools ever get the relief they need? Last week, ED released findings from the long-delayed 2017–18 Civil Rights Data Collection, a biennial survey of the nation’s public elementary and secondary schools. ED’s analysis focuses on two areas: (1) reports of sexual violence and (2) the use of physical restraint and seclusion against students. Specifically, elementary and secondary schools reported a more than 50 percent increase in reports of sexual violence during the 2017–18 school year compared to the 2015–16 school year. The agency’s Office for Civil Rights (OCR) said it is unclear what drove the increase in reported allegations. Additionally, the report highlights that students with disabilities—and specifically Black students with disabilities—were disproportionately subject to seclusion and restraint. Unfortunately, that is one of the only findings that focuses specifically on the school experiences of students of color. While the CRDC includes many data points that can be used by advocates and researchers to uncover inequities in the nation’s schools, the Office for Civil Rights provided next to no explanation of what the data means for Black and Latino students, reinforcing a troubling trend from this administration. In a statement, Alliance for Excellent Education (All4Ed) President and CEO Deb Delisle explained, “After taking far too long to release this information, the Trump administration did so without providing much-needed analysis to go along with millions of data points. This follows an insidious history of this administration’s denials of systemic racism, ranging from their rescission of OCR’s guidance on school discipline and school integration, to the recent executive order prohibiting federal agencies and contractors from engaging in trainings that promote diversity.” As we covered before on Federal Flash, ED delayed the latest CRDC by a year, citing uncertainty and unreliability of data collection due to the coronavirus, and also is planning to cease collecting a number of critical equity data points, including questions related to school funding and experienced educators. We’ll keep you posted on these efforts. COVID-19 Relief Remains Stalled With time slipping away to strike a deal on a COVID-19 relief package before the election, Senate Republicans tried again to pass a “skinny” version of their stimulus bill, the Health, Economic Assistance, Liability Protection, and Schools (HEALS) Act. As a reminder, this proposal has a lower $500 billion price tag than the $2.2 trillion Health and Emergency Recovery Omnibus Emergency Solutions (HEROES) Act passed by House Democrats. The Senate plan also includes less relief for education: $70 billion for public and private schools, with two-thirds of that contingent on schools offering in-person classes. However, Democrats blocked the measure, and it failed to pass the Senate floor. In the meantime, House Speaker Nancy Pelosi (D-CA) and U.S. Treasury Secretary Steven Mnuchin continue work on a more comprehensive bill, but major sticking points remain. As we covered onFederal Flash, President Trump abruptly sidelined negotiations with Democrats after they unveiled the new HEROES Act earlier this fall. But conversations restarted just a few days later after the President got an earful from Republican lawmakers who were wary of abandoning action to boost the economy in an election year. House Democrats bring a new Health and Emergency Recovery Omnibus Emergency Solutions (HEROES) Act to the table, with a lower overall price tag but more dedicated funding for education and home internet. Congress and the White House agree to a temporary stopgap to keep the government open through mid-December—including good news for advocates working to prevent child hunger during the pandemic. HEROES Act Includes $225 Billion for Education The debate over coronavirus aid continues. After two plans from Senate Republicans flopped, it seemed like negotiations between Congress and the White House would be at a standstill until after the election. Instead, in an eleventh-hour push for a deal, House Speaker Nancy Pelosi (D-CA) unveiled an updated version of the HEROES Act, the bill House Democrats passed in May. For months Senate Majority Leader Mitch McConnell (R-KY) has refused to bring the HEROES Act to the floor, citing objections to its $3.4 trillion price tag, including $1 trillion to shore up state and local government budgets. The new, slimmed down HEROES Act would provide $2.2 trillion in overall relief and cut the fund for state and local governments in half. However, education fares better in the revised plan. Our viewers may recall that the original bill only provided about $100 billion for education—short of the $250 billion advocates had sought. The new HEROES Act gets much closer to that figure, targeting $225 billion to education including a $208 billion stabilization fund and $5 billion for emergency school infrastructure repairs and improvements, like ventilation systems. Like the original HEROES Act, governors would receive stabilization funds based on two factors: (1) the state’s relative share of the population between the ages of five and twenty-four years and (2) their relative share of students from low-income families under Title I. Even more of the stabilization fund—85 percent or about $175 billion—would flow to school districts, based on the relative number of Title I students they serve. The rest of the stabilization fund goes to institutions of higher education and governors, with set-asides for outlying areas and for the Bureau of Indian Education and tribal colleges and universities. Unlike the Republican relief proposals, no funding in the HEROES Act is contingent on schools reopening for in-person instruction. Another difference is that no funding can support tuition for students to attend private schools, outside of special education students who require private placement to receive services. Finally, the HEROES Act includes $12 billion for home internet connectivity. The Republican plans, in contrast, failed to include any funding to help close the homework gap that’s plaguing 16.9 million children. The HEROES Act also goes further to ensure that state education funding is equitable and targeted to communities most in need. In addition to maintenance of effort requirements that states maintain funding for education, including per-pupil spending, at similar levels over the next three years, states also would need to show maintenance of equity. States could not receive HEROES funds if cuts in state funding disproportionately affect high-need districts serving the most students from low-income families. Many advocates, including the Alliance for Excellent Education (All4Ed), praised the bill for providing a level of investment in students and schools that matches the scale of the coronavirus crisis. Unfortunately, prospects for this version of the HEROES Act are grim. U.S. Secretary of the Treasury Steve Mnuchin responded with an offer of $150 billion for education—more than previous Republican proposals, but still short of the new HEROES Act. But after negotiations with the White House stalled, the House passed the HEROES Act, and the Senate has no plans to consider the legislation. We’ll keep you posted on any new developments.
Education Secretary Betsy DeVos is forced to abandon her policy to shuttle more funding to private schools with COVID-19 relief funds. The U.S. Senate can’t quite muster the votes for Majority Leader Mitch McConnell’s (R-KY) COVID-19 legislation. The U.S. House of Representatives passed the first federal legislation on school integration in more than thirty years. Federal Judge Rules Against Secretary Devos Ever since Secretary of Education DeVos took office, she has been focused on finding ways to fund private schools with federal dollars, with little success. That streak continued as a federal district court judge sided with the NAACP against the Secretary’s equitable services rule and found she had no authority to impose conditions on funding provided under the Coronavirus Aid, Relief, and Economic Security (CARES) Act, legislation passed by Congress to respond to the coronavirus. Our viewers may recall that Devos’s equitable services rule had been halted temporarily in several states after two judges issued preliminary injunctions. The latest ruling applies nationwide and, as a result, the U.S. Department of Education’s (ED’s) regulation is no longer in effect. The DeVos rule would have pushed school districts to spend a larger share of CARES Act funds on private schools than they do under Title I of the Every Student Succeeds Act (ESSA). School districts would have had two options for how to distribute CARES Act funds, but if they wanted to follow the same policy as under ESSA—instead of DeVos’s preferred method—they would have faced additional restrictions. COVID-19 Relief Bill Stalls in Senate Schools are reopening but without any additional assistance from Washington, DC. Bipartisan negotiations between congressional leaders and the White House on the next COVID-19 relief package came to a halt in August and have yet to resume. Last week, Senate Majority Leader McConnell proposed a slimmed-down version of the $1 trillion Health, Economic Assistance, Liability Protection, and Schools (HEALS ) Act, the proposal advanced by Republican leaders back in July that failed to gain support from the White House or even McConnell’s own caucus. McConnell’s new proposal, the Delivering Immediate Relief to America’s Families, Schools, and Small Business Act, costs about half as much as the original HEALS Act. By lowering the price tag to about $500 billion, McConnell was able to secure the support of his Republican colleagues. Democrats, on the other hand, balked at the proposal. While some called the bill “skinny,” Senate Minority Leader Chuck Schumer (D-NY) called it “emaciated.” One thing Senate Republicans’ COVID-19 relief bill is not slim on, however, is support for private schools. The bill requires states to set aside funds for private school scholarships; creates a new tax credit for people or businesses that donate to these scholarship funds; and expands the uses of 529 plans for homeschooling and for a wide range of other uses related to public, private, or religious schools, including books, tutoring, and dual enrollment. Overall, the legislation provides $70 billion for elementary and secondary education; however, after funds are set aside to fund the private school scholarships, two-thirds of the remaining funds are dependent on district plans to reopen schools for in-person instruction. After the bill failed to garner the sixty votes needed to pass the Senate, chances for any COVID-19 relief legislation are in jeopardy with members of Congress anxious to leave town and campaign heading into the election. However, House Speaker Nancy Pelosi (D-CA) said she will keep the House in session until they pass a coronavirus relief bill. We’ll keep you posted. In an interview with National Review, DeSantis says he was surprised at “how knee-jerk” the hostile coverage was, but he “also knew that none of these people knew anything about Florida at all, so I didn’t care what they were saying.” The conventional wisdom has begun to change about Florida, as the disaster so widely predicted hasn’t materialized. It’s worth delving into the state’s response — as described by DeSantis and a couple of members of his team — because it is the opposite of the media narrative of a Trump-friendly governor disregarding the facts to pursue a reckless agenda. DeSantis and his team have followed the science closely from the beginning, which is why they forged a nuanced approach, but one that focused like a laser on the most vulnerable population, those in nursing homes. An irony of the national coverage of the coronavirus crisis is that at the same time DeSantis was being made into a villain, New York governor Andrew Cuomo was being elevated as a hero, even though the DeSantis approach to nursing homes was obviously superior to that of Cuomo. Florida went out of its way to get COVID-19-positive people out of nursing homes, while New York went out of its way to get them in, a policy now widely acknowledged to have been a debacle. The media didn’t exactly have their eyes on the ball. “The day that the media had their first big freakout about Florida was March 15th,” DeSantis recalls, “which was, there were people on Clearwater Beach, and it was this big deal. That same day is when we signed the executive order to, one, ban visitation in the nursing homes, and two, ban the reintroduction of a COVID-positive patient back into a nursing home.” DeSantis is bemused by the obsession with Florida’s beaches. When they opened in Jacksonville, it was a big national story, usually relayed with a dire tone. “Jacksonville has almost no COVID activity outside of a nursing-home context,” he says. “Their hospitalizations are down, ICU down since the beaches opened a month ago. And yet, nobody talks about it.
