This week, helping us get Set For Sentencing is Dr. Kelly Richmond Pope. She's a fraud expert, a filmmaker, and an accounting professor at DePaul University in Chicago. Her latest book, “Fool Me Once: Scams Stories and secrets from the Trillion Dollar Fraud Industry," is burning up the charts nationally. Why do people commit fraud? What is the appropriate punishment? What is the public perception underlying and animating all of it? This was a lively discussion that really struck at the heart of the goals of punishment and the truth about how justice is "served" in America. The discussion touches on many topics, but at the center of it all is one of the largest municipal fraud cases ever, that of Rita Crundwell, the subject of Dr. Pope's incredible documentary, "All the Queen's Horses." Ms. Crundwell, was the comptroller of a small city in Illinois when she embezzled millions from the town coffers. When Ms. Crundwell received early “compassionate” release from the federal Bureau of Prisons, her victims and those following the case were outraged. They believed that because she only ended up serving 8.5 years of her 20 year sentence that a grave injustice occurred. This episode, quite unintentionally drops amidst a wave of publicity about two other very high profile offenders. The first is Elizabeth Holmes. It seems the media somehow figured out for the first time, that Ms. Holmes, like EVERY OTHER FEDERAL DEFENDANT EVER, will not have to serve her full sentence. She will literally earn YEARS off her sentence for good behavior and participating in programming. This too seems to outrage those who might otherwise have a surface level view of the many complicated layers of federal sentencing. Virtually the same day all the Elizabeth Holmes faux outrage click-bait machine revved up, we heard the news about Leslie Van Houton's parole. She was responsible, among others, for the brutal murders of Rosemary and Leo LaBianca in 1969. She was a 19-year-old runaway at the time, and under the influence of career criminal, psychopath, cult leader Charles Manson. She was sentenced to life in prison, but was paroled after serving fifty-three years. Now, compare the crimes of Van Houten (53 years for 2 heinous murders) and Holmes (11.5 years for hundreds of millions of dollars) with Crundwell (over 20 years for 50 million). Does that put Crundwell's record-setting sentence in any better perspective? Do we feel any better about the fact that she "only" served 8.5 years in federal prison? Rita Crundwell had just about everything. She owned multiple properties. A kick ass RV. 400 horses. A freezer full of horse semen. How did she support herself? Well, that depended on who you asked. Some people thought her parents had been early investors in Campbell’s Soup. Other people thought her side hustle brought in good money. One thing was certain -- Rita’s salary as the treasurer of Dixon, Illinois, wasn’t enough to cover her lavish lifestyle. Then Brandi tells us a terrible story that begins in a doublewide trailer in Florida. The bank had recently foreclosed on the trailer. Neighbors said that the two sisters who occupied it hadn’t been there in months. But when a father and son crew arrived to clean it out, they discovered a horrible stench. The body of Debbie Burns had been wrapped in several blankets and a shower curtain. Her sister, Barbara, was nowhere to be found. And now for a note about our process. Did we close the door on the centenary episode with a bang, or a whimper? ...Whimper, I'm afraid. Toby Ball kindly made room in a packed day to join me for two Cold Case properties, the first a feature film about the Paradise Lost case, Devil's Knot, that doesn't know who it's for, what it wants to say, or how to fit a Shoah-size story into a feature-size runtime. Also, who just has a picture of Robert Johnson in his office if he's not a blues musician? We hoped the second film, All The Queen's Horses, would show better (as it were), but though the story of Rita Crundwell's serial heisting of more than $50 million from the town coffers of Dixon, IL is fascinating, the direction is amateurish...and while we can live with not really understanding the why of this case, a film by an accounting professor should probably be a little clearer on the what. Our guest, Kelly Richmond Pope, will help bring this to life. She is the genius behind the movie All the Queen’s Horses. It is a true story of Rita Crundwell, one of the national’s leading quarter horse breeders, who was also arrested in 2012. She was the largest municipal fraud perpetrator in the country’s history. She embezzled upwards of $50 million dollars as a comptroller and treasurer of Dixon, Illinois. It’s not $50 or $60 billion, like Bernie Madoff. But $50 million is a lot of money. Plus, we’re talking small town Illinois and about a woman who was trusted. She was a horse breeder. There were no signs that she was going to be stealing your money... but were there? The film has actually won HBO’s best documentary award at the Martha’s Vineyard African-American film festival. Critics are going nuts. They love it. Kelly is not just a filmmaker. She’s also an associate professor in the school of accountancy at MIS at DePaul University in Chicago. There she teaches a lot of different courses around accounting and a course on leadership. She is also a speaker and an author. She’s worked in the forensic practice at KPMG on anti-money laundering engagements, insurance fraud investigations and fraud risk management projects.
