Earl Blumenauer is one of the longest-serving elected officials in Oregon history – if not the longest. He first won election to the Oregon House of Representatives in his early 20s, and over the course of five decades went on to serve on the Multnomah County Commission, Portland City Council and, most famously, for nearly 30 years representing Portland in Oregon’s 3rd Congressional District. In that time, Blumenauer has stood out for any number of reasons: his bow tie, his enthusiasm for bicycles, and his passion for cannabis legalization to name a few. But now he’s saying goodbye to public office, and looking forward to a role helping his hometown find its feet.Blumenauer came into OPB on December 13 to chat with reporter Dirk VanderHart. This Day in Legal History: SEC EstablishedOn this day in legal history, June 6, 1934, the United States Securities and Exchange Commission (SEC) was established, marking a pivotal moment in the regulation of financial markets. The SEC was created in response to the stock market crash of 1929 and the ensuing Great Depression, aiming to restore investor confidence and safeguard their interests. Tasked with enforcing securities laws and regulating the securities industry, the SEC's mission was to ensure transparency, prevent fraud, and protect investors from unfair practices. President Franklin D. Roosevelt appointed Joseph P. Kennedy, a businessman and former stock market speculator, as the first Chairman of the SEC. Kennedy's experience and insider knowledge of Wall Street made him a controversial but effective choice for the role. Under his leadership, the SEC began implementing key reforms, including the requirement for companies to provide accurate and comprehensive financial statements, the regulation of stock exchanges, and the enforcement of laws against insider trading. These measures were crucial in stabilizing the financial markets and rebuilding public trust. The establishment of the SEC represented a significant shift towards greater federal oversight and accountability in the financial sector. The U.S. Federal Trade Commission (FTC) and the Department of Justice (DOJ) have agreed to divide responsibility over the artificial intelligence (AI) industry, allowing the FTC to investigate Microsoft's relationship with OpenAI. The DOJ will probe Nvidia for potential antitrust violations and oversee Alphabet Inc.'s Google. This arrangement follows over six months of negotiations between the agencies. The FTC has already initiated a probe into Microsoft's $650 million deal with Inflection AI, scrutinizing whether the company properly notified antitrust authorities. Both the DOJ and FTC declined to comment, and representatives from Microsoft, Inflection, OpenAI, Google, and Nvidia did not respond to requests for comments. The DOJ and FTC jointly enforce U.S. antitrust laws and decide internally which agency will handle specific investigations. This process, known as clearance, has previously led to disputes, especially in high-profile cases like those involving Google. The process of "clearance" between the DOJ and FTC, which involves determining which agency will investigate specific mergers and anticompetitive conduct, is crucial in managing jurisdictional overlaps and ensuring efficient enforcement of antitrust laws.In related developments, the European Union reviewed Microsoft's investment in OpenAI but opted not to pursue a formal investigation. Meanwhile, the UK's competition watchdog is examining the partnership but determined that Microsoft's deal with French AI company Mistral AI does not warrant an investigation.Microsoft, Nvidia to Face US Antitrust Probes Over Moves in AIUS regulators to open antitrust inquiries of Microsoft, OpenAI and Nvidia | ReutersDan Jacobs, chef-owner of two Milwaukee restaurants, adopted a service charge model during the pandemic to increase employee pay, which led to a $70,000 tax bill. This situation highlights a broader issue where the U.S. tax code favors traditional tipping systems with tax credits, disadvantaging restaurants that use service charges. Service fees, which can range from a few percent to over 20% of the bill, are intended to raise wages for back-of-house workers and reduce tipping disparities.Rep. Earl Blumenauer has introduced legislation to equalize the tax treatment of service charges and tips, arguing that the tax code should not penalize restaurants adapting to industry changes. The proposed bill would allow restaurants using service charges to claim a tax credit similar to the tip tax credit, provided the service charge goes directly to employees. Critics argue that service charges reduce workers' take-home pay and believe tips give employees more control over their earnings. The National Restaurant Association supports policies offering operational flexibility, and many Democrats in Congress advocate eliminating the subminimum tipped wage. Service charges spread earnings among all staff, including those already earning the minimum wage, potentially reducing income for traditionally tipped workers. Ending the tipped wage could address these disparities and make service charges a more viable option for restaurants. In short, the disparity in tax treatment between traditional tips and service charges under the U.S. tax code, which currently benefits restaurants that rely on tips through tax credits, is a significant issue. This inequity impacts how restaurants choose to compensate their staff and has prompted legislative efforts to create a more balanced system.Restaurant Service Fees Strike a New Nerve: How They're TaxedA Georgia appeals court has paused the criminal case against Donald Trump, who is accused of attempting to overturn the 2020 election results, while it considers his request to disqualify lead prosecutor Fani Willis. This decision halts progress toward a trial for Trump and 14 co-defendants until the appeal is resolved. Trump's appeal argues that Willis, the Fulton County District Attorney, has a conflict of interest due to an alleged romantic relationship with a former top deputy. The case is one of four legal battles Trump faces as he campaigns to reclaim the presidency. Recently, a New York jury found Trump guilty of concealing hush money payments to a porn star, a verdict he plans to appeal. Two federal cases, involving attempts to overturn the election and mishandling classified documents, are also entangled in legal delays. In the Georgia case, prosecutors intend to appeal a previous ruling that dismissed some charges in the indictment. The appeal process is expected to take several months, with oral arguments scheduled for October. Trump and his co-defendants have pleaded not guilty to racketeering and other charges related to the alleged scheme to reverse his narrow loss in Georgia.Trump election interference case paused in Georgia during challenge to prosecutor | ReutersAmazon is facing a £1 billion ($1.3 billion) lawsuit in the UK, filed by the British Independent Retailers Association (BIRA) on behalf of about 35,000 small retailers. We kicked off 2024 with an episode with Rep. Earl Blumenauer--https://transit-unplugged.captivate.fm/portland-streetcar--who could be credited for the modern streetcar boom in America, and this week we see how streetcars actually drive billions in economic development in Kansas City. Streetcars aren't just moving people and connecting the city in Kansas City, they are driving businesses like the aptly named Streetcar Grill which stands in what used to be a parking lot.Tom Gerend has been part of the Kansas City streetcar project since the beginning, first as part of the planning organization that put the project in motion and now as Executive Director of KC Streetcar. For Tom, this streetcar network is his baby; it's a project that creates a legacy for all of Kansas City. But that's not where we start off the interview.Historic Union Station in Kansas City was left to rot and ruin; almost demolished from disuse, but a ballot initiative brought it back to life and is now a landmark for the city. Union Station isn't just a transportation hub for the streetcar and Amtrak, it's a gathering place for the entire city. Tom took Paul for a tour of this architectural jewel and everything that's inside, including a model train exhibit and a science museum! From Union Station, Tom takes Paul on the streetcar to tell him all about the network and its contributions to the city. From low floors that make it easy for anyone to board to keeping the system fare-free, KC Streetcar is fast becoming integral to the city.Paul and Tom finish up at the Streetcar Grill and talk more about his career, the plans for the streetcar network, and the economic benefits it's brought to the city. And if all of this sounds amazing, you can see it all on April 11th on Transit Unplugged TV! In terms of structure, I'll provide a summary of the bill, tell you who's behind it and who's not, where it stands, what it does, what it theoretically costs and what's at stake.  Chapters Intro: 00:01:06 The 117th Congress: 00:04:39 Quickie One: A Two-Fer for First Nations 00:10:14 Quickie Two: The bare fucking minimum. 00:14:20 Coffee Break 00:19:22 Quickie Three: Reefer Madness 00:20:29 Post Show Musings: 00:33:31 Outro: 00:48:53 Resources GovTrack: Statistics and Historical Comparison Congress.gov: H.R.1688 - Native American Child Protection Act Indian Country Today: House passes Gallego and Young bill to protect Native American children Congress.gov: H.R.5444 - Truth and Healing Commission on Indian Boarding School Policies Act Congress.gov: H.R.4 - John R. USA Today! Congress finds bipartisanship on animal protection issues WASHINGTON — Congress has found something cute and cuddly to agree on.   Plagued by bitter division and fierce infighting, Republican and Democratic lawmakers have found rare consensus on legislation to protect dogs, cats, horses, tigers and bunnies from abuse.   In the first few months of the new 115th Congress, House members and senators have introduced more than a dozen bipartisan bills on animal welfare, including a measure to bar people from keeping tigers, lions, and other big cats as pets and legislation to outlaw the sale of shark fins in the U.S.   About half of those stand a strong chance of passage this session, said Wayne Pacelle, president and CEO of  The Humane Society of the United States.   "I think we're positioned for success," Pacelle said. "You have such a diverse group of people — from conservative Freedom Caucus members to moderate Republicans to liberal Democrats — who have come together on an issue they know their constituents care about."   Americans' passion for animals is what's driving Congress to act, said Rep. Vern Buchanan, R-Fla., the new co-chairman of the bipartisan Congressional Animal Protection Caucus, which has more than 120 members.   "The biggest reason that this issue crosses party lines is that is has so much public support," said Buchanan, who was named the 2015 "legislator of the year" by the Humane Society. "About a third of my district is seniors, and most of them have pets that they love. I've had dogs and cats and horses myself, but I never realized how much passion there was for animals until I got this job 10 years ago. It comes up at almost every one of my town halls."   Rep. Earl Blumenauer, D-Ore., co-chairman of the caucus, said Americans have become increasingly vocal about how much they care about their pets, wildlife and farm animals.   "Members of Congress are realizing that protecting animals is not just the right thing to do, it's also developing to become potent politically," he said.   Blumenauer said that point was underscored last fall in Oklahoma, where animal protection advocates defeated a "right to farm" ballot initiative that critics said would have allowed abusive "puppy mill" operators to shield themselves from laws against animal cruelty. Residents of the conservative state, which voted overwhelmingly for Donald Trump in the same election, defeated the initiative by about 20 points.   Animal welfare advocates also helped pass a ballot measure in Massachusetts last year to ban extreme confinement of farm animals and an initiative in Oregon to ban the trade in ivory, rhino horns, and other body parts from wild animals.   Those votes have helped convince members of Congress from both parties to support animal protection laws at the federal level, Pacelle said.   "Supporting animal protection also allows them to soften their image with their constituents and show compassion," he said. "Animals help humanize them."   Among the bills that Congress is considering:   — Big Cat Public Safety Act: Reps. Jeff Denham, R-Calif., Walter Jones, R-N.C., and Niki Tsongas, D-Mass., teamed up to offer this bill to ban the possession and breeding of lions, tigers, leopards and other big cats by private individuals or unqualified exhibitors at roadside zoos. Thousands of big cats are being kept in people's backyards and basements or in poorly maintained roadside zoos, creating a serious safety hazard for the public while threatening the cats' health, the bill's supporters say.   More were listed but not included as they are not big cat focused.    Hi, I'm Carole Baskin and I've been writing my story since I was able to write, but when the media goes to share it, they only choose the parts that fit their idea of what will generate views.  If I'm going to share my story, it should be the whole story.  The titles are the dates things happened. If you have any interest in who I really am please start at the beginning of this playlist: http://savethecats.org/   I know there will be people who take things out of context and try to use them to validate their own misconception, but you have access to the whole story.  My hope is that others will recognize themselves in my words and have the strength to do what is right for themselves and our shared planet.     You can help feed the cats at no cost to you using Amazon Smile! PC focuses reports, briefs, and long analysis on local news (OR), national news (USA), and some on international news when there is need. Most of the needed news & information to report is in USA. Today, PC focuses on Oregon and how life long politician, never work a day in his adult life, criminal Earl Blumenauer used THE PEOPLE'S tax dollars/state money, his time WE THE PEOPLE of Oregon pay him to do work for us, and he sent out "Supporting the Ukrainian People" email. Here it is for you to read as I am sick of these traitors spending our money on other countries.{Dear Friends,  Just over a week ago, Putin launched an unprovoked, unjustified, and ruthless invasion of Ukraine. In the time since, President Biden has rallied virtually all of our allies to forcefully condemn and punish Russia for these illegal and inhumane actions. He even got Switzerland, which kept doing business with the Nazis during World War II, to join our sanctions. We have imposed strict economic sanctions, banned Russian aircrafts from entering our airspace, and cut off major Russian banks from the international economy. The Biden-Harris administration has also done what some may have thought was impossible in getting Germany to sacrifice access to a gas pipeline from Russia, a reversal in a policy that dates back 70 years. The United States is using every tool at our disposal, short of armed conflict, to condemn Russia and support the Ukrainian people. And this is just the start. As chair of the Ways and Means Trade Subcommittee, I am working to advance legislation to end Russia's “most-favored nation” trading status, which the United States last did against those committing genocide in Bosnia and Herzegovina three decades ago. This would immediately make all Russian imports uncompetitive in the global market, cutting off Putin's cash flow. I am also advocating that the United States to kick Russia out of the World Trade Organization, further isolating them from the rest of the globe. I am encouraged by the actions of the Ukrainian people, they deserve our support in this trying time for them and their family and friends back home. I strongly support President Biden's request for $2.9 billion in emergency supplemental assistance for Ukrainian refugees. More than a million Ukrainian civilians have already fled their country. We have a responsibility to support these refugees now, including by raising the cap on refugee admissions so they can come to the United States. I also joined my colleagues in calling on the administration to provide Ukrainians currently in the United States with Temporary Protected Status. I am committed to deploying more humanitarian aid to the people of Ukraine for the duration of this crisis.  I have also been heartened to see the Oregon Slavic community gather to pray, protest, and fundraise for the people of Ukraine. In times of great uncertainty, community is a powerful tool. I have taken time to check in with members of the Ukrainian community in our district and will continue to do so as this situation develops. I will be sure to keep our community updated as we continue these efforts.   Courage,Earl BlumenauerMember of Congress}Washington, DC Office1111 Longworth House Office BuildingWashington, DC 20515Phone: (202) 225-4811Fax: (202) 225-8941Portland Office911 N.E. 11th AveSuite 200Portland, OR 97232Phone: (503) 231-2300Fax: (503) 230-5413

With states and localities already contemplating how to maximize federal infrastructure funding after the passage of the Infrastructure Investment and Jobs Act, panelists in this episode discuss spending plan strategies and what may lay ahead for states and localities now burgeoning with one-time cash. This special briefing features a panel of experts, including US Representative Earl Blumenauer (D-Oregon); Patrick J. Brett, managing director and head of Citi's Municipal Debt Capital Markets and Capital Solutions businesses, chairman of the Municipal Securities Rulemaking Board, and advisory board member at Penn IUR; David Glick, associate professor in the Boston University Political Science Department, faculty director of MetroBridge, and co-principal investigator on the Menino Survey of Mayors with BU's Initiative on Cities; and Rebecca Rhynhart, Controller for the City of Philadelphia. Notable Quotes: “With the election of Joe Biden, we have, for the first time in my twenty-five-year career, we have a President who is not only committed to rebuilding and renewing America, but is willing to put resources behind it,” Congressman Earl Blumenauer. “So, in my view, I thought if the city spent one billion dollars more, and resident satisfaction declined, then we should be able to figure out how to balance the budget without raising taxes on people,” Philadelphia Controller Rebecca Rhynhart. “Roughly half of the mayors said something that was definitely in an infrastructure category that was in their top two, if we include housing… it is closer to two-thirds,” David Glick. “Any time you're talking about infrastructure in this country you're talking about state and local governments, because state and local governments, even with this bill, still fund over half of the infrastructure in this country,” Patrick Brett. Full text: The U.S. Postal Service boasts that “neither snow nor rain nor heat” can keep mail carriers from swiftly completing their rounds; TriMet's MAX Light Rail service can make no such claim. Last week, the heatwave brought temperatures well into the 100s, causing MAX services to shut down from Saturday to Tuesday. If you are from the Portland area, you know these closures aren't just limited to heat. They also happen when we have ice, snow, or—most commonly in Portland—excessive rain. If you are depending on public transit to get to work, why lean on the unreliability of light rail? Despite the billions of dollars our local, state, and federal governments sink into light rail, daily bus ridership doubles that of the MAX. This should come as no surprise, as buses are more reliable, faster on average, and get you much closer to your final destination. Every time the MAX fails, the buses are there to bail it out. But local leaders still haven't given up on their obsession with trains. Congressman Earl Blumenauer insists that any I-5 replacement bridge over the Columbia River must include an extension of light rail to Vancouver. However, an Express Bus Route operated by C-TRAN already runs along the same path and gets passengers into Downtown Portland—far more quickly than light rail could. Let's instead focus on what works—investing in reliable roads that support the smooth travel of our cars and buses. --- Send in a voice message: https://anchor.fm/coffeewithcascade/message

Notable Quotes: “The Biden administration is currently double-tracking, working on the big ideas of the America's Jobs Plan, but also really trying to engage in a bi-partisan way with committee leadership on Capitol Hill on a surface reauthorization,” Polly Trottenberg. “This is the fine point I think we all need to embrace, and that is this is a twenty-first century plan, for twenty-first century problems,” Marc Morial. “There's a lot of good things in the President's plan, but I think three key elements are missing, and they all three fit together. User fees, long-term financing, and private capital,” Robert Poole. “It's no secret to a number of you on this call that I have been deeply, deeply troubled by our continued underinvestment in infrastructure, and how we've reduced our investment since the 60s,” Earl Blumenauer.
