Minnesotans ages 18 through 20 could soon be able to legally carry handguns, after a federal appeals court ruled Tuesday that the state's age limit on concealed carry permits is unconstitutional. Attorney General Keith Ellison's office could still appeal to the U.S. Supreme Court and a spokesperson said they are considering whether to do so. As of now, the ruling by the 8th U.S. Circuit Court of Appeals is a win for gun rights advocates and three young adults who sued against the state's age limit. The cited the 2022 U.S. Supreme Court decision in New York State Rifle & Pistol Association, Inc. v. Bruen, in which a 6-3 majority ruled people have a right to carry a handgun in public for self-defense.The Minnesota law, passed in 2003, allowed only people over 21 to apply for a permit to carry a handgun—the federal limit is 18. MPR News host Cathy Wurzer spoke about the ruling with Rob Doar, Senior Vice President of the Minnesota Gun Owners Caucus, which was a plaintiff in the lawsuit.In a statement to MPR News, Attorney General Keith Ellison said he was “extremely disappointed” by the ruling. “This epidemic of gun violence will continue unabated unless we do something about it. Unfortunately, the Supreme Court's Bruen ruling made that far more difficult by opening the floodgates to litigation from gun advocacy groups looking to undo reasonable safety legislation.“This year alone, Minnesota has experienced at least four mass shootings. Just days ago, a 20-year-old tried to take the life of the former President of the United States. It is extremely troubling that Clarence Thomas' misguided opinion in Bruen is preventing us from acting to protect the public from senseless violence like this. The people of Minnesota want and deserve solutions that reduce shootings and improve public safety, and today's ruling only makes that more difficult.”

This is a Bonus Video Episode that continues to provide a perspective that defends Ja Morant and challenges the NBA and pundits who are intimidating Ja Morant's ability to exercise his freedom of expressions and rights to bear arms within a climate that has politicized the our constitutional rights to bear arm given the rising in gun violence. The National Basketball Association (NBA)Stephen A. Smithare using their draconian rules to control #JaMorantas if he is not also a private American with freedoms. Work rules should not trump the constitution and we should not assume that brandishing a gun is anything but protection when celebrities are being gunned down while on social media. It is not surprising that he would brandish a gun in his private vehicle from a picture taken by a private associate in an effort to ward off any attack. Rappers have been gunned down in their cars while on Live and this time he shows a gun maybe to say he not that stupid. But what crime did Ja commit? What rule did he break? Moreover, just because some are anti-gun doesn't mean Ja must accept that ethic or morality. This last incident was not reckless or dangerous. Having a gun and parading it on tv is what people do of any race who are fascinated with the gun. He is not playing in the NBA; he is a private individual who has a political position about guns as well and he is within his rights to express a political position about the rights to bear arm and gun regulations and rights. If anything, Ja was using the platform to make a political stance for less gun laws and freedom expression while sending a message that he is locked and loaded while in public for people who are after celebrities. We are rushing to judgement and now imposing on Ja's constitutional rights and freedom of expressions. There is no one who can point to any crime that Ja broke, as he did not, only breaking some NBA rule about behavior that is based on preference and taste. For the NBA cannot legislate on player's behaviors that is unconstitutional and outside of labor laws. Donohue discusses the study "Right-to-Carry Laws and Violent Crime: A Comprehensive Assessment Using Panel Data and a State-Level Synthetic Control Analysis" with Prof. Alexander Stremitzer (ETH Zurich). In their study, John J. Donohue (Stanford), Abhay Aneja (Berkeley) and Kyle D. Weber (Columbia) use indepth state panel data and new statistical techniques to estimate the impact on violent crime when states adopt right-to-carry (RTC) concealed handgun laws. They find that RTC laws increase overall violent crime and that RTC laws are associated with 13–15 percent higher aggregate violent crime rates 10 years after adoption. Using a consensus estimate of the elasticity of crime with respect to incarceration of 0.15, the average RTC state would need to roughly double its prison population to offset the increase in violent crime caused by RTC adoption. The U.S. Supreme Court hasn't issued a major gun-rights decision in more than a decade. That is about to change.  In its next term, the high court will hear a major new Second Amendment dispute, agreeing to use a New York case to consider whether the government must let most people carry a handgun in public for self-defense.Do you have an inherent right to self defense?The justices said they will take up an appeal by a National Rifle Association affiliate and two people who say the state is violating their constitutional rights by issuing concealed-carry licenses only to those who can show a special need for protection.Should you have to show a special need?  Is that even legal?The case, which the court will consider in the nine-month term that starts in October, will put the justices in the middle of one of the country's most fractious debates. It will pit people who see public gun possession as a matter of self-defense and individual freedom against others who say the result will be more crime and reduced public safety.New York is one of eight states -- along with California, Massachusetts, New Jersey, Maryland, Rhode Island, Delaware and Hawaii -- that the National Rifle Association says prevent most people from getting a carry license. Illinois and the District of Columbia also had sharp restrictions before their laws were invalidated in court.The Supreme Court in June refused to take up challenges to the New Jersey, Massachusetts and Maryland laws. That was before Justice Ruth Bader Ginsburg's death and Trump's successful nomination of Justice Amy Coney Barrett strengthened the court's conservative majority. Episode 089 Carrying a Firearm on Appraisal Inspections generated more traffic than any other episode.  There was a also a lot of buzz online about that topic.  The biggest criticism surrounded whether or not an appraiser had the right to carry a firearm in another person's house without permission.  It is an interesting question.  Chris was kind enough to join us and give his perspective.

Mr. Michael Tumminelli is an Army and Air Force Combat Veteran with 13 years of service, along with 9 years as an employee of the Department of the Army. He is one of the founding members of the "Party of Six", and is currently inolved in 1 of 2 major legal cases appealing the "Justifiable Need" statute in the state of New Jersey. January 2015: The Party of 6 was born out of necessity and frustration. All the active members of this small and eclectic team have gone all the way through the NJ permitting process to obtain a permit to carry, with all being denied. Original member’s cases have all been closed out due to lack of resourcing and support from such groups as NJ2AS, ANJPRC, NRA and others. Lack of will and many attempts to work with all these groups came to quick and painful death as we learned that NJ groups are not willing to work together for the collective good. March 2016: Brushing our slumber and regrouping, the Party of 6 was revived out of sheer will and a hell a lot of grit. We are no better than those who are reading this now, but as those who have dared wade into the turbulent process of obtaining a Permit to Carry we understand we are at a critical point in our Garden State! We understand our political foes, but more so there is an absolute disconnect between those who claim to represent us, the common folk. They have grown into the Establishment and decide who knows what and when. It is well known that NJ 2A groups are deeply divided and for a reason, well here we are. To some we shall be seen as trouble makers who obviously have no capacity to understand what is happening around us, but let us rebut these notions by our stories and our willingness to once again hold those who wish not hold themselves accountable in this fight.

As professional truck drivers make their way across the country, their job calls for them to work in every high crime area in the United States. Major cities such as Chicago, Detroit, Memphis, Baltimore, Oakland, the boroughs of New York City and everywhere in-between, truckers can find themselves in serious and dangerous situations. With the trucking industry operating 24/7 with scheduled pickups and deliveries at any given time of the day or night, these men and women of the highway face many areas of criminal activity and can often be the targeted victim as well. Even though there is no Federal Law that prohibits truck drivers from the legal right to carry a firearm for protection, individual motor carrier rules may do so. In 2012, Detroit city alone was home to 386 murders and 15,009 violent crimes as this is one of many major freight hubs where truckers must conduct business to keep America moving. Furthermore, rise in crime has fast been expanding outside of the typical major city areas such as states in the South and Midwest. The reality of trucking is that it can be a dangerous job and the inability for the driver to carry protection due to company rules and regulations can only add to the situation. Even with a legal state permit, drivers can find themselves in trouble if the transporting of the firearm is not in accordance with Federal Law 18 U.S. Code § 926A. Also, not every State recognizes an individual's State CCW. For example, only 34 states currently recognize a concealed weapon permit from the state of Florida; another aspect that could cause trouble for the driver entering such a state as New Jersey. It varies from state to state even more, as for example, only 18 states will recognize a permit from the state of Illinois.
