Episode 281: On the night of Saturday, October 25th, 1857, in Beaver Lake, a part of Simond's Parish in St John County, a heinous crime was committed unlike anything ever seen in New Brunswick up to that point. Sure, there had been murders and arsons, but those were often the result of heated arguments or drunken brawls. But this crime was different. It's hard to believe that anyone in New Brunswick would coldly and calculatedly murder a man named Robert McKenzie, his wife, and his four helpless children, all for the sake of money, and then burn down their property to destroy the evidence. The perpetrators, three Irish Catholics, Hugh Breen and Patrick Slavin Sr. and Slavin's teenage son, Patrick Jr., targeted the protestant Mackenzie family, robbing and murdering them. This crime, committed on that fateful Saturday night, was, to that point, unprecedented in New Brunswick. Some still feel the crime rivals the worst in the province's history. China vowed to support Vladimir Putin over Russia's 'sovereignty and security' on Wednesday, with the two countries set to step up their economic ties. Chinese President Xi Jinping poses for photos with the Russian President in Beijing, China, on February 4 It was the second reported call between the two leaders since Putin launched his invasion of Ukraine on February 24. The pair last met earlier in February when Putin visited Beijing for the opening ceremony of the 2022 Winter Olympics. The European Court of Human Rights' (ECHR) decision to block the deportation of asylum seekers to Rwanda may be utterly predictable but what is surprising is the speed at which it came to its judgment. As Work and Pensions Secretary Therese Coffey said yesterday on Radio 4's Today programme: 'I've never known such a quick decision made by somebody at the ECHR.' Spain has introduced a new draft law aimed at cracking down on prostitution. The proposed legislation will punish those who financially exploit prostitutes, pay for their services, or knowingly provide premises for the practice of prostitution. ..........The British Academy are to feature a large-scale project exploring accent discrimination as academics argue that accent-ism is alive and well in Britain in 2022. Though people form judgements about others from the way they speak, listeners are often unaware of their deeply embedded ‘implicit' biases. Dr Robert McKenzie who leads the Northumbria University project said: “This is the prejudice that can dare speak its name, we are not allowed to be biased in terms of gender, we are not allowed to be biased in terms of sexual orientation.” “But denigrating accents is still allowed,” he said. “You just have to watch an episode of The Simpsons to see the way people from the southern United States are depicted. It is surprising I think that people still get away with it.”

Welcome back to season 2 of PT Elevated where we are broadening our topics to include more researchers but still focusing on topics that you can use in your clinic every day. On our fifth episode of season 2, Dr. Louie Puentedura, a Professor in the Department of Physical Therapy at Baylor University and an EIM faculty member discusses the evolution of manual therapy.  Here are some of the highlights: Louie was trained and worked as a physical therapist in Australia until 1995 when he came to the United States primarily because of problems he could see in the field of manual therapy. He now is a full-time clinical professor at Baylor University. "Recently there was an update to the clinical practice guidelines for the treatment of acute and chronic lower back pain that recommended manual therapy and exercise. Not for manual therapy alone and not for exercise alone but for manual therapy and exercise combination." “I think that the take home message is that most patients will benefit if they are given a combination of education, manual therapy and exercise. Even patients experiencing chronic pain that you are attempting to convince that their pain is not because of a certain structure in their back, can benefit." "A lot of the research tends to suggest that manual therapy is not very effective but if you look at that research, they haven't tested or done experiments on manual therapy. They have a hard time defining what manual therapy is. Is it thrust? Joint techniques? Or is it non-thrust mobilization? Many of the researchers lump it altogether and say it is all the same." Louie looks at Clinical Prediction Rules as a guide to determine if a patient needs a thrust manipulation versus a non-thrust. He says the style of treatment nowadays is much more about empowering the patient and making sure they achieve self-efficacy and self-care. Back in the 80s that was not what was being promoted. "It was all about; you have come to me because I can fix you. I might need several visits to fix you, but we will get you there." "In that process of trying to promote a safer way of trying to manipulate the neck – I hope I've made it less scary to manipulate the neck. But I also hope that therapist who do manipulation thoracic techniques to the neck they are learning how to do it appropriately and safely." Louie Puentedura Clinical Pearl: "One of the things that has stuck with me over the years is that early on I wanted to be just like my mentors. I had people like Jeff Maitland, Robert Mckenzie, Bob Elvey and all these people to look up to and I would watch them treat people. The first few years out in clinical practice I didn't feel like I was making any progress. What I realize now that I'm much older is that the little bit of practice that I do every day, accumulates over the years. It's really only after many years that you start to feel very confident and skilled at what you do. It just takes time to practice. That is what we are supposed to do as PTs, keep learning, practicing, keep getting better. The godfather of tax resolution is the featured guest of the podcast today. Robert McKenzie is the guy that leading attorneys and CPAs turn to when they have criminal tax defense cases they need help with. Robert has a unique perspective into the IRS since he worked as a collections officer and literally wrote the book when it comes to representation before the IRS. [4:15] Robert started his career as a revenue officer of the IRS. While working at the IRS, Robert completed his law school education and immediately went into his own practice doing tax resolution which he’s been practicing for the past 40 years. [6:00] While at the IRS in 1976, Robert was incentivized to seize 30+ businesses and homes because that was how success was measured by the IRS before reforms were passed. Since 1998, the number of seizures has drastically decreased. [9:15] In the last 8 years, the IRS has had its budget and headcount decimated, particularly in the enforcement area. This has lead to fewer enforcement actions and less revenue officers in total. [13:00] This is a little counterproductive in terms of government revenue because a skilled revenue officer generates $11 in revenue for every $1 spent. Right now it’s a good time to be a tax cheat in this country because the odds of being caught have never been lower. [13:50] The IRS received a 2.6% increase in budget in 2019 which means they can now bring on some new people. The new commissioner, Charles Rettig, is one of the first tax lawyers to get the job. [17:35] Levies were up 8% in 2018, the first increase in over a decade. Robert believes that this indicates a trend of increased enforcement in the near future. The IRS is taking revenue officers from underutilized states and placing them in other areas that are lacking staffing to help go after higher dollar actions. [21:00] The reality is the IRS has a lot of cases in queue that are just waiting to be assigned to someone in the field and they are not having liens filed. The more they can have people to receive cases out of the queue, the more liens we’re going to see. [24:30] Sometimes it can be hard to change someone’s attitude if the IRS hasn’t started looking at their case. If you want to be delinquent in this country, you would want to live in a big city where the staff to enforce is at the lowest point. In Dallas, the IRS wasn’t going after anyone that owed less than a million dollars. [27:50] There was a study released earlier in 2019 that shows about 83% of Americans comply with their taxes, but we are auditing 0.58% of all tax returns filed. They estimate that the government is losing over $300 billion in revenue from people not properly reporting their income. [30:40] Over 43% of all the 1040 audits in 2019 were done on low dollar amounts returns. These were automated audits because auditing a high net worth individual requires a person to handle the task. Overall, 97% of people who are making over a million dollars a year will never see the IRS. [33:40] Who cut the IRS budgets? Politicians. Who donates the most to politicians? Rich people. Who has the most to benefit by an IRS that’s not properly funded? Rich people. They cheat more and have more money they could be forced to pay if they were ever audited. [34:10] The IRS has been engaging in a series of summons with the clearing houses that deal with cryptocurrencies and have been looking more closely at people making those transactions. For some people, that could mean potential criminal prosecution if the numbers are large enough. [37:30] The statute defining an employee at the federal level has been established since the 1970’s. Congress is not likely to pass legislation dealing with the gig economy similar to the one recently passed in California, since industries have varying definitions as to who qualifies as an employee. [41:45] Customer service from the IRS has improved in recent years. Their answer rate is only around 70% and even when they do connect with someone, the IRS only answers around 70% of those questions correctly. The FAIR Act is an effort to improve the IRS’s customer service but we’ll see how it goes. [45:00] Now is a good time to get into the tax resolution business. There is going to be more audits and collections in the coming years which means more potential customers for your business. You will require proper training and an understanding of how to market your business if you want it to last. [50:45] The IRS has said that they are coming after syndicated conservation easements. Conservation easements have become a scheme that some people have used as an abusive tax shelter and the IRS has made it known that they are going after those people. [52:35] Captive insurance companies are another target of the IRS, particularly where something is insured against a risk that will never happen. [53:30] Employment taxes in the collection arena is very high. Not paying employment taxes is a particular focus that they IRS is working on and increased enforcement in this area is going to lead to increased business for tax resolution specialists. [54:45] The IRS is a special creditor, they are one of the only entities that can pierce the corporate veil and assess the trust fund without a court order. Not paying employment taxes is viewed by the government as theft against the employee.     Mentioned in this episode: Robert E.
