A child victim of forced sterilization under Japan's now-defunct eugenics protection law said the surgery ruined his life, as he described his experiences at a U.N. event on disability rights on Tuesday 10th June in New York. “Because of the surgery, my life was thrown completely off course,” the 82-year-old man, who uses the pseudonym Saburo Kita, said at the event linked to a United Nations conference on the Convention on the Rights of Persons with Disabilities. Japan's government says roughly 25,000 people are eligible for compensation as victims of forced sterilization or their bereaved relatives. It is believed that some of them may hesitate to apply due to fear of discrimination or may be unable to do so because of their disabilities. The new legislation provides 15 million yen, or about 96,500 dollars, for forcibly sterilized people, 5 million yen to their spouses, and 2 million yen to women who were forced to have an abortion. Japanese Prime Minister Shigeru Ishiba has stressed the government's resolve to steadily pay compensation to victims of forced sterilization conducted under the country's now-defunct eugenics law.  He made the promise during a meeting with those including victims who sued the government over the matter at the prime minister's office in Tokyo on Friday, when a law on compensation to forced sterilization victims took effect. “The government's responsibility is extremely grave, and I sincerely reflect on it and apologize again to you from the bottom of my heart,” he said. “We must not repeat human rights violations that destroy the dignity of individuals,” Ishiba said. A settlement was reached on Friday 15th November at the Nagoya High Court in central Japan in a damages lawsuit over forced sterilization under the now-defunct eugenic protection law. After the settlement was reached, the plaintiff, Keiko Onoue (74) spoke about how she “kept silent for 50 years” as there was no one with whom she could "discuss” it. Moonlight Pulido is a mother and a caretaker for her own mom in Los Angeles. But she couldn't have more children after a prison doctor gave her an involuntary hysterectomy while she was incarcerated in 2005. She's one of hundreds of living survivors of state-sponsored sterilization.   Here in California, more than 20,000 people were involuntarily sterilized in state prisons, homes and hospitals under eugenics laws. People classified as “unfit to reproduce” were disproportionately poor women, people of color, and people with disabilities. Even though California's  eugenics laws were repealed in 1979, people who were incarcerated were still forcibly sterilized as recently as 2013. In 2021, the state passed a historic reparations law to make amends for this shameful chapter in our history. For more than a year, reporter Cayla Mihalovich has been investigating how the law has been implemented. It was intended to compensate survivors for their suffering. Japan's House of Representatives, the lower chamber of parliament, unanimously passed a bill on Monday 7th October to compensate victims of forced sterilization under the now-defunct eugenic protection law. The bill is expected to be enacted on Tuesday after approval by the House of Councillors, the upper chamber. It calls for compensation of 15 million yen each for victims and 5 million yen for their spouses, as well as a lump-sum payment of 2 million yen to those forced to have abortions. If victims and their spouses are already deceased, the bill allows their bereaved families to seek compensation. On September 13th, the plaintiffs and the government signed a settlement agreement in a lawsuit over forced sterilization under the old Eugenic Protection Law. Final adjustments were being made on the government's payment of 15 million yen in compensation to any individual who underwent the surgery. Lawsuits currently underway in various regions have been gradually entering settlement procedures, and the settlement will take place about six years and seven months after the first lawsuit was filed in 2018. A plaintiff in a damages lawsuit over forced sterilizations conducted under Japan's now-defunct eugenic protection law reached a settlement Wednesday with the government, the first such resolution among similar lawsuits filed across the country. The settlement in the suit filed by Sumiko Nishi, 77, of Hino, Tokyo, was finalized in Tokyo District Court. Nishi, who has cerebral palsy, was subjected to sterilization without consent at around 14 years old. California's use of forced sterilizations represents a dark chapter in the state's history. Up until the 1970s, state hospitals and institutions implemented a eugenics program as a way to decrease specific demographic groups including Latinos, Blacks and Native Americans. In more recent decades, California prisons performed procedures—without patient consent — that left hundreds of women unable to have children. Now, the clock is ticking for survivors to apply for compensation from a $4.5 million fund the state established in 2021. As the Dec. 31 deadline looms, relatively few survivors have applied and the state has rejected most of them. We'll talk about survivors' experiences, why they aren't receiving compensation, and hear from advocates on what should happen next. More information on how to apply for compensation for involuntary sterilization can be found at the California Victim Compensation Board website. Welcome to episode 19(ish) of series 3 where Lisa does a mini-breakdown on eugenics and how it relates to reproductive healthcare, specifically forced sterilization. She starts by explaining what eugenics, and scientific racism, is at a high level, touching briefly on Margaret Sanger & Planned Parenthood as well as the inherent ableism of eugenics. She goes on to talk about how, in the wake of SCOTUS overturning Roe vs. Wade, many people are suggesting that boys & men (presumably cis-het) should be given vasectomies until they are “fit” to be a father and how this idea is on the slippery slope to eugenicist beliefs. She runs through the recent history of forced sterilization in the USA & Puerto Rico (including that it is still legal to forcibly sterilize disabled people in 34 states) and how allowing systemically racist, ableist government systems to determine who is “fit” to be a parent is taking a massive step backward. She closes with a reminder that being branded with the title of “wokeness” should not deter us from actively working to be on the right side of history. We need to continue to educate ourselves, try to always use inclusive language (because words & language matter), and put in the work every day to protect the civil rights of all those around us, not just the people who look like or identify the same way as we do.
