Hacienda tendrá que devolverle a Shakira más de 60 millones de euros por una multa indebida por fraude. La justicia española ha dado la razón a la cantante colombiana al considerar que no se puede acreditar que fuera residente fiscal en España en 2011, pero sobre ella pesan otras condenas firmes por no pagar impuestos. Esta decisión obliga a Hacienda a devolverle una gran suma entre liquidaciones y sanciones, correspondiente a uno de los años más lucrativos de la carrera de la artista.El punto clave de la sentencia es la incapacidad de Hacienda para demostrar que Shakira pasó en España más de 183 días en 2011, requisito imprescindible para fijar la residencia fiscal. Según nos explica en el podcast el periodista especializado en información judicial de EL PAÍS Jesús García Bueno, la inspección solo logró acreditar 163 días, lo que ha resultado determinante. Aun así, la batalla legal deja un retrato complejo del caso: por un lado, la victoria administrativa en el ejercicio con mayor cuantía económica; por otro, la admisión de delito en años posteriores, que la artista zanjó aceptando una pena para evitar el juicio.Más allá del ámbito jurídico, el caso también ha tenido impacto en la narrativa pública de Shakira. Su entorno ha defendido durante años que se trata de un episodio del pasado, mientras que la propia cantante lo ha incorporado a su relato personal e incluso creativo.
