   Slam the Gavel welcomes back Carl Roberts to the podcast. Carl was last on Season 5, Episode 12. Carl Roberts is Founder of Colorado Resilience and SplitSmart.     Carl is trying to bring solutions into the divorce/family court process where a case shouldn't drag out for years, but only 30 days. There are so many homicides and suicides that are perpetuated by the Family Court system as well as CPS. Carl shared his ideas on the screen (Slam the Gavel YouTube) that contain solutions. In doing presentations, Carl discussed his ideas and solutions and was met with  silence. The path to restoration, justice and family healing is what Carl has to offer people that are divorcing and it seems the judiciary/family law doesn't want any part of it. Because of lack of accountability, oversight and transparency the court system is in the state it is in.     For instance here are 3 national judicial organizations. Also, everyone should tag relevant state government departments, agencies and policymakers within each. We need to stop just preaching to the choir and to make sure the policymakers are seeing and hearing our pleas for change. You'll have to research each group/person on each platform to see how you can tag them. IAALS (Institute for Advancement of American Legal System) iaals.du.edu, NCSC (National Center for State Courts) ncsc.org, NCJFCJ (National Council of Juvenile & Family Court Judges) ncjfcj.org. There are state departments/agencies such as Colorado Department of Human Resources, Colorado Courts and Colorado Governor, Jared Polis.     We discussed how the one problem is people hiding money and  the second problem is putting the kids in the middle. It's going to take one judge with the guts and authority to solve this equation. It just takes ONE to make it happen. Family court is a CRAP SHOOT. It all revolves around MONEY. Why would someone with decades of experience as a family law attorney and family court judge choose to pursue training as a divorce coach? We invited Chandlee Kuhn, a student in our current cohort, to share her perspective and give you some insights.Chandlee J. Kuhn is the retired Chief Judge of the Family Court for the State of Delaware. Chief Judge Kuhn recently joined the Family Law Advice Center (FLAC), a limited representation law practice. In her legal role, Judge Kuhn evaluates legal matters and advises clients regarding their Family Court matters.  She also coaches her clients to navigate the ups and downs of the legal process and life after Family Court. Judge Kuhn is a Certified Mediator for the Delaware Family Court and the Delaware Superior Court and has devoted her career to serving the community through numerous local and national boards and organizations, including as a Director of the National Council of Juvenile and Family Court Judges, the Executive Committee of the Supreme Court of Delaware, the Delaware Court on the Judiciary, the Child Protection Accountability Commission, the Domestic Violence Coordinating Council, and the Criminal Justice Council of Delaware.Those are some serious credentials, so we had to ask ... why divorce coach training? Not only does Chandlee have a love of learning, but as she transitions her work with clients to a limited law practice that doesn't litigate, she wanted to have the ability to both approach her cases from a new perspective and market her practice differently.As an attorney, she is used to giving advice and telling clients what to do. She says one of her biggest AHA moments so far has been that in divorce coaching we teach our clients to navigate for themselves. She's looking forward to letting the client lead their own journey of self-discovery and trust that they have their own answers.Chandlee was attracted to the DCA certification program because we are aligned with the ABA definition of divorce coaching as a method of alternative dispute resolution. Judge Katz is the President of the National Council of juvenile and Family Court Judges (NCJFCJ), and is the Presiding Judge in the Essex Vicinage of the New Jersey Courts.     The NCJFCJ's mission is to provide all judges, courts and related agencies involved with juvenile, family and domestic violence cases with the knowledge and skills to improve the lives of the families and children who are seeking justice.    Judge Katz was appointed to the Superior Court of New Jersey in 2008. Judge Katz is also chair of the New Jersey Supreme Court's Family Practice Committee and the Conference of Presiding Family Judges and in that capacity, he has served as a member of the New Jersey's Judicial Council. Kathleen Stewart Richey became the Director of Louisiana CASA in May, 2015.  She began her career as an attorney representing children in child dependency and delinquency matters.  During this time she served on the Children's Code Project Committee which drafted the Louisiana law regarding children's issues.  In 1991, she became the first Juvenile Judge in East Baton Rouge Parish, where she served until 2015.  During her 24 years on the bench she was instrumental in establishing Capital Area CASA and was named Louisiana CASA Judge of the year in 1997.  Additionally, she was appointed by the Louisiana Supreme Court to the Court Improvement Program Advisory Committee at its inception in 1994 and has remained active with the Court Improvement Program to the present time.  Judge Richey is a member of the Louisiana Council of Juvenile and Family Court Judges, serving as president of the Council in 2001, and chairman of the Liaison Committee with the Department of Children and Family Services from 2001-2008.  Judge Richey has been appointed to numerous legislative task forces, most notably the Legislative Task Force on Legal Representation in CINC Matters, which created the Child Advocacy Program in Louisiana.  She served on the Juvenile Justice Advisory Board, the Juvenile Underage Drinking Enforcement (J.U.D.E.) Task Force, the Audubon Girl Scout Council Board of Directors, the Baton Rouge Bar Association Teen Court Committee and the Baton Rouge Bar Association Pro Bono Committee.  Additionally, she has been a trainer for1) the National Council of Juvenile and Family Court Judges, 2) the Louisiana Council of Juvenile and Family Court Judges, 3) the Louisiana Judicial College, 4) the Pelican Center for Children and Families 5) the Office of Juvenile Justice and Delinquency Prevention, and 6) the Louisiana and Baton Rouge Bar Associations.  Judge Richey has been honored by receiving the YWCA Woman of Achievement Award, the Louisiana CASA Judge of the Year Award, the LSBA Children's Law Award, the Baton Rouge Children's Coalition For the Love of Children Award, and the Catherine D.       Slam the Gavel welcomes Michael Sayen, Author, back on the show to discuss, "Why we can't get along," Coverture, Feminism and Contract Law. History was discussed in-depth from the Magna Carta in 1066 to present time, the Leviathan principle, where the King was supreme and how that converted to, "WE THE PEOPLE."     Family Court pits parents against one another even though one parent filed for "No-fault divorce" and usually does not report Domestic Violence and Child Abuse to the police.  Instead, Family Court Judges bypass the criminal system and the jury. Family Court judges do not want to prosecute abuse and neglect as a crime, because they do not have faith in the criminal system or they fear that a parent will be found innocent and the parent uses the verdict as leverage for shared custody.      Personality Disorders play a role as Judges will give the children to the parent who looks like them, talks like them and behaves/dresses like them. The courts do not believe the woman who is honestly frantic for the safety of her child/children but instead tend to believe the Narcissist. The discussion continues on the Best Interest of the Child and how that supersedes Parental Rights. This is in fact destroying not only our nation, but the world as a whole.     Michael explains how Parens Patriae allowed for the government to gain control over our children while disregarding the rights of the parents. Family Court Judges have the power to bypass the criminal system and the jury. Family Court judges do not want to prosecute abuse and neglect as a crime, either because they do not have faith in the criminal system or they fear that a parent will be found innocent and they will be forced to give custody to both the parents. Personality Disorders such as Narcissism play a role as Judges will give the children to the parent who looks like them, talks like them and behaves/dresses like them. The courts do not believe the woman who is honestly frantic for the safety of her child/children but instead believe the Narcissist. The discussion continues on the Best Interest of the Child and how that supersedes Parental Rights. This is in fact destroying not only our nation, but the world as a whole. Michael explains how Parens Patriae allowed for the the government to gain control over our children while disregarding the rights of the parents. Tuesday, March 16, 2021, Court Leader’s Advantage Podcast Episode The Coronavirus has created a crisis in America’s jails and prisons. Many of these facilities have become COVID hotspots. Although sometimes overlooked, the pandemic also poses an enormous risk for juveniles who are detained. It is surprising to learn that, according to the Annie E. Casey Foundation, there were actually more young people in detention in December of last year than in April when the pandemic was new. And a greater proportion of those young people were Black and Latino. To investigate this alarming situation, Drexel University and the National Council of Juvenile and Family Court Judges have come together in a new project to 1) research juvenile risk assessment, risk reduction, and judicial decision-making during the pandemic; 2) develop a research-based plan to safely lower the numbers of young people confined in juvenile facilities; and 3) use that plan to motivate decision-makers to safely reduce the number of confinements, and therefore help manage the virus. · How can we benefit from the research these experts are conducting on judicial detention and placement decisions in the time of COVID? · How will this project change juvenile justice both during and after COVID? · What lessons have we learned and what advice do we have to share? About Our Panelists: The Honorable Gayl Branum Carr is a Judge on the Fairfax Juvenile and Domestic Relations District Court in Fairfax County, Virginia. She was appointed to the bench in 1994. She received her Juris Doctor from the University of Richmond School of Law in 1987 and her Bachelor of Social Work from Virginia Commonwealth University in 1984. She is a Board Member of the National Council of Juvenile and Family Court Judges. Prior to her appointment to the bench, Judge Carr served as Fairfax County Assistant County Attorney where she was responsible for prosecuting civil cases involving child dependency matters. She previously served as President of the Virginia Council of Juvenile and Domestic Relations District Court Judges and Secretary, National Association of Women Judges District 4 among other leadership positions she holds in the community. Dr. Naomi Goldstein is a Professor of Psychology and Co-Director of the Law and Psychology Program at Drexel University in Philadelphia. Dr. Goldstein collaborates with community stakeholders to use social science research to improve juvenile justice policy and practice. Her work centers on the role of adolescent development in legal settings, and the development, implementation, and evaluation of best practices in juvenile justice contexts. She currently focuses on cross-systems work to dismantle the school-to-prison pipeline, reform juvenile probation systems, and reduce racial and ethnic disparities within the justice system. Bob Bermingham is Director of the Court Services Unit at the Fairfax County Juvenile and Domestic Relations District Court. He began his career in juvenile justice in 1986 as child care specialist in the Fairfax County Juvenile Detention Center. During the past 30 plus years Bob has served in many different capacities within the juvenile justice system in Fairfax County. During his tenure Bob has held management positions with probation services, served as the County’s first Gang Prevention Coordinator, and since 2009 has served as the Court Service Unit Director of the Commonwealth of Virginia’s largest Court Service Unit.

 Vincent C. Crawford currently serve as the Chief Judge of Dekalb County Juvenile Court. He also sits by designation in Superior Court. He graduated with honors from Florida A&M University in 1987 with a bachelor's degree in Political Science.  He received his law degree with honors from Mercer University in 1990. On April 4, 2020 he was inducted into the Florida A&M University College of Social Science, Arts and Humanities Alumni Gallery of Distinction. He started his legal career as a staff Attorney for Georgia Legal Services from 1990 to 1993 representing women in that were victims of domestic violence in divorce proceedings.  In 1993 he made career change and was appointed Deputy Chief Assistant District Attorney for the Augusta Judicial Circuit. During his tenure in Augusta he was the Assistant District Attorney in charge of prosecuting violent crimes with multiple defendants. In 1995 he moved to Atlanta and served as an assistant District Attorney for the Stone Mountain Judicial Circuit. In 1997 he became a solo practitioner in the areas of criminal, domestic and juvenile law. On February 27, 2005 he was appointed to the position of Associate Magistrate Judge for the Stone Mountain Judicial Circuit.  On March 24, 2006 he was appointed to the position of Juvenile Court Judge where he currently.   He is currently a member of the Georgia Council of Juvenile Court Judges, the National Council of Juvenile and Family Court Judges and the American Judges Association.  He is the past President of the Dekalb Lawyers Association and a member of the Dekalb Bar Association. Judge Crawford has received several awards and recognition for his commitment to the youth in Juvenile Court as well as the community, such as a Romae T. Powell Award, the DeKalb County Juvenile Court Service award, the Multi Agency Alliance for children the “Shining Star Award” for his work with children in foster care, and the “Recognition of Outstanding Leadership Award” for his work in the community from Jack and Jill of America, Inc. among many more. In 2016 Judge Crawford as the appointed Chairman by the Georgia Supreme Court for the Georgia Court Improvement Project. He was the only Judge in the United States to be invited as a guest speaker to the White House by then President Barack Obama. Judge Crawford is a member of the National Council of Juvenile and Family Court Judges and the American Judges Association. Judge Crawford as a hobby serves as the Chairman and Head Judge in Georgia for the National Judge for the National Physique Committee (NPC). He is also a Judge with the International Federation of Bodybuilding (IFBB).

What Works in Public Safety: Juvenile Justice Grounded in Youth Development

Judge Patricia Martin speaks on juvenile justice at the 2011 What Works Conference held Dec. 9, 2011 in Portland, Oregon. Judge Martin is President of the National Council of Juvenile and Family Court Judges. Judge Martin is a member and past chair of the Supreme Court of Illinois Judicial Conference Study Committee on Juvenile Justice and a member of the Illinois Supreme Court Special Committee on Child Custody Issues. Judge Martin received her education at the University of Nairobi, Kenya, Middlebury College in Middlebury, Vt., and Northern Illinois University College of Law. We have seen flat fees being used by some family lawyers, mediators and Certified Divorce Financial Analysts. These professionals remain to be the minority. While the marketing benefits of the flat fees approach is little bit more certain, most professionals are concerned about how to make it work and what might some of the downside be. This month's TeleSeminar is an exploration of the advantages of charging flat fees rather than billing hours. Our guest speaker, Lee Rosen, has employed fixed fees exclusively in his 10-attorney practice for more than a decade. He will explain how, in his view, the hourly billing model doesn't work anymore for family lawyers. It drives practices in directions that make for unhappy lawyers and unhappy clients and that there's got to be a better way. His approach has evolved into to a win-win arrangement for his firm, his lawyers and his clients. In this teleseminar, Rosen will: 1. Explain the rationale for flat fees, 2. Provide practical insight into how he makes it work, 3. Tell the story of how his transition to fixed fees nearly put him out of business, and 4. Explain the practical economics of running a practice without the burden of keeping time records. About Our Guest Speaker – Lee Rosen, Family Law Attorney Lee began his legal career in 1987 and is the founder of the Rosen Law Firm. As Rosen's Chief Executive Officer, Lee oversees strategic planning, staff development and fiscal management. Never idle, he has served as a Council member of the North Carolina Bar Association Family Law Section and Law Practice Management Section, as chairperson of several committees of the American Bar Association, and as editor of Family Forum, a publication of the North Carolina Bar Association. As if that weren't enough, he serves as a member of the editorial board of the Family Advocate, the largest circulation family law publication in the country, and he is a legal advisor to the National Council of Juvenile and Family Court Judges, which included working on the Model Code on Domestic Violence.
