This Day in Legal History: Warsaw Pact States Join NATOOn March 12, 1999, the Czech Republic, Hungary, and Poland became the first former Warsaw Pact countries to join the North Atlantic Treaty Organization (NATO). This historic moment marked a significant shift in the post-Cold War security landscape, as these nations formally aligned with the Western military alliance nearly a decade after the collapse of the Soviet Union. Their accession symbolized a decisive break from their communist past and reinforced their commitment to democratic governance, rule of law, and collective defense. The expansion was not without controversy. Russia viewed NATO's eastward growth as a threat to its sphere of influence, deepening tensions that would continue into the 21st century. However, for the newly admitted countries, NATO membership provided critical security assurances against potential aggression, particularly given their historical experiences with Soviet domination. The accession process required extensive military and political reforms, ensuring that these nations met NATO's standards for democracy, civilian control of the military, and defense readiness. The inclusion of the Czech Republic, Hungary, and Poland set the stage for further NATO enlargement, with additional Eastern European countries joining in subsequent years. It also reinforced NATO's role as a stabilizing force in Europe during a period of geopolitical uncertainty. The decision underscored the alliance's post-Cold War mission of promoting security and democracy beyond its original Western European membership. Today, this expansion remains a key milestone in the ongoing debate over NATO's role in global security and its relationship with Russia. The removal of Special Counsel Hampton Dellinger has raised concerns about the politicization of the Office of Special Counsel (OSC), an independent agency that protects federal whistleblowers. Dellinger, who was dismissed by President Trump without explanation, initially challenged his firing but later withdrew his case after a federal appellate court sided with the administration. His removal highlights the administration's broader efforts to exert control over independent agencies, a move that legal experts warn could undermine their impartiality.During his tenure, Dellinger was an advocate for federal workers, helping reinstate over 5,000 Department of Agriculture employees who were improperly fired. His dismissal is expected to weaken the OSC's role in protecting workers from political retaliation. Legal scholars suggest that unless the Supreme Court intervenes, the precedent set by his firing could give future presidents greater authority over independent agencies. The case also ties into a broader legal battle over presidential power, as courts are reviewing Trump's terminations of other agency officials, including members of the National Labor Relations Board and the Equal Employment Opportunity Commission. While Dellinger had legal grounds to challenge his firing, he strategically chose not to pursue the case, allowing stronger challenges—such as that of NLRB member Gwynne Wilcox—to take precedence. The legal debate is moving toward a potential Supreme Court review of Humphrey's Executor v. United States, a 1935 decision that limits the president's power to remove independent agency officials. If overturned, the ruling could significantly expand presidential authority over such agencies.Dellinger Exit Deepens OSC Politicization as Workers Lose AllyA U.S. judge will hold a hearing on Columbia University student Mahmoud Khalil's challenge to his arrest by immigration authorities, a case that has sparked protests and political debate. Khalil, a Palestinian student and U.S. permanent resident, was arrested outside his university residence by Homeland Security agents. The Trump administration has accused him—without providing any evidence—of supporting Hamas, though Khalil has not been charged with any crime.Judge Jesse Furman has temporarily blocked Khalil's deportation and may order his release if his rights were violated. However, an immigration court—not Furman—would ultimately decide whether Khalil can be deported, a process that could take years. Khalil's lawyers argue that his arrest is political retaliation for his pro-Palestinian activism and violates his First Amendment rights. His detention in Louisiana has limited his legal access, and his wife, who is eight months pregnant, has spoken out against his treatment. The case raises broader legal questions about the intersection of free speech and immigration law, particularly as Trump has vowed to deport foreign students involved in pro-Palestinian protests. Khalil's arrest has triggered demonstrations and condemnation from Democratic lawmakers, who view it as political repression.Judge to hold hearing over Columbia student protester's challenge to arrest | ReutersA major real estate brokerage, Howard Hanna Real Estate Services, has asked a U.S. judge in Missouri to recuse himself from an antitrust lawsuit due to political donations made to his wife's campaign by the plaintiffs' lawyers. The lawsuit accuses brokerages of conspiring to inflate real estate commissions, and plaintiffs have already won significant settlements in related cases.Howard Hanna argues that the donations create an appearance of impropriety, requiring Judge Stephen Bough's recusal under ethics rules. Bough had previously disclosed the donations and offered to step down in an earlier case, but no party requested his removal at the time. Plaintiffs' lawyer Michael Ketchmark dismissed the recusal request as meritless and a delay tactic after Howard Hanna had lost key motions.Bough's courtroom previously hosted a landmark jury verdict in a related antitrust case, leading to over a billion dollars in settlements with brokerages and the National Association of Realtors. The judge's decision on whether to step aside could impact the trajectory of ongoing real estate antitrust litigation.US judge in brokerage antitrust case faces recusal bid over political donations | ReutersNew Jersey is poised to increase its angel investor tax credit (AITC) from 20% to 35% of investment costs, with a $35 million annual cap. Given the limited funds, ensuring the credit is effectively allocated is essential. However, the proposed bill includes “carbon footprint reduction technology” as an eligible category, which could allow carbon capture projects to qualify. Critics argue that carbon capture is neither emerging nor effective—it is costly, inefficient, and largely benefits fossil fuel companies by prolonging their operations rather than reducing emissions.Instead of funding speculative or ineffective technologies, the state should prioritize investments in proven decarbonization strategies like renewable energy, battery storage, and energy efficiency improvements. These sectors have demonstrated cost savings, emissions reductions, and job creation without the need for indefinite subsidies. Tightening the AITC eligibility criteria would prevent resources from being diverted to projects with questionable climate benefits.By refining its definition of eligible technologies, New Jersey can maximize the impact of its tax credit, ensuring funds support tangible climate and economic progress. States that design smart, targeted incentives will attract startups and clean energy investments, while those that fund vague or ineffective projects risk falling behind. As federal climate incentives remain uncertain, state policies will play a crucial role in shaping the future of clean energy investment.New Jersey Should Tighten Its Angel Investor Credit Eligibility This is a public episode. Here's what we're reading, recommending, and revisiting this week.Catherine's library find is a trio of cozy mysteries by Claudia Gray, all starring Jane Austen characters: The Murder of Mr. Wickham (2022), The Late Mrs. Willoughby (2023), and The Perils of Lady Catherine de Bough (2024). These are an absolutely delightful (and non-stressful) way to revisit these characters, and there's even a little helping of romance. Mentioned: Death Comes to Pemberley, another contemporary author's take on an Austen-themed mystery.Terri's random recommendation is Artful Plus, the premium version of Artful Agenda, a digital planner we both use. Gov. Mike Kehoe and Sen. Bill Eigel in the August 2024 GOP primary, has used the lawsuit to raise money for his gubernatorial campaign, where culture war issues have played a prominent role. And, he is using taxpayer funds to pay a campaign donor to represent his office in the lawsuit.Instead of using the Missouri attorney general's office to fight the challenge to the rules, Ashcroft hired the politically connected Kansas City law firm of Graves Garrett to represent his office.Law firm partner Todd Graves, a former head of the Missouri Republican Party, was named to the University of Missouri board of trustees in 2021 and Greim was mentioned as a possible pick for attorney general when Eric Schmitt vacated the post to become U.S. senator in 2021.Greim also represented the Office of the Governor in 2018 when former Gov. The contaminated creek will finally have warning signs almost 75 years later. From articleThe U.S. Army Corps of Engineers said in a statement Monday that it was working with the Environmental Protection Agency to add signs along the creek to help it monitor areas “that may pose a risk if disturbed.”Coldwater Creek has been contaminated for decades with radioactive waste left over from the World War II-era effort to build an atomic bomb. But though the creek winds through some of St. Louis' busiest suburbs and past public parks and schools, the federal government had resisted calls to post signs warning visitors of the contamination.“This is decades of potential exposure that could have been prevented that they drug their feet on,” said Dawn Chapman, co-founder of Just Moms STL, an organization formed to advocate for communities affected by St. Louis-area radioactive waste.Despite the delays, Chapman said she's thankful that the signs are finally going to be installed. The St. Louis area has long struggled with a radioactive waste problem. Uranium for the Manhattan Project, the name given to the effort to develop the first atomic bomb, was refined in downtown St. Louis. After World War II, radioactive waste left over from those efforts was trucked to the St. Louis airport and dumped — some on the open ground and some in barrels — next to Coldwater Creek. As early as 1949, Mallinckrodt Chemical Works, the company that refined uranium for the federal government, was aware the waste could escape the barrels it was stored in and contaminate the nearby creekThe Agency for Toxic Substances and Disease Registry concluded in 2019 that children and adults who played in or near Coldwater Creek or lived in its floodplain between the 1960s and 1990s may have been exposed to radioactive materials that raise the risk of certain cancers. The agency — part of the Centers for Disease Control and Prevention — recommended signs be placed along the creek to warn residents of the potential exposure risk. The Army Corps said there was nothing specific that caused the agency to change its mind on installing the signs. The decision was “driven by our commitment to continuous improvement,” George Stringham, a spokesman for the Army Corps, said in an email. Stringham said the Army Corps would “continue to prioritize the health and safety of the community.”Iowa - Gov. proposed budget is a major cut for higher edhttps://iowacapitaldispatch.com/2024/01/10/gov-kim-reynolds-budget-for-state-universities-falls-30m-short-of-regents-request/From article: Iowa Gov. The regents requested just over $609 million from the state's general fund and about $40 million from other state sources. Reynolds recommended allocating almost $619 million.Colorado - Congresswoman Diana DeGette introduces discharge petition to ban high-capacity magazines:https://coloradonewsline.com/briefs/degette-house-vote-high-capacity-magazine-ban/From article:U.S. Rep. Diana DeGette used a mechanism in the House of Representatives that would force a vote on a bill without leadership's approval to bring forward a vote on a gun safety bill. DeGette, who represents Denver in Congress, alongside House Gun Violence Prevention Task Force Chair Mike Thompson, a California Democrat, filed a discharge petition to force a vote on the Keep Americans Safe Act. The bill would ban large capacity magazines - those that can hold 30-100 rounds - with a few exceptions and will likely struggle to get through the Republican-controlled House.DeGette said high-capacity magazines were used in all of the 10 deadliest mass shootings in the country. She said the only purpose of these magazines is to kill a lot of people in a short amount of time. “These events continue to re-traumatize our community and our nation, because no community has been untouched by this deadly epidemic,” DeGette said. “In mass shootings with four or more people killed between 2015 and 2022, high-capacity magazines led to more than twice as many people being killed and nearly 10 times as many people being wounded per incident on average.”The petition requires 218 signatures to force a vote on the floor, and with 213 Democrats in the House, at least five Republicans would need to sign. DeGette said she thinks some Republicans in the House represent districts impacted by mass shootings and may be under pressure from their constituents to ban high-capacity magazines. U.S. Rep. Jason Crow, a Centennial Democrat, joined DeGette and members of the Gun Violence Prevention Task Force at a press conference outside the U.S. Capitol after DeGette filed the petition and applauded Colorado leadership for its gun safety measures, particularly banning high-capacity magazines. “In Colorado, we are fortunate to have a state legislature focused on gun reform when Congress fails to make significant change due to Republican stonewalling over and over again,” Crow said. Crow highlighted several high-profile mass shootings in Colorado where the perpetrator used high capacity magazines: the 1999 Columbine High School shooting in Littleton, the 2012 Aurora movie theater shooting, the 2021 Boulder King Soopers shooting, and the 2022 Club Q shooting in Colorado Springs. Closing Note: Doing anything this weekend?  @TheHeartlandPOD on Twitter and ThreadsCo-HostsAdam Sommer @Adam_Sommer85 (Twitter) @adam_sommer85 (Post)Rachel Parker @msraitchetp (Post) Sean Diller (no social)The Heartland Collective - Sign Up Today!JOIN PATREON FOR MORE - AND JOIN OUR SOCIAL NETWORK!“Change The Conversation”Outro Song: “The World Is On Fire” by American Aquarium http://www.americanaquarium.com/

Chip Roy (R-Texas) has been flirting with the idea of trying to remove Johnson, saying in a radio interview on Tuesday: "If they totally botch [the appropriations bills] ... I don't know why we would keep him as speaker."One Republican leadership ally described the revolt as a "shot across the bow."Missouri AG and recent melted blob of flesh on CNN, Jay Ashcroft, gets smacked down in courthttps://www.stltoday.com/news/local/government-politics/judge-rejects-jay-ashcroft-s-bid-to-dismiss-high-profile-lawsuit-against-his-office/article_01f1fdc6-af1c-11ee-8076-27fdb2bf7fa8.html?utm_medium=social&utm_source=twitter&utm_campaign=user-shareComplaint https://business.cch.com/srd/20231023_SIFMA-v-Ashcroft_amended-complaint.pdfFrom the articleA federal judge rejected an effort by Secretary of State Jay Ashcroft to dismiss a lawsuit against his office over new, politically charged rules aimed at limiting the impact of environmental, social and governance factors in investment decisions. In a ruling Friday, U.S. District Judge Steven Bough ruled unanimously in favor of a trade group that is suing the Republican gubernatorial candidate and his office on the grounds that the rule imposed by Ashcroft fails to acknowledge that federal law already requires financial advisers to act in the best interest of their clients when providing personalized investment advice.“The court finds that Plaintiff adequately alleges that the rules violate the First Amendment,” Bough wrote. “The court finds that Plaintiff adequately alleges that the rules are unconstitutionally vague.”And Bough said the trade organization can continue its pursuit of the case because it has the legal standing to represent financial advisers who object to Ashcroft's rule.Ashcroft issued the rules — the first in the nation — after a similar “anti-woke” investing proposal died in the Legislature last year.Ashcroft, who is facing Lt. This is a re-release of one of my favorite Victorian ghost stories. I had to take a little break from podcasting for the past couple of weeks, and publishing a re-broadcast for the second episode for this month will really help me continue to get caught up.This is a story that was set in the 17th century and was passed along verbally, but really gained popularity in the 1830s when a song was written about the tale. You may have heard this tale told a little differently but I'm going to relay it to you as I first heard it in honor of upholding the tradition of storytelling. This is the legend of Mistletoe Bough.Follow along on Instagram, TikTok, or YouTube @agoodnightforamurder or www.agoodnightforamurder.com, and subscribe where ever you listen to podcasts.

Victorians loved telling ghost stories at Christmas and I'm here to tell you one of their favorite tales. This is a story that was set in the 17th century and was passed along verbally, but really gained popularity in the 1830s when a song was written about the tale. Now you may have heard this tale told a little differently but I'm going to relay it to you as I first heard it, in honor of upholding the tradition of storytelling. This is the legend of Mistletoe Bough.Follow along on Instagram or TikTok @agoodnightforamurder or www.agoodnightforamurder.com, and subscribe where ever you listen to podcasts.

Do you smell that? Could it be the warm smell of colitas rising up through the air? Or did Dave over-microwave his gas station burrito again? Well, whatever the odor is, this path paved with good intentions (and a little cement) is leading Aeneas and company to you know where. Our Trojan exiles have finally reached the stillettoed boot of Italy. But before they can plant a flag and put up their feet, Aeneas has to take a detour down into the Underworld for one last chat with dad. But how to get there? As the Cumaean Sybil says, the gettin' in is the easy part, it's the leaving that'll give you fits. So, keep your eye out for lost comrades, watch those birds, and “bough down”, ut dicunt. Such a lovely place, such a lovely face.

This week we're talking about two ( oddly festive for July?) ghost stories! These legends date back many years ago and are sure to give you the heebie jeebies. We talk about the Brown Lady of Raynham Hall, one of the most famous hauntings in the UK. What would you do if you saw this spooky lady grinning at you? I'd leg it personally.  We also talk about the Mistletoe Bough, legend says she was locked inside of a chest for FIFTY YEARS playing hide and seek on her wedding night... Kate is a psychology graduate & Abbie is a demonologist. Together they talk about all things scary, strange and silly.
