This Day in Legal History: United States v. VirginiaOn this day in legal history, June 26, 1996, the U.S. Supreme Court issued its landmark decision in United States v. Virginia, striking down the Virginia Military Institute's (VMI) male-only admissions policy. The 7–1 ruling held that the exclusion of women violated the Equal Protection Clause of the Fourteenth Amendment. Writing for the majority, Justice Ruth Bader Ginsburg emphasized that gender-based government action must demonstrate an “exceedingly persuasive justification” to be constitutional.VMI had long argued that its adversative, military-style education would be compromised by the inclusion of women. In response to the lawsuit, Virginia created a separate program for women at Mary Baldwin College, which the Court found to be inherently unequal. One of the most glaring issues is the average 20-month wait time for identity theft victims to resolve their cases, many of whom are low-income taxpayers urgently awaiting those refunds.Staffing levels are at crisis lows: the IRS workforce shrank by 26% in the first half of 2025, casting doubt on its ability to maintain performance as the temporary funding from the Inflation Reduction Act winds down. The Trump executive order on birthright citizenship has been banging around the lower federal courts for months now, with court after court opining on its unconstitutionality and issuing injunctions against it that span the nation.  The Supreme Court took cert on the question of whether such national injunctions are appropriate, and if not, how the relief that appears indicated can be offered.  Along the way questions of the merits poked their way through, with interesting results.  In this episode you will hear from the justices and the attorneys, and you will hear Professor Amar doing his Howard Cosell halftime highlights imitation, opining on their arguments, responses, and questions, and offering a holistic approach to the case as well as some new theories on how to think about citizenship in this context.  A “clip episode” as only Amarica's Constitution does it.  CLE credit is available for lawyers and judges from podcast.njsba.com.

With so many issues stemming from President Trump's executive orders now before the Supreme Court, it's tough to know where to begin. So Andrew and Mary start this week with the arguments heard last Thursday from Mary's ICAP team on the courts issuing national injunctions in several birthright citizenship cases. They recap Thursday's highlights and note the Justices' interest in getting to the merits of the birthright issue. Then, they talk through two SCOTUS decisions from Friday and Monday: one on the Trump administration using the Alien Enemies Act to ‘extract' Venezuelan migrants, and the other on their attempt to revoke the protected status of Venezuelans.
