On October 16th, 1986 Kerrie Ann Brown would go missing from a house party in Thompson Manitoba Canada. Her body was later found on October 18th, 1986 by 2 ladies on a horseback ride. Several suspects were considered but her case is still unsolved to this day. Ann Brown is a medical oncology nurse for over 15 years. She received her BS in Biology first from Penn State Behrend in 2003, and then did an Innovative Program for Nursing, it was 15 months and intense at times. She graduated from Edinboro University in 2005. She started on the floor as a student intern, then moved to PCT and then to the nurse role. She has a great floor to work on, but the chronic stressors of life and nursing have taken its toll. She has been diagnosed with her own health problems, mostly related to acute on chronic stress. Through her own health journey, she realized that she enjoys the holistic, more natural approach to medicine. She enjoys bringing this to my patient and fellow healthcare workers. She has transitioned into a Transformational Health Coach and is working with exhausted healthcare professionals struggling with overwhelming challenges and burn out helping them build resilience by taking ownership of their wellbeing through the balance of work/life, stress, and self-care. She lives in a small rural community and enjoys sharing her new knowledge of food as medicine and the benefits of good nutrition, eliminating exposures to toxins in our lives, and the need for self-care with those who are struggling with their own health.

This week we cover cases focusing on wrongful convictions. Nathalie starts us off with the extremely frustrating case of Joyce Ann Brown, who was wrongfully convicted of robbery and murder in the 1980s. She spent nearly a decade in prison before her conviction was overturned. In this case, it was pretty clear they had the wrong person from the start but they went ahead with the conviction. Her case was one of the first to be overturned due to media attention and was even featured on an episode of 60 Minutes. Rachel discusses the case of Paula Gray and the Ford Heights Four, who were wrongly accused of kidnapping and murder. Paula was interviewed for two days straight without legal representation. At the time, Paula was only 17 years old and had a mental disability. This case gained a lot of media attention after 3 journalism students and a professor from Northwestern University decided to step in. This episode is inspired by a question from a Patron: “Yesterday I had a re-listen to your podcast episode with Cara about connecting with nature. At one point Cara suggested that people might be missing out on connecting with the land etc. because of fear of what others might think of them and you talked about people being surprised to hear that you walk alone, as that can seem frightening to people. It got me to thinking again about the fears which tend to prevent us prioritising and making the most of what we have access to in life and how to quieten down unhelpful distractions and wondered if you had any thoughts or suggestions on this theme? Many thanks!” This is a very timely topic, as I just started re-reading Gavin de Becker's book The Gift of Fear, which I discuss in this episode. There are two types of fears: helpful fears and unhelpful fears. It's important to distinguish between the two so you know what you're dealing with. Some fears we want; others prevent us from doing the things we want to do in life. I have been a very fearful person in the past, and I've worked to overcome many of my fears, both through mindset work and through taking practical action to face my fears in a supportive environment. Damon Ewing suffered a work-related injury while working for Pine Craft, Inc. Pine Craft admitted liability for Ewing’s ankle-sprain injury. Ewing alleged other injuries as a result of the ankle injury. The compensation judge found that these other injuries were not casually related to the work injury and that the ankle sprain was resolved by April 20, 2016. The compensation judge denied all benefits after April 20, 2016, including rehabilitation benefits. The qualified rehabilitation consultant (QRC), Optimal Recovery, Inc. and its owner Ann Brown, appealed the denial of rehabilitation benefits. The Workers’ Compensation Court of Appeals (WCCA) reversed. Relying on Minn. Stat. § 176.102, subd. 8 (2018), it concluded that an employer is liable for rehabilitation services until the employer files a plan amendment with a request to terminate those services. Because Pine Craft did not file that request until April 2017, the WCCA held that Pine Craft was liable for the QRC’s services from April 2016 through April 2017. On appeal to the supreme court, the following issues are presented: (1) whether the WCCA erred in reversing the compensation judge, who denied the QRC’s bills once the temporary injury resolved and there was no primary liability for all other ailments and body parts; (2) whether the WCCA erred in applying Minn. Stat. § 176.102 (2018), and Minn. Rules 5220.0510 (2017), and in holding that an employer is required to pay for QRC services, even when those services were for denied ailments and body parts; and (3) whether the QRC forfeited and/or waived the arguments she made on appeal regarding an alleged violation of the statute or rule.
