Liability Rolls Downhill — Protecting Your Trucking Company After Montgomery v. Caribe | The Long Haul

On May 14, the Supreme Court handed down one of the biggest trucking decisions in a generation — and most small carriers still haven't heard about it. Montgomery v. Caribe Transport. Nine to zero. Freight brokers can now be sued in every state in the country for negligently selecting an unsafe motor carrier. The federal shield that protected them for years is gone. Every headline called it a broker problem. Bryan Nelson will tell you the truth — it's about to become your problem. Because when brokers carry that kind of exposure, they don't absorb it. They push it down. Tighter vetting. Deeper background checks on your authority, your scores, your insurance. Rewritten agreements with indemnification language designed to make you hold the bag. Monitoring you've never dealt with before. And carriers with conditional ratings, rough inspection histories, or brand-new authority are about to find doors closing that were open six months ago. Bryan has spent his career on both sides of this table — years as general counsel inside a broker, a motor carrier, and a TMS, and now a partner at a transportation law firm defending trucking companies. He breaks down what the Court actually decided, what brokers are changing right now, the contract language headed for your inbox, and the exact moves that protect your authority, your assets, and your access to freight in the new landscape. Your safety scores just became your sales resume. Your paperwork just became your armor. This episode shows you how to build both. Follow The Long Haul Podcast Other FreightWaves Shows Learn more about your ad choices. Visit megaphone.fm/adchoices

Email us your listener questions or hot or nots at microcosmcoaching@gmail.com.Check us out online at microcosm-coaching.comDownhill running is a technical skill, not a fitness problem, and this week Zoë Rom and TJ David break down the science of eccentric loading, the repeat bout effect, and how to descend faster without trashing your quads. They go inside the muscle to explain what actually happens to your sarcomeres on a long descent, why delayed onset muscle soreness peaks a day or two later instead of immediately, and why force output can stay down for up to a week even after the soreness clears. From there it's the practical stuff: how braking multiplies eccentric load, why sitting back is the single most common descending error, how to train your eyes on technical terrain, why fear itself makes descending harder, and where strength work genuinely helps versus where it can't replace actual practice. Plus Hot or Not on blood donation for endurance athletes, the red blood cell and iron math every runner should understand before donating, and how to time it around a race build, and random race pacers. In the listener question, a runner training for their second 50 miler on seven hours a week asks whether elite ultra training is fundamentally different from everyone else's. Short answer: same recipe, different dose. The episode opens with training through summer heat, racing amid wildfire uncertainty, and why holding your goal race lightly is a useful gut check.

Every racer's journey is built on failures as much as victories. The crashes, the setbacks, the missed opportunities and the hard lessons all shape who you become. Shawn Neer's career has taken him through all of those moments, from chasing results as a racer, to failed businesses and learning what it takes to create lasting change in the sport he loves. Now he's going all in on a new challenge: building the future of American downhill racing through the Mountain States Cup. In this episode, Shawn shares the story behind his racing journey, the failures that helped shape his mindset, and why he believes the next generation of US downhill riders needs a cutting edge race series in the Rockies. This week we’re diving into the second round of the Pearce DH Series, where Jonny and Ben were both back between the tapes. We break down how their weekends went, what worked, what didn’t, and the changes they’ve been making to their bike setup, training and approach to racing. We also get into one of the more interesting ideas we’ve talked about on the show for a while: why, if you really want to get faster, you probably need to be willing to push yourself to the point where crashing becomes a real possibility. One quick thing before we get into this discussion: when we talk about ‘crashing more’, what we’re really talking about is safely exploring your limits in appropriate environments, not taking unnecessary risks. I think that becomes clear in the conversation, but in this modern world, it’s worth saying up front. This one really got me thinking, so sit back, hit play and listen to this episode with me, Ben and Jonny. You can also watch this episode on YouTube here. The main topic was a discussion of a difficult, nuanced topic: how to think about power development over time, and what that means in a messy athletic life. It all comes from a “Dear Younger Me” letter that David wrote to his 11-year-old self, and it extends forward to the performance revolution we're seeing across endurance sports. Running is a POWER SPORT. That discussion starts at 55:04.And this one was full of the best topics! This week's Frankly is part three of the series How to Think About the Future. Today, Nate builds a framework for understanding the pathways that connect today's choices to tomorrow's realities. Drawing from biology, ecology, history, and systems thinking, he introduces a civilizational terrain of ridges and valleys that is constantly shifting as we are moving through it. Nate also uses the concepts of switchbacks and erosion to explain why some futures emerge by default from existing incentives and momentum, while others require deliberate effort, coordination, and sustained commitment. Through examples that range from cell development to lake ecosystems to political systems, Nate examines how complex systems settle into stable states, and why some transitions are far easier to make than to reverse. As economic, geopolitical, and ecological pressures reshape the landscape we traverse, knowing which futures are downhill and which require climbing becomes increasingly important. The episode offers a conceptual tool for interpreting the composite worlds Nate will outline in the next part of the series, and invites listeners to consider both where they stand in the terrain and whether their daily actions are building pathways toward a more desirable future, or letting those paths erode. How do societies become trapped in self-reinforcing systems, and what does that look like in our current reality? Which futures seem most likely if present incentives and momentum hold? And which social, cultural, or ecological switchbacks are being built today that could open new possibilities tomorrow (Recorded May 22nd, 2026)   Show Notes and More   Watch this video episode on YouTube   Want to learn the broad overview of The Great Simplification in 30 minutes?
