Welcome back to another episode of the Third Sub Podcast! In this episode, Alex and Sam are back, as usual, this time to chat all things Vancouver Whitecaps and the Canadian Premier League after another busy weekend on both fronts.  To begin, they take a look at the Whitecaps, who welcomed Carl Robinson, Cristian Dájome, Erik Hurtado and Wayne Rooney's DC United to BC Place, in Vancouver's first home game in a long time after their 7-game road trip.  And after going winless in their last three games to close out their road trip, Vancouver's woes continued in this game, as they drew 2-2 despite leading twice. Arson for Profit Scheme Defeated by RescissionPosted on September 14, 2023 by Barry Zalma Rescission of Insurance for Innocent Misrepresentation of Material Facts See the full video at https://rumble.com/v3hdpj2-arson-for-profit-scheme-defeated-by-rescission.html  and at https://youtu.be/CAarrB84t6E Back in 2001 I examined James E. Mitchell under oath on behalf of his insurer, United National Insurance Company who admitted to misrepresenting material facts when he applied for the insurance. As a result of that EUO and the testimony of the underwriter, United National decided to rescind the policy rather than accuse him of fraud and arson for profit, but still refuse his claim for fire damage and offered to return the premium he paid. Of course, in an expression of “chutzpah” (unlimited gall) he sued only to have the court conclude the rescission was appropriate. In James E. Mitchell, Individually and as Trustee of the Mitchell Family Trust v. United National Insurance Company, No. B170364, Court of Appeal, Second District, Division 5, 25 Cal.Rptr.3d 627, 127 Cal.App.4th 457 (March 8, 2005) the Court of Appeal established a standard for dealing with rescission of an insurance policy.  It concluded that an insurer may, under Insurance Code sections 331 and 359, rescind a fire insurance policy based on an insured's negligent or unintentional misrepresentation of a material fact in an insurance application. Because there was undisputed evidence that the insurer relied upon the misstatements of material facts in the insured's application for insurance, the summary judgment granted by the trial court was affirmed. During the policy period, the building was destroyed by arson. The arsonist, an acquaintance of Mitchell's, perished in the fire. The trial court granted summary judgment. Mitchell purchased the building in February 2000 in the name of his trust. On April 11, 2000, Mitchell's brokers applied for insurance to Debra Messina of Excess & Surplus Lines Insurance Brokers, Inc., an authorized underwriter for United National. Mitchell represented in the application that: the property to be insured consisted of a 3,420-square-foot commercial building; the building was to be used by Mitchell as a “video production studio and offices”; the business to be conducted in the building had $20,000 in payroll and generated $300,000 in receipts; there was no existing insurance on the building; the building had no uncorrected fire code violations; the building had a burglar alarm; and Records & Records & Filmworks, Inc. (later changed to James E. Mitchell) was the purchaser of the building. In fact, the seven representations were false including the fact that the building was subject to a City of Los Angeles abatement order stating that the building could not be occupied without a clearance or repaired without a permit and contained such deficiencies as being open to unauthorized entry, littered with combustible debris, excessive dry weeds or vegetation, broken windows, damaged or missing doors, damaged exterior wall covering, damaged interior wall and ceiling covering, and deteriorated flooring (and no permit had been obtained for corrective work on these deficiencies). Carl Robinson a business consultant with a prospective buyer for the property. Mitchell gave Robinson the keys to the property for the purpose of showing it to the prospective buyer. On November 22, 2000, while Mitchell was in Chicago, Robinson set fire to the building and was killed in the ensuing blaze. AI and Podcasting - Talking to Computers“Branded podcasting was one of the first things that I thought this would be perfect for, and I still personally believe that branded podcasts are one of the biggest untapped opportunities in podcasting because there are just so many companies out there that don't yet have a podcast. And podcasting really is, you know, on the up. Soon it will be ‘you have to have a podcast,' it's not just a nice-to-have, and I think voice technology will spur that on as well. An Untapped OpportunityAs the second half of our interview begins, Carl tells us how Rumble Studio's conversational AI is particularly suited for branded and company podcasts. “Branded podcasts,” he says, “are one of the biggest untapped opportunities in podcasting because there are just so many companies out there that don't yet have a podcast.” We discuss podcasting as a labor of love vs a business necessity as well as the role sound quality plays in our listening habits, and whether there's a happy medium to be found. “If I turn on a podcast,” Carl explains, “and it's at all difficult to listen to I'll just turn it off immediately but I don't think I'll listen to a podcast just because it has fantastic sound quality.” The Human QualityNext, we talk about how software tools like Auphonic and Resound have made professional audio quality easier to attain than ever, and whether over processing might remove something vital and human from the end result. “If you remove the human quality from the voice,” Carl tells us, “that's the same as it becoming unintelligible.” We also take a look at the ease of digital voice transformation and how its misuse could add to our skepticism toward online media. “If nobody believes in the information they're seeing on these platforms,” he notes, “the platforms will die a quick death.” Like a Digital ParrotAs our interview comes to a close, we take a deeper dive into the future of AI, just how authentic it might become, and what that might mean. “If you train it long enough,” Carl observes, “with enough data, it sounds incredible... but it's so far from being sentient it's not funny” He explains how machine learning algorithms work and how, like a digital parrot, chatbots emulate human speech and interaction without truly understanding what it is they're saying. “Those models that you create,” he observes, “don't understand anything that you're saying. He tells us how his career began with voice technology and, as a result, soon segued into podcasting. We discuss his early work with healthcare chatbots at a time when they relied much more on human guidance: as he puts it, "I was one of the many people behind the curtain." Now on to my guest for today, Carl Robinson, founder of Rumble Studio, which offers technology to help podcasters cut down on the time needed to make a show.  Carl studied computer science in England and first worked as a management consultant, then moved to China to found a startup with a friend. They had success with one app but not so much with the other. Carl went back to being an employee, and returned to school to pursue a master's in data science in France, where he still lives.  While doing an internship for his studies, Carl started a podcast that focused on voice technology and AI. Though it was a lot of work, Carl acknowledges that all the conversations he's had with his guests have helped him to better understand the landscape of voice technology and the possibilities for AI. He combined this knowledge with a problem he identified: the amount of time and work it takes to put into creating a podcast. When Carl was approached by an entrepreneur incubator, he jumped at the chance to develop the idea he had for making podcasts more efficient. He joined forces with co-founder, and they developed the technology that became Rumble Studio. This technology allows podcast hosts and their guests to have asynchronous conversations and provides a streamlined solution for recording, editing, and promoting the episode. We also talked about the potential the technology has for helping companies obtain customer feedback, among other possibilities.   Now, let's get better together. Actionable Insights Carl's advice to entrepreneurs is to always be curious and always be learning. His own curiosity and drive to learn helped him connect with people in the industry through his podcast, ultimately helping him see opportunities.  Carl also stresses the importance of being able to see into the future and not just paying attention to the now. The key is finding that innovative idea - and having the guts to follow through with it.  Thinking of starting your own podcast? I offer the advice I was given, which Carl attested was good advice: Do at least 5 interviews before publishing your podcast. I started podcasting when I was doing an internship for this Master's degree, I was doing it in France. Studying machine learning A.I. Tell us about some podcast rain that's happened to you because of your show.  One of the surprising things for me was interviewing two billionaires in one day. How has your podcast helped you to deepen relationships? It made me a speaker, it made me more confident, it led to structure my thoughts, it made me more empathetic as well. Communication skills and the ability to relate to people and continue a conversation. Talk about the startup and how podcasting led to that. I was doing the voice tech podcast and after I finished my internship I kept it going and it grew so doing really well. Because my podcast is all about voice technology, I thought this is really coming along. I looked online and there was really no automated creating a podcast and so that's really where the idea of Rumble Studio came along. Have you leveraged your podcast to build and grow your business?
