It's an EmMajority Report Thursday! Emma speaks with David McWilliams, Irish economist and writer, to discuss Trump's interest in the presidency of William McKinley. Then, she speaks with Lily Greenberg Call, former political appointee in the Biden administration, to discuss the recent developments in the detention of Mahmoud Khalil. First, Emma runs through updates on the Senate's vote on cloture and the Continuing Resolution, Trump's mass layoffs, the gutting of the DOE, Trump's trade war with Europe, the falling stock market, Trump's failed nomination for CDC director, Tim Walz's political tour, the UN's independent inquiry into Israel's genocide, the Russian invasion of Ukraine, the Mayor of Miami's crackdown on free speech, and the attack on the IRS, before expanding on the ongoing fight within the US Senate to block the GOP's partisan Continuing Resolution which would effectively neuter Congress amid Trump's reign, and watching Markwayne Mullin accidentally give away the game on Trump's tariff war. David McWilliams then dives right into the historical context for Trump's obsession with William McKinley – 25th President of the United States – highlighting how the election of McKinley in 1896 served as a major turning point in the evolution of the Gilded Age, as a culmination of a populist push against growing economic consolidation amid increasing culture war and a rapidly growing (and changing) working class with an influx of European immigration, and the very clear parallels with how Trump is handling the similarities in this moment, from his alignment with the monopolists and oligarchs of the time, to his obsession with small territorial acquisitions while pushing an isolaitonist economic agenda. After touching on the end to McKinley with his assassination in 1901 and the major role his Vice President Teddy Roosevelt would play in pushing back against the political takeover of robber barons and monopolists, putting a bit of a damper on potential parallels to the Big Tech-backed JD Vance, McWilliams walks Emma through McKinley's expansive project to bolster the pockets of his wealthy donors, from cementing the shift to a gold standard (crypto reserve anyone?!) and bolstering rail monopoly at the expense of America's farming majority, to the inception of lobbying with the backing of his 1896 campaign by notorious businessman Mark Hanna (Musk), who would rally the wealthy elite behind McKinley to change the facts on the ground. Having briefly expanded on McKinley's imperial agenda, and the particular role it plays in creating an atmosphere of chaos to mask the kleptocracy at work, David looks to the extreme lengths Trump has taken McKinley tariff regime, applying them to quite literally every close ally the US has in such a drastic manner it offers little explanation outside of in-group speculation while the economy as a whole collapses. They wrap up the interview by touching on the role McKinleyism and the Gilded Age played in spurring the emergence of the US labor movement under FDR. Lily Greenberg-Call then joins as she and Emma parse through the abduction and detainment of Columbia University activist and Greencard holder/permanent US resident Mahmoud Khalil over his speech in support of a free Palestine, reflecting on the vast distance between the response Chuck Schumer gave – largely defending Israel and denouncing Khalil's speech – and that of Chris Murphy – who cites the criminalization of speech that goes against Trump's agenda in contrast with the happy embrace of explicitly Nazi speech. Next, they dissect the particularly disgusting way in which antisemitism has been abused over this fight, from the White House's explicit references to judaism in their flaunting of this authoritarian overstep, to the fact that the statute they're using to defend their action is grounded in the antisemitic McCarthyist movement, and the value of seeing Jewish Americans stand up and fight for Mahmoud Khalil's rights, wrapping up the interview by emphasizing the need to keep that momentum going, showing up in the streets to fight for Khalil and any other victims of the Trump regime. And in the Fun Half: Emma is joined by Brandon Sutton and Matt Binder as they unpack dweebs Tim Pool and Russell Brand's fear of a real punk rock lifestyle (shoutout Against Me!), before talking to Rob from DC about calling our Senators. They also do some side-by-side comparisons of NYC candidates for Mayor Zohran Mamdani and Andrew Cuomo in their response to the abduction of New Yorker Mahmoud Khalil at the hands of the Trump administration, before listening to Tommy Tuberville explain why its fine to treat protesters this way, actually, and watching economists struggle with explaining Trump's tariff agenda. With the Synapse bankruptcy case seemingly nearing some kind of conclusion, impacted end users are left wondering, will they ever get their money back?While, at this point, Synapse cofounder and former CEO Sankaet Pathak can't really answer that question, he is able to provide greater context on what happened and why.In this podcast, recorded as a X (formerly Twitter) livestream yesterday, November 11th, I had the chance to interview Pathak and impacted depositors had an opportunity to ask him questions directly.Key takeaways I had from the conversation include:* Pathak revealed that Evolve had sent him a cease and desist as a result of him posting what he says is an anonymized version of the trial balance report of the funds Evolve held for end users.* A description of the process by which Evolve prepared and sent files to Synapse for reconciliation, including a possible reason why balances between Evolve's systems and Synapse's appeared to varied substantially day to day, and Evolve's claim that this wasn't something to worry about, Pathak said.* Pathak said that Evolve was aware of and acknowledged that fees owed to Tabapay were improperly debited from customer funds, but that Evolve disputed whether it was the bank's fault.* Synapse didn't want Synapse Brokerage to contract with Evolve or keep the Brokerage's funds at Evolve due to the known shortfalls, Pathak said.* The plan with the Brokerage structure, per Pathak, was that incoming funds would land in users' DDA accounts at Evolve, a portion of those funds that users would transact with would stay at Evolve, and the rest would be swept out to AMG. However, Pathak says, in late September or early October 2023, Evolve, without explanation why, ceased processing sweeps out of Evolve to AMG.* Pathak described how Evolve's reversal of position on funding the FBO shortfalls led to the collapse of the deal for Tabapay to acquire Synapse's assets and, ultimately, the collapse of the company and freeze of end user funds.* Pathak acknowledged taking two loans from the company, one in late 2023 and one in early 2024, which totaled $320,000. The transactions, Pathak said, were approved by the Synapse board — though, at the time, the board consisted of Pathak himself, a seed round investor that, and a Synapse cofounder. While Pathak didn't name specific individuals, per filings in the bankruptcy case, the seed investor is Doug Marchant and the Synapse cofounder is Hilary Quirk. Pathak declined to elaborate on the purpose of the loans, besides saying he had “good reasons” to do it, which would “become obvious” relatively soon.* Full reconciliation should be possible, Pathak said, but it would require the right data, resources, people, and time.* Pathak acknowledged anonymously leaking a letter that Synapse had sent to Evolve to me (which I suspected at the time but didn't know until now.)* According to Pathak, Synapse's board of directors, which, at points, included Andreessen Horowitz's Angela Strange, Trinity Venture's Schwark Satyavolu, and Core Innovation Capital's Arjan Schütte, was broadly aware of the issues Synapse faced, that they were “trying to do the right thing,” and that the board ask Pathak “not to shut down and escalate.”* While Chapter 11 trustee McWilliams and Judge Martin Barash have made numerous references to not being able to confirm or deny if they have made any referrals to law enforcement, Pathak said that he is not aware of any criminal investigation and has not been contacted by law enforcement authorities, though he did acknowledge speaking with broker-dealer self-regulator authority Finra.* When asked if, in the regular course of its business, Synapse had any interaction with Evolve's regulators, the St. Louis Federal Reserve or the Arkansas Department of Banking, Pathak indicated that it did not.Additional Context & Fact Checking* Pathak suggested that Evolve or others not suing him for defamation should be interpreted as a sign that he's telling the truth. However, Evolve has explicitly stated that it believes Pathak's claims about a shortfall of end user funds and the causes of it are “based on ledgers that are demonstrably inaccurate and that his company prepared” (see FAQ #17 here.) It's also worth noting that Evolve may have other reasons to avoid filing such a suit against Pathak — namely, that Evolve would presumably have to turn over relevant documents as part of discovery in any such suit.* Pathak said that Synapse launched the brokerage sweep program in October 2023, in response to Evolve raising Synapse's reserve requirement and withholding interest payments owed to end users, fintech programs, and Synapse. However, the Synapse Brokerage entity had been up and running for sometime by this point, and Synapse had been working with many of its programs to migrate them to the new structure since significantly earlier in 2023.* Asked directly if Pathak or Synapse ever inappropriately used end user funds, including using end user funds to meet bank reserve requirements, Pathak said he was not aware of any instances of customer funds being misappropriated. Pathak described the allegation that Synapse used customer funds to meet reserve requirements at Lineage as “factually false.” However, Pathak's answer glosses over that it was Synapse that would have instructed from Evolve to Lineage and, per my prior reporting, represented that these were Synapse's own funds, not end users'.* Pathak also denied that Synapse knowingly allowed fees Synapse owed to be debited from end user funds, saying that, as soon as such issues came to the company's attention, it alerted Evolve and worked to fix them. However, Pathak did not specify if when these types of issues occurred, whether or not end user balances were made whole.* Asked about his robotics startup's attempt to raise funds and purported relationship with GM, first reported by me and subsequently confirmed by CNBC, Pathak described the CNBC reporter as “a piece of s**t” and “highly unethical,” alleging that the reporter contacted an auto industry union leader, not GM, leading the union leader to threaten a strike if GM didn't pull out of the deal. However, the CNBC piece quoted a GM spokesperson as saying, “GM has never invested in Foundation Robotics and has no plans to do so. In fact, GM has never had an agreement of any kind with the company. Any claims to the contrary are fabricated.” GM sent me a statement to the same effect.Existing subscriber? In this episode, Dr. Ettensohn draws on psychodynamic dimensional models of personality development to describe narcissism and NPD at the borderline level. Characterized by identity diffusion, blurred boundaries, and disrupted internal experience, borderline personality organization represents an "in between" level where the perceptions of the self and others float in and out of clear focus. This episode reviews the important concepts of personality style vs. organization, helping the viewer to understand what a personality disorder actually is and why all personality disorders share common features. James Bond is a Psychopath? Is James Bond a psychopath?   Well, despite the obvious fact that he is a fictional character who has had many authors, actors, and screenwriters involved in defining this character, just . . . maybe! In this episode, Dan and Tom bring in Dr. Stephen McWilliams, author of the book “Psychopath? Why We Are Charmed by the Anti-Hero” to discuss this topic. We're getting deep into the mind of James Bond and with Stephen's help, we define what a psychopath really is, then examine the known mind of James Bond to determine if he can be considered a psychopath.  (Hint, Bond doesn't score 100 on the test).  We use the famed professor, Robert D. Hare's psychology checklist as our driver for the analysis.  Hare's checklist includes breakdowns of the following categories: Interpersonal Traits, Affective Traits, Lifestyle Traits, and Anti-Social traits. How many of those apply to the agent with the OO designation we know as James Bond?  Can you be a spy with a license to kill without some psychopathic traits?  Can you be a great spy and still be a psychopath?  Listen to find out. Stephen is a Consultant Psychiatrist at Saint John of God Hospital, Dublin, and an Associate Clinical Professor at the School of Medicine and Medical Sciences, University College Dublin.  In addition to talking about James Bond, McWilliams's book talks about other fictional characters such as Hannibal Lecter, Frank Underwood, Amy Elliott Dunne, and more. He has also authored the book “Fiction & Physicians – Medicine through the Eyes of Writers”. Art Spitzer for four decades served as the legal director of the American Civil Liberties Union of the national capital area. Fairfax, Virginia criminal and DUI defense lawyer Jon Katz has known Art since before the time Jon served on that group's board for three years in the early 1990's, and through that experience has met such great civil libertarians as Art Spitzer, Eugene Fidell (a dean of military criminal defense lawyers), and Mary Jane DeFrank, who for years served as the affiliate's executive director.   Art tells a fascinating story about how he started his post-law school career in a traditional path of serving as a federal judicial law clerk followed by doing litigation with one of the nation's most prestigious corporate law firms, except he did not personally care whether his corporate clients won or lost, even though he was professionally invested in their winning. He did enjoy the pro bono work his law firm did for such groups as the ACLU. Attending college in the 1960's, Art witnessed the political demonstrations of the time, and ultimately he learned that the D.C. ACLU was hiring a replacement legal director, a job that he loved throughout.  Art won the essential Ake v. Oklahoma, 470 U.S. 68 (1984), which provides that when the defendant's sanity at the time of the alleged crime is likely to be a significant defense at trial, the government must pay for a psychiatrist to assist on the issue for an indigent defendant.  Our recent previous podcast guest Stephen Bright thirty-three years later won McWilliams v. Dunn, 582 U.S. 183 (2017), which breathed further strength into Ake. Hear Art and Jon discuss the overlap between the First Amendment and criminal law, demonstrators' rights, and the ACLU's opposition to criminalizing the possession (versus production) of child pornography. When Jon asks how to beat the prosecution or any litigation opponent, Art sticks to fully preparing and fully serving clients.
