False allegations should be held as perjury and shared custody should be the initial starting point; the burden of proof should be on why that cannot be the case. A 2019 study by Child Law Practice showed that 70% of false abuse allegations are made during family court custody disputes, demonstrating the dire need for reform.Family court restructuring is not just a matter of justice system transparency but also critical to protect the rights and well-being of the children involved. The Psychological Association has highlighted that children fare better in shared custody arrangements, making it crucial to make this the default presumption.If we believe in fairness, in protecting our children, and in the essential role both parents play in a child's life, then we must call upon our representatives to enact meaningful change in our family court systems. For those of you dealing with post separation abuse and the family court system this episode is for you.How can you live your life accepting or stomaching the decisions made by a judge or evaluator that you know in your heart is not in the best interest of your children.How do we just accept that our systems are unjust when it is negatively affecting our babies? Hopefully these strategies will be a place you can start.Focusing on what is in your control vs what is not in your control.  In this system and situation there are SO many things outside of our control.  Focusing on the things we can control will give us a bigger bang for our buck than sharing focus with things outside of our control.Ask yourself these questions:Can you be at peace with your efforts to protect your children?Can you be at peace with your effort to heal yourself so you can be the best parent for your children?Focusing on effort vs focusing on outcome can be a helpful perspective.Be present with your children when you are with them.  Give them the unconditional love that will carry them through all of the challenges they will experience.Think back to positive times with your child(ren).  If you have had your children taken from you, this can be excruciating and healing all at the same time.  Children will have benefited from your attachment and love from the past even if they are not getting it directly now.  Remember how you have positively impacted them in the past.Compartmentalization: Give yourself time where you can think about things, vent about things, do your research and then set up times where you put this fight away and put it on the shelf.  It's important to not solely avoid it because avoidance will increase your trauma symptoms and it is not helpful to be in it all the time because then you cannot focus on anything else.  Find your tribe.  Put as many safe people around you where you can share the struggle and allow you to hate the injustice and speak to it so that it doesn't constantly come out when you don't want it to.Depending on where you are in the healing process, can you speak out or work towards greater change?In this FREE webinar, we will teach you 5 key strategies for creating a loophole-free parenting plan to set yourself up for success -- protecting yourself and your children and limiting your ex's pathways back to court. In response, a group of social reformers embarked on a mission to protect children and mold them into productive, law-abiding citizens. Known as child-savers, these overwhelming white and well-off reformers laid the therapeutic foundation for family court. At its core was the Great Idea that judges would take the lead and provide, whether preventive or rehabilitative, personalized justice for the child. “This mandate to do good was never accomplished, not then and not now,” states Jane M. This week's episode of The 1 Girl Revolution Podcast features the amazing Tina Swithin, founder of One Mom's Battle. In this episode, Tina shares her inspiring life story and talks about growing up in the family court system; how as an adult she suffered trauma and abuse from her narcissistic ex-husband and how she ended up back in the family court system with her own family; how One Mom's Battle came to be and how it's evolved to become a hub for parents and children who are caught up in the family court system worldwide.  One Mom's Battle started out as a blog that Tina started to share her own experiences as she navigated through her own divorce and the family court system. Tina acted as her own attorney in the high-conflict custody battle that turned her family's life upside down (which lasted for over a decade) and she quickly learned that divorcing a narcissist or another high-conflict individual escalates family law cases to levels that few can comprehend - and she realized by sharing her own experiences and resources, that she could help others.  Tina's plight grew from just one mom (herself) to a village of tens of thousands who all share the same story - through One Mom's Battle. There were different variations and nuances, but the common denominator is toxic, high conflict individuals and post-separation abuse. Tina has chosen to assume the title of survivor versus victim and has become an advocate for change in the Family Court System after seeing the flaws first-hand. Tina believes that the courts have lost sight of their primary focus, which should be the best interest of the child and instead, are too focused on parental rights. Tina believes that children are suffering unnecessarily due to the lack of education on the front lines—and behind the judicial bench.   One Mom's Battle is the intersection of narcissistic abuse and child custody issues; with a mission to raise awareness and educate family court professionals on post separation abuse as it relates to co-parenting and the family court system (divorce, paternity and child custody battles). Education on high-conflict individuals and post separation abuse allows family court professionals (Judges, Commissioners, Magistrates, CPS workers, Guardian ad Litems (GAL), Parenting Coordinators (PC), Custody Evaluators, therapists and attorneys) to recognize the abusive dynamics that play out in the family court system so they can make decisions that are in the best interest of children. The first book—Loving Men, Respecting Women: The Future of Gender Politics—was published in 2011 and is available on Amazon.com. The second book—Equal Partners: The History of Gender Equality—is due out in 2023. He has also created a series of YouTube videos under the umbrella title of “Man Against the Wall.” He was last on the podcast Season 4, Episodes 32,58 and 80.      We had a great discussion on how it all balances out between men and women. Some arguments are that it doesn't balance out and men have more power and women are victims and vice versa. MVP: Most Victimized and Powerless, it goes nowhere and call it even. Another argument is how do you know it all balances out? It's an outlook, a choice. Men are more important than women, and women are more valuable than men. The last argument is that it's an assumption of it all balancing out, creating a new beginning.      We discussed naïveté  and how there are more personality disorders prevalent today than years ago and how there is a correlation to steroid abuse to anorexia. These things mirror each other and there is a need for gender politics to equal it out.    Gender Equalizes take turns. She has over 24 years of experience and began her career, after graduating from Tennessee Technological University, at RSM International in Washington DC.  After working in public accounting for RSM as an Audit Supervisor Leisa left public accounting to work for Stanley Associates as an Accounting Manager.      While at Stanley Leisa successfully assisted in taking the company public on the NYSE with their IPO in October 2006 raising over $80 million dollars in capital. Prior to the IPO she assisted in designing and implementing newly enacted legislation, known at the time as Sarbanes Oxley. Her work satisfied the PCAOB, SEC, DCAA as well as the audit teams of both Deloitte & Ernst & Young. Leisa worked through several M&A's and Stanley was later merged with CGI, Inc out of Canada. She returned to her hometown of Cookeville, Tennessee where she opened her consulting practice in 2007 while continuing to work as a federal contractor in Washington DC.       Loftis CPA was a paperless hybrid firm from inception as Leisa worked remotely from DC and occasionally met with her clients in person in Tennessee. Leisa volunteered her time to many local nonprofits as well as gave back to the accounting profession by mentoring local high school accounting students through the TSCPA. One of her student teams from CHS competed internationally in a business plan competition sponsored by Microsoft and won 3rd place for 'Best Business Plan'.  Leisa also chaired a successful mentoring pilot program with the AICPA Young CPA committee.      Slam the Gavel welcomes Deandre Arnold. He is a Father, an Equal Rights advocate for PARENTS involved in Family Court proceedings and potential political candidate. He is the Chief Organizer of a group called the Father's Rights of Georgia as found on Facebook, the CEO of a Youth Group based in Atlanta to educate young adults about the importance of family to counter Motherless and Fatherless-hood as well as alienation of children, including the Founder of a 150 member organization called the United Coalition Family and a self taught scholar on the United States Constitution.      Mr. Arnold's mission is to bring about a uniform transformation of unjust custody and support laws that he feels will save America's FUTURE. This is what we discussed today, which was his own personal plights involving shocking claims of ongoing corruption in the State of Georgia involving local and state level officials including the family court system which he states has resulted in public corruption complaints to law enforcement alleging threats to his safety and security as a result of this corruption.      We also talked about a legislative proposal that he believes will not only put American families first before the states purse/wallet and save the seed-corn of our nation, but to ensure that no other parent experiences or undergoes the type of systematic abuse that he is currently up against...     Mr. Arnold studied law and the constitution and the reasons why he formed the organizations and Youth Groups. He went on to explain how this conspiracy started and his challenge to the constitutionality of state court convictions in Georgia's city courts and all relevant actions. This conspiracy spilled over into a Family Court CUSTODY proceeding  that resulted in the removal of his daughter over the claims of alienation and assault of his child's mother and the falsification of records that would be used to falsely imprison him.     Deandre Arnold's claims are currently pending in Federal lawsuits concerning what he has alleged is a state of created danger and how his legislation would have prevented the WEAPONIZATION of the CHILD SUPPORT SYSTEM and how it can save parents across the United States from the inequitable abuses of the Family Court System. How does Domestic Violence lead to children and women being seriously injured or killed and why is this being overlooked by the courts.    Cases are going on a lot longer than anticipated and it appears that bias is ruling and not the judge. Judges and lawyers are operating inconsistently with bias and unaccountability. Whoever alleges mental illness, Parental Alienation or any other allegation FIRST will win their case. We discussed how lawyers have a role in this too. There is a non-profit agency in California that supports women, but instead refers them to lawyers who don't do much for them. That's why this is a multi-billion industry for the lawyers and Guardian Ad Litems. We talked about remedy such as Family Court could be torn down and rebuilt, as three years in Family Court is ENOUGH and a jury of six could evaluate the case and make the final decision.    We talked about Robert's cases involving a homeless Mother, the case of Terra Schlinger and her attorney fees totaling over  $100,000.00 and how do judges make their decisions. We discussed how CPS puts kids into Foster Care so quickly and adopts them out. "Where is the best interest of the child?" Once a child is out of Foster Care they are out on the streets with no means of supporting themselves or education they are then subject to homelessness. By design it is working brilliantly while destroying the lives of good, fit parents and their children. The perfect extortion scheme.   Lawyers are looking at both sides, figuring out the case. Lawyers want to know how much the case is worth, where exactly is the money and  how do they get their hands on the money.     All it takes is two perfectly normal, reasonable people to end up with a litigious attorney egging one parent on or the opposing attorney not only running interference,  but running the other parent into the ground financially. Lawyers will call out vexatious and litigious. Unfortunately the law is what the judge says it is.      Slam the Gavel welcomes Marta Bryceland, a Nurse Practitioner in the field of Psychiatry and Mother of a legally kidnapped child through the family court system. She has filed for Full Custody against the father based on documented neglect and alienation, which has lasted so long that it has been determined by the forensic psychologist to be an abuse.      Like with many other court cases, her evidence of the abuse of her child has been long ignored by Staten Island Family Court Judges beginning with Judge Janet Mc Farland, through Judge Peter DeLizzo and Supervising Judge of Staten Island Court Helene Sacco.      Marta's child was legally kidnapped from my NJ Court on Jan 6th, 2021 without any evidence or facts of her ever harming her child, having any serious health issues, any criminal convictions or addictions.      All of the afore mentioned judges including Supervising Judge of NY Family Courts Janet Di Fiored have ignored her pleads.      However, Marta is not the only parent in this situation in NY state and in other States. There is a major SYSTEMIC PROBLEM in the United States of children being kidnapped from loving, fit parents by government appointed officials. It is very difficult to fight against these organized crimes as the Courts protect themselves. Most parents become too exhausted to keep fighting while losing all their finances, health, sanity and often their lives by suicide. Marta personally battles depression, PTSD and anxiety.        Attorneys that are supposed to help to fight for justice are actually feeding into injustice. Many parents have gone through 5 or 6 attorneys who are quick to collect retainers but barely put up a fight. They are not fighting for children's best interests. They are feeding into the food chain of the Family Court System.     Finally, if the attorneys make a real attempt to stop this injustice they will not have as much business (and this means less vulnerable customers).      Marta has created non-profit called PARENTS FOR CHILDREN'S BEST INTERESTS. It should be fully running in about a month and Marta is planning, along with other parents whose children were kidnapped, to support those less fortunate.       Family Courts are destroying the target parent's mental health and her goal is to teach other parents to protect their mental health and get appropriate treatment as soon as possible. Marta has recorded a few informational videos on YouTube about how to preserve your mental health during the custody battle and how to file a lawsuit in Federal Court against the judge that kidnaps your children.
