What prevents women from seeking safe, legal abortions? Studies show that the awareness about abortion and its legality is very low among people. To add to the confusion, the implementation of the Pre-Conception and Pre-Natal Diagnostic Techniques Act, 1994 or PCPNDT Act which makes sex selection illegal gives anti-abortion messages. This is the fifth and final episode of a series Matter of Choice, a series that explores how women face medical, legal and social barriers to abortions. Suno India's Menaka Rao spoke to Saraswati Sahu, a leader with the Chhatisgarh Mahila Mukti Morcha that works on the rights of workers, who talks about her own abortion stories and how she used to feel abortion was illegal, and that she had to undergo abortion surreptitiously. Menaka also talked to Pritam Potdar, the managing director with the Pune-based non-profit, Samyak Communication and Research Centre, which works on gender rights. How getting an abortion is linked to contraceptive use How a person seeking abortion is treated often relates to their contraception history. When someone seeks abortion, the health system discriminates against those who take temporary contraceptives or no contraceptives at all. The public health hospitals often deny abortion unless women undergo a permanent sterilisation or at least take a long acting contraceptive such as intrauterine devices. This is the second episode of a series Matter of Choice, a series that explores how women face medical, legal and social barriers to abortions. This episode is based in Delhi where despite facilities, women are given a run-around for abortions. In this episode, Menaka Rao speaks to three women who had a hard time seeking abortion in the country's capital. These women were either treated with disrespect, or asked for very hefty fees in the private sector, often with very little assurance that the provider will provide abortion. Menaka speaks to these women at the non-profit Parivar Seva Sanstha which provides them with safe, affordable abortion care. The NGO has clinics in 11 states of India, including Delhi. Abortion is legal in India with certain conditions. But it is hard to access in many parts of the country, especially in rural India. An estimated eight women die everyday from abortions in India. This series called - Matter of Choice- will explore how women face medical, legal and social barriers to abortion. In this first episode, Menaka Rao goes to villages in Azamgarh where women have little or no options for legal abortions. Today, we embark on an enlightening exploration of the constitutional safeguards enshrined in Article 21, which guarantees the protection of life and personal liberty for all individuals, irrespective of their citizenship status. This pivotal provision serves as the bedrock of our legal framework, ensuring the preservation of fundamental rights in our democratic society. Let us delve into the intricacies of Article 21 and its profound implications for the administration of justice and the protection of human dignity. 1. Historical Context: Article 21 of the Indian Constitution, a cornerstone of our legal system, unequivocally declares that no person shall be deprived of their life or personal liberty except according to the procedure established by law. This right extends to both citizens and non-citizens, emphasizing the universality of its application and the inherent dignity of every individual. 2. Narrow Interpretation in the Gopalan Case: Initially, the Supreme Court, in the landmark Gopalan case (1950), adopted a narrow interpretation of Article 21. It held that the protection under Article 21 was limited to safeguarding against arbitrary executive action and did not extend to arbitrary legislative action. This meant that the state could deprive individuals of their right to life and personal liberty based on laws enacted by the legislature. The court emphasized the phrase "procedure established by law," distinguishing it from the American concept of "due process of law." 3. Broadening of Interpretation in the Menaka Case: However, in the Menaka case (1978), the Supreme Court revisited its interpretation of Article 21 and adopted a broader perspective. It ruled that the right to life and personal liberty could be deprived by law only if the procedure prescribed by that law was reasonable, fair, and just. This marked a significant departure from the earlier interpretation and introduced the concept of "due process of law," akin to the American jurisprudence. The court emphasized that the right to life extends beyond mere existence and encompasses the right to live with human dignity, ensuring a meaningful and fulfilling life. 4. Expanded Scope of Article 21: Subsequently, the Supreme Court has reaffirmed and expanded the scope of Article 21 in various judgments. It has declared a plethora of rights as part of Article 21, including the right to live with human dignity, right to livelihood, right to privacy, right to health, right to education, right to shelter, and many more. These rights reflect the comprehensive nature of Article 21, which encompasses a wide array of personal liberties essential for the holistic development and well-being of individuals. 5. Right to Education (Article 21A): In addition to the protection of life and personal liberty under Article 21, the Constitution also guarantees the right to education as a fundamental right under Article 21A. This provision mandates the state to provide free and compulsory education to all children between the ages of six and fourteen years. This is the last episode in the series on Kala Azar reported by Suno India's Menaka Rao. The Indian government has said that it has hit the elimination target for Kala-azar, a parasitic disease that is life-threatening. But miltefosine, the drug used to treat the skin manifestation of Kala-azar, called Post-Kala-azar Dermal Leishmaniasis (PKDL), is being linked to eye problems, including blindness. The government has taken steps to try to reduce the side effects in 2021, but not much has been done for those who have lost their eyesight either in one eye or both, possibly as a result of miltefosine. The World Health Organization has found 83 cases of people in India who have suffered a problem in the eye after intake of miltefosine. In this episode, Menaka spoke to Iliyas Marandi, one of the patients who lost his eyesight completely after taking miltefosine treatment. She also spoke to ophthalmologists Dr Rakhi Kushumesh and Dr Asim Sil who treated such patients, and helped develop the guidelines to prevent such ocular side effects. Kala Azar, a deadly parasitic disease, is very close to elimination in India. As per the World Health Organisation, the definition of elimination is the annual incidence of less than one case per 10,000 population at block level. The last few districts which are on the borderline remain in Jharkhand, and public officials appear confident that this year, the country may achieve the elimination target. The target has to be kept for 3 years for it to receive a WHO tag. Suno India is publishing a series of podcasts related to Kala Azar elimination. Few stories have captured more headlines in India this year than the saga of Gautam Adani. Adani is CEO of the Adani Group and a regular fixture on the Forbes list of Global Billionaires. He was at one point the third richest man in the world.In January, Adani and his companies were accused of stock manipulation by New York-based investment firm Hindenburg Research. This sent Adani Group stocks plummeting while Adani's own net worth took a massive nosedive. On August 15, 11 convicts in the case relating to Bilkis Bano during the 2002 Gujarat Riots were released. The 11 convicts were serving life sentences, and the jail time was commuted. Bilkis was 21 years old and five months pregnant when she was gang-raped while fleeing riots. In this incident, her three-year-old daughter along with six others were killed.Menaka and Padmapriya DVL discuss the stringent remission policy, its fairness in the context of Bilkis Bano convicts, and remission and other reformative practices that should be available to more prisoners. Does our social identity, be it caste, religion, or tribe, affect how long we live? Two papers show that Dalits, Adivasi and Muslims have a disadvantage when it comes to life expectancy as compared to the higher caste Hindus. In this podcast Suno India's Menaka Rao spoke to demographers Aashish Gupta, Sangita Vyas, both research fellows at the research institute for compassionate economics or r.i.c.e. The Wives of Western Philosophy: Gender Politics in Intellectual Labor (Routledge, 2020) fills in a rather large hole in the understanding and the substance of the generation of knowledge. This edited volume provides an exploration of the thinking around the role of the wife, helpmeet, or intimate companion, and how political theory is created, written, and moved into the public sphere. This book also pays particular attention to what we understand to be intellectual labor, and how we have come to think about the genesis of ideas and theories as the work of a solitary individual—usually male—when others are often quite intimately involved in the generation of this labor. The contributing authors all focus on three themes: how are intellectual work, knowledge, and theory produced or created across disciplines and topic areas—who is actually involved in this process as a contributor to the outcome; the political reality of what wives have done, are expected to do, actually do, and how we have come think about the wife as a political concept itself; the crafting of the biography or narrative of the thinker—who is included and excluded from this construction. These issues or themes are not necessarily indigenous to political theory—they come up in context of any intellectual production, in any field or discipline. But The Wives of Western Philosophy: Gender Politics in Intellectual Labor concentrates on some of the canonical thinkers and their intimate partners, and what we know but perhaps were unaware of in regard to these contributions, not merely fulfilling daily needs like cooking food, but the actual intellectual contributions by intimate partners that are threaded into the work of these theorists. All of the contributing authors pay attention to trying to understand how the intellectual communities are, in fact, the spaces and places where theorists live and engage—and that these communities contribute to the formation of ideas and knowledge. This is a different narrative than those that generally surround theorists, who are often cast as solitary thinkers, disembodied minds, alone, developing ideas and writings. Collaboration is often eschewed in these conceptions of the author, the thinker, and gendered collaboration between men and women is even more suspect as a means to generate important concepts and work. Forestal and Philips have assembled a fascinating, interrogating group of authors and discussions in this edited volume. Authors include Arlene Saxonhouse, Sara Brill, Boris Litvin, Emily C. Nicol, Bryan A. Banks, Jennifer M. Jones, Ross Carroll, Terrell Carver, as well as contributions by the editors themselves, Jennifer Forestal and Menaka Philips.
