La herida invisible del asfalto: cuando la prisión y las indemnizaciones no bastan para sanar un siniestro vial Un profundo estudio ético de la Cátedra Ethos de la Universidad Ramon Llull y la asociación P(A)T revela las carencias del sistema penal convencional y propone la justicia restaurativa como una vía necesaria para reparar el desgarro moral de víctimas y causantes. Para la mayoría de nosotros, un siniestro de tráfico grave no es más que un síncope temporal en la circulación diaria. Una retención en la autovía, un destello de luces de emergencia y, pocos minutos después, el asfalto limpio. El tráfico vuelve a fluir; el mundo debe seguir rodando. Sin embargo, cuando los restos de metal y cristal son retirados, comienza la verdadera catástrofe humana. Detrás de las estadísticas frías —como las más de 300.000 muertes acumuladas en España desde que existen registros históricos— se esconden vidas rotas de forma irreversible, atrapadas en un laberinto judicial que prioriza el castigo sobre la sanación. Un reciente y revolucionario estudio desarrollado por el Dr. Guillem Martí Soler, bajo la dirección de la Cátedra de Ética Aplicada de la Universidad Ramon Llull y en colaboración con la asociación P(A)T (Prevención de Accidentes de Tráfico), ha venido a sacudir los cimientos de la seguridad vial. El informe, titulado «Siniestralidad vial y justicia restaurativa: una vía por transitar», se desvía del código penal para adentrarse en la herida moral, analizando el dolor de las víctimas, la parálisis de los causantes y la incapacidad de la justicia tradicional para recoger los platos rotos. El fracaso del engranaje penal: víctimas reducidas a números «El sistema penal convencional falla a las víctimas porque, sencillamente, no está diseñado para ellas», argumenta el Dr. Martí. Su engranaje interno tiene un objetivo prioritario y casi exclusivo: determinar si se ha violado la ley, dirimir responsabilidades penales e imponer una condena al infractor. En este proceso estrictamente racionalizador, la víctima es tratada como un mero testigo del pasado, una prueba viviente de la que extraer información técnica. Mientras su presente se desmorona, su cuerpo, secuelas y sufrimientos son diseccionados en un frío cálculo matemático de incapacidades y baremos económicos. «Muchos nos decían la demoledora frase de me sentí un simple número», señala el investigador. La justicia tradicional cosifica a la persona afectada y reduce la pérdida de un ser querido a una fría transacción monetaria. Pero la paradoja del sistema tradicional es que tampoco resulta útil para el causante del accidente. Cuando este se enfrenta al tribunal, lo hace bajo un foco cegador. La estrategia de su defensa, diseñada legítimamente para evitar que la condena le llegue al cuello, le impone una coraza de silencio y distanciamiento absoluto. Se le prohíbe pedir perdón o mostrar empatía para no comprometer su posición procesal. Esto congela su evolución ética. El victimario queda atrapado calculando tasas de alcoholemia o años de condena, un cálculo puramente instrumental que bloquea la asunción moral del daño real provocado.La cartografía del dolor: las cuatro necesidades éticas El estudio cualitativo —basado en entrevistas en profundidad con víctimas supervivientes, familiares que han perdido a seres queridos y causantes que han cumplido penas de prisión— identifica cuatro grandes necesidades éticas que la justicia tradicional deja en el desamparo absoluto: 1. La necesidad de reconocimiento No se trata de recibir una indemnización, sino de que la sociedad y el causante validen la gravedad de la tragedia. El informe destaca el doloroso testimonio de Patricia, madre de un niño atropellado mortalmente: «Nadie le dio a los hechos la importancia que merecían». Para ella, el juicio fue un "teatro" donde el baremo económico intentó poner precio a la vida de su único hijo, ignorando el impacto devastador que la pérdida causó no solo en su hogar, sino en todo el entorno de amigos del niño. 2. Rehacer lazos y la "comunidad del secreto "Un siniestro actúa como una bomba de fragmentación intrafamiliar. Elena, superviviente con graves secuelas físicas, confesaba cargar con una profunda culpa silenciosa hacia sus hermanos. El hecho de que sus padres tuvieran que volcar todos sus recursos y atención en cuidarla a ella arrebató a sus hermanos espacio afectivo. Es lo que el estudio define como la «comunidad del secreto»: familias que sufren juntas, pero se distancian internamente para no sobrecargar el dolor del otro.Por su parte, Ariadna, superviviente de otro atropello, relataba que costó años de terapia familiar comprender por qué sus padres seguían llenos de rabia mientras ella intentaba avanzar. «En la familia tenemos que estar perdonándonos cosas continuamente», afirmaba de forma brillante. Cualquier palabra o silencio cotidiano puede reactivar el sedimento emocional del trauma. 3. El deseo de no repetición: multicausalidad bajo sospecha Las víctimas no suelen exigir un endurecimiento de las penas de prisión; lo que de verdad las repara es tener la certeza de que nadie más pasará por su infierno. Sin embargo, esto destapa una red de responsabilidades colectivas que el sistema penal prefiere recortar e ignorar: Gael, cuyo hijo murió atropellado en un entorno escolar sin que mediara delito del conductor, se rebelaba éticamente: ¿cómo hemos normalizado que las calles de nuestros colegios sean tan inseguras que el error de un niño de cinco años se pague con la muerte? Cloe, superviviente de un choque frontal con un camión provocado por un conductor ebrio y adicto que falleció en el impacto, dirigía su indignación hacia la empresa de transportes: ¿cómo es posible que no existieran controles internos ni prevención corporativa que le impidieran ponerse al volante? El propio testimonio de Miguel, un transportista causante de un accidente mortal, confirma esta visión corporativa. Aun asumiendo su culpa individual, denunciaba las condiciones de semiesclavitud de su sector: jornadas sin descanso real, falta crónica de sueño estructural y la presión extrema para acortar plazos de entrega que imponen las grandes plataformas comerciales. Una realidad que salpica directamente a una sociedad consumidora que exige inmediatez a golpe de clic y con envío gratuito. 4. La liberación del perdón El perdón en el ámbito restaurativo no es una imposición ni un regalo para el causante, sino un acto de soberanía de la víctima para recuperar su futuro. Dani, motorista arrollado por un conductor ebrio, lo explicaba así en un documental sobre su proceso: «No es que quiera perdonar; necesito perdonarle para seguir adelante, para quitarme el peso del odio y cerrar una etapa de diez años de reconstrucción». En otros casos, como el de Simó, cuyo hijo murió porque un amigo de la familia se quedó dormido al volante, el perdón se ofreció de forma proactiva al año del siniestro: «La vida te ha dado una segunda oportunidad. Si por mi parte puedo ayudarte...». Para Simó, el perdón fue el motor que le permitió transitar el duelo sin amargura.La paradoja de la prisión: la cárcel no educa la responsabilidad Una de las conclusiones más demoledoras del informe de la Cátedra Ethos es que el paso por prisión no promueve la responsabilización moral del causante. Al contrario, la dificulta activamente a través de tres factores críticos: El cálculo de supervivencia: La dinámica endógena de la cárcel es profundamente autorreferencial. El interno se convierte en un gestor burocrático de su condena. Pasa las veinticuatro horas del día calculando cuántos días le quedan para salir, qué actividades puntúan para el tercer grado o cómo complacer a los evaluadores del centro. Este frío cálculo utilitarista ahoga cualquier espacio mental para la empatía real hacia la víctima.El castigo como escudo autoexonerativo: Se genera un perverso mecanismo mental donde la pena borra la deuda. Es el caso de Sergi, un interno que afirmaba que el mejor tributo que podía hacer a las víctimas era «salir, vivir una buena vida, viajar y disfrutar». Es la peligrosa lógica de: «Como ya he pagado mis años de cárcel, ya he cumplido. Ya no me corresponde responsabilizarme moralmente».El enrarecimiento de los lazos: El caso de Pedro ilustra una paradoja dolorosa. Al recibir terapia en prisión, comenzó a desarrollar sensibilidad y empatía, pero simultáneamente empezó a rechazar las visitas de su madre y hermanos porque ya no sabía de qué hablar con ellos. Cuanto más se acercaba a la asunción moral de su culpa, más incapaz se sentía de sostener las relaciones del presente. La prisión incomunica, aísla y desnutre moralmente al individuo.Justicia restaurativa: una respuesta sin mitos románticos Frente a la frialdad de las celdas y las salas de vistas, la justicia restaurativa emerge como un faro de humanidad. Sin embargo, el Dr. Martí es tajante a la hora de desmitificar este proceso, alejándolo de la idea idílica del abrazo lacrimógeno entre víctima y victimario.«La justicia restaurativa no es un método único ni consiste obligatoriamente en un encuentro cara a cara. Es un conjunto de prácticas flexibles, voluntarias y profundamente acompañadas por facilitadores profesionales», aclara. De hecho, en la gran mayoría de los procesos restaurativos no hay un contacto físico directo. Una víctima puede realizar un proceso restaurativo asombroso centrado en su necesidad de saber o en reconstruir su entorno familiar sin que el infractor participe en absoluto. La clave reside en que el consentimiento es absoluto y puede revocarse en cualquier momento si se detecta que hay riesgo de revictimización secundaria o que el causante actúa por puro interés estratégico procesal.¿Es viable en todos los casos? No, porque requiere la libre voluntad de las partes. Sin embargo, los expertos señalan que las barreras iniciales suelen ser la materia prima del cambio. En el ámbito de la ética aplicada, se sostiene un principio fundamental: cualquier razón inicial para no comenzar un proceso restaurativo (el miedo de la víctima, la culpa del ofensor, la rabia de la comunidad) es, en realidad, una razón poderosa para iniciarlo de forma acompañada.Una cita imprescindible con la memoria El asfalto de las carreteras españolas seguirá cobrándose vidas mientras no abordemos la seguridad vial como una cuestión humana y corresponsable. Para dar visibilidad a esta "vía por transitar", la asociación P(A)T presentará el próximo miércoles 27 de mayo de 2026, a las 17:00 horas, en el Auditorio de la Fundación Mapfre (Paseo de Recoletos, 23, Madrid), el documental "Vías Restaurativas", basado de forma directa en las conclusiones de este informe.Será una oportunidad única para comprender que, aunque el juicio penal termine, el camino hacia la verdadera reparación humana y la reconstrucción de las almas rotas apenas acaba de comenzar.

Hoy la Biblioteca de Hoy por Hoy se convirtió en Bibliobús para viajar a La Pedrera (Casa Milá)  en Barcelona. Ha sido un programa dedicado al año Gaudí, pero también un homenaje a los 25 años de la tercera novela más leída en español tras 'el Quijote' de Miguel de Cervantes y 'Cien años de soledad' de Gabriel García Márquez. Hablamos de 'La sombra del viento' de Carlos Ruiz Zafón (Planeta). Se publicó en 2001 tras una curiosa peripecia del manuscrito que cuenta el editor Enrique Murillo en sus memorias 'Personaje Secundario'  (Trama Editorial). La historia de una novela que se presenta al Premio Fernando Lara, llega tare,  cae en manos de Enrique Murillo y  luego en las Terenci Moix para terminar en las de Fernando Lara que decide que se publique. Una locura, pero no tan grande como su éxito. En estos 25 años se convirtió en un fenómeno global con la venta de 25 millones de ejemplares  desde aquel mayo de 2001. Se ha traducido a 36 idiomas, publicado en más de 30 países. No me extraña que con estas cifras Planeta haya decidido sacar una espectacular edición de 'La sombra del viento'. Pero ojo, que las millonarias cifras que hemos dado sólo son de la sombra que era la primera de una tetralogía que siguió con 'El juego del ángel' (2008), 'El prisionero del cielo' (2011) y 'El laberinto de los espíritus' (2016), todos editados en planeta. Pero el premio gordo del homenaje a 'La sombra del viento' hoy ha sido otro libro. el de nuestro invitado, el periodista cultural y escritor Sergi Doria autor de de 'La Barcelona de Carlos Ruiz Zafón" (Destino) .Ha quedado claro en l conversación de Àngels Barceló y Antonio Martínez Asensio con él que , de todas las barcelonas literarias que existen, la más internacional es la de Carlos Ruiz Zafón ¿es un libro de viajes o una guía? Ni una cosa ni la otra y las dos a la vez, es un viaje a través de  Barcelona con la mirada y la imaginación de Carlos Ruiz Zafón.
