Prof. Eugene Volokh joined us to discuss restraining orders, how many of them violate the First Amendment as unlawful prior restraints, and how you can spot the First Amendment problems. The purpose of a restraining orders is to get a person to stop harassing you, but “harassment” can be a pretty vague term—and the same goes for “bullying,” “cyberbullying,” “hate speech,” etc.—especially when no physical violence threatened or happening. The result is that many restraining orders not only prevent the subject from speaking TO the plaintiff, but from speaking ABOUT the plaintiff, and last INDEFINITELY.Here are the key issues to spot the next time a client calls you about a restraining order or injunction that affects free speech:Raise First Amendment challenges, and get familiar with the precedent by reading Prof. Volokh's articles.Look to see if the restraining order merely prohibits speaking to the plaintiff, or goes further and prohibits speaking ABOUT the plaintiff. That's a big difference that implicates the First Amendment.If the subject of a restraining order is facing contempt, consider raising the unconstitutionality of the order as a collateral bar. In the United States, the racial divisions among us seem to be deepening, fueled at least in part by political opportunists who prey upon fear and emotion.Our Lean to the Left podcast guest is Juliet Hooker, a leading thinker on democracy and race and author of a new book, Black Grief, White Grievance. Her book examines racial politics and argues that both White and Black communities must learn to accept loss – for different reasons and to different ends."Political loss has been unequally distributed in the history of the United States," she says during the interview. "Because of White supremacy, Black people, in general, have had to shoulder a disproportionate number of losses and Whites as a group have been able to avoid loss more because of their position as the dominant group, politically, economically, socially."This uneven distribution of loss has consequences for democracy," she asserts, "because it means that some citizens are making more sacrifices on behalf of the stability of the country than others. And in democracy, everyone is supposed to lose, right? That's the definition of democracy. There's change, there's rotation, no one wins all the time. And so that's one of the overall arguments."The Jan. 6, 2021 attack on the Capitol by Donald Trump's MAGA supporters is a perfect example of the "White grievance", says Professor Hooker."I think it is," she says. "Of course, there are a number of different things that were going on that fueled January 6th, but I think We one way to think about or one of the factors is definitely this mobilization of the sense that that certain people aren't supposed to lose right in the US that they are the true Americans, right?"About Professor HookerProfessor Hooker is the Royce Family Professor of Teaching Excellence in Political Science at Brown University, where she teaches courses on racial justice, Black political thought, Latin American political thought, democratic theory, and contemporary political theory. You also write that “while Black grief has historically been mobilized by Black activists in service of Black freedom, we must reckon with the loss this entails.” What do you mean?Q. You write that Black citizens are “expected to protest only in the most civil, nondisruptive ways in order for their losses to be legible. Refusals to contain Black rage are said to be counterproductive because they alienate potential white allies.” Are you saying that violent, disruptive protests are justified?Q. But you write that “armed white antimask protesters at various state capitals and white insurrectionists at the Capitol received kid-glove treatment compared to the heavy-handed, violent, repressive tactics unleashed on racial justice protesters.” Do you believe justice is being served in these January 6 cases?Q. Her book examines racial politics and argues that both White and Black communities must learn to accept loss – for different reasons and to different ends."Political loss has been unequally distributed in the history of the United States," she says during the interview. "Because of White supremacy, Black people, in general, have had to shoulder a disproportionate number of losses and Whites as a group have been able to avoid loss more because of their position as the dominant group, politically, economically, socially."This uneven distribution of loss has consequences for democracy," she asserts, "because it means that some citizens are making more sacrifices on behalf of the stability of the country than others. And in democracy, everyone is supposed to lose, right? That's the definition of democracy. There's change, there's rotation, no one wins all the time. And so that's one of the overall arguments."The Jan. 6, 2021 attack on the Capitol by Donald Trump's MAGA supporters is a perfect example of the "White grievance", says Professor Hooker."I think it is," she says. But you write that “armed white antimask protesters at various state capitals and white insurrectionists at the Capitol received kid-glove treatment compared to the heavy-handed, violent, repressive tactics unleashed on racial justice protesters.” Do you believe justice is being served in these January 6 cases?Q. Prince Andrew, the Duke of York and a member of the British royal family, became embroiled in a controversy involving his association with Jeffrey Epstein, a wealthy financier and convicted sex offender. The controversy emerged following Epstein's arrest in 2019 on federal sex trafficking charges involving minors.Prince Andrew had been acquainted with Epstein since the late 1990s and was known to have maintained a friendship with him over the years.However, their relationship came under intense scrutiny due to allegations made by Virginia Roberts Giuffre, who claimed that she had been trafficked by Epstein and forced to have sexual relations with Prince Andrew on multiple occasions, including when she was underage.Prince Andrew categorically denied the allegations, stating in a BBC interview in November 2019 that he had no recollection of ever meeting Giuffre.The interview, however, was widely criticized for its perceived lack of empathy and its failure to address the seriousness of the allegations.The controversy deepened when a photograph emerged showing Prince Andrew with his arm around Giuffre's waist when she was a teenager, further raising questions about the nature of their relationship. It is really frustrating when the person living with dementia refuses to accept care or tells you that he or she already performed the task. You know the drill. “Take a shower,” you say. “I just did,” they say…even though you know it has been days, weeks, maybe months since they have had a shower. Bathing isn't the only challenging behavior. Convincing a person with dementia to remove soiled clothing can be a nightmare, a literal tug-of-war between the two of you. One strategy that is useful is called “caregiver vibes.” This strategy has two parts. The first part is to become calm. Yes, I know that can be a tall order when you are exhausted and overwhelmed. I recommend taking 3 deep breaths. Seriously—breathing long and deep helps to reset the vagus nerve and slows down the heart rate. The second part is to picture yourself successfully getting the care done. In this podcast episode, I explain in detail how to accomplish both steps. I also explain how to integrate "caregiver vibes" with other strategies to gain cooperation. They've launched a new app to help blind people, turned away from places because of their guide dog, report the incident to the charity. Blind Guy Steven Scott and that other blind guy Shaun Preece talk to guide dog owner and fellow blind guy Robin Christopherson about his own experiences, and he also shares a demo of how the apps works. In recent years, charity Guide Dogs have published research that found 75% of guide dog owners had experienced some form of refusal of entry. Unfortunately, guide dog refusals are still very common and so we look into what steps you can take if it happens at an indoor establishment, for example: restaurants, shops, garden centres etc. We speak to a guide dog owner about his recent experience when being refused entry into a restaurant and to Clive Wood, the Lead Regional Policy and Campaigns Manager at Guide Dogs. If you're a savvy smartphone user, you may have heard of NaviLens. It is an app that enables visually impaired people to detect and scan special QR codes from a distance. On detecting the code, the app then makes the information contained within it accessible. It can dictate what you are facing toward, read signage at busy train stations and its also attached to many beauty and food products, enabling you to hear the ingredients. The RNIB's Marc Powell explains how it could be a potentially useful tool for blind or low vision smartphone users. On today's show, Ben and Alex have the privilege to dish with Dr. Anita Mannur, Professor of English and Asian American Studies at Miami University, about her research on the intersections that food has with culture, race, and gender.We begin the conversation by reflecting on how discourses around food and consumption practices, especially in postcolonial contexts, reflect our ideas of national identity and “authenticity” - for instance, the debate over whether Chicken Tikka Masala is an “authentic” Indian dish, despite its origins as an accommodation of traditional Indian cuisine to Anglo-European sensibilities. As Anita notes in her work, cultural conversations around food, and reactions to those foods' smells, tastes, and appearance are often tied to various social identities that we carry in other aspects of our lives, and can tell us a great deal about what happens as we negotiate those identities through various sensory experiences.Throughout our discussion, we trace the transformative (often homosocial and even queer) practices that emerge in intimate spaces of food production like the kitchen - exchanging knowledge, gossip, and other affective sensations. We also examine some sites that constitute of what Anita calls “intimate eating publics,” such as the now-defunct Conflict Kitchen in Pittsburgh, PA (RIP). Between talking about Anita's analyses of some of these eating publics from her new book Intimate Eating (such as The Great British Baking Show), we share intimate stories from our own culinary lives, and make a few delicious food puns along the way.
