The Constitutional Court says investigations by the suspended Public Protector, Advocate Busisiwe Mkhwebane into President Cyril Ramaphosa could not expose the president to a conflict of interest in her suspension. This is according to Deputy Chief Justice Mandisa Maya who over-turned the decision of the Western Cape High Court which had declared Mkhwebane's suspension as invalid. Ramaphosa had suspended Mkhwebane in June last year following her decision to initiate an investigation into the theft of the president's Phala Phala Game Farm. Delivering the judgement, Deputy Chief Justice says Mkhwebane's suspension did nothing for the benefit of the president. Recent polling by Data for Progress for the Appeal taken between March 5 and March 7 found public opinion since the murder of George Floyd has shifted to support for alternatives to policing and the ways in which communities can reimagine safety outside of armed officers. They found, “As many as half of the individuals killed by law enforcement have a disability; and people with an untreated mental illness are 16 times more likely to be killed during a police encounter. Emergency First Responder (EFR) programs differ from place to place, but the purpose is the same: armed law enforcement is often not the best tool for responding to a range of requests for emergency assistance.” A new national poll from Data for Progress and The Lab, a policy vertical of The Appeal, “shows overwhelming support among likely voters for creating non-police emergency first responders to handle emergency calls that involve mental health issues, substance use disorders, health and safety check-ins, and people experiencing homelessness—and to reallocate law enforcement funding in order to do so.” To discuss these polling results, Everyday Injustice spoke with Alana Sivin and Emily Galvin-Almanza of the Appeal. Recently, I sat down with Imani Gandy, Senior Legal Analyst with Rewire. In the course of our conversation, there are several interesting points raised including why are we as progressives willing to excuse some people while holding others to the fire. This conversation is probably one of my favorites since starting the show because I was able to talk with a Black woman like myself who has gone from being an unhappy lawyer to honing their craft as an advocacy journalist. There are so few of us in these independent media spaces so it was interesting to get more insight into her path and perspectives.
