Department of Commerce, two challenges to the so-called Chevron doctrine (or Chevron deference). The conservative-leaning court seems poised to limit or strike Chevron deference down, reversing 40 years of judicial precedent that was once championed by conservative icon and former Supreme Court Justice Antonin Scalia. Interestingly, in 2019, former Obama Administration Department of Homeland Security Jeh Johnson said 1,000 illegal border crossings per day would “overwhelm” the country. 5:05pm- The Drive at 5: 81-year-old Martha Stewart will be featured on the cover of the Sports Illustrated swimsuit edition. 5:15pm- Aruna Viswanatha and Sadie Gurman of The Wall Street Journal write of Special Counsel John Durham's findings: “He said the bureau swiftly pursued a vague tip about potential contacts between a Trump campaign aide and Russia authorities in July 2016, even though, the report says, the bureau had no other information in its files to corroborate any such contact. The Justice Department's inspector general in 2019 found similar flaws in the FBI inquiry but found the investigation was justified…He concluded that the FBI didn't rigorously analyze information it received, especially from people and groups with political affiliation, prolonging the investigation and prompting the appointment of Special Counsel Robert Mueller. In this episode, I talk to Jacob Sullum, senior editor at Reason magazine, about a recent piece he wrote entitled The Perils of Trying to Curtail Hazily Defined ‘Disinformation'. In this article, he discusses a recent rating given to Reason by an organization called the Global Disinformation Index (GDI) that named Reason as one of the '10 riskiest online news sources' in the United States. In this interview, we discuss the subjectivity that is inherent in popular conceptions of ‘disinformation', how the criteria used by the GDI are deeply contradictory, how the GDI received funding from the State Department, and why free speech and the 1st Amendment are so important. Jacob provides a wide-sweeping and insightful analysis of the massive contemporary (mis)use of the term ‘disinformation' and the ways in which organizations often wrongly apply it in popular discourse. Chad Pradelli and Sharifa Jackson report that the alleged shooter “stood over [Officer Fitzgerald] and shot him several more times in the head while he was on the ground.” The alleged shooter is being held without bail—he was arrested in 2021 for making a terroristic bomb threat. 3:15pm- While addressing the shooting death of Temple University police officer Christopher Fitzgerald, Philadelphia Mayor Jim Kenney bizarrely compared the sale of alcohol to the sale of firearms—ultimately blaming the loose interpretations of the 2nd Amendment for violence throughout the city. 3:25pm- During a Tuesday press conference, Philadelphia May Jim Kenney stated: “You can say you back the blue, but if you don't back gun control…you don't back the blue.” 3:40pm- New Jersey State Senator Ed Durr joins The Rich Zeoli Show to discuss the unmitigated violence in neighboring Philadelphia, the benefits of nuclear power, and the danger of sonar surveys for wind turbine construction off the coast of New Jersey which may be the cause of a suddenly massive number of whales being beached and killed. 4:05pm- New Jersey State Senator Ed Durr wraps up his segment with Rich—advocating on behalf of parents' rights and protecting young children from explicit subject matters being discussed in some public school classrooms. 4:10pm- Why do whales flee from sonar? Jacob Sullum discusses the Biden administration's possible moves on gun control. Thanks to recent mass shootings, says Sullum, gun control is back in the public eye, resulting in some proposed new laws like background checks, increased "red flag" rules, an "assault weapons" ban and the reclassification of certain firearm accessories. Most of these laws, Sullum says, would do very little to reduce gun violence: most mass shooters, for instance, use common handguns—many also obtained them legally and would pass a background check. Leaving mass shootings aside, which constitute a tiny fraction of gun violence in America, almost all of these laws would inhibit responsible hobbyists while doing very little to stop potentially violent criminals from committing their crimes. Scott interviews Jacob Sullum about the trial of Derek Chauvin for the death of George Floyd. Sullum highlights two important features of the prosecution’s case so far: the first is that paramedics testified to Floyd’s already being dead when they showed up, and the second is an argument about Floyd’s possible drug overdose. Sullum explains that while the level of fentanyl found in Floyd’s system during the autopsy might be high for a normal person, it was actually on the extreme low end of what can cause an overdose, especially for a habitual opioid user. These factors make it unlikely that drug overdose was a primary cause in Floyd’s death—but more importantly, whether drugs played some role or not, the relevant fact in a murder or manslaughter trial is whether the victim would still be alive had the defendant not done what he did. In this case, argues Sullum, Floyd pretty clearly would be. Last week I shared my curated COVID-19 reading list, which is keeping me relaxed and confident in my belief that we are overreacting. While we should worry about the incursions of civil and economic freedoms being brought about in response, people like Jacob Sullum of Reason and Jeffrey Tucker of AIER are doing a service by calming people down about the virus itself.Don Boudreaux over at Cafe Hayek also deserves special mention for leading me to most of my trusted sources with his blog's daily links. It's hard to keep up with all of the outstanding writing he's highlighted over the past weeks, including his own increasingly relevant review of Robert Higgs's Crisis and Leviathan for the American Institute for Economic Research, and a must-read article for the Pittsburgh Tribune-Review on Essential Questions about Essential Medicine.Twitter has reportedly begun to censor non-certified-expert advice on matters related to the coronavirus, so I will limit this Sunday's show to the subject of economics and politics where we are still free to opine (for now). I predict that future economics and political science students will look back in horror at this period – not for the mortality rate, which appears to be marginally higher than an average flu season – but for the acquiescence to draconian restrictions, unprecedented spending, and enlargement of state, local and federal bureaucracy (not to mention the failure of basic functions by the existing apparatus, i.e., FDA).Most media analysis misses what Frédéric Bastiat called “that which is unseen.” Dead bodies being carted away by truck to the morgue is a striking image, and is seen by millions on media loop.
