When You Win it is Best to Shut Up and Accept It As a young lawyer one of the first things I learned was never argue with a judge whose tentative ruling is to grant your motion. Insurers often seek, when there is a dispute of insurance coverage, declaratory relief from the court about its duty to defend or indemnify the insured. However, when there is no claim, it is a waste of the time of counsel, the insured and the courts to bring a declaratory relief action. The axiom to never argue over a win was explained by the USDC for the Eastern District of Virginia, in Hanover Insurance Company, et al. v. C. David Venture Management, LLC, et al., Civil Action No. 1:21-cv-790 (RDA/JFA), United States District Court, E.D. Virginia, Alexandria Division (August 30, 2022). Hanover sought a ruling it owed neither defense nor indemnity to the defendants. The defendants, David Venture Management, LLC and Venture Street, LLC's (“Defendants”) moved to dismiss The Hanover American Insurance Company's (“Plaintiffs” or “Hanover”) suit. BACKGROUND The lawsuit for Declaratory Judgment implicates Hanover's potential duties to defend or indemnify Defendants in a putative class action brought in the U.S. District Court for the District of Colorado. Beginning on December 9, 2017, Hanover issued the first of several Commercial General Liability (“CGL”) policies to CDVM. Hanover also issued Commercial Follow Form Excess and Umbrella Policies (“Excess/Umbrella Policy”) for the same effective dates. During gay pride celebrations, Jacobs tells that students were encouraged to wear dresses during Gay Pride Month, and a male teacher taught a class in high heels. Jacobs further explains his qualms, telling of a punishment his son faced for wearing a pair of Uggs to school, which administrators called slippers, and the response when raising a concern about the teacher wearing high heels. Kiribati has withdrawn from the Pacific Islands Forum meeting, which starts in Fiji today. Prime Minister Jacinda Ardern will attend the meeting of 18 countries including Australia and New Zealand. In a letter sent to the forum's secretary general on Saturday, Kiribati President Taneti Maamau's outlined his reasons for not attending, including a "gentleman's agreement" that Micronesia would be awarded the organisation's secretary general role. Cook Islander Henry Puna was appointed to that role, and the Micronesian states said they felt sidelined. Over the weekend, UNC transfer target Matthew Mayer (Baylor) withdrew from the 2022 NBA Draft to return to play in college. Could he join RJ Davis, Caleb Love, Leaky Black, & Armando Bacot to help fill out North Carolina's starting lineup in the void left by departing Brady Manek? He projects as the type of player and young man that Hubert Davis would want on his roster and that the rest of the Tar Heels would want to play alongside. Pete Nance (Northwestern) is another name that has emerged lately in conversations about UNC transfer targets. Nance is a 6'10" four-year player currently still in the 2022 NBA Draft; however he has also maintained his college eligibility including entering the transfer portal. If he decides to return to college. Nance would be another seemingly strong fit in the Carolina system. The UNC women's lacrosse and tennis teams each competed in their respective NCAA Tournaments over the weekend. The tennis team advanced to the Final Four but lost to eventual national champion Texas. The lacrosse team defeated Stony Brook in the national semifinals and will play Northwestern on Friday in the Final Four.
