The cosmetics and grooming products industry is like the wild wild West. Until recently, the regulatory system failed to keep consumers safe from toxicants that likely increase their offspring's “risks of cancer, fertility issues, neurological deficits, and immune dysfunction.” And then came the Modernization of Cosmetics Regulation Act of 2022, or MoCRA. Today, we talk about MoCRA with subject matter expert Dahlia Kelada, founder/CEO of TopicalFormulator.com and Salve Naturals & Native Earth. When Congress passed the new law, it did so with the goal to help ensure the safety of multiple cosmetic products many consumers use daily. MoCRA went into effect in late December 2024. In December, America's first big move to regulate the beauty industry in more than 80 years went into effect with the Modernization of Cosmetics Regulatory Act of 2022, best known as MoCRA. But it isn't until the end of this month that the industry will meet its first big deadline from the Food & Drug Administration. By July 1, brands and manufacturers must provide a list of their products and where they were made to the FDA through its online portal called Cosmetics Direct. It's the first of many deadlines and requirements, some of which are still in flux, that will slowly reshape how the industry is regulated over the next few years. For example, MoCRA will give the FDA new visibility into what's in beauty products and where they are manufactured. It also provides new authority to the FDA to issue mandatory product recalls and alert consumers to common allergens through mandatory warning labels. That's thanks, in part, to new visibility into fragrance ingredient lists, which had long been classified as intellectual property but must now be shared with the FDA. Previously, America's regulation was made up of small federal and state laws, which created a growing movement for better regulation. For example, brands like BeautyCounter spent years lobbying for better regulation on social media and on the hill in Washington, while brands like Henry Rose by Michelle Pfeiffer was created to offer an alternative to the under-regulated fragrance industry. So how did this piece of legislation finally get passed? While you may not know attorney Katlin McKelvie by name, she is a Washington D.C.-based lawyer who was integral in the creation of MoCRA. McKelvie has more than two decades of experience working in food and drug law, including 11 years at the FDA. She also served as the Deputy General Counsel of the United States' Department of Health and Human Services and as the Deputy Health Policy Director and Senior FDA Counsel to the Senate Committee on health, education, labor and pensions for chair Patty Murray. While working with Congress, she helped shape many pieces of legislation that have impacted us all, including MoCRA, before becoming a partner of a private D.C. firm called Gibson, Dunn and Crutcher. On today's episode of The Glossy Beauty Podcast, McKelvie shares the origin story for MoCRA, including the challenges and compromises made during its early days in the Senate. She also shares the challenges she suspects brands may face while navigating compliance, the requirements the FDA will release next and the changes consumers can expect in the coming years.

Earlier this month, in a step toward implementing the Modernization of Cosmetics Regulation Act of 2022 (MoCRA), FDA issued a draft guidance document titled “Registration and Listing of Cosmetic Product Facilities and Products: Guidance for Industry.” For those who may be new to MoCRA, this legislation significantly overhauled FDA oversight of the cosmetics industry by requiring manufacturers, packers, and distributors, to comply with a range of new standards, including mandatory product and facility registration, creation of safety substantiation information, and adverse event reporting subject to a December 2023 deadline (per the one-year timeframe set per statute). About Tom Kiefer: Pertenencias / Belongings In July 2003, fine art photographer Tom Kiefer started working part-time as a janitor and groundskeeper at a U.S. Customs and Border Protection processing facility near Ajo, Arizona. In mid-2007, he was given permission to collect food confiscated from migrants and asylum seekers and donate it to a local food pantry. He was deeply moved at finding personal belongings in the trash bins along with the food. These items, necessary for hygiene, comfort and survival, were deemed “non-essential” or “potentially lethal” and seized and discarded by officials. When MOCRA opened in 1993, many people were skeptical about a museum focusing on expressions of religion and spirituality in contemporary art. Preconceptions were firmly lodged for those coming from the perspective of art and for those coming from the perspective of faith and spirituality. By the time Founding Director Fr. Terrence Dempsey, S.J., retired from the museum on June 30, 2019, however, MOCRA had convincingly established that the religious and spiritual dimensions continue to nourish vital and varied currents in contemporary art. MOCRA celebrated Fr. Dempsey on Nov. 10, 2019, in a program called Pursuing the Spirit in Contemporary Art: A Celebration of Terrence Dempsey, S.J. The afternoon featured a talk by author and curator Dr. Aaron Rosen, who reflected on MOCRA's significance and took stock of the present and future of the dialogue between contemporary artists and the religious and spiritual dimensions. In 2013, MOCRA celebrated its twentieth anniversary, a perfect time to talk with people who have been affiliated with the museum over the years: those who had a hand in MOCRA’s genesis, artists who have participated in exhibitions at MOCRA, and other participants in the broader dialogue between contemporary art and religion and spirituality. With "MOCRA Memories" we bring you these conversations and reflections. In this episode, MOCRA director Terrence Dempsey, SJ, reflects on three people who played pivotal roles in the creation and development of MOCRA. He encountered art historian Jane Daggett Dillenberger, theologian John Dillenberger, and art historian Peter Selz during his doctoral studies at the Graduate Theological Union (GTU) in Berkeley, California, a leading center of research in the intersection of contemporary art and religion. Dempsey discusses how these important scholars shaped his thinking and practice in ways that ultimately led to the establishment of MOCRA. Showing how art can be a vehicle for interfaith understanding is a key element of MOCRA’s mission. But MOCRA isn’t the only arts institution exploring that possibility. In this two-part episode, MOCRA Assistant Director David Brinker speaks with Batya Abramson-Goldstein, Executive Director of the St. Louis Jewish Community Relations Council, and Timothy O’Leary, General Director of Opera Theatre of Saint Louis. Part 1 focuses on Opera Theatre’s 2011 production of the John Adams opera The Death of Klinghoffer, and how that opera became a springboard for interfaith conversation and action through the arts. For this episode of MOCRA Voices, MOCRA Director Terrence Dempsey, S.J., and Assistant Director David Brinker talk with Israeli artist Archie Granot and American collector Max Thurm. Thurm and his wife Sandra commissioned a body of work from Granot titled The Papercut Haggadah, which was displayed at MOCRA in 2012. They discuss a range of topics, including how Granot was drawn to the art of papercutting, how the commission came about, the special considerations engaged in creating an artwork based on a sacred text, and continuity and innovation in the Jewish tradition. Curator and art historian Thomas Sokolowski is no stranger to MOCRA audiences, having lectured at the museum in 1994 with a talk called "The Changing Face of AIDS" and again in 2002 with a talk called "The Last Impression: Andy Warhol's Art as Belief." In this interview, MOCRA Director Terrence Dempsey, SJ, and Sokolowski discuss issues related to art and AIDS. Topics include Sokolowski's experiences in presenting some of the earliest exhibitions of art about AIDS, and his role in the creation of the red ribbon for AIDS awareness. Also addressed are Sokolowski's role in introducing Dempsey to the late artist Adrian Kellard, and Sokolowski's significant role in making several MOCRA exhibitions possible. Artist Regina DeLuise and gallerist Susan Schreiber join MOCRA Voices to talk about the life and art of Adrian Kellard (1959–1991). DeLuise and Schreiber share stories of Kellard that serve to illuminate his artistic aims and influences, his distinctive visual style and treatment of his woodcut medium, and the ways in which Kellard's upbringing, sexual orientation, and faith found expression in his work. Dan Ramirez been exhibiting Nationally and Internationally for over 35 years. A major influence in his work during his formative years was the Minimalist movement of the late 50's and 60's and a love for the art of Barnett Newman. Over time, his paintings developed into a synthesis of Geometric Abstraction coupled with the visual aesthetic of Minimalism. Dan tends to see his work as a form of Minimalist/Romantic/Baroque. Dan is in the collections of numerous major museums including the Art Institute of Chicago, The National Museum of Mexican Art, The Museum of Contemporary Art, Chicago, MOCRA, St. Louis, The Daum Museum of Contemporary Art, and Fundacion Llorens Artigas in Spain. There are numerous books and publications featuring his work and he is currently represented in Chicago by Zolla Liberman Gallery.
