What should conservatives make of the first 100 days of Trump's second term? Rachel Bovard, vice president of programs at the Conservative Partnership Institute, joins Oren to discuss how to measure an unconventional administration's early successes, what to make of DOGE, and where the administration should direct its efforts to capitalize on its public mandate.Plus, they discuss one major change that all conservatives should celebrate: a better approach to antitrust enforcement, led by Andrew Ferguson and Mark Meador at the FTC and Gail Slater at DOJ.Further reading:“Break 'em Up” by Rachel Bovard“Antitrust's Conservative Future” by FTC Commissioner Mark Meador

On this episode of Ropes & Gray's Antitrust Insights podcast series, seasoned antitrust partners and former FTC and DOJ prosecutors Jonathan Klarfeld and Samer Musallam discuss significant changes—and their substantial impact on businesses—to the Hart-Scott-Rodino (“HSR”) rules, which went into effect on February 10, 2025, with private equity transactions partner Chau Le. The discussion covers expanded data and disclosure requirements, enhanced business and competition documents, and increased scrutiny of prior acquisitions. They also offer practical advice on navigating these new rules, emphasizing the importance of early engagement with antitrust counsel and diligent compliance efforts. *Since the recording of this podcast, the new FTC Chair, Andrew Ferguson, has publicly endorsed the new HSR rules.
Is the terror in the skies a bit overblown? The seemingly myriad of mid-air mishaps recently have made flying seem like playing Russian Roulette at 30,000 feet. Infamous recent examples have included the Alaska Airlines door disaster in March and Southwest Airlines' near crash-landing recently. However, experts have mixed opinions regarding whether it's still safe to fly the friendly skies. In the headlines on #TheUpdate this Wednesday, in our continuing coverage of the death of UnitedHealthcare CEO Brian Thompson, the man charged with murder in the killing made it clear he wasn't going to make things easy for authorities, shouting unintelligibly and writhing in the grip of sheriff's deputies as he was led into court and then objecting to being taken to New York to face trial. Elsewhere, Former U.S. Rep. Anthony Weiner has filed to run for a seat on the New York City Council, launching a potential political comeback after his once-promising career was destroyed by sexting scandals and later a criminal conviction for having illicit online contact with a child. And in the ongoing transition of power from Joe Biden to Donald Trump, President-elect Donald Trump made another flurry of job announcements, selecting Andrew Ferguson as the next chair of the Federal Trade Commission, Ron Johnson was nominated to be ambassador to Mexico, and Kimberly Guilfoyle to be ambassador to Greece.
This week, Paul and Mesh start off by discussing Andrew Ferguson, the next FTC chair, and how his approach may differ from Lena Kahn's anti-competitive, pro-consumer approach. Next, they recap the Golden Globe and Critics Choice Award nominations. Finally, they discuss Jay-Z being implicated in a civil lawsuit which now accuses both Diddy and Jay-Z of raping a 13-year old at a 2000 VMA's after party – and Jay-Z's vehement response. It's an EmMajority Report Thursday! She speaks with Michelle Phelps, professor of sociology at the University of Minnesota, to discuss her recent book The Minneapolis Reckoning: Race, Violence, and the Politics of Policing in America. Then she speaks with Gabriel Hetland, associate professor of Latin American, Caribbean & Latino studies at SUNY Albany, to discuss his recent piece on the Build Public Renewables Act (BPRA) published in The Nation entitled "This Solar Panel Kills Fascists." First, Emma runs through updates on Biden's lame duck action, AOC's bid for Dem lead on Congressional oversight, Meta's Trump donation, Fetterman's support for Trump's cabinet, Manchin-Sinema hand the NLRB to Trump, Trump's ICE reform, the Albertsons-Kroger lawsuit, LA's new minimum wage policy, the NYT Tech Guild, and the UK's puberty blocker ban, also watching Joy Reid and Elizabeth Warren unpack the dangers of the GOP's attack on the CFPB. Professor Michelle Phelps then joins, diving right into the start of her research on Minneapolis' relationship with policing at the first peak of the Black Lives Matter movement in 2016, originally wrapping up in 2019 before the murder of George Floyd – and the global (and Minneapolis-based) abolitionist movement that followed – brought this topic back to the fore of her research, as she unpacks the direct correlation between communities being at heightened risk of police violence also being the ones most at risk of the community violence said police are supposed to prevent, creating a complicated relationship between being the community most in need of public safety reform AND the community most in need of public safety systems writ large. As she walks through Minneapolis' reaction and overwhelming abolitionist organizing effort in response to the murder of George Floyd, Professor Phelps explores the amorphous relationship between police and crime, and the relationship race and poverty have to both, which puts marginalized communities in such a tight bind when it comes to mitigating all violence, and the ultimate need to rethink where to investment to most benefit public safety. Expanding on the story in Minneapolis, Michelle and Emma unpack the evolution of the political establishment pushback to the abolitionist movement, tackling the relationship between Mayor Frye and the Minneapolis Police Department and the economic incentive of being an entertainment destination for suburbanites, before wrapping up with the ultimate sentencing of killer Cop Derek Chauvin and the minimal reciprocity it provided. Professor Gabriel Hetland then walks Emma through the genuinely incredible “New York State Build Public Renewables Act,” unpacking its plan for a green energy transition and the creation and maintenance of a robust clean energy grid bolstered by union labor, an investment in low and moderate-income workers, and an emphasis on public input and ownership. Expanding on this, Professor Hetland tackles New York's growing problem of skyrocketing energy costs and the fundamental fact of renewable energy's lack of profitability, wrapping up by emphasizing the importance of a shift away from private- and profit-driven energy systems. And in the Fun Half: Emma is joined by Matt Binder as they watch Jesse Watters gleefully call for the abuse of UnitedHealth CEO killer Luigi Mangione, Jake from Dallas calls in to discuss Texas education, and Tyler from Cleveland tackles divesting from Israel. They also reflect on an incredibly inspirational congressional tenure from Cori Bush and the danger of letting right-wing money invade Democratic primaries, Ben Shapiro goes to war with his audience over the Healthcare CEO killer and Bill Burr, and Andrew Ferguson's dangerous blueprint for his FTC chairmanship comes out – and gives important insight into what “right-wing populism” actually entails. Andrew Ferguson is a journalist and author; John Podhoretz is the editor of Commentary magazine and the host of the daily Commentary Magazine Podcast; Henry Olsen is a veteran political analyst, host of the Beyond the Polls podcast, and one of the few people who correctly predicted the outcome of the 2024 presidential election. This discussion hosted by Peter Robinson centers on the shifting political landscape in America, dissecting voter behavior, demographics, cultural changes, the shifting role and influence of legacy and new media, and leadership dynamics in the context of the 2024 election. As the conversation unfolds, the panelists evaluate Donald Trump's presidency—both past and future—and his potential legacy. They debate his character, leadership style, and policies, weighing his effectiveness in breaking establishment norms against the risks of his divisive rhetoric and unconventional governance. They also discuss the implications of his actions for America's future, particularly the possibility of a political realignment or a new conservative coalition. The panelists conclude with reflections on national renewal, the importance of moral leadership, and whether America is poised for a period of economic and cultural resurgence similar to the Reagan era. The trio discuss whether the political and cultural shifts in the country indicate a deeper realignment or merely a reaction to current circumstances. Recorded on November 20th, 2024.
The Federal Trade Commission (FTC) is a once sleepy, three-letter agency in Washington that serves as the nation's general purpose consumer protection regulator—dealing with everything from deceptive advertising to fraud. In recent years, however, the FTC has become somewhat of a household name thanks to current chair Lina Khan and high-profile cases against tech giants Microsoft, Meta, and Amazon. While some populists on right and left have praised the agency for taking on big business, others, particularly in the business community, have railed against the agency for an anti-business stance and preventing legitimate mergers and acquisitions.Conservatives and Republicans have generally been skeptical of antitrust enforcement and government regulation, but in recent years they have been rethinking how to apply their philosophy in an era when trillion-dollar tech behemoths could be threats to online free speech. And as concerns around other tech issues like data privacy and children's online safety continue to persist, the FTC sits at the center of it all as the nation's de facto tech regulator. Is there a balance to be struck between Khan's aggressive enforcement and the lax treatment preferred by the business world? And how should the agency tackle challenges like artificial intelligence?Who better to help answer these questions than one of agency's five commissioners. Evan is joined by Andrew Ferguson, one of two Republican commissioners at FTC. Prior to that, he was the solicitor general of Virginia and chief counsel to Republican senate leader Mitch McConnell.

Recorded Future - Inside Threat Intelligence for Cyber Security
In the U.S. criminal justice system, a lot of things hinge on the simple police report. As departments begin to use AI and large language model software to help cops write them, American University law professor Andrew Guthrie Ferguson worries people don't understand the possible downstream effects.
Oklahoma City's police department is one of a handful to experiment with AI chatbots to produce the first drafts of incident reports. Police officers who've tried it are enthused about the time-saving technology, while some prosecutors, police watchdogs, and legal scholars have concerns about how it could alter a fundamental document in the criminal justice system that plays a role in who gets prosecuted or imprisoned. “They become police officers because they want to do police work, and spending half their day doing data entry is just a tedious part of the job that they hate,” said Axon's founder and CEO Rick Smith, describing the new AI product—called Draft One—as having the “most positive reaction” of any product the company has introduced. Axon is best known for developing the Taser and as the dominant US supplier of body cameras. “Now, there's certainly concerns,” Smith added. In particular, he said district attorneys prosecuting a criminal case want to be sure that police officers—not solely an AI chatbot—are responsible for authoring their reports because they may have to testify in court about what they witnessed. “They never want to get an officer on the stand who says, well, ‘The AI wrote that. I didn't,'” Smith said. AI technology is not new to police agencies, which have adopted algorithmic tools to read license plates, recognize suspects' faces, detect gunshot sounds, and predict where crimes might occur. Many of those applications have come with privacy and civil rights concerns and attempts by legislators to set safeguards. But the introduction of AI-generated police reports is so new that there are few, if any, guardrails guiding their use. “I am concerned that automation and the ease of the technology would cause police officers to be sort of less careful with their writing,” said Andrew Ferguson, a law professor at American University working on what's expected to be the first law review article on the emerging technology. Ferguson said a police report is important in determining whether an officer's suspicion “justifies someone's loss of liberty.” It's sometimes the only testimony a judge sees, especially for misdemeanor crimes. Human-generated police reports also have flaws, Ferguson said, but it's an open question as to which is more reliable. This article was provided by The Associated Press.

Based on a true story, THE KEEPER tells a sweeping story of US Army veteran George Eshleman, a man heavily impacted by his fellow veteran's suicides, he decides to help raise awareness for military member suicides by hiking the entire nearly 2,200-mile Appalachian Trail from Maine to Georgia. On the trek, he carries 363 name tapes from the uniforms of military members who committed suicide, given to him by their families. Along the way he is given the trail name of “The Keeper” (of the names) and finds support and comfort from fellow hikers, civilians, military and veteran hikers (Michael Maclane, Haley Babula, Andrew Ferguson, Nicholas Asad) who shadow his hike, motivate his efforts along "Hiker Universe.” Despite their support, his depression threatens to overtake his judgment as the days pass. With his darkness only a few paces from his mind as he travels the trail, George struggles to prove his mettle, conquer his depression, and focus on the mission. Co-director, Co-Producer and lead actor Angus Benfield joins us to talk about the importance of remembering those who have sacrificed and died while in and out of uniform, how he sought to honor them and the support he received from his film crew, his cast and the people he met along the Appalachian Trail, many of whom are on the trail for the same reasons he made The Keeper.
