In the wake of this year's Supreme Court positions, treating OB/GYN emergencies according to standards of care can now result in criminal or civil charges for you and your patients in some states. Major medical societies have come out against the Dobbs v. Jackson decision that overturned Roe and Casey. While EMTALA currently provides some support for emergency physicians, state laws and local prosecutors still might try to take you to court. Understanding your state's law and interpretation by your institution is crucial. On this episode host Kate Joyce (@sceneisnotsafe) talks with attorney Carmel Shachar (@CarmelShachar), policy analyst Cat Duffy (@catduffy), EM resident Jessica Adkins Murphy (@DrAdkinsMurphy), and OB/GYN resident Andrea Contreras about keeping your job and patients safe in today's legal and political landscape.

288: Will the New Laws Punish the Perpetrators?

Life Matters

With the overturn of Roe v. Wade and the implementation of the Dobbs Decision, each state will now have the authority to create new laws protecting innocent human life. But there are some dangers, and we must consider well how these laws are to be presented. Most importantly, we must realize that every abortion has two victims: obviously the child, but the mother herself is a victim of the act of abortion. As discussed and examined in depth in my book: “Evil Twins: Roe and Doe - How the Supreme Court Unleashed Medical Killing,” it is very clear that the Supreme Court instructed that in all states, it was only to be doctors who were to make the decision of performing an abortion, that women were not given this authority, but could only ask. All authority for the abortion decision was given entirely to the doctor alone  It is critical as pro-lifers look at which new laws to put into place, that women not be viewed in the way that the radical feminist movement has portrayed them, i.e. as agents of ‘choice' but instead, the law must recognize it is the perpetrator of the abortion, the abortionist, who, in performing an abortion, has one goal - the ending of a human life. The indirect object of the abortion procedure is in fact a pregnant woman. Her ‘participation' is necessary. But Roe v. Wade itself is clear she is not given any moral agency or authority. Years later, Justice Ruth Bader Ginsburg underscored with vigor that irony.  Roe versus Wade and its progeny was very clear the woman did not have authority - she was free to have a consultation with the abortionist, but a consultation does not grant authority nor should it give culpability to the woman. Many women went through consultation, and while still on the abortionist's table had second thoughts about being there, had felt manipulated, had felt there was something wrong. In the best of situations they won against all peer pressure and the social pressure of the clinic staff and literally ran from the abortionist table. There are numerous such stories and young men and women who will tell those stories today, they are alive because their mother ran from the clinic.  Legally speaking, a consultation is not the same as performing an abortion. As we look to the future we must understand that the purpose of the law is not to blame, but in fact to instruct. The law principally is a teacher and a protector. We are as a society addressing abortion to protect children and young women.   Remember, when we protect young women who have been sex trafficked, we do not demand they be prosecuted as prostitutes. We hunt down the manipulators and pimps who took advantage of them. It is they whom the law must more stridently address. Similarly, laws regarding truancy are not designed to ‘punish' students who are absent from school. Rather their purpose is to ensure that that student is getting an education. And if there is to be any penalty, it ought to be directed toward malfeasant parenting. The student is to be protected by the truancy laws, not punished by them. As states consider enacting new pro-life laws, we must look to protect the second victim of the abortion: the indirect object of the abortionist pursuit, the vulnerable young mother. She is in that unfortunate situation. We must not punish women, but use the law to guide.  And to keep them from harm, we must punish the perpetrators.

From our friend and today's guest Daniel Gay "I chose Philip Glass' “Solo Piano” because it's the most transportive record I've ever heard.  It's music for all seasons of life; it can be warm, cold, stark, ambitious, unrelenting, but more than anything it's constantly beautiful.  Each track, each arpeggiated run.  It's reference points have always resonated with me.  Kafka, Ginsberg, the Dali Lama, Buddhism, social justice, anti-authority.  For more than 25 years, this music has accompanied me through the births of my kids, deaths, degrees, jobs, marriage, love and loss, and I attribute some of its power to helping me quit alcohol and remain on a path of alcohol sobriety.  It's mindful music, not in the “Life is Good” hippie way, but in the way that it centers me.  It's classical music for punk rockers, or  music for thinkers and dreamers.  Glass won't physically  be around much longer, but the next generation, guys like Richter, Tiersen, O'Halloran…they'll push the minimalist form forward and continue to inspire people to step out of their boxes, focus, and be conscious of the beauty of the world and my place in it."Enjoy the episode, and check out Daniel Gay's YouTube Channel! In her debut podcast launch, Dr. Amy engages in a riveting discussion with Dr. Ken Ginsberg, a pediatrician with 35 years of experience.  Dr. Ginsberg is a resiliency expert who focuses on building trauma awareness in medicine, establishing tools and resources for providers, and shifting the lens from what is “wrong” with patients to what is “good and right” with them.  During this hour-long podcast, you will get to explore a different perspective when it comes to treating kids who have experienced trauma.  More importantly, you'll learn how to reframe the conversation with your patients and explore positive ways to deal with trauma.  You'll learn that you can advocate for resiliency, instead of framing a patient as “broken”  You'll also learn not to take it personally and how to avoid changing the narrative for your own perspective. As providers, you will need to be there for the critical moments in your patient's lives.  This captures all the elements of your patients' lives, whether it be the good or the bad.  However, after listening to this podcast, you'll learn how to focus on the good, so that when the bad does happen, your patients will be well equipped to handle it.  Dr. Ginsburg is the Founding Director of CPTC and Professor of Pediatrics at Children's Hospital of Philadelphia. He travels the world speaking to a parent, professional, and youth audiences and is the author of 5 award-winning parenting books including a multimedia professional toolkit on “Reaching Teens.” CPTC follows his strength-based philosophy and resilience-building model. I cannot believe it has been a year since the podcast launched. So much has happened over the year, and I am very thankful to have you here with me! Season 3 starts today, and in this season we are talking about fear. Fear can manifest in many forms, and this season we will explore some of those forms. In this episode you will meet Phyllis Ginsberg, M.A., MFT. Phyllis is the author of Brain Makeover - A Weekly Guide to a Happier, Healthier, and more Abundant Life, and Tired and Hungry Not More. Phyllis and I talk about why we fear, and how we disguise fear. We even touch on how we teach fear, or pass it to others. We all have some type of fear, and I think there are different ways we can deal with or manage fear; however, there are times we just need to continue on in life while still feeling fear. Phyllis says this about fear, "Fear is a topic that is near and dear to my heart. When I look back at the 30 plus years that I have been working with individuals of all walks of life as a therapist, as a person who has expertise in high conflict, divorce, child abuse, and domestic violence the common factor is these people have been in fear. So it got me started thinking about what is it in our brain that actually creates that fear response and how come we get so stuck in fear to where it can be debilitating or that's all we're focused on is that one problem or a whole array of problems rather than being able to shift to something else." We talk about how fear comes in many layers or forms, such as self-sabotage, negative self-talk, embarrassment, dread, and even laziness and procrastination. Phyllis believes most of us grew up in households where you didn't talk about anything that really mattered; or we grew up in a household where there was a lot of conflict. Fear of conflict is huge, and most people will avoid it at all costs. Phyllis points out that we first need to start having conversations like this podcast episode to discuss fear and how it impacts our lives. That we first need to peel back those layers to get to the bottom of why we are feeling the fear so then we can work on those individual reasons. Phyllis has a simple but impactful method to reason out just how much fear we have in our daily life and how much it controls our decisions. She starts off by asking, "What percentage of decisions do you think you make out of fear". She then goes on to uncover some of the layers by asking about the decisions made around fears for loyalty to friends and family, fear related to fitting in or belonging, fear of being physically or emotionally hurt, and fear related to staying within your comfort zone. When Phyllis asked me these questions my original response had to be updated based on her more specific questions. My guess is yours would as well. Understanding the layers or variations of fear can allow us to understand why we make some of the decisions we do. This can help us look deeper in ourselves to try and determine the root of that fear, and stepping in the right direction to work through the fear. To do this we will have to start working to make a change to our thoughts. Phyllis's motto for living life with fear is, ". If you want something different, you have to do something different on purpose." Very special thanks to Jake for my new podcast music! Early in Marnie Ginsberg's public school teaching career, she discovered that most of her 6th grade students were reading at least 2 years behind. And she had no idea how to rapidly shrink that gap. (A common experience she hears still to this day.) Thus began a career-long passion to discover the most efficient and effective approaches to teach anyone how to read. After growing a successful private reading tutoring and consulting business, she studied literacy further through doctoral studies at the University of North Carolina. At UNC, she led the development of a unique, well-researched K-2 reading intervention, the Targeted Reading Intervention (TRI), that provides webcam-based PD and coaching to teachers who deliver instruction to struggling readers in their classrooms. Firing Line with Margaret Hoover

Republican election lawyer Ben Ginsberg joins Margaret Hoover to discuss speaking out against his party over former President Donald Trump's false election fraud claims and his recent testimony before the House January 6th Committee. Ginsberg, who represented GOP candidates for nearly 40 years, details the fallout from Trump's election lies and the reforms to the 135-year-old Electoral Count Act that he believes could help avert chaos in 2024 and beyond. The attorney also assesses the work of the January 6th Committee so far, the controversial actions of Trump legal adviser John Eastman, and the possibility that the Justice Department could pursue criminal charges against the former president. Ginsberg reflects on the 2000 recount, during which he represented George W. Bush's campaign, as well as other disputed elections in recent decades, and the responsibility he sees for both parties to restore faith in American elections. Support for “Firing Line for Margaret Hoover” is provided by Stephens Inc., Robert Granieri, Charles R. In this episode, Dr. Jeffery Gladden discusses with Dian Ginsberg MD, who has years of experience providing comprehensive obstetrics and gynecology treatment and is a functional medicine physician. They talk about young plasma, young plasma transfusion, and the various benefits. Dr. Ginsberg has a special interest in functional medicine and how it helps minimize severe symptoms and optimize health. She is the author of The PCOS Environmental Roadmap. Rectangularization of aging is her passion. She is faculty at the American Academy of Anti-Aging, where she lectured about bio-identical hormone replacement and telomeres (DNA caps) and how instrumental their preservation is for ongoing health. Dr. Gladden introduces Dr. Ginsberg and gives an overview of their discussions (1:00) Dr. Ginsberg introduces herself and how she got to start doing what she does today. She mentions how her transition to the functional space came from her kids and how she brought it into her Obgyn to help others. (2:59) Dr. Ginsberg mentioned how about three to four years ago, her patient decided to be involved in the longevity space and look at what younger factors could to the aging process. This led to them getting involved with a lab that collected plasma with young factors. (4:55) Dr. Ginsberg talks about how the lab they connected with was already using young plasma to randomly do a whole bunch of things. Dr. Gladden also mentions how sex/gender and blood groups are essential when using plasma. (6:35) Dr. Ginsberg mentions how plasma is used and what quantity is run into the recipient. She talks about how they started with a liter of plasma. Dr. Ginsberg also says running it very slowly helps them avoid problems and complications. The liter of plasma, as she mentioned, is usually infused in two to three hours, giving the body time to process it. (8:00) Dr. Ginsberg mentions that she is into the research aspects of plasma transfusion. She notes that as the research started to come out, people are becoming more receptive to using plasma transfusion. (10:32) Dr. Gladden mentions a study on Parkinson's done at Stanford, and Dr. Ginsberg responds that plasma is safe for people. (13:54) Dr. Gladden explains what Parkinson's disease is all about and mentions how it affects the brain and has systemic components. Dr. Ginsberg also notes how the improvement and benefits of plasma transfusion are measured. (16:12) Dr. Gladden speaks about his approach at Gladden Longevity and how albums are used. He also talks about removing the old stuff and putting in the young stuff. ( 19:30) Dr. Ginsberg talks about her present focus with respect to young plasma and mentions that we don't know the answers to what is best. (21:00) Dr. Ginsberg mentions the arrays of tests and perspectives that she considers to give her an accurate picture of what is best. (22:50) Dr. Gladden mentions that there is a stress to undergoing the procedure and mentions some of the things they follow with people they work with. (25:35) Dr. Ginsberg talks about the safety of the plasma transfusion process, the basic screening, and other tests are done. (26:49) Dr. Ginsberg talks about the immune system and how powerful it is, HLA typing, and how the body reacts to a foreign substance. (28:00) Dr. Ginsberg talks about some of the studies they are involved in and what they focus on with respect to plasma transfusion. (32:00) Dr. Ginsberg mentions that eating right and exercising are great, but it's important to put young factors back in. (36:10) Dr. Ginsberg mentions how the body has a cost of doing business and how cleaning the old stuff out and putting in something new is essential. Dr. Gladden also mentions how aging drivers are compounding on themselves. (38:35) Dr. Ginberg mentions one of the reasons why she finds plasma transfusion interesting and that it is a perfect mixture. (40:05) Dr. Gladden talks about oxytocin and how isolation affects older people. (42:18) Dr.Ginsberg mentions that they have two sites where people are being enrolled. (44:08) Dr. Ginsberg mentions her three takeaways for listeners. The first is to do what you can control and do what you can and maintain it every day. Number two is to get good testing as you grow older and do your bio-individual testing. Level three is to listen to expert advice religiously. Here's my question.... is there anything we are missing in the whole "overturn Roe discussion?" Of course there is, but do we even care? Let's start here - in the internal working of the SCOTUS, there is a certain level of required trust. People were often amazed that Scalia and Ginsberg were such good friends. That friendship required something that we don't like to talk about - trust. The trust between them allowed them to be good (if not great) friends while still disagreeing on nearly everything. --- Send in a voice message: https://anchor.fm/plausibly-live/message
