The U.S. Constitution famously outlaws “cruel and unusual punishments.” But there's another, far more obscure part of the Constitution called the Excessive Fines Clause, which basically says that the fine has to fit the crime. So far, the Supreme Court has been pretty mysterious about what that means. But for Ken Jouppi, the fate of his $95,000 plane hinges on it.Ken is a bush pilot. He used to run an air taxi service in Fairbanks, Alaska. In 2012, police caught one of Ken's passengers with a six-pack of Budweiser in her luggage. Over that six-pack, Ken was convicted of bootlegging. As punishment, he was ordered to forfeit his $95,000 Cessna.The Supreme Court is now considering whether to take Ken's case. And what's at stake here is more than just a plane. Welcome to your weekly UAS News Update. We have three stories for you this week: the FCC is set to vote on new rules that could impact covered list entities, DJI is appealing the "Chinese Military Company" court ruling, and we have a drones-for-good story out of New York. Let's get to it.First up, FCC Chairman Brendan Carr announced that the agency will vote on October 28th to close two major loopholes that companies on the "Covered List" have been using. The proposed rules would do two things. First, they would prohibit the authorization of any new devices that contain component parts from a Covered List company. And second, they would give the FCC the power to revoke previously issued authorizations in specific cases. This vote is happening just as DJI faces a December 23rd deadline from the National Defense Authorization Act. If a security review isn't completed by then, DJI automatically gets added to the FCC's Covered List. This is a direct shot at the strategy we've been discussing, with companies like Skyany, Skyrover, and Jovistar popping up with what are essentially rebranded DJI drones. According to the press release from the FCC, there may be an NPRM to follow, but the new rules could also prevent the import and sale of devices already approved.Next up, in a related story, DJI is appealing a federal court decision that kept it on the Pentagon's “Chinese Military Company” list. This is a really interesting case because DJI is in a legal paradox where it seems to have won based on the facts but lost in court. On September 26th, a D.C. District Court judge ruled that DJI would remain on the list, BUT the judge's decision explicitly rejected most of the Defense Department's core allegations. The court found no evidence that DJI is owned or controlled by the Chinese Communist Party or that it's linked to a military-civil fusion enterprise.The court only upheld two of the Pentagon's claims. The first was that DJI holds a "National Enterprise Technology Center" status, which the court acknowledged is widely granted to innovative tech companies, including U.S. ones. The second was that DJI products have "substantial dual-use applications," which is true for tons of off-the-shelf technology. Critically, the court found no evidence of actual misuse by the Chinese military. Despite all this, the judge deferred to the Pentagon's “broad discretion” on national security, keeping the label in place. This designation restricts federal contracts and spooks the private sector, which is a major problem when DJI still controls about 76% of the U.S. consumer drone market. And finally this week, a drones-for-good story! The Olean Police Department in upstate New York used a thermal drone to rescue three kayakers in distress on the Allegheny River. The distress call came in just before 8 p.m., and in the darkness, a traditional search would have been incredibly difficult. Instead, police and fire personnel quickly deployed their drone, which appears to have been a Mavic 3 Thermal. Within minutes, the drone's thermal sensor picked up the heat signatures of two of the kayakers in the cool water. This dramatically cut down the search time and likely prevented hypothermia. The search teams then shifted to the surrounding woods and located the third person on land. Until very recently, when many of the Navy Department's parts and other materials were removed from units that no longer needed them, those items tended to sit in storage without much visibility until they were eventually turned over to be disposed of as excess government property. But that's changed significantly in recent years, thanks to the Naval Supply Systems Command's Consumable Asset Reutilization Program, or CARP. NAVSUP Fleet Logistics Center in San Diego has been able to rescue and redirect 116,000 items, saving the government almost $14 million so far by reutilizing assets it already owns. Robert Medina is the deputy director for the CARP program's nearby Ventura County site, and Doug Murphy is the material management and warehouse utilization product and service lead. Dave and Bethlie continue their  multi-part series on the book Shepherding a Child's Heart by Tedd Tripp. Part 4 5.  The rod defined - p. 104 “The rod is a parent, in faith toward God and faithfullness toward his or her children, undertaking the responsibility of careful, timely, measured, and controlled use of physical punishment to underscore the importance of obeying God, thus rescuing the child from continuing in his foolishness unto death.”  It is a parental exercise 2.    It's great to be back in the comfort of the home studio and we're firing right out of the gate this week with a really interesting story about where we stayed at a golf resort in Utah.  It involves Patrick Mahomes buying the course and Andy Reid building a house there.  You have to hear this.    We had some really sad looking Trump protesters this weekend in KC and I feel terrible for them that they can't find something better to do.    Dems seem hell bent to stop Trump's tariffs that are bringing tax breaks to Americans and creating peace deals around the world.  Yes, Dems, lets stop all these good things from happening so you can blame the prez.    The Chiefs have one player they are focusing on more than others Friday in the season opener against the Chargers.  It's game week for the first Border War since 2011.  Bama, Texas and now Bill Belichick have really bad starts to the college season.    And our Final Final is the Chiefs rescuing the good people of Germany from a life without Kansas City's very own creation.... Cheez-It.

Will he/she live under their own authority? Proverbs 29:15, 17 The rod defined - p. 104 “The rod is a parent, in faith toward God and faithfullness toward his or her children, undertaking the responsibility of careful, timely, measured, and controlled use of physical punishment to underscore the importance of obeying God, thus rescuing the child from continuing in his foolishness unto death.”  It is a parental exercise It is an act of faith in God and His Word It is an act of faithfulness - an expression of love and comitment It is an act of responsibility - not a parent determining to punish, but a parent determining to obey It is an act of physical punishment Not venting or parental anger Not frustration Not based on a feeling of my child is bothering me It is always measured and controlled It is a rescue mission Rescues the child from continuing in foolishness To ignore your child's rebellion against God's authority is to ultimately brings God's greater chastisement into their lives. The Rod clarified Not unbridled temper Not the right to hit my child Not venting or frustration not retribution Not payment but restoration Not vindictive The Rod objected I love my child too much too spank You love yourself too much to spank them I am afraid I will hurt them “Biblically-balanced discipline never physically endangers a child” I am afraid it will make him rebellious and angry Proverbs 29:17 teaches the exact opposite I am afraid it will teach them to hit Only if you spank in anger It doesn't work It doesn't when you spank in anger or out-of-control It doesn't when you are inconsistent It doesn't when you fail to be persistent It doesn't when you aren't effective I could be arrested for child abuse Only spank in the privacy of your home and do it right
