Episode 036 - You Did What With Your Ownership? What happens when you pull back the curtain of ownership? Probably nothing. Clients buy homes every day. But the legal form of ownership is this “thing” that happens behind the scenes and no one notices…until…they do! Legal ownership is tough to comprehend--and usually unimportant--until problems start to show up, like divorce, death, and taxes. Agents can better serve their clients by informing them of potential legal and taxation issues tied to the type of ownership of their real estate. Take care to stay in your lane, unless you are an attorney or accountant. However, it's vital to the client since ownership is something to pay attention to. In this episode, we'll talk about different forms of real estate ownership and the issues that each can bring.   SHOW NOTES 00:35 – Is B hopped up on caffeine? Two key pieces: Separate interest, owners can do what they want with their interest in the property. 10:25 – Ability to split ownership into any percentage. Cate eats Twix bars. Debate over the right or left side. 11:35 – If client does not decide how to split the percentage ownership, equal ownership is automatically set. 11:55 – Cate: you do this with the title company. Communicate to the title company and the deed is drafted. 12:25 – Cate’s Side Note Tangent: Working with investors and experiences. Cate has fleas. Cate is a belly dancer apparently. Dealing with squatters. Have not found a dead body…yet. 16:22 – Email from Sally in San Diego: Please get to joint tenancy. 16:50 – Joint Tenancy w/ Right of Survivorship: the last person living gets full ownership of the property. 17:38 – Cate: as people pass, the interest is absorbed by the remaining owners. 18:04 – Joint tenancy does not allow owners to take an unequal percentage share. Owners must have an equal percentage ownership. 18:59 – Anyone can use joint tenancy but be careful who you choose as a co-owner. If you pass, your co-owner gets all the property. Is that what you want? 19:20 – Cate: Parents and a child own property might be a way to eliminate probate but be careful of other issues such as taxes. 19:48 – The right answer is to what form of ownership is based upon an informed client’s decision. They each have their pros and cons. Make sure your clients know to choose wisely. 20:30 – Bobby from Walla Walla Washington has a question: please tell us about Tenancy by the Entirety. 20:57 – Similar to joint tenancy but reserved exclusively for married couples. Some states recognize marriage as a legal union of two people into one. Two physical humans, but one legal entity that is inseparable. 21:39 – Cate’s example from earlier. Ownership shifted from Tenancy by the Entirety to Tenants in Common. 22:44 – Get advice from attorneys and accountants. There are legal concerns but also taxation and liability concerns with ownership. 23:54 – Probate issues can be affected by the type of ownership. “What is the title of Tricia’s next (fifth) book?” Despite her brother’s teasing, Tricia came to this podcast ready to present the new title of her new book in this episode!  The new title is, “This Book Is For You!”  Subtitle: Loving God’s Words in Your Actual Life. Tricia describes the book as ideal for anyone who has ever thought the Bible is boring, or anyone who honestly admits, “I know I’m suppose to like the Bible, but I just don’t.”  She describes the purpose of this book as being about “falling in love with the Bible in your actual life. It’s about the reality that you don’t have to be a monk or nun, or one who can step away to a place of enlightenment or a person of great discipline, or a person who isn’t in the carpool lane late and doesn’t have mismatched socks on her kids!”  The theme of this book is to help us learn what the Bible really says and how it still very much applies in this century, this place, and in our “actual lives.” Tricia talks about living according to what the Bible teaches with an awareness that sometimes we have gotten it wrong; we make assumptions or believe very strongly about things that we believe are important, and yet, we may not learn until later in our lives that, actually, we were wrong.  It has happened many times in history among Christ-followers who thought they were doing what God wanted.  What would happen if we open our minds as we read the Bible and ask God to be “the Lord over our ignorance?” When we are sure we are right but we might be wrong…what should we do as people who follow Jesus in a world that is filled with opposition? Tricia advises taking these steps: (1) be still and listen, and  (2) lead with love, knowing there’s a chance we might find out some day that we were wrong about what we thought was right!   “We have one job. She graduated from Middlebury with a BA in biology, but was "too busy playing rugby to focus on grades." The year after she graduated she worked as a river guide on the Snake, then quickly started working for Outward Bound. In 1987, she started ski patrolling in Idaho, and by 1989 she was guiding on Mount Rainier. She guesses that she was the fourth or fifth woman hired on the mountain, and soon she was guiding big mountains in Mexico and Alaska, too. In 2002, Emily Johnston was a mountain guide, ski patroller, and 39 years old. And she started her first year of medical school. After she graduated from medical school (at age 44), Johnston completed her residency at the Oregon Health & Science University (OHSU) in Portland. During her residency, she did medical work in Nepal and the Republic of the Congo. She also designed and conducted a research project on Denali, where she measured the effects of carbon monoxide in tents where people were cooking. She finished her residency at age 47. Now in her 50s, Emily guides and serves as medical director for International Mountain Guides. She teaches courses on international mountain medicine and advanced wilderness life support, and she consults with the Mount Rainier National Park to streamline their rescue protocol. Within the community, she is affectionately known as the "dirtbag doctor."

John Kitsteiner of Temperate Climate Permaculture joins me to discuss his series of blog posts, The Myth of the Perfect Job. So many of us are stuck in the rat race. We want to be farmers, homesteaders, or something else that involves working closer to home, and not for the man. But we never end up doing that. Why? I think people are either afraid to take a risk and start, or they don't know where to start. This podcast should start to address both of those issues and at least get you thinking. Key Takeaways from this Episode: Be careful of the danger of just pursuing your passion. At the end of the day you have to make a living and get some sort of yield for your work. Balance: Biological, physical, social, spiritual health. Most people focus on one or two areas, not all. Consider this when pursuing a career path. Start looking for a career where your passion and skills overlap. Then start adding in what does the world need (will they pay for it) and does it have meaning to your own life. Think about if a new career is sustainable. Could you do it every day all day for the next 1, 2, 5, 10 years? Along with all of the side baggage that goes with it - accounting, marketing, legal, etc.. A lot of marketing is driven to you to consume more stuff. Often times that consumption is fueled by debt and is filling a void to pursue happiness. Forcing kids into careers. How many people were "forced" down a career path by parents, counselors, and teachers because it "was a good career path." And the you could parlay that career into a life of "success with a big house, nice car, and a whole bunch of bills. Embrace the idea of having a few primary careers, and multiple secondary careers. That creates resiliency and helps to eliminate boredom and burnout. Permie examples - think: Paul Wheaton, Joel Salatin, Darren Doherty, Rob Avis. Permaculture Principle 10: Use and value diversity. "Diversity reduces vulnerability to a variety of threats and takes advantage of the unique nature of the environment in which is resides." [permacultureprinciples.com] Apply this thought to careers and finances. Embrace the diversity to meet your needs and become more resilient. Money is the excuse, but fear it the reality. He transitioned into farming in 2009 with his wife Marina after leaving a career in mechanical contracting.
