Procedural due process When the government seeks to burden a person's protected liberty interest or property interest, the Supreme Court has held that procedural due process requires that, at a minimum, the government provide the person notice, an opportunity to be heard at an oral hearing, and a decision by a neutral decision-maker. For example, such a process is due when a government agency seeks to terminate civil service employees, expel a student from public school, or cut off a welfare recipient's benefits. The Court has also ruled that the Due Process Clause requires judges to recuse themselves in cases where the judge has a conflict of interest. For example, in Caperton v A T Massey Coal Company (2009), the Court ruled that a justice of the Supreme Court of Appeals of West Virginia had to recuse himself from a case involving a major contributor to his campaign for election to that court. Incorporation. While many state constitutions are modeled after the United States Constitution and federal laws, those state constitutions did not necessarily include provisions comparable to the Bill of Rights. In Barron v Baltimore (1833), the Supreme Court unanimously ruled that the Bill of Rights restrained only the federal government, not the states. However, the Supreme Court has subsequently held that most provisions of the Bill of Rights apply to the states through the Due Process Clause of the Fourteenth Amendment under a doctrine called "incorporation". Whether incorporation was intended by the amendment's framers, such as John Bingham, has been debated by legal historians. According to legal scholar Akhil Reed Amar, the framers and early supporters of the Fourteenth Amendment believed that it would ensure that the states would be required to recognize the same individual rights as the federal government; all these rights were likely understood as falling within the "privileges or immunities" safeguarded by the amendment. By the latter half of the 20th century, nearly all of the rights in the Bill of Rights had been applied to the states. The Supreme Court has held that the amendment's Due Process Clause incorporates all of the substantive protections of the First, Second, Fourth, Fifth (except for its Grand Jury Clause) and Sixth Amendments, along with the Excessive Fines Clause and Cruel and Unusual Punishment Clause of the Eighth Amendment. While the Third Amendment has not been applied to the states by the Supreme Court, the Second Circuit ruled that it did apply to the states within that circuit's jurisdiction in Engblom v Carey. The Seventh Amendment right to jury trial in civil cases has been held not to be applicable to the states, but the amendment's Re-Examination Clause does apply to "a case tried before a jury in a state court and brought to the Supreme Court on appeal". The Excessive Fines Clause of the Eighth Amendment became the last right to be incorporated when the Supreme Court ruled in Timbs v Indiana (2019) that right to apply to the states. The amendment is a response to the Quartering Acts passed by the British parliament during the buildup to the American Revolutionary War, which had allowed the British Army to lodge soldiers in private residences. The Third Amendment was introduced in Congress in 1789 by James Madison as a part of the United States Bill of Rights, in response to Anti-Federalist objections to the new Constitution. Congress proposed the amendment to the states on September 28, 1789, and by December 15, 1791, the necessary three-quarters of the states had ratified it. Secretary of State Thomas Jefferson announced the adoption of the amendment on March 1, 1792. The amendment is one of the least controversial of the Constitution and is rarely litigated, with criminal justice writer Radley Balko calling it the "runt piglet" of the U.S. Constitution. To date, it has never been the primary basis of a Supreme Court decision, though it was the basis of the Court of Appeals for the Second Circuit case Engblom v Carey in 1982. Text. The complete text of the amendment is: No Soldier shall, in time of peace be quartered in any house, without the consent of the Owner, nor in time of war, but in a manner to be prescribed by law.. Background. In 1765, the British parliament enacted the first of the Quartering Acts, requiring the American colonies to pay the costs of British soldiers serving in the colonies, and requiring that if the local barracks provided insufficient space, that the colonists lodge the troops in alehouses, inns, and livery stables. After the Boston Tea Party, the Quartering Act of 1774 was enacted. As one of the Intolerable Acts that pushed the colonies toward revolution, it authorized British troops to be housed wherever necessary, including in private homes. The quartering of troops was cited as one of the colonists' grievances in the United States Declaration of Independence.

Vi diskuterer flittig, og er enige med klubben om at formasjonsendring er riktig vei å gå, men lurer veldig på hvorfor denne endringen kommer først nå, etter at sesongen er i gang.En gjennomgang av kampen mot Kristiansund er naturlignok en del av programmet, inkludert SF-Poddens spillerbørs. Sandefjord spiller ingen kjempekamp, men kjemper gjør de med nebb og klør, og det er nok til å skape entusiasme! Eller?Banens beste var uten tvil Flamur Kastrati, som meget offensivt etter kampen annonserte at han ikke skal sitte på noen benk igjen. Er du enig?Gjest i denne ukens episode er Administrativ Leder for Sandefjord Fotball Kvinner, Lasse Saga. Han forteller om satsingen til kvinnelaget, målsetninger for sesongen, hvilke spillere som man bør se opp for og ikke minst hvorfor man bør ta turen for å se på kvinnelaget. Saga forteller om et ungt lag med store ambisjoner, de vil rykke opp til andre divisjon med en gang. SF Kvinner har aldri tapt en seriekamp, og alle i studio er enige om at den trenden vil fortsette etter årets første bortekamp, mot Ørn Horten/Eik-Tønsberg 2. Hvordan tror du kvinnelaget gjør det i år?Bortekamp skal også herrelaget spille til helgen. Da venter en tøff kamp i Tromsø. Tromsø har som Sandefjord, hatt veldig varierende resultater så langt i sesongen, og det pleier å være jevnt mellom lagene. I studioet råder dog optimismen og alle har tro på seier med den nye formasjonen, og ikke minst spisspartnerskapet mellom Engblom og Kastrati. SF-Podden er tilbake. Gjest i studio er den nye spissen til Sandefjord, Pontus Engblom. Engblom forteller valg han måtte ta i sin oppvekst, hvor han var aktiv både som hockey, innebandy og fotballspiller. Dette er en del av de ti faste spørsmålene som SF-Podden stiller spillere når de er på besøk. Vet du hvilken kjent internasjonal fotballspiller Pontus vokste opp med, og spilte innebandy med? Det var noen likhetstrekk i de to kampene, noe gutta i studio trekker frem. SF var best i første omgang i begge kampene, men spiller dårlige andre omganger, og mot Ranheim, svært dårlig. Hva var årsaken til det? Den nye vingbacken Eleftheriou ble også svært lite brukt på høyresiden gjennom begge kampene, er Sandefjord Fotball for venstrevridde?Engblom kommer med interessante synspunkter fra innsiden, og avslører at spillerene selv også var svært misfornøyde med det som ble vist i andre omgang.Søndag er det ny kamp mot Kristiansund. SF-Podden tar ut laget som de mener bør starte mot Kristiansund, de foreslår en formasjonsendring, vil du også bytte formasjon?Tilskuertallene på de to hjemmekampene som ble diskutert var urovekkende lave, noe gutta i studio ikke er særlig fornøyde med. De tar et lite oppgjør med "sofasupportere", som de mener bør komme seg ut av sofaen og opp på stadion, istedenfor å bare vise misnøye andre steder. #225. Henrik Engblom is the bosun on the tall ship Pommern, one of the classic Cape Horn clipper ships that sailed out of the Aland Islands in the early 20th century. Aland is a Swedish-speaking but legally Finnish archipelago in the Baltic Sea, about 40 miles northeast of Stockholm, and home to a rich cultural & maritime history. Only in his 20s, Henrik, a native Alander Islander, is already a Master Rigger and in charge of Pommern’s restoration. Mia & I visited the ship back in 2013 when we sailed to Aland on Arcturus.
