Op 10 maart begon de angst voor een bankencrisis toe te nemen. Het Amerikaanse Congreslid Jared Moskowicz, een Democraat uit Florida, verkocht toen zijn aandelen Seacoast Banking Corporation. Dat is een kleine regionale bank en werd dus hard getroffen. In een interview zei Moskowitz dat hij een speciale overheidsbijeenkomst had bijgewoond over de problemen in de bankensector. Sorry? Je had voorkennis, handelt daarmee en je ziet niet eens het probleem? De koers van Seacoast is flink gedaald en staat nu een kwart lager. Zijn excuus achteraf was dat zijn adviseur zei dat hij moest verkopen. Die verklaring was genoeg en Moskowitz ging vrijuit. Nou meneer Moskowitz, goed gedaan, financieel gezien. Maar moreel verwerpelijk. Ik zit liever aan de goede kant. Ik had ooit SNS-aandelen, werkte daar, maar had geen voorinformatie. Ik heb die aandelen tot het laatst toe vastgehouden, ook voelde je op een gegeven moment aan je water dat het mis zou gaan. Financieel dom, maar het voelt een stuk beter. The New York Times heeft er onlangs onderzoek naar gedaan. Bijna een vijfde van de politici heeft gehandeld in aandelen van bedrijven die beïnvloed kunnen worden door de beslissingen van commissies waarin ze zitten. Democraten en Republikeinen zijn allebei even erg. De gemiddelde aandelenportefeuille van de congresleden deed het vorig jaar maar liefst 17,5% beter dan de brede index. Goh. Een paar voorbeelden. De vrouw van congreslid Alan Lowenthal, een Democraat, verkocht één dag voor de uitslag van het rapport over de ramp met de Boeing 737 MAX, haar aandelen van die vliegtuigbouwer. Te toevallig om toeval te zijn. Bob Gibbs, een Republikein, kocht aandelen in farmaceut AbbVie in 2020 en in 2021. Maar hij zat in de commissie die onderzoek deed naar de hoge prijzen in de farmaceutische industrie, waaronder die van AbbVie. Óf zijn oordeel over het bedrijf werd beïnvloed door zijn privébezit, óf hij had voorkennis. In beide gevallen zit hij fout. En dan vragen ze zich af waarom het vertrouwen in de Amerikaanse politiek zo onder druk staat. Hun morele kompas is flink van slag. Gelukkig zijn in Nederland de regels een stuk strenger. Bovendien zijn Nederlandse bedrijven zo internationaal, dat wetgeving van de Tweede Kamer nauwelijks invloed heeft op beursgenoteerde bedrijven. Tegenwoordig kun je als gewone belegger meeliften op deze politieke voorkennis. Een indexbouwer heeft een fonds gemaakt dat de transactie van de Democraten nabootst: NANC. Inderdaad, die ticker is afgeleid van Nancy Pelosi, de voormalige leider van de Democraten. En voor wie de Republikeinen wil volgen, is er het KRUZ indexfonds, U raadt het al, van Ted Cruz. Beide fondsen presteren overigens in de korte tijd dat ze beursgenoteerd zijn ondermaats. Zou er dan toch nog gerechtigheid zijn? The final vote was 228-195. Eight Republicans crossed over to vote with Democrats. Reps. Liz Cheney of Wyoming, Nancy Mace of South Carolina, Fred Upton of Michigan, Anthony Gonzalez of Ohio, John Katko of New York, Brian Fitzpatrick of Pennsylvania, Maria Salazar of Florida and Adam Kinzinger of Illinois joined all the Democrats in voting for the bill. Two Republicans, Reps. Bob Gibbs of Ohio and Mike Kelly of Pennsylvania, voted present, meaning they took no position either way on the bill The vote falls among action House Democrats are trying to take following the Supreme Court's decision that overturned Roe v. Wade. In that decision, Justice Clarence Thomas wrote separately in a concurring opinion that the high court should reconsider "substantive due process precedents" in decisions, including Griswold v. Connecticut, that allows access to contraception. The Right to Contraception Act, introduced by Democratic Rep. Kathy Manning of North Carolina, aims to "protect a person's ability to access contraceptives and to engage in contraception, and to protect a health care provider's ability to provide contraceptives, contraception, and information related to contraception," according to text of the bill. We should note that the text of the bill also includes “emergency contraceptives” in its list of what is included. Historically “emergency contraceptives” has also included chemicals intending to prevent or disrupt implantation of a fertilized egg. It should also be pointed out that some forms of oral contraception also include this as an intended function. Why would we trust Margaret Sanger and her descendants to give us good medicine? The mindless embrace of birth control by Christians got us into this mess. The White House said it "strongly supports" the bill in a statement Monday, adding "access to contraception is essential to ensuring all people have control over personal decisions about their own health, lives, and families." This on the heels of Earlier this week, the House passed a bill that would enshrine protections for same-sex marriage into federal law, with 47 Republicans joining Democrats voting in favor of the bill. It is unclear whether the bill can pass the Senate where at least 10 Republicans are needed to side with Democrats to overcome the filibuster's 60-vote threshold. The first is sponsored by nine Republican senators (Susan Collins, Shelley Moore Capito, Lindsey Graham, Lisa Murkowski, Rob Portman, Mitt Romney, Ben Sasse, Thom Tillis, and Todd Young) and seven Democratic senators (Joe Manchin, Ben Cardin, Chris Coons, Chris Murphy, Jeanne Shaheen, Kyrsten Sinema, and Mark Warner) and is focused on the Electoral Count Act itself. This bill clarifies that states must appoint presidential electors in accordance with the laws they each pass before election day and does away with the dangerously vague concept of a “failed election” in the original ECA. It requires that the governor of each state (or else another particular official specifically assigned this role by state law) be the person to certify the state’s slate of electors, to avoid the possibility of different officials sending different slates to Congress. It clarifies that the vice president’s role in counting electoral votes in Congress is purely ministerial and does not involve any sole decision-making authority. It raises the threshold for raising objections to a state’s electoral votes in Congress from one member of each house to one-fifth of the members of each house and narrows and clarifies the grounds for filing objections. And it allows for expedited federal judicial review of any challenges raised by a presidential candidate under already existing federal law to a state’s certification of its elections, but does not create any new right of action in federal court regarding state officials’ enforcement of state laws. Some Democrats wanted to go further, and give the federal courts more jurisdiction over the ways in which state officials enforce state election laws. This was a disastrously misguided idea, and it is very good that this proposal avoids any such path. This is a significant success for a number of Republicans who fought hard against that approach — particularly Ben Sasse and Mitt Romney. And it is the reason why I think this bill could get enough Republican votes to pass the Senate. The restraint shown in this proposal suggests this bipartisan group really wants to get these reforms enacted. The second bill, sponsored by most of the same senators as the first (with the exception of Republican senators Capito, Young, Sasse, and Graham) takes up some issues beyond the scope of the Electoral Count Act. It would increase the penalties for threatening election officials, improve the postal service’s procedures for handling mail-in ballots where those are allowed under state law, reauthorize the Election Assistance Commission, and increase the penalties for tampering with election records. These are modest reforms directed to modest problems, and the result is a bill that doesn’t do anything particularly important. If it’s necessary to get more Democrats to accept the restrained approach to ECA reform in the first bill, then I see no problem with it, and certainly some of what it proposes is worthwhile. Chaplains File Class Action Lawsuit Against DODhttps://uncoverdc.com/2022/07/21/vaccine-mandate-chaplains-file-class-action-lawsuit-against-dod/ Thirty-one military chaplains filed a class action lawsuit in May alleging the unconstitutional denial of religious accommodations relating to the vaccine mandate. The chaplains maintain they are protected by the First Amendment and the Religious Freedom Restoration Act (RFRA). Defendants in the case are the Department of Defense (DoD), several military branches, the Department of Health and Human Services, the FDA, and the CDC. The lawsuit provides a fulsome review of the blatant, concerning changes in definitions and procedural rules to achieve politically driven agendas and goals that seemingly ignore service members’ most basic constitutional rights. Plaintiffs argue that the vaccine mandate and the military’s “no accommodation directive” are unconstitutional. Military chaplains who fail to comply with the vaccine mandate face “threat of disciplinary action” and “punitive discharge,” violating their “express statutory rights to follow their conscience as formed by their faith.” Defendants in the case contend the “venue is not proper,” Plaintiffs’ claims “are not ripe or justiciable prior to exhaustion of military remedies” (some requests have not yet been adjudicated), and the vaccine is the best remedy for “the health and readiness” of the military forces. The 2013 National Defense Authorization Act (NDAA) lays out in Section 533—the right of chaplains to conduct themselves according to their conscience or religious faith. Section 533 allows a chaplain to reject performing any duty that violates their conscience without repercussion or penalty. As the footnote on page 5 of the lawsuit explains, the genesis of the 2013 NDAA amendment grew out of social policy changes in 2012 during the Obama administration concerning “the repeal of the military ban on homosexual behavior and the Supreme Court’s invalidation of the Defense of Marriage Act.” Chaplains at the time were concerned that they might have to perform wedding ceremonies that would violate their religious beliefs. Those protections were reinforced in both the 2016 and the 2018 NDAAs. Retired Army veteran Arthur A. Schulcz’s testimony filed on July 18, 2022, speaks poignantly to the difficulties of defining and implementing religious freedom policies in the military in recent years. He fought to properly define the role of chaplains in the military in December 2012, working with Congress in anticipation of amendments to the 2013 NDAA to “defend chaplains’ rights to authentically represent their faith to the military, especially in their speech.” He describes the discrimination many in the military have experienced over the years if they dared speak against the prevailing political agenda. The complaint states military chaplains are “unique military officers” because they are both commissioned officers and clergy. As such, they “raise unique statutory and constitutional religious liberty claims, in addition to the claims for systematic violations of service members’ RFRA and First Amendment rights that several courts have recently found Military Defendants likely committed.” The lawsuit states congressional authority concerning honoring and protecting military chaplains’ conscience and faith has been violated by the mandate. Chaplains are unique in their roles as service members because they are afforded additional First Amendment protections as a result of their clerical roles. It has to do with the potential violations of the First Amendment’s Establishment Clause. He fought to properly define the role of chaplains in the military in December 2012, working with Congress in anticipation of amendments to the 2013 NDAA to “defend chaplains’ rights to authentically represent their faith to the military, especially in their speech.” He describes the discrimination many in the military have experienced over the years if they dared speak against the prevailing political agenda. The complaint states military chaplains are “unique military officers” because they are both commissioned officers and clergy. As such, they “raise unique statutory and constitutional religious liberty claims, in addition to the claims for systematic violations of service members’ RFRA and First Amendment rights that several courts have recently found Military Defendants likely committed.” The lawsuit states congressional authority concerning honoring and protecting military chaplains’ conscience and faith has been violated by the mandate. Chaplains are unique in their roles as service members because they are afforded additional First Amendment protections as a result of their clerical roles. It has to do with the potential violations of the First Amendment’s Establishment Clause. Bills Highlighted in This Episode H.R. 1155: Searching for and Cutting Regulations that are Unnecessarily Burdensome Act of 2016 (SCRUB Act)" Retrospective Regulatory Review Commission Establishes a new five-year commission that will review government rules to determine which ones should be eliminated "to reduce the costs of regulation to the economy." The Chairman will be appointed by the President and must have "experience in rulemaking". The other eight members will come from lists created by the majority and minority leaders in Congress of "individuals learned in rulemaking". The commission will have subpoena power and "the attendance of witnesses and the production of evidence may be required from any place within the United Stats at any designated place of hearing within the United States." The bill appropriates $30 million which are available until expended. The commission members will be paid, and will be given travel expenses including a per deim. The commission will hire staff, who will also be paid. The commission can hire "experts or consultants", and may "lease space and acquire personal property" "to the extent funds are available" The commission will review the Code of Federal Regulations to find rules "that should be repealed to lower the cost of regulation to the economy". Priority will be given to "major rules" which have been in effect more than 15 years, impose paperwork burdens" which could be reduced without "significantly diminishing" regulatory effectiveness. Goal is to reduce the cost of Federal regulations by 15% with a "minimal reduction" in the effectiveness of the regulations. Criteria for recommending repeal Whether the rule achieved its purpose and could be repealed without "significant" recurrence of adverse effects If technology, time, economic conditions, market practices, or "other relevant factors" have rendered the rule obsolete. If the rule is ineffective If the rule has "excessive compliance costs" or "is otherwise excessively burdensome", as compared to rules that give goals instead of orders and "give economic incentives to encourage desired behavior" If the rule "inhibits innovation in or growth of the United States economy" If the rule "harms competition" of entities based in the United States "Such other criteria as the Commission devises..." Repeal procedure If Congress passes a joint resolution approving the Commission's repeal suggestions, the Federal agencies will have to repeal the rules within 60 days of the joint resolution's enactment. Repealed rules can not be reissued without a new law enacted All records of public meetings and hearings will be published on the Commission's website within 1 week, Regulatory Cut-Go When an agency makes a new rule, they have to repeal a rule recommended by Commission so that costs of enforcement offset each other, but the agency must have a net reduction in costs Vote Passed the House of Representatives 245-174 There is an identical bill in the Senate: S. 1683 President Obama issued a veto threat Author Rep. Jason Smith of Missouri's 8th district Organizations Who Lobbied for H.R. 1155 America's Natural Gas Alliance U.S. Chamber of Commerce H.R. 712: Sunshine for Regulations and Regulatory Decrees and Settlements Act H.R. 712 is a combination of three bills: The Sunshine for Regulatory Decrees and Settlements Act, the All Economic Regulations are Transparent Act, and the Providing Accountability Through Transparency Act. Title 1: Sunshine for Regulatory Decrees and Settlements Any agency that is challenged by a private company on a regulation must publish the complaint online within 15 days. The suit can not be dismissed until after the complaint is published online and there is a public comment period. The agency much have a public comment period before settling cases and must respond to every comment received. A court can not approve of consent decree that doesn't "allow sufficient time and incorporate adequate procedures" for the agency to comply with all administrative rule making procedures and any Executive order that governs rulemaking. Title II: All Economic Regulations are Transparent Act Makes every Federal agency submit monthly reports) on the status of every rule they are working on. Rules can’t go into effect) until they have been published on the Internet for at least 6 months. Exemption for national security, emergencies, or implementing international trade agreements. Requires the first report to include cost-benefit analysis for all proposed or final rules for the 10 years) before the enactment of this law. The agencies will have 30 days to complete this report. Title III: Providing Accountability Through Transparency Requires agencies to publish summaries of their regulations on the Internet, capped at 100 words. If the research is not published on the Internet 90 days before a rule or draft's publication, the rule cannot move forward for 60 days plus the number of days the research publication was delayed. If the publication of research data is delayed by 6 months, the Secretary must withdraw the rule unless that would cause "imminent and sever threat to human life". Study Which Delays Regulations A study on the regulatory effectiveness of the Stream Buffer Rule must be completed within two years and 90 days of this bill's enactment. The Secretary of the Interior can not issue any new rules or regulations related to the stream buffer zone rule until one year after the study is submitted. H.R. 4718 Permanent Bonus Depreciation Tax Cut Brings back a tax cut that expired on December 31, 2013 and makes it permanent. The cut they want to make permanent is for upgrading the inside of retail stores. Expands the tax cuts to include deductions for "trees and vines bearing fruits and nuts". Gives corporations more choices about how they'd like to get taxed. The effects of this bill won't be counted in the PAYGO budget. CBO Score: "Enacting H.R. 4718 would reduce revenues, thus increasing federal budget deficits, by about $287 billion over the 2014-2024 period." Article: New Estimate Puts Rising Big Dig Costs at $24.3 billion. July 2012. The bills passed the House of Representatives on July 11 by a vote of 258-160. Only two Republicans voted against it: Retiring Rep. John Campbell of Orange County, CA Rep. Walter Jones of North Carolina The bill was written by Rep. Patrick Tiberi of Ohio's 12th district. H.R. 4195 Federal Register Modernization Act Says that copies of the Federal Registrar don't need to be printed on paper. CBO Score: It would have no effect on the Federal budget. Passed the House of Representatives on July 14 by a vote of 386-0. Written by Rep. Darrell Issa of southern California's 49th district H.R. 4719 America Gives More Act of 2014 Eliminates the tax deduction for donating stuffed actual animals to charity. Increases the charitable deduction limit for food donations from 10% of a person's net income to 15%. Charitable donations that exceed the cap can be carried over for five years. This would be effective for 2014 taxes. Makes permanent a tax cut that expired in 2013 for charitable contributions direct from retirement funds. Makes permanent tax credits for charitable donations towards conservation and tax credits for corporate farmers and ranchers. Allows people to claim charity deductions for a year that is over if the donation happens before tax day. Cuts the excise tax rate for private foundations investment income in half. The effects of this bill the budget will not be counted in the PAYGO budget. CBO Score: "enacting H.R. 4719 would reduce revenues, thus increasing federal budget deficits, by about $1.9 billion over the 2014-2024 period" The bill passed the House of Representatives on July 17 by a vote of 277-130. The bill was written by Rep. Tom Reed of New York's 23rd district H.R. 4450 Travel Promotion, Enhancement, and Modernization Act of 2014 Changes the board of directors of Brand USA - a non-profit organization that advertises U.S. tourism - from being made up of travel industry specialists to one made up of entirely of executives, with five seats reserved for people with ties to multinational corporations. It eliminates the seat for the specialist in intercity passenger rail. Extends the authorization for the government to spend $100 million per year on Brand USA through 2020. Extends the Travel Promotion Fee - a $10 fee charged to people who get a visa to travel into the United States - until 2020. CBO Score: The bill would decrease the deficit by $231 million over the next ten years. Passed the House of Representatives on July 22 by a vote of 347-57 Written by Rep. Gus Bilirakis of Florida's 12th district H.R. 4411 Hezbollah International Financing Prevention Act of 2014 Prohibits United States banks from completing large financial transactions for Hezbollah. The worst penalty for completing a Hezbollah transaction can be for twice the amount of the transaction. This won't apply to "authorized intelligence activities of the United States" The bill is paid for by reducing our yearly financial gift to Pakistan by $3 million. The bill passed the House of Representatives on July 22 by a vote of 404-0. Written by Rep. Mark Meadows of North Carolina's 11th district H.R. 3136 Advancing Competency-Based Education Demonstration Project Act of 2014 Authorizes a maximum of 30 "entities" to launch demonstration projects of "competency-based" education programs, which would replace credit hours as the system of measurement to get a degree. Schools that participate would be exempted all kinds of existing educational regulations. Projects that reduce the amount of time and/or money required to get a degree would be prioritized. The only restriction to make a school eligible is that it has to be in the United States. Each demonstration project would have between 50 and 3,000 students. After the program has been around awhile, that number can be increased to 5,000. The bill passed the House of Representatives on July 23 by a vote of 414-0. Written by Rep. Matt Salmon of Arizona's 5th district Representatives Quoted in This Segment Rep. John Kline of MN Rep. Matt Salmon of AZ Video Shared in This Segment H.R. 4984 Empowering Students Through Enhanced Financial Counseling Act Mandates that schools make sure that students know and understand the terms and conditions of their Federal student loans every year by using either in-person counseling sessions or online. Students must be told that Federal loans usually have better terms and conditions than private loans. Students will get another counseling session to explain their loan status and the consequences of failing to re-pay it as they leave college. The bill passed on July 24 by a vote of 405-11. All Democrats voted yes. Written by Rep. Brett Guthrie of Kentucky's 2nd district H.R. 3393 Student and Family Tax Simplification Act Permanently extends a tax credit for college expenses that is scheduled to expire in 2017. The tax credit and eligibility numbers would increase with inflation starting in 2018. Includes the text of H.R. 4935: The Child Tax Credit Improvement Act and prohibits the effects of that bill on the budget from being counted. The effects this would have on the budget would not be counted. CBO Score: The bill would increase the deficit by $96.5 billion over the next ten years. Passed the House of Representatives on July 24 by a vote of 227-187 Written by Rep. Diane Black of Tennessee's 6th district H.R. 4935 Child Tax Credit Improvement Act of 2014 Increases the amount of money a family is allowed to make and still claim the child tax credit. Currently, married people can make $110,000; this bill would increase that to $150,000. Single people can make $55,000, which would increase to $75,000. Increases the tax credit with inflation starting in 2015. CBO Score: The bill would increase the deficit by about $115 billion over the next 10 years. The bill passed on July 25 by a vote of 237-173 Written by Rep. Lynn Jenkins of Kansas' 2nd district H.R. 935 Reducing Regulatory Burdens Act of 2014 Prohibits States from requiring permits to dump pesticides into oceans and rivers as long as the pesticide is legal to sell. The bill passed on July 31 by a vote of 267-161. The bill failed to pass three days prior as an uncontroversial "suspension" bill. All Republicans voted yes. Written by Rep.
