(Briefing.com) Japan Crypto News - Japan inched closer to allowing venture capital firms and other investment funds to hold digital assets directly, after Prime Minister Fumio Kishida's administration agreed to submit a revised bill to implement the change. - His cabinet approved the text of a bill on Feb. 16 that seeks to partially amend the country's industrial competitiveness enhancement act, according to a statement published on the Ministry of Economy, Trade and Industry's website. The bill states that “measures will be taken to add cryptoassets to the list of assets that can be acquired and held by investment limited partnerships,” referring to a vehicle used by venture capital firms to secure capital for investments. China - China's southern province of Hainan moved to cut down-payment ratio for first-time homebuyers, the latest region in the country to ease mortgage policies to boost slumping home sales. - Minimum down payment for first homes was cut to 20% from 25%, according to a Monday report by Hainan Daily. The ratio for second homes remains unchanged at 30%, the outlet reported, citing a government notice without saying when the measure would go into effect. More China - China's market opened after the long Lunar New Year break with a thud. - China looks to be still buying directly into markets to prop up - Reports about pre-pandemic level spending on goods and travel, especially during the Lunar New Year did not lift the mood much China's Newest Concern: Lie Flat - "lie flat", a Chinese term used to describe people who work just enough to afford to spend their time on what they enjoy. ---- Not like Japan Inc of the 1980's - Although there is no data on how many young Chinese are opting out of corporate jobs that they traditionally would have taken, the youth jobless rate rose to a record high of 21.
There is a great Simon Sinek video floating around about how companies say employees are important, but don't really act like it. He lines up the typical CEO hit list of growth, shareholder value, customers and in fourth place, employees. Richard Branson is also a powerful advocate for putting employees first before all else. It makes sense. We want motivated, enthusiastic staff engaging with our customers and going the extra mile. Japan's Escalator System No Longer Works We can't rely on the Japanese nenkojoretsu system of steady escalator career advancement based on seniority and age. In a global economy, awash with disruptive and competitive technologies, waiting for the best and brightest to become older in order to be given their leadership shot is an opportunity cost we don't want to pay. There are 1.4 jobs available for those looking for work to choose from. They have the whip hand here not the bosses. After the Lehman Shock, Japanese companies moved to creating a lower risk work environment by employing more and more people part-time. The thinking was, if the economy tanks again, it will be easier to fire these part-timers than regular employees. This was seen as a positive, a stable buffer against future unknowns. The use by date on this idea however is well and truly over because we are running out of people. Those part-timers are increasingly being absorbed into firms to give them the staff numbers they need, because hiring in people is so fraught. Demographics are the key to the future The reality of less and less young people coming into the workforce is creating labor shortages. Women re-entering the workforce and older workers continuing on working is preferred to the perceived social disruption of having immigrants come in substantial numbers. The recruiting war for talent has been replaced with the recruiting war for anyone with a pulse. Retaining staff will become even harder. Recruiters will have a field day, searching for talent to lift them out of their current firm and place them elsewhere. Automatically, this worker shortage has swung the pendulum to place workers first above shareholder value and customers. However, we are not going back to the cushy old Japan Inc days of “who cares about shareholder value and corporate performance”. People are now at the forefront of company business plans. Do we have a middle management skillset able to retain our most talented people? Are bosses still thinking they can just hire in new staff easily? Have we replaced the elevation by age and stage with performance evaluations which identify, inspire and mobilise the talent. Do we have the right training in place which will actually lift staff productivity. The soft skills are where the big gains will come from, as we better lead our teams, engage them, motivate them and keep them. This time around, the workers can more easily vote with their feet and leave. Already 40% of young staff into their third and fourth year at the firm are heading for greener grass. This situation isn't going to improve. Are our company leaders ready for the revolution?

It was one of those turning points in the global economy which deserved more attention: Chinese passenger car exports exceeded Japan's this past May, powered by the country's rapidly-expanding electric vehicle sector. It's a marker of China's increasing dominance in this emerging industry, and another sign of Japan's struggles to make more headway, despite its early forays into alternative fuel vehicles. But secure is China's EV dominance, how big a threat are its EVs to the likes of Toyota, and will a steady flow of EV exports trigger a regulatory backlash? The Tokyo Stock Price Index has returned 12% in yen and 8% in dollars this year, on par with the S&P 500. Japan lifted Covid restrictions only recently, so the recovery that happened in the West last year is happening there now. We anticipate the Bank of Japan will widen its yield curve control band or even abolish it, during its June or July meeting, and see the dollar yen rate 10% higher than where it is now, in a year's time. There is an argument that wage inflation and corporate reform will force Japan Inc.'s 8% return on equity higher. We believe the combination of a declining population and low profit margins will keep it low. However, some Japanese companies are leaders globally in what they do, with returns on equity above 20%. They have been good stocks to own over the past five years, and should continue to be going forward too. This episode is hosted by Mark Matthews, Head Research Asia at Julius Baer.
“What anchors their behavior is the salaryman's desire to protect himself – no one wants to put their position at risk by telling the truth”. This little gem of an insight was made by a retired nuclear engineer who worked for Toshiba. He was referring to the various scandals that had taken place there and explaining why illegal decisions made by senior management like cooking the books went unchecked internally. Corporate Japan in some ways, could be a modern model for George Orwell's dystopian novel “1984”. Big Brother is the leadership group who define that truths are lies and lies are truths. They determine that anyone against the system must be eliminated, because 100% loyalty is the minimum. There are facts and then there are “alternative facts”. The bosses do the thinking around here and your job is to carry out their genius ideas. This is not surprising, because kids are inculcated into accepting authority, doing not questioning, following authority figures, even if they are only one year older. Sempai (seniors) sensei (teachers) are respected as part of Japan's Confucian construct. Group responsibility lessens the burden and gives air cover to individuals. They have learnt this is essential if you want to avoid the stain of failure on your record. When everyone is responsible, no one is responsible. Errors are kept track of and come into play later in your career when the bosses consider who gets the promotion to move up and who goes sideways. That is one of the reasons HR is so powerful in Japanese companies – they decide the transfers to new roles and locations and they have the dirt file on everyone as they come up through the ranks. This system guarantees little risk taking or attempts to push the envelope fold. Keeping your head down and a low profile is the safe path forward. So how do we get innovation going in our companies? The innovation process has trial and error built into it, by virtue of the fact that what we are going to do is new, untested, experimental. How do we test stuff if no one wants to try anything new, because there is a risk of failure? The fear of failure restricts people mentally from the very start. They are afraid to voice opinions because they have learnt from early childhood that going along is how you get ahead. Don't stand out by taking a stand. Blend in, find the absolute middle of the fence and sit there. If the survey is a one to five scale select three for everything. Just employing someone into your firm doesn't erase years of conditioning here about what is acceptable and what isn't. Yet, we hear foreign executives moaning about they don't get any quality ideas from below, that productivity is low, decisions are painstakingly slow, people don't contribute during meetings, etc. All true, but not a fait accompli. The environment for failure has to be secured. The fear to step out has to be replaced with rewards for trying, not just succeeding. Performance reviews and the measures used have to be changed away from just outcomes to include more process. Process in the sense of generating ideas, suggestions, taking risks, trying new things. All unrelated to actual success. If we only reward success, then we had better hope we have a bunch of geniuses working for us. In the Western work environment, we reward success but we don't see failure as fatal, if people fail in the right way. Being incompetent in your current task is not acceptable. However, pioneering some new intervention or iteration is seen as good work and if it fails, the lessons learnt are considered valuable and the person is not terminated. HR is not making a note for later reference when the promotions are being considered. In a Japanese context, nobody believes failure is not fatal. It has to be shown that failure is acceptable as part of the innovation process. That means bosses have to walk the talk. The worst case is saying we welcome innovation and then whacking someone in the head as soon as they fail. Maybe “innovation is good, we accept failure as part of the process” is the ethos in the dark wood paneled recesses of the executive floor, but it also has to permeate the culture throughout middle management. Getting middle management to accept this culture requires a lot of re-training in Japan. However, is this factored into the firm's formal innovation process or are we just hoping for the best instead? Let's make sure we are all walking the talk and sending the right message of “your ideas are welcome here, experimentation is welcome here, we understand not every attempt will succeed but we support the attempts regardless”. Innovation is needed and the process is messy. Our internal systems and corporate culture have to be able to deal with that reality.

The CEO handled the endless stream of Congressional accusations and suspicion about as well as could have been expected. And it did him as little good as a cynic would have expected. Jim Dempsey and Mark MacCarthy think Congress is moving toward action on Chinese IT products—probably in the form of the bipartisan Restricting the Emergence of Security Threats that Risk Information and Communications Technology (RESTRICT) Act. But passing legislation and actually doing something about China's IT successes are two very different things. The FTC is jumping into the arena on cloud services, Mark tells us, and it can't escape its DNA—dwelling on possible industry concentration and lock-in and not asking much about the national security implications of knocking off a bunch of American cloud providers when the alternatives are largely Chinese cloud providers. The FTC's myopia means that the administration won't get as much help as it could from the FTC on cloud security measures. I reissue my standard objection to the FTC's refusal to follow the FCC's lead in deferring on national security to executive branch concerns. Mark and I disagree about whether the FTC Act forces the Commission to limit itself to consumer protection. Jim Dempsey reviews the latest AI releases, including Google's Bard, which seems to have many of the same hallucination problems as OpenAI's engines. Jim and I debate what I consider the wacky and unjustified fascination in the press with catching AI engaging in wrong think. I believe it's just a mechanism for justifying the imposition of left-wing values on AI's output —which already scores left/libertarian on 14 of 15 standard tests for identifying ideological affiliation. Similarly, I question the effort to stop AI from hallucinating footnotes in support of its erroneous facts. If ever there were a case for generative AI correction of AI errors, the fake citation problem seems like a natural. Speaking of Silicon Valley's lying problem, Mark reminds us that social media is absolutely immune for user speech, even after it gets notice that the speech is harmful and false. He reminds us of his thoughtful argument in favor of tweaking section 230 to more closely resemble the notice and action obligations found in the Digital Millennium Copyright Act (DMCA). I argue that the DMCA has not so much solved the incentives for overcensoring speech as it has surrendered to them. Jim introduces us to an emerging trend in state privacy law: bills that industry supports. Iowa's new law is the exemplar; Jim questions whether it will satisfy users in the long run. I summarize Hachette v. Internet Archive, in which Judge John G. Koeltl delivers a harsh rebuke to internet hippies everywhere, ruling that the Internet Archive violated copyright in its effort to create a digital equivalent to public library lending. The judge's lesson for the rest of us: You might think fair use is a thing, but it's not. Get over it. Darren McKellin shared great insight into how he became a leader through his journey to mindful leadership. Mr. McKellin's choice to come to Japan was both one of economic strategy and love for international affairs after studying in both Mexico and Sweden during college. After college, Mr. McKellin joined the Japanese air cargo company Kintestsu located in Chicago. Through the directors' brother, he was able to move to Japan as an English teacher in Yamanashi. After a year he moved to Omotesando to work at his old boss's brothers' company in Minami Aoyama where he worked for four years. This was the beginning of his 30-year long career in Japan. At this company, Mr. McKellin learnt about sales and selling products to a Japanese consumer. When he left this company after four years, he had one failing venture at Chrysler Japan but that did not stop him from persevering through a difficult time with macho management and a harsh environment to thrive him. Afterwards, he moved to sell ads for a computing magazine known as Japan Inc. Through Japan Inc he was able to gain connections with various tech companies both large companies and small start-up companies. Through this opportunity selling ad space for the Japan Inc magazine, he learnt more about systems interrogation type of work. Through the gaining rise of technology and his gaining interest in the IT market, this would eventually be his last job outside the IT world. After Japan Inc. He would later join the tech company called Techno Box. This company was the first cloud serving within Japan which allowed him to learn more about managing a team of people. After this, he would move to World Com but they went bankrupt two years later. After this stressful time, he gained a job at Vodafone. He did this through the power of intention which was an important part of his success. Mr. McKellin has gained an appreciation for intention and mindfulness when he read the book “Think and Grow Rich” by Napoleon Hill as a young child at his grandfather's house. The idea of mindfulness had become an integral part of Mr. McKellin's life and the reason for his success. At and after his time at Vodafone, he began to grow as a leader managing large teams of people at Oracle and later NetSuite. As a leader, he learnt how to use harmony, and patience as a way to motivate and lead his team to great success. Through his use of mindfulness and gaining inspiration from Google's ‘search inside yourself' program, he co-founded the Mindfulness Project at Oracle which helped improve the lives and mental health of employees. After his time at these two companies, he became the regional head of Zscaler. Currently, through his ideals, he has helped the team at Zscaler grow at a tremendous speed. He has helped develop the team from five people to sixty. Which has also helped Zscaler become a top leading IT company which now has a $40 billion market cap. Not only has he helped Zscaler become a leading company he also wrote a book to help others. His book ‘Mind Over Sales' is a revolutionary book that helps readers gain knowledge about how they should use mindfulness to develop a more fulfilling life and successful career. The faintest glimmer of hope is reflecting off a trillion hypodermic needle tips, as we vaccinate our way out of the Covid pandemic nightmare. Very shortly, we will be back into it, but actually what will we be doing in this totally time shifted world. We have lost nearly two years of our normal lives, as well as millions of loved ones, through this virus. My colleague Matt Norman in Minnesota gave a presentation at our virtual Dale Carnegie Owner's Meeting which focused on some of the challenges we will face going forward and I have adapted it for Japan. Here are five trends we need to start thinking about. Managing a split workforce Covid will be contained, but many in our workforce won't be satisfied to be contained in the office anymore. They want the freedoms of working from home to continue to some extent. Regimented lives, genie like, have tasted freedom and won't be so easily stuffed back in the 9 to 11 bottle. How do we avoid a two class system evolving of those present and accounted for and those invisible men and women no longer in the boss's line of sight? How do we make sure information is flowing freely, quickly, accurately and equally throughout the organisation? Selling virtually forever By definition, if buyers are working from home, then selling online will continue. Listening to our clients, most Japanese salespeople have made a mess of it so far and so how long can this situation be tolerated? A big proportion of selling will go back to face to face, but not all. Are we just going to give up on the virtual sales component and leave that to our rivals to rule the field of business battle? Why can't salespeople do both and do both at a very high skill competency level? Leading to foster agility and resilience Leaders in Japan were outed for their actual lack of competent leadership skills during the work from home phenomenon. Covid really showed how inflexible the systems were and how unagile firms were in Japan. Resilience and dealing with change are skills which can be learnt. The irony has been that most organisation stopped their training during Covid and tried to tough it out. Agility's biggest enemies are inertia, red tape, politics, factional infighting, overly extended decision making processes and working in isolated silos. The base solutions to these problems are building real trust and dramatically improving communication. How do you do that when the team are scattered to the winds and are not that interested in going back to the old ways? Leadership capability creation at all levels Japan doesn't seem to function well in a crisis. I believed in Japan Inc and the Japanese Government until the January 1995 Kobe earthquake. Much was revealed then. Natural disasters are part and parcel of life here – earthquakes, tsunami, typhoons, landslides, floods, etc. Yet we didn't seem to learn much and when the March 2011 Tohoku earthquake, tsunami and nuclear meltdown combo hit, again the leadership was lacking. The 2020 Covid pandemic has been frustrating, especially seeing how poor the leadership has continued to be. Inside companies we need a culture where our people are confident to step up and become accountable and lead. This will never happen by itself. We need leaders who can create that environment and when we do that, speed of action becomes a powerful competitive advantage. Post Covid employee engagement Covid has raised a lot of questions about life, death, values, family. Are leaders thinking to get everyone back to the salt mines and work them like dogs, seeing them catch the last train home night after night. We have a severe population decline which is going to up the ante in business's war for talent. Inflexibility will come at a concrete cost, as your people flee to a better home somewhere else. Why would they do that? Because the leaders are not able to understand the new reality and cannot respond to the changes needed. Leader communication skills, which were already tatty and quite poor before, will become own goal lethal in this new zero sum game. While the pandemic pounds us with a continual barrage of issues, problems, inadequacies, contradictions and challenges, we tend to hunker down in our fox holes and hope for the best. “Hope”, as they say in the classics, “is not a great strategy”. What are the key issues we need to address as we begin to poke our noses above the parapet? It is clear we need to be thinking differently, because we are not going back to what was. So what are you thinking about the future world of work and what are doing about it today?

Sakaiya Taichi, a well known author and futurist, made some interesting observations about trends in Japanese youth society. He referred to young Japan's current lack of yoku (desire), yume (dreams) and yaruki (guts). What does this mean for business and for our companies if we are staffed by young people without these three Ys? The triple whammy of earthquake, tsunami and nuclear core meltdown in 2011 underlined Japan's fragility. The social contract was broken and companies preferred to hire part-timers, to enjoy the greatest flexibility to respond to future downturns. Many company's profits have been soaring but employee wages have not been moving. Covid-19 has seen companies rescind employment offers to new graduates, unemployment is rocketing and the economy is in bad shape. Demographics has been exerting more pressure on companies to focus harder on recruiting and retaining their workers, as the supply of young workers steadily reduces. It is not such an easy transition though. The expectation that this current generation will fit in like every preceding generations is Japan Inc's geriatric illusion. What is the reality? The young will need a lot more conversations about their future prospects inside the company, than their current aging bosses ever received from their superiors. They want praise and feedback to give them the confidence to step up and take responsibility. Not delegating and thereby not enabling them to gain experience, so they can position themselves to step up into higher levels of authority, won't cut it either. Coaching and mentoring skills are going to be going at a premium as leaders are sought out who can develop future leaders, retaining the best talent and leveraging the ideas, insights and innovations of those at the bottom – those closest to the action. Apart from the obvious relationship with the immediate supervisor as a key driver of engagement in staff, the other two drivers are belief in the direction senior management are taking the company and pride in the organization. These last two are communication necessities. Take a good hard look at your middle managers and senior leaders – do they get it? Are they able to encourage the young to see a future with the firm and to not think they have to leave in order to advance in their career? Are they able to get across the key messages required?

Currently Lloyd is Founder and CEO of the following companies: 1. Japan Travel KK– Japan's largest (by content volume) and second largest (by traffic) inbound travel site. Lloyd invented a unique “structured” crowdsourcing software platform to create massive amounts of user generated content at low cost for Japantravel.com. As a result, the website now has 18,600 writers, photographers, and videographers, is producing 30-50 articles and videos a day, and is available in 13 languages. Big Brother Japan Inc Style “What anchors their behavior is the salaryman's desire to protect himself – no one wants to put their position at risk by telling the truth”. This little gem of an insight was made by a retired nuclear engineer who worked for Toshiba. He was referring to the various scandals that had taken place there and explaining why illegal decisions made by senior management like cooking the books went unchecked internally. Corporate Japan in some ways, could be a modern model for George Orwell's dystopian novel “1984”. Big Brother is the leadership who define that truths are lies and lies are truths. That anyone against the system must be eliminated because 100% loyalty is the minimum. There are facts and then there are “alternative facts”. We do the thinking around here, your job is to carry out our genius ideas. This is not surprising because kids are inculcated into accepting authority, doing not questioning, following authority figures even if they are only one year older. Sempai (seniors) sensei (teachers) are respected as part of Japan's Confucian construct. Group responsibility lessens the burden and gives air cover to individuals that they have learnt is essential if you want to void the stain of failure on your record. Errors are kept track of and come into play later in your career when the bosses consider who gets the promotion and who goes sideways. That is one of the reasons HR is so powerful in Japanese companies – they decide the transfers to new roles and locations and they have the dirt file on everyone as they come up through the ranks. So how do we get innovation going in our companies? The innovation process has trial and error built into it, by virtue of the fact that what we are going to do is new, untested, experimental. How do we test stuff if no one wants to try anything new because there is a risk of failure? The fear of failure restricts people mentally from the very start. They are afraid to voice opinions because they have learnt from early childhood that going along is how you get ahead. Don't stand out by taking a stand. Blend in, find the absolute middle of the fence and sit there. If the survey is a one to five scale select three for everything. Just employing someone into your firm doesn't erase years of brainwashing here about what is acceptable and what isn't. Yet, we hear foreign executives moaning about they don't get any quality ideas from below, that productivity is low, decisions are painstakingly slow, people don't contribute during meetings, etc. All true but not a fait accompli. The environment for failure has to be secured. The fear to step out has to be replaced with rewards for trying not just succeeding. Performance reviews and the measures used have to be changed away from outcomes to more process. Process in the sense of generating ideas, suggestions, taking risks, trying new things. All unrelated to actual success. If we only reward success, then we had better hope we have a bunch of geniuses working for us. In the Western work environment, we reward success but we don't see failure as fatal, if people fail in the right way. Being incompetent in your current task is not acceptable. However, pioneering some new intervention or iteration is seen as good work and if it fails, the lessons learnt are considered valuable and the person is not terminated. In a Japanese context nobody believes it is not fatal. It has to be shown that failure is acceptable as part of the innovation process. That means bosses have to walk the talk. The worst case is saying we welcome innovation and then whack someone in the head as soon as they fail. Maybe “innovation is good, we accept failure as part of the process” is the ethos in the dark wood paneled recesses of the executive floor, but it also has to permeate the culture throughout middle management. Getting middle management to accept this culture requires a lot of re-training in Japan. However, is this factored into the innovation process or are we hoping for the best instead?
