Hello everyone, I've missed you.Due to a confluence of factors which I won't waste time or energy going into here, we had a slightly longer hiatus than I expected, but we are back and I expect the content to be a little more regular going forward.This episode is meaningful for a number of reasons.  First, I bring on my law partner, Bob Gottlieb of Robert C. Gottlieb and Associates, to discuss the issues surrounding the Crumbley case.  Second, while we agree on some of the guideline principles, we do not see perfectly eye to eye on this prosecution.  You asked for more viewpoint diversity and variety.  I deliver.  Third, this is truly a fascinating case because it revisits some of the topics we've discussed in previous episodes, but in a new way.In late November 2021, James and Jennifer Crumbley bought their 15 year old son, Ethan, a Sig Sauer pistol as an early Christmas present.  In Oxford, Michigan, where they lived, this was not uncommon or out of the ordinary.  Ethan took the requisite safety courses, went to the gun range with his mother, had no history of violence, and was not a problem at school.Regardless, a few days after the pistol was given to him as a gift (though still supposed to be locked in a safe by his parents), Ethan brought both the gun and ammunition to his high school, and killed four people.Ethan pleaded guilty in October 2022 to all the charges and was sentenced to life without the possibility of parole as a 16 year old.  But the county prosecutor went on and charged his parents, Jennifer and James Crumbley with manslaughter for their role in facilitating the shooting.  The prosecution argued that the parents knew, or at least should have known, that giving their mentally disturbed 15 year old a gun would result in a school shooting.We tackle the question of when a parent can be liable for the acts of their child, especially if the child has already been found fully liable for those acts themselves, and to what degree a parent needs to be fully aware of what is going on their child's life.  When does negligent parenting become accessory to homicide?Paul and Bob hope you enjoy the conversation.

As James and Jennifer Crumbley awaited sentencing for their conviction for involuntary manslaughter, both sought to avoid jail. Their son Ethan Crumbley is serving life in prison for the school rampage where four were killed and seven others were injured. The gun used was given to the teen as a birthday present by his parents. James, convicted of involuntary manslaughter, asked the judge for "time served" and Jennifer asked the judge to let her serve her time on house arrest in a guest house at her attorney's home. Oakland County Prosecutor Marc Keast has recommended 10-to-15-year jail sentences for both Jennifer and her husband, James. While James was in jail,  damning phone conversations surfaced in which Crumbley had allegedly threatened Oakland County Prosecutor Karen McDonald. In a call from October 9, 2023, five months before the trial, Crumbley says, “Yeah, Karen McDonald, you're going down. … Go ahead, record this call. Send it to Karen McDonald. Tell her how James Crumbley is going to f------ take her down." In a call on December 23, 2023, Crumbley says “There will be retribution, believe me."  The threats were bad enough that Crumbley's jail communication privileges were revoked during his trial.  Neither received the sentence they asked for. Over the years, there had been allegations of abuse by other family members. In March 2024, Veronica was only able to see her children via supervised visits due to the allegations. On March 30, Veronica set out with Jilian Kelley to pick up her children to attend a birthday party.  Jilian was an acquaintance who had been allowed by the court to supervise Veronica's visits with her children.   The two women would never arrive to pick up the children.  Their vehicle was found abandoned in a remote area. Jennifer and James Crumbley were both sentenced to 10–15 years in prison on charges of involuntary manslaughter after the prosecution convinced the jury that the Crumbley's gross negligence enabled their son to commit a mass shooting at Oxford High School in 2021. Sentencing the parents of mass shooters is a relatively new concept for the courts. While the sentencing guidelines for this crime are typically seven years, the actual sentence Judge Cheryl Matthews handed down exceeded those guidelines, opting for a harsher-than-recommended punishment. Criminal defense attorney Jonna Spilbor joins the podcast to break down how this case marks a shift in standards for punishing guardians of mass shooters, why she feels that this case should not have been taken to criminal court, and shares her fears that this ruling will be a legal slippery slope. U.S. Secretary of Homeland Security Alejandro Mayorkas is set to become the first cabinet member facing impeachment in over 100 years. The move has been met with enthusiasm from Senate Republicans. Now, it faces an unlikely path forward, with Senate Majority Leader Schumer reportedly looking at multiple procedural options to avoid or table these articles of impeachment. In a landmark ruling, James and Jennifer Crumbley, parents of the Oxford High School shooter Ethan Crumbley, were each sentenced to 10-15 years in prison for their role in failing to prevent the tragic shooting that claimed the lives of four students in 2021. Appearing at the Oakland County Court, the Crumbleys sat close together but barely exchanged glances as their attorneys argued for lesser sentences. Impact statements from relatives of the victims, Madisyn Baldwin, Hana St. Juliana, Tate Myre, and Justin Shilling, were delivered before sentencing. "The ripple effects of both James and Jennifer's failures to act have devastated us all," expressed Justin's mother, Jill Soave, highlighting the anguish felt by the victims' families. (10:03) James Crumbley verdict, Moscow madness (17:45) Kris Kremers & Lisanne Froon Dutch tourists Kris Kremers and Lisanne Froon arrived in Boquete, Panama in March 2014. They had prearranged to volunteer at a local school and were excited to spend time in the beautiful country.  When they went to the school to start their work, they were told there was no place for them. They were disappointed and looked for ways to fill their days. On April 1, 2014, Kris and Lisanne went for a hike on the El Pianista Trail. They were only planning to spend a few hours there and took no supplies with them. They headed onto the trail and were never seen alive again. Months later, some of their belongings were found, including their phones and a camera.  Investigators determined that they had attempted to make emergency calls from their phones for days after the hike, but the calls never connected.  There were many interesting photos found on the camera, including 90 photos taken in a short period, one week after they went missing.  One photo was found to have been deleted from the camera and authorities have never been able to recover it. Some remains of Kris and Lisanne were eventually found. In a rare case, Jennifer Crumbley, the mother of Oxford High School shooter Ethan Crumble was convicted last month and could face up to fifteen years in prison for her role in the shooting. Prosecutors said she failed to warn authorities about threats her son had made. Now, Ethan's father, James Crumbley, is also on trial in Michigan for manslaughter. Shortly after James Crumbley's trial began, FOX News contributor and George Washington University Law Professor Jonathan Turley joined host Dave Anthony to discuss this unusual case and the legal questions it raises. Jennifer Crumbley becomes the first parent in the United States to be found guilty of involuntary manslaughter for a mass school shooting committed by her son, Ethan. She was convicted of four counts of involuntary manslaughter and faces a maxium sentence of 60 years in prison. Prosecutors said Jennifer Crumbley knew her son was struggling with mental health issues. They alleged instead of getting him the help he needed, Jennifer and her husband, James Crumbley, bought Ethan the gun he later used in the attack. The prosecution also showed the Crumbleys were attempting to flee when they realized they were going to be charged in the crime.
