The case demonstrated the expanded use and power of social media often by third parties not involved in the actual case. The latest episode of "Miranda Warnings", host David Miranda breaks down the trial and the effects that social media use had in the case and in the court of public opinion.Joining him in the discussion is Scott Malouf, a social media attorney in the Rochester area, who focuses on all things social media for lawyers and business clients. The Depp v Heard case was unique in that it was not only involving two celebrities, but televised in real time from a Virginia courtroom. Both guests say the coverage started small and as it grew, took on a life of its own."Small influencers were watching the case starting to comment on it and getting a lot more traction which means more ad revenue," said Malouf. "Some of influencers said they supported Johnny because that content did better. It had nothing to do with who was winning and I think for litigants and organizations that's a really tough and scary prospect."Debra Hamilton says attorneys have a tough job balancing what is right for their clients and trying to prevent an outside party from affecting the case. "We are in the business of helping our clients solve issues however if they get involved in social media and third parties get involved in carrying their water so to speak in social media it can really escalate."

Prior to his work as a mediator, he practiced law as a trial lawyer with Friedman and Friedman in Bridgeport, Connecticut. After several years as an advocate, he sought a new approach to resolving disputes through increasing the participation of the parties in the resolution of their differences. At that time, he and his colleague, Jack Himmelstein, began to develop the Understanding-based model that is now practiced extensively in the United States and Europe. As one of the first lawyer mediators and a primary force in the current mediation movement, he has used this model to complete over one thousand mediations in the last two decades, including numerous two-party and multi-party disputes in the commercial and non-profit realms, in the area of intellectual property, real estate, corporate, personnel, partnership formations and dissolutions, and family law. Through the Center for Mediation in Law, Gary has trained lawyers, law professors and judges in the Center's method of mediation and a mediative approach to lawyering and collaborative practice. Since l989, he has been training lawyers, judges and psychotherapists in the United States, Europe, and Israel. He has taught courses in negotiation and mediation at Stanford University Law School and the New College of Law and has taught at Harvard Law School's Program on Negotiation and at the World Intellectual Property Organization in Geneva. This week on the Good Dog Pod, host Laura Reeves is joined by Debra Hamilton, Esq. to talk about the power of mediation in resolving issues surrounding dogs. Debra is the owner of Hamilton Law and Mediation and has extensive experience helping breeders, owners, and vets foster peaceful solutions. What are the different ways to approach a legal dispute? There are three main ways to settle a legal issue. One, the two parties can choose to negotiate an agreement outside of court, which is done without a third party. Two, a party can choose to pursue litigation, in which both parties have lawyers representing them in a court trial. Finally, the two parties can choose mediation, in which both parties agree to settle the issue with the help of a neutral third party. Why is mediation oftentimes the best answer? Mediation allows for both parties to truly listen to each other and understand the other's intentions. The neutral mediator facilitates the ability to listen, and helps both parties be more open and less defensive. Oftentimes, problems arise because someone was overwhelmed and said something they didn't really intend to say. Mediation can help in these sorts of situations, including owner-veterinarian disputes, breeder-buyer disputes, owner-handler disputes, and more. If encountering a problem, do not jump to litigation or write a bad review online; that would immediately ruin mendable relationships. On today's "Why Do Pets Matter?" Podcast we're hearing from a new voice in the animal law community, Jessica Chapman, JD. Currently, Jessica is pursuing her LLM at Lewis & Clark Law School -- the only University in the country offering an LLM in the field of animal law. (An LLM is a secondary degree for lawyers who have achieved their JD and passed the bar exam, and who are interested in a focused, specialized course of study in a specific topic of law.) Jessica's work revolves around having a different conversation and approach to animal abuse... 1. Healing abusers of their victimization and trauma from their own abuse or learned violence experiences will protect non-human animals and humans from becoming future victims. 2. Exploitation of animals and the legal abuse that occurs in industries that exploit animals -- like traumatized industrial workers -- which can manifest itself as abuse to companion animals and domestic violence. 3 We as advocates should develop relationships with individuals who the courts have convicted of abuse and with individuals who self-identify as abusers to find out which therapy techniques will help them heal from their past trauma. Condemning the individual and excluding them from therapy discussions enable the abuse to perpetuate. Experts in multiple areas should collaborate on therapeutic and rehabilitative approaches. Today Mindy Dutka from Dogs I Meet is our special guest today! Mindy is a professional photographer based in Boston who helps people take pictures of their dogs for posterity. She also takes pictures of dogs at rescues and shelters so they are more adoptable.Photography had always piqued her curiosity. Dr. Randall Lockwood is an internationally recognized expert on the connection between animal cruelty and human violence. He currently consults with the ASPCA about policy, response, and engagement regarding animal abuse since he retired from his position as Senior Vice-President with them. During this incredibly educational conversation, Randall and I talk about how pets benefit people, public health surrounding pets, and why people harm animals.We all know that while the pandemic has created a huge spike in pet adoptions -- a very good thing for both the people and pets, it has also been hard on a lot of people, both in terms of their resources and their mental health.When people are stressed or angry and they're always at home, that anger can be taken out on an animal, or a spouse, or even a child. Family pets are often ‘part of the domestic abuse cycle’ and there has been an increase in that since COVID hit the scene.Randall has done a lot of work with police agencies on issues related to dog shootings.Police departments throughout the country need to develop better training so officers can more accurately assess which dogs are life-threatening and dangerous and which are not.Most officers just aren't adequately trained to quickly and correctly assess the risks a dog poses and determine how to best handle the situation.Frequently, shooting a dog is a knee-jerk reaction by an officer not familiar with dogs. And, as police officers receive better training, the number of shootings is declining.

Since then she has worked in the field of animal welfare policy and research at the Animal Welfare Institute in Washington, D.C. and she has also volunteered with the rehabilitation of dogs with problem behaviors in the canine rescue community.In 2010 she took on a full-time position to develop and manage the training department at Fur-Get Me Not in Arlington, VA, creating all the behavior specialty classes, she held this position for 8 years.In 2018 she co-founded "Positive Dog Solutions" -- a company created to help build strong and healthy relationships between people, their dogs, and the community in which they live, using scientifically proven, practical, and humane methods.
