In the Public Interest is excited to present the final episode in our miniseries examining landmark decisions recently issued by the United States Supreme Court. The final episode explores the Court's decision in Moore v. Harper, a case involving control over electoral redistricting by state legislatures.In the episode, co-host Felicia Ellsworth is joined by Partner Seth Waxman, a former United States Solicitor General who focuses his practice at WilmerHale on appellate and Supreme Court litigation. Ellsworth and Waxman discuss the legal theory known as “independent state legislature theory” at the core of the case and provide an overview of previous cases in which the Court considered similar legal questions. Waxman describes WilmerHale's role filing an amicus brief representing the Democratic leadership of both the North Carolina House of Representatives and the North Carolina Senate. They also attempt to preview the implications of the Court's decision on electoral maps beyond the state of North Carolina. The episode concludes with Ellsworth and Waxman highlighting notable points from the oral argument and dissenting opinions in Moore.

In this week's North American Ag Spotlight Chrissy Wozniak gets an update from Congressman David Rouzer on the #WOTUS ruling and President Biden's recent veto. Congressman David Rouzer proudly represents North Carolina's 7th Congressional District, stretching from the beautiful coastline of Southeastern North Carolina west to the small-town, agricultural communities around Lumberton and Fayetteville. Elected to the United States Congress in 2014, David is beginning his 5th term in the U.S. House of Representatives. David serves on the House Agriculture Committee and the House Transportation and Infrastructure Committee where he currently serves as Chairman of the Subcommittee on Water Resources and Environment. He has served as a ranking member or chairman of a subcommittee on both since his first day in office, which has enabled him to better address the unique needs of his district and state. He is a member of a number of caucuses in Congress including as a founding member of the Primary Care Caucus and the Supply Chain Caucus, as well as co-chairing the United Kingdom Caucus.Prior to Congress, David formed his own business doing consulting and sales work, predominately in the agricultural arena. His public service includes two terms in the North Carolina Senate representing Johnston and Wayne counties (2009-2012) where he was consistently ranked as one of the most effective pro-business legislators. David also served as assistant to the dean and director of commodity relations for the College of Agriculture & Life Sciences at NC State University in between two stints with U.S. Senator Jesse Helms, where he started out as a legislative assistant and later served as senior policy advisor. He was also senior advisor for U.S. Senator Elizabeth Dole. In 2005, he took a senior level appointment at USDA Rural Development and helped manage a program level budget of more than $1.2 billion and a loan portfolio of more than $5 billion in investments in rural America. David has garnered a number of awards during his career for his work in each of these capacities as well as a Member of Congress. David, a Southern Baptist, was raised in Durham and spent his summers working on the family farm just outside of Four Oaks, N.C. The money he earned those summers enabled him to pay his tuition at N.C. State University where he graduated with three degrees in Agricultural Business Management, Agricultural Economics, and Chemistry. He is also a graduate of The Fund for American Studies. David resides in Wilmington, N.C. A Republican-backed piece of legislation called the Parents' Bill of Rights has passed the North Carolina Senate and is on its way to the House. The law would require teachers to tell parents when students are questioning their gender. Supporters of the bill say parents have a right to know this information. Those opposed to the bill, including many LGBTQ advocates, say this could cause some parents to reject or abuse their children and could even lead to suicide. WRAL's capitol bureau chief Laura Leslie explains the bill and the debate.

Friday, two other cases in the North Carolina Supreme Court were decided on gerrymandering and the freedom to vote. Harper vs. Hall is also about redistricting, this time a state senate map used in the 2022 election, which the North Carolina Supreme Court struck down on December 16th. The court said the Republican-dominated legislature violated the state constitution's Free Elections, Equal Protection, and Freedom of Speech and Assembly clauses. The legislature argued the map was “race-blind” but the court's ruling said, “The provisions enacted … were formulated with an impermissible intent to discriminate against African American voters in violation of the North Carolina Constitution.” The maps will need to be redrawn, but they've already added to a significant Republican lock on the North Carolina Senate. Also decided Friday was Holmes v. Moore, which struck down a voter ID law which accepts only a few types of ID. The court also deemed this as targeting Black voters, but the Washington Post reports that the Republican legislature will likely pass another bill after the North Carolina Supreme Court shifts from a liberal-leaning court to a conservative one next year.Links to articles and groups taking action at AmericanDemocracyMinute.org. North Carolina has been a target for Democrats this election cycle, with Democratic Senate candidate Cheri Beasley out fundraising and outspending her Republican opponent, Congressman Ted Budd, seeking to flip this seat blue. While the Beasley campaign pushes to sway voters in the state, Budd has consistently outpolled Beasley throughout the race, suggesting he may have a slight edge in the election to replace retiring Republican Senator Richard Burr. In this episode we talk about the tax consequences of student loan forgiveness. Generally, debt forgiveness is treated as income, and is therefore taxable. If the Biden Administration's current plan to forgive portions of student loans comes to fruition, the forgiven amount would normally be taxable. Provisions have been made to make student loan forgiveness tax free at the federal level. Some states, including North Carolina, would still treat the loan forgiveness as taxable, and borrowers would owe state taxes on the forgiven amounts. We discuss that issue, along with other issues related to taxes and higher education in North Carolina, along with the general business climate and taxation in the state of North Carolina with Senator Phil Berger, President Pro Tempore of the NC Senate.

In campus news, the Appalachian provides us with a handy guide to the Watauga County candidates for election in this November 8th midterms. A North Carolina Senate seat is up for grabs as Senator Richard Burr finishes his term, and contenders from both major political parties, as well as the Libertarian and Green parties, are vying for the spot. The 5th congressional district is also electing a representative for the House. That voting group comprises of Watauga, Wilkes, Ashe, Alleghany, Caldwell, Burke, Gaston, Cleveland, Alexander and parts of Rutherford County, so whoever winds up in Washington has a direct stake in Boone. We'll see you all at the polls! Locally, the Watauga Democrat reports that the Appalachian Theatre of the High Country has unveiled a new mural showing off some of the history of Watauga County. The mural, painted by local artist Brenda Councill, will occupy the second floor of the Theatre, and depicts 5 different moments from Watauga history in 5 different panels. The art is sepia-toned and decked out in silver leaf, both of which are meant to evoke the history the artwork is designed to convey. I'm looking forward to seeing the mural for myself, and learning a bit more about the history of our awesome county! In national news, everyone's favorite annual competition has found its victor. I know we were in the red for one. Uh, hopefully we'll start to see some of this come back up, but we all know cannabis doesn't trade, like anything else.So let's get to it. First and foremost, Canadian cannabis sales increased 46% in July to a record 339 million. I like seeing a new record for Canada. A lot of people bearish on that market and comparison, but I still think there are some fantastic companies there with a lot of international prospects. So keep an eye on that.Uh, as it grows, as it continues to grow, we'll touch on a few of the Canadian companies here in a second. A couple of things I do want to touch on politically Booker that's. Senator Cory Booker. Uh, as opposed to the safe act and the national defense act, um, not overly surprising is everybody wants a win, I guess, but Chuck Schumer and Corey Booker will continue to push for their, a COA bill or what will be a bill, uh, that they proposed a few months ago.Uh, the industry generally just believes is too broad to get anywhere. Uh, the industry wants safe banking and right now, uh, the Democrats, uh, are the ones in power and standing in front of it as the Republicans have done in the past, but politics being politics. Uh, hopefully we can get this through and this does not, um, get halted for the fifth time.Aurora cannabis closing their Edmonton facility. We touched yesterday. Uh, on some happenings there, uh, this impacts 8% of their workforce. There's a $50 million cost associated with the facility. They're closing down, which I believe is the Aurora Polaris facility. Um, along with a cost, it is somewhat close to another Edmonton facility for Aurora.Overall analysts are incredibly bearish on the figures of the company will report next week. Uh, in diva in D V a F announces a warrant incentive program, each unit will consist of one common share and one warrant gross proceeds to the company. If all warrants are exercise would be over 6 million, $800,000 Canadian, uh, in diva, kind of on a terror.They are they PR they reported fantastic Q2 earnings. Uh, I think this is another initiative for them, uh, moving forward along with continuing to strengthen their brand portfolio and that investment from century bank Corp, uh, which is attached to sundial lesson DL, high tide NASDAQ listed H I T I opens to more retail cannabis stores in Ontario bringing their Canadian total to 97 97.Dispensary's in Canada, 26 and Ontario. My thoughts on high tide is it's a fantastic brand. Um, you know, they, they don't do much, uh, publicity, we'll say they, they do it all in their operations, all in, uh, you know, what they're doing as a company. But to me that I wish they were a little bit more out in the public.Uh, because right now it seems to me like they might be a massive M and H. Either way, H I T I is a wonderful, wonderful company that continues to grow at massive scale. THE NEVERENDING COOF 33 deaths: Indonesia, Kamuli District (Uganda) 33 new cases: Alberta, the Pee Dee region of South Carolina, and Wisconsin A 33-year-old London dad who jokingly told a man the chippy wouldn't let him in with his mask on ended up being stabbed in the eye, which will remain stitched for a year and ultimately replaced with a prosthetic. BEHIND THE CURTAIN 33 kilograms of ganja were seized by Nagpur cops out of a train station toilet stall. That's 72.75 pounds, bowlers! Police found it while making the rounds with their bomb-sniffing dogs. Sha'Carri Richardson will not be competing in the Olympics because of a THC positive drug test. She is serving a one-month suspension. A reporter broke the news to her of her biological mother passing away a few days before the 2020 United States Olympic Trials and she admits to using weed in her legal state of Oregon to cope. Hours before it was scheduled for a House floor vote, Delaware adult use bill, House Bill 150, was removed from the agenda. The bill's primary sponsor, Representative Ed Osienski, said the vote was cancelled because they did not have the 3/4 (31) votes necessary to pass it with its proposed social equity fund. Had they removed the fund, they would only need a 3/5 majority. Delaware's earliest opportunity for legalization is January 2022. In 2015, a decriminalization bill passed and another bill expanded it to minors in 2019, but folks are still being arrested and locked up when caught with more than an ounce. Pennsylvania Governor Tom Wolf signed House Bill 1024 into law, increasing the amount of pot medical patients can legally possess from a 30-day supply to 90. They may also use telehealth and curbside pickup. Caregivers are no longer restricted to the amount of patients they can care for and more eligible conditions have been added: cancer remission therapy and central nervous system-related neuropathy. As of July 1st, South Dakota patients will no longer be arrested for possessing three ounces or less of cannabis...as long as they alert the law enforcement officer of their condition and provide documentation from a doctor since they won't be able to get a card until this fall. The state's Department of Health shared its preliminary list of conditions covered by the medical program, which include AIDS/HIV, ALS, MS, cancer, Crohn's, epilepsy, glaucoma, and PTSD as well as any "debilitating medical condition" which was the language voters passed in 2020. The secretary of health says a process will be available for South Dakotans to petition to add more conditions in the future. Last Wednesday, a North Carolina Senate committee voted for the first medical marijuana proposal in the state's history with overwhelming support. On this episode of the Life in the Carolinas podcast, Carl sits down with Ted Alexander. Apart from working at the North Carolina Senate, Ted also serves as the Western Regional Director for Preservation, North Carolina. Preservation, North Carolina is a statewide nonprofit organization that has been around in some form or another for about 81 years, having first started out as the North Carolina Society for the Preservation of Antiquities in 1939. The group looks to protect, preserve, and even repurpose built environments regarded as significant to the state’s heritage. These included properties that tell rich stories about North Carolina’s history, from Gastonia's Loray Mill Village to the Bellamy Mansion in Wilmington. When asked why it is important to preserve these historic buildings, Ted first makes it a point to give due credit to President J. Myrick Howard with the overall vision-mission of Preservation, North Carolina. He says that there are several reasons why these assets need to be preserved. For one, “there are some properties that are inherently important”, whether it was the home of a famous individual, the location of a significant event, or a very important piece of architecture of a certain style. Another reason for preservation is to “create a sense of place”, as historic buildings help to establish the identity of the community in terms of its values and self-image. A building might also “offer a very functional use in today’s world”, such as serving as a tourist attraction. Then there is the economic benefit to preserving historic assets, since not only do the buildings themselves go up in value, but they may also pave the way to further investments or the creation of more jobs. Finally, there is patriotic value to preservation, being an activity that brings the entire community together. According to studies, historic sites are almost always near the top of a tourist’s agenda. Ted says that modern travelers want to collect experiences—speaking particularly of millennials. He says that even smaller towns who understand this and do whatever they can to promote these historical buildings by telling their stories will have an edge as tourist destinations. These schools allow students to earn college credits while working towards graduation and are typically paired with a local community college or university. The North Carolina Senate now wants to end funding for them. On March 26, 2019, the Supreme Court heard argument in Rucho v. Common Cause and Benisek v. Lamone, two cases involving gerrymandering.Rucho v. Common Cause involves whether North Carolina’s 2016 congressional map involves unconstitutional gerrymandering in violation of the Equal Protection Clause of the Fourteenth Amendment, the First Amendment, and Article I. In March 2017, a three-judge district court ruled that North Carolina’s 2016 Congressional Redistricting Plan constituted unconstitutional gerrymandering because the state General Assembly improperly relied on “political data” to draw districts to increase the number of Republicans in North Carolina’s congressional delegation. The court ordered new maps to be drawn for use in future elections. Following the court’s instructions, the General Assembly drew a new congressional district plan according to criteria identified by the Joint Select Committee on Redistricting. One such criterion was “partisan advantage,” which, relying on population data and political data, would “make reasonable efforts to construct districts in the 2016 plan to maintain current partisan makeup of North Carolina’s congressional delegation.” The plan was approved by the committee, the North Carolina Senate and North Carolina House of Representatives, all along party lines. Others filed objections to the plan and asked that the court reject it as partisan gerrymandering. The court held that the plan constituted unconstitutional partisan gerrymandering, enjoined North Carolina from using the plan in any election after November 6, 2018, and directed the parties to submit briefs relating to whether the court should allow the plan to be used in the 2018 election and allow the General Assembly a third opportunity to draw a plan. Although the U.S. Supreme Court vacated the district court judgment and remanded the case for reconsideration in light of its 2018 decision in Gil v. Whitford on standing, the district court subsequently concluded that the plaintiffs had standing and reasserted its earlier determination on the merits. In August 2018, the district court concluded that there was not enough time to review a new plan before the seating of the new Congress in 2019 as well as determined that a new schedule for elections would interfere with North Carolina’s electoral machinery. Thus, the court declined to enjoin use of the plan in the November 2018 election. The Supreme Court thereafter granted certiorari to consider (1) whether plaintiffs have standing to press their partisan gerrymandering claims; (2) whether plaintiffs’ partisan gerrymandering claims are justiciable; and (3) whether North Carolina’s 2016 congressional map is, in fact, an unconstitutional partisan gerrymander. Lamone v. Benisek involves Maryland’s 2011 redistricting plan, particularly whether the State redrew the boundary of one district to burden Republicans. Following the 2010 census, Maryland redrew the lines of its congressional districts and state legislative districts. The Sixth Congressional District had grown by approximately 10,000 residents, which required adjustment of the district boundaries. If only a slight adjustment for population had been applied, the district would have been unquestionably Republican. Instead of this slight adjustment, the plan swapped half the population of the former Sixth District with about 24,000 voters. The change created in effect a difference in 90,000 Democratic votes. Plaintiffs argued that in enacting 2011 law, the State deliberately diluted Republican votes in violation of the First Amendment. A three-judge district court agreed with plaintiffs, enjoining the State from using the 2011 congressional redistricting plan after the 2018 congressional election and requiring it promptly to adopt a new plan for use in the 2020 congressional elections. The Supreme Court granted certiorari to consider (1) whether the various legal claims articulated by the three-judge district court are unmanageable; (2) whether the three-judge district court erred when, in granting plaintiffs’ motion for summary judgment, it resolved disputes of material fact as to multiple elements of plaintiffs’ claims, failed to view the evidence in the light most favorable to the non-moving party, and treated as “undisputed” evidence that is the subject of still-unresolved hearsay and other evidentiary objections; and (3) whether the three-judge district court abused its discretion in entering an injunction despite the plaintiffs’ years-long delay in seeking injunctive relief, rendering the remedy applicable to at most one election before the next decennial census necessitates another redistricting.To discuss the cases, we have Derek Muller, Associate Professor at Pepperdine University School of Law.

Tonight's Guest - Glen Bradley is a fmr Republican member of the North Carolina House of Representatives for the 49th District of North Carolina. Bradley previously served as a US Marine Corps Corporal, Intelligence Analyst from 1993-1997. Bradley defeated Democrat John May in the general election held on November 2, 2010 with 51% of the vote. Bradley's election signaled a wide swing in the district, which had voted for former Democratic representative Lucy T. Allen 58%-41% over Keith Shearon in 2008. In the House, Bradley filed bills to study whether or not the state should authorize an alternative currency, and to require the state to accept gold and silver as legal tender.Bradley ran for the North Carolina Senate in 2012 but lost the Republican primary on May 8, 2012. He finished in last place out of three candidates, getting about 14% of the vote. In 2013, Bradley announced that he would be running for Vice-Chair of the North Carolina Republican Party.
