Because the real, disgusting, nauseating truth behind the revelations in the Goldberg Atlantic piece is that it touches the third and FOURTH rails of Donald Trump's America: many of his people believe whoever is in charge SHOULD be supported by and in fact kept in power by “the kind of generals Hitler had.” The antisemites in the Trump cult love it. This Day in Legal History: Alabama Ten Commandments MonumentOn August 28, 2003, the Supreme Court of Alabama took down a monument of the Ten Commandments from its courthouse rotunda, marking the culmination of a high-profile legal battle. The monument had been installed by Chief Justice Roy Moore in 2001, who argued that it reflected the moral foundation of U.S. law. However, this act sparked a federal lawsuit, Glassroth v. Moore, in which three Alabama attorneys claimed the monument violated the Establishment Clause of the First Amendment, which prohibits government endorsement of religion.The federal District Court for the Middle District of Alabama agreed with the plaintiffs, ordering Moore to remove the monument. Moore refused, maintaining that he had a duty to acknowledge God in his official capacity. The case was subsequently appealed to the Eleventh Circuit, which upheld the lower court's ruling. When Moore continued to defy the court orders, the Supreme Court of Alabama intervened, removing him from his position as Chief Justice. Girardi, a prominent figure in toxic tort litigation, was convicted on four counts of wire fraud in Los Angeles federal court. Once renowned for his work on the Erin Brockovich case and his appearances on "Real Housewives of Beverly Hills," the disbarred attorney faced accusations of defrauding vulnerable clients. While California is pushing for laws that explicitly protect personal data in AI, the German approach may set a precedent for a more lenient interpretation under the GDPR. This divergence highlights the complexity of applying traditional privacy laws to AI technologies, with ongoing discussions about how to reconcile these differing perspectives.By way of brief background, LLMs do not directly memorize the training material they are exposed to. Instead, they analyze vast amounts of text data and learn patterns, correlations, and structures within the language, which are then used to generate responses. This new version removes claims related to Trump's communications with government officials, including efforts to involve the Justice Department, but retains the core charges accusing Trump of conspiring to reverse his election loss. The case comes as Trump campaigns for the 2024 election, adding tension to the legal proceedings. Trump criticized the indictment on social media, calling for its dismissal. The updated indictment also cuts references to former Justice Department official Jeffrey Clark as a co-conspirator and modifies Trump's description, downplaying his role as president at the time. San Francisco sat at the epicentre of the first wave, with bands like Crime, Dead Kennedys, Avengers, Chrome, The Mutants, and The Nuns bringing the house down at the legendary Mabuhay Gardens. East Bay bands like Green Day, Operation Ivy, Rancid, and The Mr. T Experience ruled the punk revival of the late '80s and beyond. But, all over the northern part of California, great bands sprouted up in cities like Stockton, Santa Cruz, Davis, and Fulton. This week, we'll cover some of the great punk singles from the area, from familiar favorites to obscure treasures. What better Third Lad for this assignment than Northern California alternative music legend Jeffrey Clark?!? Jeffrey got his start as the singer/songwriter in early '80s Stockton garage/psych/synth combo The Torn Boys, whose recordings were recently released by Independent Project Records as 1983. Following the demise of the band, Jeffrey departed for LA with Torn Boys bandmade Grant-Lee Phillips (later of Grant Lee Buffalo fame) and formed the moody, mystical, marvelous Shiva Burlesque, who released two LPs - their eponymous debut in 1987 and Mercury Blues in 1990. Jeffrey subsequently released two cinematic, gorgeous solo records - Sheer Golden Hooks in 1996 and If Is in 2009. But wait, there's more: This renaissance man also founded one of the most acclaimed film festivals in North America, the Nevada City Film Festival; he revitalized the legendary Independent Project Records with label founder/Savage Republic guitarist Bruce Licher; and, he co-produced the documentary Louder Than You Think: A Lo-Fi History of Gary Young & Pavement. As we've discussed, the Supreme Court threw a major wrench into the various prosecutions of Donald Trump with their ruling on presidential immunity. The RICO prosecution in Atlanta was already so hopelessly fucked that they probably won't need to think about it for a couple of years, and the documents case in Florida is, for now, dismissed. But in New York, Judge Juan Merchan is proceeding toward sentencing, notwithstanding immunity being one of Trump's several issues for appeal, and in Washington, DC, Judge Tanya Chutkan is trying to figure it out, though the issue probably won't even be fully briefed until after the election.Plus: Judge Chutkan has ruled that Trump was not a victim of selective or vindictive prosecution. A committee of the District of Columbia Bar Association has recommended that Jeffrey Clark's law license be suspended. Sen. Bob Menendez has been convicted — showing that bribery is still illegal. On today's show we discuss the fallout from President Biden's awful debate performance and the impact of the SCOTUS immunity decision on Fulton County's case against former President Donald Trump. Two weeks ago, President Biden had one of the worst debate performances in the history of politics. The blowback has been severe, with non-stop speculation from the media about his political future and many elected Democrats calling for him to drop out of the race. To date, he has been pretty unequivocal about his intention to stay in the race, but should he? Next up, the U.S. Supreme Court's ruling on July 1, 2024, determined that former President Donald Trump has broad immunity from federal prosecution for actions taken as part of his official duties while in office. The court's 6-3 decision, along ideological lines, grants Trump a presumption of immunity for his official acts but denies immunity for unofficial acts. The ruling complicates Trump cases like the one in Fulton County, where evidence related to Trump's communications with officials like Jeffrey Clark and Mark Meadows may now be thrown out. If it is, does Fani Willis still have a case to make? Lastly, we discuss the news that Athens-Clarke County District Attorney Deborah Gonzalez will face a general election challenge in November from Independent candidate Kalki Yalamanchili. The storyline before the Trump Trial began was: If Michael Cohen keeps his cool when Todd Blanche screams at him, he'll prevail. He did it, and yet the networks rushed to ignore it. Prosecutors have already said they'll only need about an hour of re-direct of Cohen next Monday, meaning that's all the time they expect to require to polish him back up. They are still winning - plus there is still the wild card that in his perpetual over-confidence Trump may testify. And yet that's not where I start because sometimes the most important story and the most interesting one are not the same thing. The primary sidebar takeaway from Cohen's testimony was based on a poorly worded tweet that the author, Ron Filipkowski, deleted. “Cohen testified that his main media contacts to get positive stories run about Trump were Maggie Haberman, Katy Tur, and Chris Cuomo." Except Cohen DIDN'T say that. He was asked if he had good relationships with reporters. Haberman? "Yes," he replied. Tur? "Yes." Cuomo? "Yes." I am thus in the position of defending - in part - the transactional Haberman, my appalling ex, and the ridiculous Cuomo. Having said that, they are all imperiled because of what Cohen DID say. Plus we have a really great punchline to the day in the courtroom in which a would-be Trump Insurrectionist learned that loyalty to him is a one-way street, even if the only thing you wanted was a wave. It's been a really bad couple of days for two Trump-affiliated lawyers, John Eastman and Jeffrey Clark. After a bar counsel ethics trial, a California judge ruled that John Eastman - one of the architects of the fake elector scheme - should be disbarred, saying that his "actions were carried out with deceit or dishonesty" and his plan to derail Joe Biden's election victory "was unlawful and lacked any factual or legal support." Former DOJ official Jeffrey Clark is contending with his own disbarment hearing in Washington, DC. When given the opportunity to testify in the hearing Clark repeatedly pleaded the 5th - invoking his 5th Amendment right against self-incrimination. Of course, disbarment may be the least of Eastman and Clark's worries, as both are charged co-defendants with Trump in his Georgia state RICO prosecution. And both are also un-indicted co-conspirators in Trump's federal prosecution in DC. This week, Trump filed his opposition to Jack Smith's SCOTUS petition in the immunity case, and the Supreme Court has denied that petition to grant certiorari before judgment.Meanwhile, the DC Circuit Court of Appeals has granted Jack Smith's request for an expedited appeal. Also, Trump has asked for a hearing in front of the full DC Circuit court panel on his appeal of Judge Chutkan's limited gag order.
