Let's go!” The Trump Administration has openly contemplated arresting Newsom for interfering with ICE's deportation efforts. Videos circulating on social media show ICE agents being assaulted with bricks and commercial-grade fireworks. As the New York Post notes, Waymo vehicles are electric and as they burn, the lithium-ion batteries are releasing toxic gases. At the New Jersey state supreme court, all of the justices seem to get along–even though they maintain a 4-3 partisan split in their ranks. The unique system, based on an unwritten rule that the governor will select justices and maintain a 4-3 balance politically, leads to an extraordinary amount of agreement among the justices. And attorneys like it, too. On this episode of our podcast, On The Merits, senior correspondent Alex Ebert talks about how the New Jersey Supreme Court maintains its system when so many state supreme courts have become partisan battlegrounds, and how attorneys prepare to argue in this unusual environment. On this episode we return to the subject of zoning. With the doors to federal courthouses barred shut, advocates for reforming zoning have turned to state courts and state constitutions. Most famously, in 1975, the New Jersey Supreme Court took a look at a zoning ordinance that made it illegal to build low- and moderate-income housing in the township of Mount Laurel and said in no uncertain terms: enough. But the story of the Mount Laurel doctrine, which calls for municipalities to do their fair share to meet the regional demand for affordable housing, is not all milk and honey. Additionally, we take a look at some current efforts in other states to protect property rights under state constitutions. Click here for Open Fields Conference Click here for episode transcript. A daily news briefing from Catholic News Agency, powered by artificial intelligence. Ask your smart speaker to play “Catholic News,” or listen every morning wherever you get podcasts. www.catholicnewsagency.com - Vatican Secretary of State Cardinal Pietro Parolin arrived in South Sudan on Monday, August 14, to meet people fleeing violence from neighboring Sudan among other activities lined up for his four-day visit to the east-central African country. In an interview with ACI Africa, CNA's partner news agency in Africa, ahead of the visit, the apostolic nuncio in South Sudan said the visit by Parolin is an extension of the “care and love” of Pope Francis to the people of South Sudan. Parolin is visiting South Sudan at the invitation of Bishop Stephen Nyodho of the Diocese of Malakal as a follow up to his July 2022 visit to review the situation of internally displaced persons and those fleeing violence in neighboring Sudan. In February, Pope Francis became the first pope — and the first Western leader — to visit South Sudan. Amid an enthusiastic welcome, more than 100,000 people attended his papal Mass February 5 in the capital city of Juba, during which the pope made an impassioned plea for peace in the war-torn nation. https://www.catholicnewsagency.com/news/255093/vatican-secretary-of-state-to-meet-refugees-from-sudan-in-four-day-visit-to-south-sudan The New Jersey Supreme Court on Monday unanimously upheld a Catholic school's ability to enforce an employee code of conduct in line with Catholic moral teaching and to fire teachers for violating that code. The ruling in Victoria Crisitello versus Saint Theresa School further solidifies the ability of New Jersey religious schools of all types to enforce moral codes of conduct in line with their religious practice. In its ruling, the New Jersey Supreme Court wrote that “the religious tenets exception allowed St. Theresa's to require its employees, as a condition of employment, to abide by Catholic law.” Peter Verniero, counsel for Saint Theresa School, told CNA that “this is a significant validation of Saint Theresa School's rights as a religious employer.” https://www.catholicnewsagency.com/news/255094/new-jersey-court-rules-catholic-school-can-require-teachers-to-follow-catholic-teaching Honolulu Bishop, Larry Silva, visited the town of Lahaina Tuesday to celebrate Mass and meet survivors of the wildfires that he said “shockingly devastated” the town. While the scope of the crisis has been “overwhelming,” the response from the local community has been “remarkable,” the prelate told CNA. Silva's bishopric encompasses the entire state of Hawaii, including Maui, the second-largest of the Hawaiian islands and the third-most populated. That island has been ravaged by wildfires this month, with at least 99 lives lost and major buildings and communities burned and destroyed. The bishop told CNA via email that he celebrated Mass at Kapalua, Maui, on Sunday for about 200 Catholics gathered there. Law enforcement, including the National Guard, are keeping guard over Lahaina, the bishop said. Silva urged visitors to the diocesan website to donate to the Hawaii Catholic Community Foundation to “support the relief efforts for our fellow community members affected by the Maui wildfires.” https://www.catholicnewsagency.com/news/255092/honolulu-bishop-details-shocking-devastation-on-maui-after-visit-to-lahaina Today, the Church celebrates the feast day of King Saint Stephen of Hungary, the monarch who led his country to embrace the Christian faith during the 11th century. In 1038, on the feast of the Assumption of the Virgin Mary, Stephen delivered his final words to leaders of the Church and state, telling them to protect and spread the Catholic faith. Stephen of Hungary died on Aug. 15, 1038. He was buried alongside his son Saint Emeric, and the two were canonized together in 1083. https://www.catholicnewsagency.com/saint/st-stephen-of-hungary-565

We set business goals at the beginning of the year with every intention of meeting them. But life can get messy and this year things got VERY messy. In today's episode I am going to teach you three strategies you can use to get your business back on track. These are concrete strategies that you can not only use right away but you can work on RIGHT NOW as I outline them for you. In this episode we discuss: What to do when you find yourself off course from making your goals due to unplanned challenges out of your control, such as covid. The importance of knowing your numbers when evaluating your business. How your reaction to unplanned challenges can impact business outcomes. Taking personal responsibility for your choices as they influence and contribute to outcomes going forward. Owning control over the things that you can control. Taking stock of your mental health and mindset. Asking yourself how you have maintained or changed your standards to adjust to a changed workplace. The impact PPP loans may have on your tax bill due to be paid next year. How there's still time for an amazing fourth quarter with the right course corrections. Bio: Allison C. She received her B.S., magna cum laude, and her M.S., summa cum laude, from Florida State University. She received her J.D., cum laude, from Syracuse University College of Law. Snip-Its: 00:17:21 (47 Seconds) Almost instinctually, we go to the mindset of if something is happening in the external world, we have no choice but to accept the ramifications of that in our law firm. And many times that is not true. Many times we are making choices that have adverse consequences for our business and if we were to make a different choice, the consequence would be different. And so you have to start thinking about what exactly is the cause of the current circumstance that you're experiencing in your business, whether it's an uptick or a downward slide in business. Where did that come from and what are all the pieces that contributed to that so that you can start making different choices to change the outcome that you're experiencing. 00:35:57 (43 Seconds) There are ways for you to keep the standard the same in terms of production, but allow for some modification of what will actually be produced, meaning if I don't have the work to give to a client, I could give the work into a marketing initiative or I could give the work into a system for the firm, or I could give the work into, you know, pouring into the cultural morale, depending on how high your standards are. Ultimately, that will dictate whether or not your standards should be modified. But if there's a modification, the modification should be a revamping of your structure and it ought to have very clearly defined parameters around it. It should not be simply a wholesale walking away from the standards that you created. 00:41:31 (19 Seconds) But your goal is to be fully educated and to make decisions that are best for your business based on your business metrics and separating your emotional connection to those decisions from the analysis. And this is where taking stock of yourself and why you are doing what you were doing is very important.

Meg and Jeff Horn, Toms River, NJ family law attorney and host of The Bold Sidebar, continue their discussion of 2021 New Jersey Supreme Court decisions. In Episode 2 in this series, Meg and Jeff discuss State v. Kanem Williamson, a unanimous May 10, 2021 decision in which the NJSC upheld the admissibility of the victim's video-taped non-verbal identification of Williamson as the person that shot her 11 months before she died from “complications of multiple gunshot wounds”.
Meg and Jeff Horn, Toms River family law attorney and host of The Bold Sidebar, continue their discussion of 2021 New Jersey Supreme Court decisions. In Episode 3 of this NJ law podcast, Meg and Jeff discuss several cases dealing with New Jersey motor vehicle statutes prohibiting license tag frames that conceal a portion of the license tag and New Jersey motor vehicle statutes prohibiting tinted windows, in terms of when the police can lawfully stop a driver who is violating these laws. In the consolidated appeals of State v. Darius J. Carter and State v. Miguel A. Roman-Rosado, the New Jersey Supreme Court decided to narrowly interpret NJSA 39:3-33, which makes it illegal to have a license plate frame that conceals any part of the tag. Earlier this year the New Jersey Supreme Court granted cert in State v. David L. Smith, a case dealing with NJSA 39:3-74 and -75, the law prohibiting tinted windows. We are anxiously awaiting the Court's decision next year on this issue Although these motor vehicle statutes may seem minor, a stop due to a violation of them may have grave consequences due to the domino effect of a subsequent search and seizure of alleged contraband on the person or on the vehicle of the driver.
Meg and Jeff Horn, Toms River family law attorney and host of The Bold Sidebar, continue their discussion of 2021 New Jersey Supreme Court decisions. In October and November 2021, the New Jersey Supreme Court granted cert in two cases dealing with Miranda and the admissibility of a defendant's statement to police. In State v. Jamal Wade, the Court agreed to address the question of whether the defendant, who contends that he was not informed of the nature of the charges against him or that he was under arrest, knowingly and voluntarily waived his Miranda rights. In State v. Abayuba-Rivas, the Court agreed to address the question of whether the suppression of the defendant's statement to police due to a violation of his right to counsel requires the suppression of defendant's later statement to the police made the following day. Meg and Jeff discuss these relevant Miranda decisions and the Court's willingness to grant cert to protect an individual from implicating himself when the police have violated his rights. If you enjoy NJ law podcasts... please rate and subscribe anywhere you listen.
Meg and Jeff Horn, Toms River family law attorney and host of The Bold Sidebar, continue their discussion of 2021 New Jersey Supreme Court decisions. In State v. Steven Bookman, the New Jersey Supreme Court granted cert to address the issue of whether it is permissible for police officers to enter a third party home under the hot pursuit doctrine when they are chasing someone in an attempt to execute an Automated Traffic System warrant and the person flees. Meg and Jeff wrap up their 5-part series on 2021 New Jersey Supreme Court decisions by reviewing State v. Gabriel Garcia in which the New Jersey Supreme Court admonished a prosecutor for exploiting an evidentiary ruling favorable to the State, thereby presenting a false narrative during his closing argument. Justice Albin sternly reminded all prosecutors that they are “required to turn square corners - because their overriding duty is to DO JUSTICE.”
In this series, Meg and Jeff Horn, Toms River, NJ family law attorney and host of The Bold Sidebar, discuss highlights of several 2021 New Jersey Supreme Court decisions and cases it has agreed to hear in 2022. First up in Episode 1 is State v. Lodzinski. On October 6, 2021, in a stunning and highly unusual decision, the New Jersey Supreme Court agreed to reconsider its May 2021 decision affirming the conviction of Michelle Lodzinski for the murder of her 5 1/2 year old son in 1991 after his disappearance from a carnival in Sayreville - a crime that she wasn't charged for until 2014.
Join us for a conversation with top New Jersey trial lawyer, Edward Capozzi, author of the best-selling Trial Guides book, The Domino Theory. Ed describes how his upbringing in a blue collar family and background as a front man for a rock band readied him for the world of trial law. Ed talks about how he began trying the most difficult "no offer" cases and honed his approach and skills by trying more than a dozen jury trial a year for more than decade. His insight led him to develop the "Domino Theory," and approach to litigating and trying a case that allows the lawyer to envision each building block of the case as a separate "domino," and culminating with a hands-on demonstration in which Ed uses individually crafted dominos tailored with the issues in each case and literally builds the case in front of the jury at the end of his closing argument--and then lets the dominos fall. The dominos show the jury the proximate cause and damages elements of the case and serve to rebut comparative fault defenses. Listen as Ed walks us through this unique and effective approach.About Edward CapozziOne of New Jersey's most renowned and dynamic personal injury attorneys, Edward P. Capozzi exclusively handles auto, trucking, NJ Transit, products liability, and other catastrophic personal injury cases. He has successfully represented seriously injured clients in New Jersey, New York, Pennsylvania, North Carolina, Michigan, West Virginia, Florida, Massachusetts, Virginia, and Delaware. Edward is certified by the Supreme Court of New Jersey as a civil trial attorney. The New Jersey Supreme Court has designated this honor to attorneys who are able to demonstrate sufficient levels of experience, education, knowledge, and skill in civil trial practice.Known for his fierce cross-examination of medical witnesses and artistic presentations of his cases, Edward lectures across the country on trial techniques and the concept of proximate cause.Edward is the author of The Domino Theory, a Trial Guides publication in which he explains proximate cause and shows other attorneys how to successfully present any case to a jury. In his popular YouTube video, “Capozzi Causation Dominos,” Edward demonstrates, step-by-step, how to set up each element from discovery to settlement to opening statement to arguing damages in closing – when you knock down your dominos and demonstrate the inevitable logic of your case.Edward is an active participant, advocate, and educator in the field of law. He is a published author and lectures nationally on trial techniques and cross-examination of defense medical experts. In 2014, Edward received the New Jersey Law Journal's Personal Injury Hall of Fame Award for receiving the largest verdict in the state in a products liability case and from 2012-2018 received at least one, and as many as three, of the state's top 20 verdicts or settlements. In 2018, Edward had one of the top 50 work accident settlements in the United States, according to TopVerdict. He is recognized by the New Jersey Law Journal as having the top personal injury settlement in an auto case for 2017.
