Any criticism of the termination of Ronen Bar is manufactured and disingenuous rage, in his view. Listen and decide. We get into the weeds on the recent revival of judicial reform efforts and the dramatic fallout from the firing of Ronen Bar and also discuss his position regarding the renewed fighting in Gaza and the issue of negotiating for the return of the hostages languishing in Hamas hell. Knesset reporter Sam Sokol joins host Jessica Steinberg on today's episode. Sokol reviews the Knesset on Monday, as hostage brother Danny Elgarat was thrown out of a committee meeting by committee chair Simcha Rothman after a disagreement with the brother of another hostage about the hostage deal under discussion.  Sokol discusses the comments and images that Finance Minister Bezalel Smotrich offered as he voiced his disapproval for the hostage deal, and his underlying threat to bolt the coalition if the government agrees to the deal, along with other Knesset members' recent remarks that this government may not last much longer. Smotrich's ultra-right ally, National Security Minister Itamar Ben Gvir, then threatened ultra-Orthodox party Shas that he would not support their narrowed bill for community rabbis, calling Shas "a lapdog of the left," while Shas Knesset member Aryeh Deri retorted, by calling Ben Gvir "an inflated balloon." Sokol also mentions the statement made by Knesset member Gideon Sa'ar hinting that former Prime Minister Naftali Bennett is considering a return to politics. If you follow news out of Israel these days—and who doesn't?—you may have caught the story early this week that Israel's Supreme Court issued a ruling that the government may not exempt the haredim (Israel's ultra-orthodox community) from military service. The ruling went further, though, than just ending an exemption from service: the court ruled that government funding must be cut off from any yeshivas (schools) that do not comply with the ruling.Aside from the legal reasoning behind this ruling is the larger question of the continuing arrogation of power by Israel's high court. Last month John Yoo and Steve Hayward, overseas for a conference on international law, sat with with Simcha Rothman, a senior member of the Knesset who, as chair of the Knesset's Constitution, Law and Justice Committee, has been deeply involved with proposals to reform and rein in the runaway judiciary. This controversy was roiling Israeli politics last year until the events of October 7 put it on the back burner, but we think Americans will be surprised to learn more about the peculiar circumstances of Israeli's judiciary. One year ago, Simcha Rothman was a household name in Israel and beyond. As Chair of the Knesset Committee on Constitutional, Law and Justice Issues, Rothman was the man in a scorching hot seat, taking the lead in shepherding through the legislature the controversial judicial reform package. Working closely with Minister of Justice, Yariv levin, Rothman bore the brunt of public anger and became a convenient target for political mudslinging. For much of 2023 Israel was roiled by unprecedent civil disobedience and dissent set off by the judicial reform legislative package. And then, October 7th happened. Since then Rothman has largely been out of the public eye but still very active in dealing with the unprecedented legal challenges posed by the horrors of that day and the challenges with respect to how Israel will manage various legal issues going forward. We discuss the new world in which we all find ourselves and we also manage to squeeze in a few minutes of discussion of the judicial reform moment. That issue will surely resurface and I, for one, expect Simcha Rothman to be front and center, yet again. Rothman and I don't exactly see eye to eye on many issues but – as I have always said – State of Tel Aviv aspires to be a platform where respectful discussion and debate are facilitated. And I am grateful to Simcha Rothman for being game. Many other politicians and officials are not prepared to discuss and that is the real threat to democracy – when we lose the ability to speak to one another.State of Tel Aviv is a reader-supported publication. This week, the Knesset's Constitution Committee restarted deliberations over pieces of judicial overhaul legislation after compromise talks in the President's residence broke down. 75 years after its foundation, Israel's rules of procedural governance are still unclear, and clearly hot-button issues as the country heads into a 26th week of judicial overhaul protests. But from the first announcement of the judicial overhaul in January, our guest this week, Prof. Yedidia Stern got to work: In cooperation with other former heads of law schools and under the aegis of President Isaac Herzog, they came up with a first compromise solution — which was turned down. Today, he's bring to the podcast a partial solution, what is called a thin constitution. Stern, who is now the head of the Jewish People Policy Institute, talks about the procedural constitution as well as earlier attempts in Israeli history to write a constitution and why they didn't work out. But when, several months ago Stern brought the first potential judicial overhaul solutions to Justice Minister Yariv Levin, he didn't receive the welcome he'd been expecting. "I formed a group of 10 law professors, trying to figure out a professional solution to this situation and we met with Simcha Rothman, and we met also with [Justice Minister] Yariv Levin. So when Yariv Levin, first meeting, entered the room, he gave us a big smile... he looked at me, pointed with his finger and told me, 'The whole thing is because of you, Prof. Stern.'" In a rare moment of agreement, Israeli media from all sides of the political spectrum is closely following the proposed legislation for judicial overhauls — some of which will have their first preliminary votes early next week. And while almost everyone seems to agree that there is a need for a judicial overhaul, many ask, why so extreme and why so fast? For weeks we've reported on protests in the street, sharp rebukes from legal experts, and businessmen threatening to take their money elsewhere. The President of Israel Isaac Herzog waded in and asked legislators for a pause for reconsideration and potential compromise. But one who doesn't think the overhaul is all that radical is the Member of Knesset who wrote the bills that are being determinedly pushed through, Simcha Rothman from the Religious Zionism party. For the past decade, Rothman, a lawyer by training, has worked towards this legislation through his advocacy work at Meshilut, the Movement for Governability and Democracy. A fixture in the halls of the Knesset, Rothman has written books and lobbied for what he terms a stronger democracy -- through a rebalancing of power from the Supreme Court to the Knesset. A member of Knesset since 2021, Rothman is clearly one of the most driven lawmakers in the new coalition. As the chair of the Constitution, Law and Justice Committee, he is fast-tracking these first points of reform, which include judicial appointments, curbing the Supreme Court's test of reasonability, a slim override clause and severely limiting the High Court of Justice's ability to strike down Basic Laws. There are major concerns facing Israel's democracy today. Some have to do with voting and Israel's system of electoral representation. Others relate to Israel's judiciary. Champions of the current configuration of the Israeli judiciary believe that its famous independence is a necessary check on the legislature, and that it exercises proper authority in checking and repealing illegitimate laws. Critics, on the other hand, assert that Israel's supreme court has no right to undo laws that were passed by democratically elected members of the Knesset. Since Israel has no constitution, they ask, on what basis can an Israeli court assert that a law is illegitimate? This debate, one of the biggest in Israeli society today, will likely be at the top of the agenda for the incoming government. This week's podcast guest, the Knesset member Simcha Rothman, is one of the most important players in that debate—he is a central architect of the effort to reform Israel's judiciary. In conversation with Mosaic's editor Jonathan Silver, he explains how Israel's judiciary got stronger over time, why so many have sought to change it in recent years, and what changes he hopes to put into law. The terrorist was the son of a Palestinian from Jenin who was married to an Israeli-Palestinian woman from Northern Israel. This week the Knesset is scheduled to vote on one of the most impactful laws legislated in recent years, a law that could breach the very concept of what it means to be an Israeli - the Citizenship bill. This law is so controversial that it threatens to dismantle the coalition. Included in the law is the fundamental question of how a non-Israeli Palestinian may become a citizen of the State of Israel. One of the versions of this law to be voted on was proposed by our guest today, Knesset member Simcha Rothman. Simcha Rothman recently joined the Knesset as part of the Religious Zionist party led by Betzalel Smotrich. He is a lawyer and the co-founder of The Movement For Governability And Democracy, an NGO which advocates for returning power from the judicial to the legislative branch. His book, “The Supreme Court Faction” depicts how judges, prosecutors and bureaucrats have stolen power from the democratically elected representatives. My guest today is Simcha Rothman. Recently named by the Israeli financial daily "The Marker" as one of the 100 most influential people in Israel. I know Simcha from my TV days hosting the Spin Room, a debate show, and Simcha, being the attorney that he is, was a fierce and formidable rival for the folks I put up against him. He is the co-founder and legal counsellor of an NGO called Meshilut, the Movement for Governability and Democracy and he recently wrote a book called “The ruling party of Bagatz – How Israel became a legalocracy”, which is basically a tearing down of what he believes is the Israeli Supreme Court's over-interventionism.Now, I know I set out at the beginning of this podcast journey to listen to everyone and anyone between the River and the Sea, but I have to admit, this one was a challenge. Simcha is a settler, he doesn't even live in a settlement, he lives in an outpost! He's hardcore, Jewish right wing. Otherwise Occupied is not supposed to be a debate podcast, but I think at times this episode came close to that...I'll let you be the judge.
