This Day in Legal History: United States v. VirginiaOn this day in legal history, June 26, 1996, the U.S. Supreme Court issued its landmark decision in United States v. Virginia, striking down the Virginia Military Institute's (VMI) male-only admissions policy. The 7–1 ruling held that the exclusion of women violated the Equal Protection Clause of the Fourteenth Amendment. Writing for the majority, Justice Ruth Bader Ginsburg emphasized that gender-based government action must demonstrate an “exceedingly persuasive justification” to be constitutional.VMI had long argued that its adversative, military-style education would be compromised by the inclusion of women. In response to the lawsuit, Virginia created a separate program for women at Mary Baldwin College, which the Court found to be inherently unequal. The Court concluded that Virginia failed to show that its gender-based admissions policy was substantially related to an important governmental objective.Justice Ginsburg's opinion stressed that generalizations about gender roles cannot justify the denial of opportunity. The ruling did not require VMI to change its core program but made clear that women must be given equal access to it. This position diverges from another recent ruling in which Judge William Alsup found that Anthropic's AI use of copyrighted content qualified as fair use.The authors' legal team criticized the decision, calling Meta's actions a form of “historically unprecedented pirating,” while Meta praised the outcome and defended fair use as essential for developing transformative AI technologies.This case is part of a broader legal wave in which creators are challenging companies like OpenAI, Microsoft, and Anthropic over AI systems trained on copyrighted materials. While headline numbers are strong, the IRS suspended over 13 million returns, largely due to fraud checks or errors, delaying refunds and spotlighting operational vulnerabilities. One of the most glaring issues is the average 20-month wait time for identity theft victims to resolve their cases, many of whom are low-income taxpayers urgently awaiting those refunds.Staffing levels are at crisis lows: the IRS workforce shrank by 26% in the first half of 2025, casting doubt on its ability to maintain performance as the temporary funding from the Inflation Reduction Act winds down. The Supreme Court took cert on the question of whether such national injunctions are appropriate, and if not, how the relief that appears indicated can be offered. Along the way questions of the merits poked their way through, with interesting results. Underwood Chair in Free Enterprise at Vanderbilt Law School in Nashville, Tennessee, debate the merits of originalism in constitutional interpretation. Originalism is a theory that argues that the U.S. Constitution should be interpreted based on its original meaning, as understood at the time of its adoption nearly 250 years ago, rather than evolving with society. Arguments for originalism in this debate include: Originalism limits judicial discretion and prevents judges from imposing their own political views under the guise of constitutional interpretation.It promotes certainty, predictability and stability in law by relying on a fixed meaning of constitutional texts.Changes to the Constitution should be left to the formal amendment process, rather than judicial interpretation.Arguments against originalism include: Originalism is often unworkable in practice because it's difficult to determine the original meaning or intent of constitutional provisions, and historical context can be challenging to fully understand. Houston's legal market wasn't always one of the most competitive arenas in Big Law. But today, 14 of the 15 largest law firms by revenue have an office in Space City. The market's growth has mirrored the explosion of the country's energy industry over the past decade or so. And the competition among law firms continues to evolve, as the biggest firms fight for their share of a market once dominated by local firms. On this episode of On the Merits, Bloomberg Law's Roy Strom spoke with Nick Dhesi, the managing partner of Latham & Watkins' Houston office, which is credited as the first to truly crack the once-insular market. Latham in February celebrated its 15th year in Houston. The firm has more than 120 lawyers in the city, the fifth-largest presence among the 100 largest firms by revenue, according to Leopard Solutions. Other firms, such as Kirkland & Ellis, Sidley Austin, Simpson Thacher & Bartlett, and Gibson Dunn & Crutcher, have piled into the market, lured by its dominant oil and gas scene. Just last year, Paul Weiss made an unsuccessful effort to open in Houston, Bloomberg Law reported, which included an attempt to poach from Latham. Latham, the second-largest firm by revenue, now has a roughly $2 billion energy and infrastructure practice, led by Houston partner Justin Stolte. In the podcast, Dhesi talks about Latham's main competitors now, what a "dirt lawyer" is, and how the Texas legal market will respond to an economy that's branching out of the traditional oil and gas deals that powered its growth. He also discusses how the Houston and Dallas legal markets are different, and what Texas law schools have been doing to supply more high-caliber lawyers to all the top firms clamoring for talent in the state. In Crystal McKinney v. Combs, et al. (Case: 24-cv-03931), Plaintiff Crystal McKinney filed suit under the Victims of Gender-Motivated Violence Prevention Act (GMVA), N.Y.C. Admin. Code § 8-901 et seq., alleging that Defendant Sean Combs subjected her to sexual assault, physical abuse, and forcible drugging, resulting in lifelong injuries. In opposition to the Defendants' Motion to Dismiss her Amended Complaint (ECF No. 36), the Plaintiff argues that her claims were sufficiently pled and should proceed to litigation. On January 8, 2025, McKinney requested a retroactive extension for submitting her opposition, which the Court addressed with an order on January 10, 2025.
