Today's Headlines: A CIA-trained Afghan asylum recipient shot two National Guard members in DC—one fatally—prompting Trump to announce (on his little app) a “pause” on all migration from “third world countries”. The administration is now freezing asylum and Afghan visas while somehow avoiding the question of why the National Guard is still posted in DC at all. Meanwhile, the Trump team is escalating its hunt for “sedition,” with the FBI now interviewing the six Democratic veterans who reminded troops not to follow illegal orders. And in the Department of Defense (War), Pete Hegseth allegedly ordered a second strike to kill survivors of a botched boat attack—something even a few Senate Republicans have decided is maybe a bridge too far. Trump also pardoned former Honduran president and convicted drug trafficker Juan Orlando Hernández, who immediately went home like it was checkout time at Club Fed. On the Ukraine front, Rubio, Kushner, and Steve Witkoff are still trying to spin their “peace plan,” which reporting suggests was always just a giant business deal in disguise. The drama deepened when Zelensky's chief-of-staff Andriy Yermak resigned after a corruption raid and announced he's headed to the front lines. In other news, the families of Americans killed or injured on Oct. 7 are suing Binance for allegedly helping fund Hamas and other militant groups—just weeks after Trump pardoned Binance's founder. Over in Israel, Netanyahu is trying to get a presidential pardon mid-trial because sure, why the heck not. The United States… that's us... We blew up a boat with 11 people in it, then we circled around and we murdered all the survivors.  We have murdered at least 83 in boats… Most of the world understands that is wrong, and we might have stopped murdering the swimmers, which we might all agree is somehow even more reprehensible. But we didn't just decide that was bad yesterday, we always knew that was a bad thing to do. Except of course for Pete Hegseth, who we, or at least some of us, hired to not do an evil job. Hic-seth thought that this was really funny at first but sobered up quickly to transfer the blame to his soldiers. Donald K. Trump doesn't know a "Hegseth", but if you write it at the bottom of the check, he'll pardon him. Juan Orlando Hernández made millions as president, raping Honduras in partnership with El Chapo while creating one of the largest drug-trafficking organizations in the world and was sentenced to 45 years. Oh well. Alina Habba, one of the biggest Trump's lawyers, is out as U.S. Attorney for the District of New Jersey. Sure, Kristi Noem disregarded court orders to send Venezuelans to El Salvador, but that wouldn't be against the law if judges didn't say so. No one needs more ballroom less than Trump and even his architect says so. Do reactionaries just feel left out? Trump has almost reached Jan 6 levels of unpopularity, and Republicans are feeling it. Another Gop seat could be flipped in Tennessee tomorrow, as they plan to redistrict Nashville away. One Republican Senator in Indiana drew the line on Trump insulting his daughter, while another wasn't swayed by swatting and doxxing. and yet another by a pipe bomb. Meanwhile, Troy Nehls of Texas feels now should be when he spends more time with his family.

SERIES 2 EPISODE 200: COUNTDOWN WITH KEITH OLBERMANN A-Block (1:44) SPECIAL COMMENT:  With the news that tomorrow night, debate moderators Danna Bash and Jake Tapper will NOT fact-check Trump in real time, CNN has abrogated yet another journalistic imperative at yet another Trump event offering him yet another step towards imposing a dictatorship on this nation. Oh, ok, says CNN: on the 2020 election, yeah, they'll push back. But otherwise?The moderators “are not participants in the debate. They are facilitators,” said a CNN spokesman. CNN's woeful political director David Chalian – largely responsible for the Trump Town Hall debacle last year – told the New York Times that a live debate “is not the ideal arena for live fact-checking”even as that spokesperson who refused to give their NAME to Axios said that there WOULD be SOME fact-checking of major falsehoods and smaller details on secondary CNN platforms. So they're going to do it, they're just not going to do it where it matters or when it matters. Just to further confess that the decision to NOT fact check Trump's firehose of lies as he makes them, WHERE he makes them, is another principle thrown away to make sure Trump shows up or doesn't batter the network, or both, that SAME spokesman said that Trump's lies about 2020 are “inaccuracies.” WHAT SHOULD BIDEN DO? When Trump says something crazy – about sharks OR the economy OR anything in between – START by saying “Donald Trump is insane. And he's wrong. Here's why.” This is especially true if Trump tries the “are you better off now than you were four years ago?” Emphasize Trump's criminal culpability about Covid. The million dead. The bleach. The putting light in your body. The economic collapse. The fact that in February Trump knew it was airborne and lied to the public for months as Americans died. Say it, Mr. President, say it bluntly: Trump killed a million Americans. There are American millions HE killed for whom there is no question – they ain't better off now than they were four years ago. AND bluntly say that he killed the economy. That the inflation we are finally stopping now is TRUMP Inflation. It's TRUMP COVID inflation. That the president with the worst job records since Herbert Hoover was Trump. That violent crime exploded under Trump. That there were two kinds of criminals under Trump: muggers and murderers on the street… and ex-presidents who tried to overthrow the government. And the most important truth to hit him with – the most important truth to dispel what Brian Beutler dubbed “Trump-Stalgia and Trump-Nesia” – the most important truth to enrage Trump – is the truth that he lost. That he lost the election. That he's a loser. And that instead of taking it like a man, he had other people try to overthrow the government, he didn't even have the guts to go to the Capitol during the coup. Except the margin of error plus the undecided number is 9.  I'll explain the "Keith Number" we should always attach to polling, and why polling was once considered unacceptable for inclusion in American TV newscasts, and how I sat there as an MSNBC executive once ordered Frank Luntz to take two polls or do two focus groups to confirm the predetermined outcome he wanted. Though there WAS one useful "interior number" in that Swing States poll that could augur a Biden landslide. But when the third one exploded yesterday, it finally dawned on me. Trump - using milquetoast seemingly benign surrogates, has already begun to threaten the Supreme Court and especially his three appointees that they had better find in his favor in the "presidential immunity" and 14th Amendment Disqualification cases - or else. Alina Habba delivered a message on Fox yesterday clearly designed for Justices Barrett, Gorsuch, and Kavanaugh, warning them not to try "so hard to look neutral (and) make the wrong call" and that the only "American" verdicts would be those in Trump's favor. This echoed what Maggie Haberman reported last week (and Habba was nice enough to reveal she and Haberman are friends). And it puts in a new light Christina Bobb's boast Tuesday that it doesn't matter even if Trump IS guilty of insurrection: the people will decide who's president. It is muted, but it is a threat of violence and MORE insurrection, being delivered against the Supreme Court. B-Block (16:48) IN SPORTS: ESPN and ABC and Disney have quite the conundrum. Its new supposed savior of the sports network, Pat McAfee, failed to retract, or even apologize for, a statement by football's Aaron Rodgers implying that Jimmy Kimmel was on the Jeffrey Epstein "list." Kimmel already threatened to sue - and that was before the fake screenshots started, and before McAfee said that since Rodgers was only "talking shit" it's not like what he said mattered. Me? I think Kimmel should sue but even better, he should do what Chick Hearn did when he was fed up with his rookie sidekick Al Michaels on the broadcasts of the 1967-68 Los Angeles Lakers. I'll explain.
