After taking a trip out of the country, leaving his home in Portland, Oregon, to visit Sudan in 2010, Yonas Fikre was approached by FBI agents who tried to recruit him as a government informant. Most likely because he refused the FBI's advances, he was arrested, tortured, and interrogated, and then placed on a No Fly list. He was stuck outside the US for 6-or-so years. That story is itself appalling, and we'll hear it in more depth in just a moment, but, on Tuesday, the Supreme Court ruled with a full consensus – a 9-to-0 decision, that the government must allow Yonas Fikre to pursue a court case in which he claims that being on the official No Fly list caused him reputational harm and violated his due process. The FBI argued that since they took him off the list, the case was moot. Essentially, the Supreme Court ruling admits that the FBI's No Fly list can continue to be interrogated in court. Joining us to discuss the case is Justin Sadowsky, a trial attorney with the Council on American-Islamic Relations or CAIR. CAIR is the organization that brought Fikre's lawsuit and successfully argued it in the Supreme Court. Justin, our guest, co-wrote many of the briefs in that case. First up this week is the new FAA Administrator, Michael Whitaker.  As we previously speculated, this confirmation process appears to have gone smoothly. Z Whitaker worked for three years as the Deputy Administrator of the FAA and Chief NextGen officer, coming to the FAA now from Hyundai's Supernal eVTOL manufacturer. AOPA's President Mark Baker said “I am really pleased the Senate took action to confirm Mike and look forward to working with him to help pilots and to move GA forward… He's a capable leader, knows aviation, knows the agency, and he's a private pilot.”  We'll look forward to see how Whitaker lead the FAA in the coming months and years!  Next up this week is one for all our Texas folks out there, the ruling labeling Texas drone law (Code 423) unconstitutional, has been reversed. In March of last year (2022) a federal judge declared Texas code 423 unconstitutional under the first and 14th amendments, now after an appeal in the fifth circuit court, the decision has been reversed.  The NPAA (National Press Photographers Association) says the law has been used to target journalists in situations where privacy hasn't been an issue.  The court decided the plaintiffs lacked standing for a 14th amendment claim because none of the plaintiffs had been arrested or prosecuted under Texas Code 423.  In addition, the appeals judge said “And nothing in the No-Fly provisions has anything to do with speech or expression. These are flight restrictions, not speech restrictions,”, which is interesting considering the FAA is the sole party permitted to control the airspace.  Brenden Schulman, former DJI VP of Legal said “In a very significant drone law update, the prior decision in Texas articulating a First Amendment right to drone journalism, and striking down a Texas statute that interfered with that right, has just been overturned by the Fifth Circuit… Depending on what the plaintiffs decide to do, this could be the first drone law case to go to the US Supreme Court.” This means that Texas Code 423 is now back on the books, and we'll see if it's appealed again to the Supreme Court.  Alright, last up is a fun one, we have a new possible world record for the largest foam quadcopter!  Engineers in the UK have created and flow what they believe is the largest quadcopter, at over 21 feet from corner to corner!  The “GFQ” or Giant Foam board Quadcopter appears to use hobby foam for its structure and weighs 54lbs.  Next up, the team hopes to expand the project to create a quadcopter even larger!  That's it! A climate scientist whose pledge not to travel by plane - leaving him with a long trip back to Germany from where he's been working - has put him at odds with his employer.Dr Gianluca Grimalda is a senior researcher at the Kiel Institute for the World Economy (IfW) and has spent most of the year in Papua New Guinea studying the relationship between globalisation, climate change and social cohesion. He started his journey to PNG in February overland and by sea and had intended to go back the same way - a 22-thousand kilometre trip that he calculated would create four tonnes of greenhouse gases by plane, but just 400 kilograms by rail, bus and ship. While he was due back in the office last month, his research was delayed - at one point he and his assistants were hostage under machete threat. He's also had his belongings taken and held for ransom. But his employer now says he's due in the office Monday - and if he's not there - his job won't be either. Dr Grimalda joins Kathryn from Papua New Guinea.

Almost immediately after Russian forces invaded Ukraine, Ukrainian President Volodymyr Zelenskyy began calling for a no-fly zone to be implemented over his country to negate the effects of Russian airpower. It’s a call that NATO leaders have resisted. To discuss why, and to offer a very unique perspective on what putting a no-fly zone in place actually entails, John Amble is joined by retired US Air Force Colonel Mike Pietrucha, a veteran aviator with extensive combat experience—including taking part in the enforcement of no-fly zones over both northern and southern Iraq and in the former Yugoslavia in the 1990s.
