Since at least 2019 the United Nations has tried to justify banning anime and manga due to what they consider to be potentially obscene depictions of sexual material related to children. This has failed miserably in the US, Japan, and Australia. In Texas a new bill seeks to do the same, though Ashcroft v. Free Speech Coalition will likely rule it to be unconstitutional regardless. It's strange that a product like anime or manga, admittedly open for interpretation - the characters are often part cat or animal, are hyper exaggerated, or are based on kawaii culture - would be targeted instead of actual pornography or actual sex trafficking operations. At least in terms of the publicity and priority. Perhaps the priority is based on something else, like certain groups claiming that such content, including game versions, promotes racial homogeneity and marriage norms. And there it is! While the United States admits it has the ability to “manipulate time and space,” the country still can't seem to pick up trash, clean subways, build high speed transportation, or fix infrastructure, let alone create anything new. In fact, the implication of scientific-fiction technology from the White House Science adviser might explain where the trillions of missing US dollars go. The thing is the United States maintains its power in the world through fear of war and economics, and by banning and censoring the outside, like China does. The country has lost any moral high ground and certainly any real essence of culture. Perhaps that's why anime and manga are growing so rapidly in the United States. It's something unique, different, fresh, and certainly not politically correct. Once again, priorities, because instead of building better cars, trains, infrastructure or even good entertainment, the country sabotages all of that and wastes its money on weapons and war. Even the Internet and GPS, two major contributions from the USA to the world, were invented by DARPA and the DOD - for killing and control. This power, and the power of politics, like Oregon cancelling math and reading requirements for graduation, also keeps the citizens in the dark of an antiquated reality. Much of the technology the country does have doesn't come from American minds anyways, it comes from Asia and largely from Israel. The county that gives us anime and manga, which is one of the least politically correct in the world, and one of the most conservative, also gives us QR codes, emojis, plastic that dissolves with no microplastics, tornado prediction software that is accurate, super advanced solar panels, bullet trains since 1964, hybrid cars since 1997, laptops, portable music, the novel, navigation systems, and most discs like DVD and CD. It is also a country that when there is widespread technological failure, citizens still voluntarily pay there toll fees because the money actually goes into infrastructure, and because it is a culture of honor and respect. On the other hand, the US state of California has blown through $15.7-billion and failed at constructing a high-speed rail in 2025. On January 15, the Supreme Court heard oral arguments for Free Speech Coalition, Inc. v. Paxton, a case involving Texas H.B. 1181, which is a law that imposes an age-verification requirement for adult sexual content websites. While content filtering has been used in the past by parents to regulate their children’s access to adult websites, the rapid advancement of technology in the past 20 years has raised concerns about the success of content filtering. Free Speech Coalition, Inc. v. Drawing on a line of cases including Ashcroft v. ACLU (2004), the plaintiffs argued that since the law impacted constitutionally protected speech, strict scrutiny should be applied and the TX law failed that test. In reviewing the case, the Fifth Circuit denied that argument, instead applying a rational basis test, drawing from the precedent of Ginsburg v. Episode 23: Free Speech Coalition, Inc. v. Paxton Free Speech Coalition, Inc. v. Paxton, argued before the Supreme Court of the United States on January 15, 2025. Argued by Derek L. Shaffer (on behalf of Free Speech Coalition, et al.), Brian H. Fletcher, Deputy Solicitor General of the United States (on behalf of the United States as amicus curiae), and Aaron Nielson, Solicitor General of Texas (on behalf of Ken Paxton). Background on the case, excerpted from the introduction of the Brief for Petitioners: Texas House Bill (H.B.) 1181 imposes requirements on commercial websites “more than one-third of which” are “sexual material harmful to minors”—a term that includes all sexually suggestive content, as might be found in romance novels or R-rated movies. The law requires a covered website to verify the age of every user, typically via government-issued identification. Entities conducting such verification may not “retain” users' “identifying information,” but H.B. 1181 does not prohibit transfer of that information or impose any other protection against disclosure. And while Texas insists that forcing users to endure chilling online privacy and security risks is necessary to protect minors from harmful sexual content, H.B. 1181 exempts the search engines and social-media platforms that are principal gateways for minors' access to that very content. Confirming Texas's real aims, H.B. 1181 also requires covered websites to post stigmatizing, unscientific “[w]arnings” that condemn their content as harmful to health. The district court preliminarily enjoined H.B. 1181, finding that the law is subject to strict scrutiny and likely to fail it under this Court's governing precedent. In particular, the court explained that H.B. 1181's age verification requirement is materially identical to the Child Online Protection Act (COPA), 47 U.S.C. § 231, which this Court in Ashcroft held was subject to strict scrutiny and likely unconstitutional. The Fifth Circuit agreed that H.B. 1181 is materially identical to COPA, but a divided panel held that it was not bound by Ashcroft because that decision contains what the majority termed “startling omissions.” The majority concluded that the proper level of scrutiny is instead rational-basis review, as applied in Ginsberg. To justify its departure from Ashcroft, the majority reasoned that this Court there applied strict scrutiny to COPA only because Attorney General Ashcroft, represented by Solicitor General Olson, erroneously accepted strict scrutiny rather than urging mere rational-basis review in defense of the statute. Question Presented: This Court has repeatedly held that States may rationally restrict minors' access to sexual materials, but such restrictions must withstand strict scrutiny if they burden adults' access to constitutionally protected speech. See, e.g., Ashcroft v. ACLU, 542 U.S. 656, 663 (2004). In the decision below, the Fifth Circuit applied rational-basis review—rather than strict scrutiny—to vacate a preliminary injunction of a provision of a Texas law that significantly burdens adults' access to protected speech, because the law's stated purpose is to protect minors. The question presented is: Whether the court of appeals erred as a matter of law in applying rational-basis review to a law burdening adults' access to protected speech, instead of strict scrutiny as this Court and other circuits have consistently done. There is growing concern among parents and policymakers over the Internet's harms to children—from online pornography to social media. Despite that, Congress hasn't passed any legislation on children's online safety in decades. And while psychologists continue to debate whether and to what extent certain Internet content harms children, several states have stepped into the fray, passing legislation aimed at protecting kids in the digital age. One such state is Texas where Governor Greg Abbott signed HB 1181 in June of 2023.The bill requires adult or online pornography websites to verify the age of users to prevent users under the age of 18 from accessing those sites. A group representing online porn sites sued, and the bill was enjoined by a district court, then partially upheld by the Fifth Circuit, and will now be heard by the Supreme Court in Free Speech Coalition v. Paxton, with oral arguments scheduled for January 15.The ruling in this case could have major implications for efforts to regulate the online world both at the state and federal level—not just for porn but other online content social media. On today's show, Evan moderates a debate on the following resolution: Texas's Age Verification (AV) Law is Constitutional and AV laws are an effective means of protecting children from online harms.Arguing for the resolution is Adam Candeub, senior fellow at Center for Renewing America, professor of law at michigan state university, and formerly acting assistant secretary of commerce for telecommunications and information under President Trump. Arguing against the resolution is Robert Corn-Revere, chief counsel at the Foundation for Individual Rights and Expression (FIRE). Days after dropping out as the Democratic presidential nominee, Joe Biden addressed the nation from the Oval Office, pledging his commitment to finishing his term and restating his support for Vice President Kamala Harris as his replacement on the November ballot. A whirlwind of donations and support for Harris has re-energized Democrats — does that effort qualify as “grassroots?”Both Trump and Harris spoke following the candidate change. Internet age verification bills are emerging nationwide. Several have been signed into law. According to the Free Speech Coalition's May 28, 2024 update, “Bills in Alabama, Georgia, Kansas, Kentucky, Oklahoma, South Carolina, and Tennessee were enacted in the last two months, bringing the total number of states with age verification laws to 18.” The stated intent of age verification laws is to keep minors from accessing pornography sites. This, of course, is a reasonable effort. After all, she has the ashes of her burned home and business to prove it. She and her family were caught up in violence in their community in Ethiopia. She said, “When we left our home, it was very difficult. We couldn't even find a way to get out; we hid in a neighbor's house three houses down. I can't explain the pain and worry I felt in the chaos. Our possessions were destroyed; we lost everything.” Thankfully, Open Doors was able to help her with both immediate needs—and long-term trauma care. Desta explained, “Because I came [to the trauma care seminar], countless things have changed in me. I've learned about humility, and how Jesus was also persecuted. … Jesus was also hated, and He was also cast out.” In John 15:18-19, Jesus said, “If the world hates you, keep in mind that it hated Me first. If you belonged to the world, it would love you as its own. As it is, you do not belong to the world, but I have chosen you out of the world. That is why the world hates you.” Open Doors lists Ethiopia as the 32nd most dangerous country worldwide in which to be a Christian. Chinese Bible distributor sentenced to 5 years in prison In April 2021, Chinese authorities arrested 10 Christians for selling and distributing Bibles in Hohhot, the capital city of Inner Mongolia — an autonomous region in northern China. Just last month, a judge sentenced one of these believers to prison. On April 15, 2024, Ban Yanhong was sentenced to five years in prison for “illegal business operations.” That's how the Communist government describes the distribution of Bibles to Christians in Inner Mongolia. Originally, the 10 Hohhot Christians purchased the Bibles legally from a church in Nanjing associated with the Three-Self Patriotic Movement. These churches are the only legal churches in China and are controlled by the Communist government. In Ban's case, prosecutors argued that even though the Bibles were initially purchased legally in Nanjing, selling and distributing them in Inner Mongolia by unregistered house church members was illegal. Supreme Court agrees with Texas' age requirement for porn Great news! The United States Supreme Court has rejected a request to block enforcement of a Texas law that requires porn sites to verify the age of its users. This will ensure that far fewer minors will have access to these ungodly images. In a one-sentence miscellaneous order released Tuesday that included no dissents, the Supreme Court declined to issue a stay in the case of Free Speech Coalition v. Paxton. This allows a ruling from a three-judge panel of the U.S. Court of Appeals for the Fifth Circuit that upheld the age verification law to remain in effect. Last June, Texas Republican Governor Greg Abbott signed House Bill 1181, which requires porn sites to verify a user's age. Any company found violating the requirement faces a fine of as much as $10,000 per day. Additionally, a porn company can be fined $250,000 if a minor sees explicit content because their age was not properly verified. Second Boeing whistleblower died unexpectedly A second Boeing whistleblower has died unexpectedly as the company faces scrutiny over safety failures on its passenger jets, reports Fox News. Joshua Dean, a quality inspector for the Boeing supplier Spirit AeroSystems, died this week after a surprise infection left him in critical condition for days. The cause was MRSA, an antibiotic-resistant staph infection, according to what his aunt Carol Parsons told the Seattle Times, which first reported the death. The 44-year-old lost his job in 2023 and filed a retaliation complaint with federal labor officials, alleging that he was only fired for speaking out. Dean had been deposed in connection with a shareholder lawsuit and had reported dangerous faults in components of Boeing's 737 MAX plane — a model linked to a number of catastrophes in recent years. John Barnett, age 62, is the other Boeing whistleblower. He had sued Boeing, claiming that he had been retaliated against, harassed, and spied on by the company. He never showed up for his second day of depositions. Barnett was found dead from an apparent self-inflicted gunshot wound on March 9 outside his Charleston, South Carolina hotel the day after he gave a deposition in connection with his own retaliation lawsuit. “Unsung Hero” is a must-see Christian movie And finally, Joel and Luke Smallbone, the Australian duo that make up the Grammy Award-winning group for King and Country, and their older sister, artist Rebecca St. James, are widely known in music circles. The company behind it also released “Jesus Revolution,” “I Can Only Imagine” and “Ordinary Angels.” A wholesome, faith-based film, “Unsung Hero” focuses largely on the power of prayer. In Philippians 4:6, the Apostle Paul wrote, “Do not be anxious about anything, but in everything, by prayer and supplication with thanksgiving, let your requests be made known to God.” “Unsung Hero” also underscores the necessity of a vibrant church community, and the importance of family sticking together against all odds.
