This Day in Legal History: Switzerland's Federal CharterOn August 1, 1291, the seeds of what would become modern Switzerland were planted with the signing of the Federal Charter, or Bundesbrief, by the cantons of Uri, Schwyz, and Unterwalden. This wasn't the dramatic formation of a nation-state as we think of it today—it was three rural Alpine communities making a legal pact for mutual defense and cooperation in the face of growing Habsburg pressure. The document itself is barely over 300 words long, written in Latin, and mostly focuses on conflict resolution and how not to stab each other in the back (literally and figuratively). But make no mistake, this was a radical assertion of local legal autonomy during a time when imperial rule was the norm. The Federal Charter stands as an early example of federalism—three small political entities entering into a horizontal, legally binding agreement without ceding total sovereignty to a monarch or emperor. In legal terms, it was more covenant than constitution, but its emphasis on mutual aid, lawful arbitration, and collective security laid the groundwork for Switzerland's famously decentralized structure. The signatories agreed to resist foreign judges and unlawful acts of violence, a precursor to ideas we now enshrine in due process and the rule of law. This wasn't a flashy revolution. There were no declarations of independence or fiery speeches. Just some pragmatic legalese scratched onto parchment that said, in effect, “Let's have each other's backs, settle disputes fairly, and not get bossed around by some distant duke.” Over time, this unassuming agreement evolved into the Swiss model of federalism and neutrality that still defines the nation today. It's not just legal history—it's a reminder that even minimalist governance structures can have maximal staying power.Federal judges who issued rulings against Donald Trump's policies have come forward with disturbing accounts of harassment, threats, and violent intimidation. At a “Speak Up For Justice” event, five judges—including Chief U.S. District Judge John McConnell—described receiving death threats, being targets of “swatting” incidents, and even having pizzas delivered to their homes under the name of a murdered judge's son. McConnell, who blocked a major White House funding freeze earlier this year, disclosed that he received six credible death threats and over 400 hostile voicemails. One threat involved someone searching the dark web for his address, saying they wanted "Smith & Wesson to pay him a visit."Judge John Coughenour, who ruled against Trump's effort to limit birthright citizenship, recounted a terrifying police raid on his home due to a false murder report. The FBI later alerted him to a bomb threat. Despite being appointed by Republican President Reagan, Coughenour criticized political attacks on the judiciary as damaging to democratic institutions. The White House called the threats unacceptable and emphasized the importance of judicial safety. On the same day as the event, the Senate confirmed Trump's nominee Gadyaces Serralta to lead the U.S. Marshals Service, who pledged to prioritize judge protection.By mid-June, 408 threats against 297 judges had been logged in the fiscal year. Judge Esther Salas, whose son was murdered in 2020, praised the speaking judges for breaking their silence in defense of judicial independence.US judges recount death threats, 'swatting' after rulings against Trump | ReutersAccording to exclusive reporting done by Reuters, the U.S. State Department plans to allocate up to $7.85 million to support deportation operations in Costa Rica, marking a significant expansion of American-backed regional immigration enforcement. The funds, redirected from an economic development account, will be transferred to the Department of Homeland Security, which will coordinate with Costa Rican authorities to carry out deportations of migrants—especially those transiting through the country en route to the U.S.This arrangement resembles a 2024 Biden-era agreement with Panama, where the U.S. financed detention and deportation of migrants moving northward. The new Costa Rica program is framed as a capacity-building effort that will fund deportation logistics and training on asylum screening. Still, critics warn it could deny vulnerable populations fair access to asylum protections. The plan follows a Trump administration request earlier in the year for Costa Rica to accept 200 migrants from Africa, Asia, and Europe previously detained in the U.S. Many of them remain in Costa Rica, raising questions about long-term outcomes. Details on when deportations will begin or the final destination countries remain unclear.Officials have also acknowledged that some migrants are now traveling south through Costa Rica, fleeing northward crackdowns and the end of Biden's humanitarian parole options. The agreement does not require a direct connection between the migrant and the country to which they may be deported, a detail likely to fuel ongoing human rights concerns.Homeland Security Secretary Kristi Noem has been visiting countries throughout Latin America to explore similar arrangements, suggesting this may be part of a broader regional deportation strategy under Trump's immigration policy.Exclusive: US plans to fund deportations from Costa Rica, document shows | ReutersThe U.S. Court of Appeals for the Federal Circuit closely examined whether President Donald Trump overstepped his authority by using emergency powers to impose sweeping tariffs on foreign imports. The legal challenge, brought by 12 Democratic-led states and five small businesses, centers on Trump's use of the International Emergency Economic Powers Act (IEEPA)—a 1977 law typically used for financial sanctions—to justify tariffs against countries like China, Canada, and Mexico. Judges on the panel, many of whom were appointed by Democratic presidents, expressed skepticism, with one noting the law “doesn't even say tariffs.”This is the first major appellate test of Trump's tariff authority, and it comes just as a deadline approaches for new tariff hikes. Trump has used tariffs aggressively in his second term as both an economic and geopolitical tool, citing trade imbalances and foreign inaction on fentanyl as justifications. The challengers argue that only Congress has the constitutional power to impose tariffs, not the president. While the court has allowed the tariffs to remain in place during the litigation, a final ruling could have major implications. A previous lower court decision had already questioned whether IEEPA allows for tariffs tied to longstanding trade deficits. Meanwhile, tariffs have become a significant revenue source, generating over $100 billion so far this fiscal year—money the administration may need after passing new tax cuts. The case won't affect tariffs enacted under other legal provisions, like those on steel and aluminum. Trump's legal team argues that restricting presidential tariff power would hinder trade negotiations. The president has recently secured agreements with the EU and Japan, and is currently working on deals with Mexico and others to avoid further tariff hikes.US appeals court scrutinizes Trump's use of tariffs as trade deadline looms | ReutersThis week's closing theme is by Wolfgang Amadeus Mozart, a composer of some note. This week's closing theme is a bright and confident slice of Mozart at his most charming: the Piano Concerto No. 19 in F major, K. 459, first movement, Allegro. Written in 1784 during a period of remarkable productivity, this concerto is one of the six that Mozart composed that year alone—each one displaying a different facet of his evolving style. No. 19 stands out for its buoyancy and rhythmic vitality; it's elegant without being self-serious, energetic but never frantic.Mozart, still in his late twenties, was performing regularly in Vienna, dazzling audiences with works that showcased both his pianistic skill and his compositional inventiveness. This piece was likely written for one of his own concerts, tailored to suit both his technical flair and his subtle wit. The Allegro opens with a playful orchestral theme, crisp and sunny, which soon gives way to the piano's entrance—graceful, witty, and full of character. There's a conversational quality to the movement: the orchestra tosses out ideas, the piano responds, elaborates, jokes, and dances. But beneath its lightheartedness lies Mozart's usual sophistication: unexpected harmonic turns, rhythmic displacements, and crisp motivic development keep the listener alert. The movement doesn't strive for drama or tragedy—it's pure Mozartian joy, rendered in tight musical logic and unfailing charm. As a closer, it offers an ideal farewell note: upbeat, clean, and full of clarity. You leave the room a little taller, a little lighter, like the music has tidied your thoughts and restored your sense of order. Mozart's No. 19 may not be the flashiest of his concertos, but it radiates something rarer: calm confidence, musical humor, and the sense that everything—at least for a few minutes—is exactly where it should be.Without further ado, Wolfgang Amadeus Mozart's Piano Concerto No. 19 in F major, K. 459, first movement, the Allegro.

What does it mean to keep showing up when life changes your body, your voice, your sense of self? Dr. Phil Schneider has spent a lifetime helping people find their voice. But when he was diagnosed with Parkinson's, he found himself on the other side of the therapeutic relationship, learning how to live with a tremor, navigate shame, and reclaim agency in a body that no longer behaved the way it used to. In this episode, Uri sits down with his father, mentor, master clinician, and co-founder of Schneider Speech, for one of the most personal and moving conversations on the podcast to date. Together, they explore Phil's decades of work helping people find their voice, and how his understanding of communication deepened through his own health journey. What helped him move forward wasn't hiding. It was naming the tremor, talking about it with family, and choosing connection over shame. Opening up was the moment he began reclaiming agency. Resilience didn't come from isolation. It came from letting people in. This episode is full of warmth, story, and hard-earned wisdom on voice, vulnerability, and what it really means to be present with another human being. In this episode on connection and resilience, you'll discover: How a nonverbal girl found her voice on stage and transformed Phil's career What Parkinson's taught Phil about stuttering, shame, and self-acceptance Why communication is about connection, not correction How being seen is more healing than being “fixed” The hidden cost of hiding, and the freedom of naming what's hard How moments of presence can shape the course of a life And more invaluable insights TIMESTAMPS 01:10 Meet Dr. Phil Schneider: A Legacy in Communication 03:03 How His Career in Speech Therapy Began 08:54 Learning from a Student: A First Encounter with Stuttering 13:38 The Power of Belief: How Gladys Found Her Voice 17:09 Connecting Through Communication 26:22 Teaching, Mentorship, and Shaping Future Therapists 29:29 Why Emotions Matter in the Therapy Room 30:39 Transformative Voice Therapy 34:35 Shame, Parkinson's, and the Cost of Hiding 36:54 Openness, Vulnerability, and Reclaiming Agency 48:29 The Heart of Therapy: Growth Through Honest Connection 53:57 What Parents and Young Adults Need to Hear 57:06 Final Thoughts and Reflections ABOUT THE GUEST Phil Schneider, Ed.D. Uri Kaufman is the author of American Intifada: Israel, the Gaza War and the New Antisemitism. He joins host Sean Speer to explain how a cognitive dissidence is to blame for today's ideological revolt against the moral foundations of the West. And while elite institutions and protesting students are getting much of the blame for the anti-Israel sentiment sweeping across America, Uri argues that young people - though figures of ridicule - are not the danger. The real problem is serious people and serious institutions changing facts to suit their progressive narrative and giving rise to a new form of antisemitism paved with the best of intentions. Ep. 163: Abroad at home | Pahalgam: Imperial fortresses and the settler-colonial complex at play

Shadow Warrior by Rajeev Srinivasan

Please note: I wrote this on April 28th, and then was traveling abroad for the last few weeks, so I had no opportunity to post this until now, sorry about that: but nothing I have said here has been rendered wrong by Operation Sindoor and the near-war that happened after I wrote this. Deccan Herald ran a slightly edited version as my regular column on May 4th at https://www.deccanherald.com/opinion/on-pahalgam-imperial-fortresses-and-kashmir-s-settler-colonialism-3523731 With good reason, India has focused on Pakistan as the culprit behind the Pahalgam atrocity. It is telling that their army chief declared to Pakistanis that Hindus and Muslims are two different nations and that Kashmir is Pakistan's jugular vein. He implied that Pakistan is the ideal Islamic state as in Venkat Dhulipala's “Creating a New Medina: State Power, Islam, and the Quest for Pakistan in Late Colonial North India”. This could have been a signal to the terrorists to create maximum offence while massacring Hindus.Given Kargil, IC 814, Bombay 26/11, Uri, Pulwama, and now Pahalgam, India is justified in cutting ties to Pakistan, including trade, sports, the cringe Attari circus, even diplomatic relations. India did once mass its forces at the Line of Control in Operation Parakram, but honoring the Shimla Agreement, did not cross. Now that Pakistan has canceled the Agreement, there is no legal reason for restraint, especially since the nuclear bogey is no longer credible. But there is more. The Pakistani defense minister said that his country had been doing the dirty work for the US and the West for decades. Maybe he meant the Afghan war against the Soviets and post-9/11 somersaults by Pakistan. But that's only scratching the surface.Britain explicitly created Pakistan as a Great Game weapon against Russia/Soviet Union, and when that collapsed, against india. Britain has been using Pakistan as an “imperial fortress”, as I pointed out in “Britain's outsized, malign role in global chaos”. Whitehall tilts strongly towards Pakistani interests, even in the case of widespread gang-rapes of minor white girls, not to mention their antics against Hindus in Leicester.Official mouthpiece BBC never speaks of Pakistani terrorists, only ‘gunmen'; it's always “Indian-controlled Kashmir”; and an extraordinary headline recently said: “Pakistan suspends visas for Indians after deadly Kashmir attack on tourists”. These are not accidents.Britain and the US Deep State (eg. Madeleine Albright and other Atlanticists) worry about the waning influence of Europe (or “northwest Asia” as I wrote in “The End of the European Century”). Naturally, incumbent powers go to war with a rising power (Thucydides Trap: Graham Allison's thesis). This has been the rationale for containing Russia, now it is being turned to Asia. China is rather inscrutable and impregnable, so they attack India, which is easier prey. Then there is the Otherization of Hindus and thus Indians. Even as staunch an atheist as Richard Dawkins (“The Blind Watchmaker”) admits Judeo-Christian cultural biases. Only Christopher Hitchens among modern atheists was self-reflective enough to avoid this. Abrahamics would like to make us disappear, and so engendered great famines in India (“Late Victorian Holocausts”). Now this is reprising through climatism (at an Alexandra Ocasio Cortez rally there was a woman earnestly saying “we have to eat babies” to reduce emissions). Covid was possibly another attempt at depopulating ‘deplorables', that is black and brown people.Let's not forget China, also unhappy about India's possible economic rise; so it dutifully regurgitated “all-weather” support for Pakistan. They have used Pakistan to keep India down, as a force multiplier for violence and trouble. Then China can market itself as a safe investment destination compared to a dangerous India where FDI may be risky. I suspect this is part of their siren-song to big firms (eg. Apple) now. Finally, and most importantly, there is the settler-colonial complex of Muslim Kashmiris. They trot out South Africa, other European conquests and Gaza as examples of colonialists violating natives' rights and imply the same in Kashmir. The bitter irony of course is that it is the Muslims who are the colonialists wiping out Kashmir's indigenous Hindus who have a 5000 year history there. They have turned the logic on its head: see the Harvard Law Review paper “From Domicile to Dominion, India's Settler Colonial Agenda in Kashmir”.There have been seven tragic exoduses of Hindus from Kashmir: 1. 1389–1413 (Sultan Sikandar Shah), 2. 1505–1514 (Fateh Shah II), 3. 16th–17th Century (Timurid Period), 4. 1752–1819 (Durrani Rule), 5. 1931 (Anti-Dogra Riots), 6. 1986 (Anantnag Riots), 7. 1989–1990 (Militancy-Driven Exodus). Most Hindu Kashmiris now rot in refugee camps.I wrote long ago in “India, the Kashmiri colony” about Muslim Kashmiris extracting tribute from the Indian/Hindu taxpayer. Worse, there is evidence emerging that local overground workers (eg. mule handlers) arranged the logistics for the Pahalgam massacre. Acts of terror need local support, possibly including from local politicians (a former CM referred to terrorists as “the boys with guns from the mountains”).Yes, it's good to punish Pakistan (eg. Indus Water Treaty), but terror will persist until Muslim Kashmiris realize their future lies with rising, multi-religious India, not jihadi failed-state Pakistan; and the Deep State desists from further mischief.798 words, Apr 28, 2025 This is a public episode. He adds, “This time, the strike is far greater in intensity and in the number of targets.” Jayashree, acknowledging public sentiment but questioning the nature of response, says, “What we're seeing right now feels more like muscle-flexing.”Shardool highlights how the United States and Western nations are responding differently to the current crisis compared to earlier years. “The U.S. is far less interested now…One reason is that they don't need Pakistan the way they did before.”Manisha points out that Operation Sindoor marks a shift in the Indian government's stance. She says what it signals is that the government “now has a clear intention: to state unambiguously that Pakistan is the enemy”.This and a lot more. This is the Catchup on 3 Things by The Indian Express and I'm Ichha Sharma.Today is the 2nd of May and here are the headlines.Prime Minister Narendra Modi chaired the second Cabinet Committee on Security meeting following the Pahalgam terror attack that killed at least 26 people. Key ministers including Amit Shah, Rajnath Singh, and S. Jaishankar attended. Modi also led meetings of the Cabinet Committee on Political Affairs and the Cabinet Economic Affairs Committee. Meanwhile, External Affairs Minister S. Jaishankar spoke to U.S. Secretary of State Marco Rubio and emphasized that the perpetrators, backers, and planners of the Pahalgam terror attack must be brought to justice.Additionally, Pakistan violated the ceasefire for the seventh consecutive night, firing across the Line of Control in Kupwara, Uri, and Akhnoor. The Indian Army responded in a controlled and measured manner. The ongoing violations come amid heightened tensions after the April 22 Pahalgam terror attack. On Tuesday, the DGMOs of both countries held a hotline discussion, during which India warned Pakistan about repeated unprovoked ceasefire breaches. The situation remains volatile as Pakistan continues to provoke along both the LoC and the International Border. The next decennial Census of India is set to break new ground by including a detailed enumeration of caste—something that hasn't been attempted since the British-era census of 1931. With the Centre indicating its willingness to capture OBC data, this marks a significant policy shift with far-reaching social and political implications. The most crucial question the government must now address — and one that will ultimately be a political call, much like the decision to enumerate caste itself — is which list to use while enumerating OBCs. In the last Census, for SCs and STs, the proforma relied on the official lists notified under the Constitution (Scheduled Castes) Order, 1950, and the Constitution (Scheduled Tribes) Order, 1950. These lists — currently comprising 1,170 castes under SC and 890 communities under ST — are periodically updated through amendments passed by Parliament.Communal tensions erupted in Nainital, Uttarakhand, after the family of a minor girl filed a rape complaint against a 65-year-old contractor, Usman. The incident allegedly occurred on April 12. The accused was arrested on Wednesday under the POCSO Act. That night, mobs vandalized shops and eateries belonging to the minority community and protested outside a mosque and police station. Videos show shop staff being slapped. Police confirmed the situation is under control, but the incident has inflamed already sensitive communal sentiments in the area. The United States and Ukraine signed a major agreement granting Washington access to Ukraine's critical mineral reserves, including titanium, lithium, and uranium. Known as the U.S.-Ukraine Reinvestment Fund, the deal aims to boost Ukraine's post-war recovery while attracting global investors. The pact also sends a strong message to Russia, showing the U.S. remains committed to Ukraine's sovereignty and economic stability. Treasury Secretary Scott Bessent said the fund represents a long-term partnership focused on rebuilding Ukraine as a free and prosperous nation. This was the Catchup on 3 Things by The Indian Express.

On Tuesday, the DGMOs of both countries held a hotline discussion, during which India warned Pakistan about repeated unprovoked ceasefire breaches. The situation remains volatile as Pakistan continues to provoke along both the LoC and the International Border.3. Supreme Court Rejects Judicial Probe PleaThe Supreme Court on Thursday declined a plea seeking a judicial probe by a retired judge into the Pahalgam terror attack. A bench of Justices Surya Kant and N. K. Singh said this was not the time to make demands that could demoralize security forces. They stressed that judges are meant to resolve legal disputes, not investigate terror incidents. The Public Interest Litigation had also requested the formation of a judicial commission. The court, however, emphasized national unity during this “crucial hour” of fighting terrorism.Communal tensions erupted in Nainital, Uttarakhand, after the family of a minor girl filed a rape complaint against a 65-year-old contractor, Usman. Take from among you a contribution to the Lord. Whoever is of a generous heart, let him bring the Lord’s contribution: gold, silver, and bronze; blue and purple and scarlet yarns and fine twined linen; goats’ hair, tanned rams’ skins, and goatskins; acacia wood, oil for the light, spices for the anointing oil and for the fragrant incense, and onyx stones and stones for setting, for the ephod and for the breastpiece. “Let every skillful craftsman among you come and make all that the Lord has commanded: the tabernacle, its tent and its covering, its hooks and its frames, its bars, its pillars, and its bases; the ark with its poles, the mercy seat, and the veil of the screen; the table with its poles and all its utensils, and the bread of the Presence; the lampstand also for the light, with its utensils and its lamps, and the oil for the light; and the altar of incense, with its poles, and the anointing oil and the fragrant incense, and the screen for the door, at the door of the tabernacle; the altar of burnt offering, with its grating of bronze, its poles, and all its utensils, the basin and its stand; the hangings of the court, its pillars and its bases, and the screen for the gate of the court; the pegs of the tabernacle and the pegs of the court, and their cords; the finely worked garments for ministering in the Holy Place, the holy garments for Aaron the priest, and the garments of his sons, for their service as priests.” Then Moses said to the people of Israel, “See, the Lord has called by name Bezalel the son of Uri, son of Hur, of the tribe of Judah; and he has filled him with the Spirit of God, with skill, with intelligence, with knowledge, and with all craftsmanship, to devise artistic designs, to work in gold and silver and bronze, in cutting stones for setting, and in carving wood, for work in every skilled craft. And he has inspired him to teach, both him and Oholiab the son of Ahisamach of the tribe of Dan. He has filled them with skill to do every sort of work done by an engraver or by a designer or by an embroiderer in blue and purple and scarlet yarns and fine twined linen, or by a weaver-by any sort of workman or skilled designer. “Bezalel and Oholiab and every craftsman in whom the Lord has put skill and intelligence to know how to do any work in the construction of the sanctuary shall work in accordance with all that the Lord has commanded.” Bezalel made the ark of acacia wood. Two cubits and a half was its length, a cubit and a half its breadth, and a cubit and a half its height. And he overlaid it with pure gold inside and outside, and made a molding of gold around it. And he cast for it four rings of gold for its four feet, two rings on its one side and two rings on its other side. And he made poles of acacia wood and overlaid them with gold and put the poles into the rings on the sides of the ark to carry the ark. And he made a mercy seat of pure gold. Two cubits and a half was its length, and a cubit and a half its breadth. And he made two cherubim of gold. He made them of hammered work on the two ends of the mercy seat, one cherub on the one end, and one cherub on the other end. Of one piece with the mercy seat he made the cherubim on its two ends. The cherubim spread out their wings above, overshadowing the mercy seat with their wings, with their faces one to another; toward the mercy seat were the faces of the cherubim.
