Ben and attorney Meryl Poulin of Gideon Asen talk with Rahul about a verdict obtained on September 30, 2022, in which a jury in Androscoggin County, Maine, returned a verdict of $5.5 million on a claim brought by the daughter of a decedent against a funeral services business for mishandling of her father's remains after death.  This is the largest jury verdict in Maine this year, and for the past several years.   At trial, the evidence showed that the funeral service was picking up decedents for cremation, but not processing the bodies for cremation, but rather allowing them to decompose in the basement of the funeral home.  Plaintiff alleged negligent and intentional infliction of emotional distress claims.  The damages claim was limited to Plaintiff's emotional distress in learning about the mishandling of her father's remains.  There were no physical injuries, medical expenses, or lost earnings claimed.   The pretrial offer was $7,500.   Here are some of the issues discussed on the podcast:  1. How to overcome defense attempt to benefit from a stipulation to liability.  2. How to turn Defendant's “acceptance of responsibility” argument against them at trial.  3. How to maximize recovery of emotional distress damages when there is minimal (or no) physical injury.  4. How to dismantle the “death by 1000 cuts” defense.  5. How to use voir dire to find jurors willing to assign real value to emotional distress damages.  6. How to captivate the jury with a powerful opening.  7. How to frame a powerful closing and rebutting close, even in a conceded liability case.  About Meryl PoulinMeryl is a Maine native and attended Colby College and the University of Maine School of Law. Meryl is an extraordinary athlete. At Colby, Meryl played varsity hockey, field hockey, and softball and was captain of the hockey and field hockey teams. Meryl was able to achieve incredible athletic success despite being sidelined for many months with two major knee injuries and reconstructive surgeries. Her experience dealing with chronic knee injuries gave her insight into the difficulties of living with pain and the effect of debilitating injuries on every part of a person's physical and emotional well-being. At Maine Law school, Meryl distinguished herself as an appellate advocate, winning the honor of “Prize Arguer” in her class and the Gignoux Award for Appellate Advocacy. Meryl was a part of two moot court teams that competed on a national level. In her third year, she and her moot court partner finished in the top three of a competition of more than forty. After law school, Meryl worked at a large law firm in Portland defending medical malpractice and personal injury cases. This work gave her a keen understanding of how insurance companies operate. “There is no shortcut to getting your client fairly compensated by an insurance company,” says Meryl. “You have to put your head down and do the work. Insurance companies respond only to intelligent, persistent, and dogged advocacy.” More recently, Meryl worked at Pine Tree Legal Assistance, Maine's largest legal aid organization. At Pine Tree, Meryl represented low-income Mainers in housing and eviction cases and survivors of domestic violence and sexual assault in protection order and family law cases. At Pine Tree Legal, Meryl tried nearly twenty cases to verdict and prevailed in all but one case. “I met Meryl when she was representing hospitals,” said Taylor Asen. “She was fearless, and I could see right away that she was going to be one of the best trial lawyers of her generation.”

Widely known as the “Pigford” or "Black Farmers" cases, this national class action lawsuit sought to address the racial discrimination Black farmers experienced between 1981 and 1996, including the denial or delay of their applications for federal farm credit services, loans or benefit programs. Citing the USDA's internal report of a failed civil rights complaint management system and a lack of diversity in Farm Service Agency county-level commissioners, Greg was able to negotiate a record settlement with the USDA for $1.25 billion to be distributed to class members in the form of damages, forgiveness of debt owed to the USDA and/or a tax payment to offset the awarded funds. This historic settlement was reached on February 18, 2010. As part of the settlement, President Obama signed the Claims Resolution Act of 2010, which provided $1.15 billion to pay successful claims. In May 2021, Gregorio published Just Harvest, a book detailing these groundbreaking cases against the U.S. government. Click Here to Read/Download the Complete Trial Documents   Guest Bio: Gregorio "Greg" Francis Awarded the Vince Monroe Townsend Legends Award by the National Bar Association for historic leadership in the area of Civil Rights and designated as a Game Changer by Politic365. Gregorio (Greg) Antonio Francis currently serves as lead counsel for the historic Black Farmers case. This national class action challenged the ongoing disparate treatment of Black Farmers across the United States resulting in a $1.25 billion dollar settlement. Nearly 20,000 Black farmers or their descendants received the “JUSTICE” they had long demanded. In RE: Black Farmers is the largest settlement of a Civil Rights case in the history of the American Civil Justice system. Francis began his legal career in 1994 as an associate with a statewide defense firm specializing in medical malpractice defense, nursing home defense and municipal defense. In 2001, Francis joined the law firm of Morgan and Morgan, P.A., as a Partner, focusing his practice on medical malpractice, police misconduct, wrongful death and catastrophic personal injury cases. From 2004-2006, Morgan & Morgan, P.A., participated in a joint venture with famed trial lawyer Johnny Cochran to open an office in Miami, Florida where Francis served as the co-managing partner. After achieving great success with The Cochran Firm, Francis became a shareholder of Morgan & Morgan, P.A. As the firm expanded, Francis was instrumental in opening new offices in Atlanta, Georgia and Jackson, Mississippi. He held the position of managing partner for the Jackson, Mississippi office from its inception through 2014, Francis also served on the firm's Executive Committee. In 2018, Francis joined longtime friend and colleague Joseph A. Osborne in forming their own firm, Osborne & Francis, PLLC. The firm has offices in Boca Raton and Orlando. Their firm will focus primarily on product liability, medical device litigation, pharmaceutical litigation, medical malpractice and personal injury litigation. Today on See You in Court, we are honored to be joined by the Honorable Stephen Louis A. Dillard, presiding 73rd Judge of the Court of Appeals of Georgia.  Honorable Stephen Louis A. Dillard: Presiding Judge Stephen Louis A. Dillard was appointed as the 73rd judge of the Court of Appeals of Georgia on November 1, 2010, by Governor Sonny Perdue. Prior to his appointment, Judge Dillard was in private practice with James, Bates, Pope & Spivey in Macon, serving as chairman of the firm's appellate practice group. Judge Dillard was elected and reelected by his fellow Georgians in 2012 and 2018. On July 1, 2017, Judge Dillard was sworn in as the 30th Chief Judge of the Court of Appeals of Georgia for a two-year term that ended on June 30, 2019. He currently serves as the presiding judge of the Court's Fourth Division. Judge Dillard was born in Nashville, Tennessee on November 13, 1969. He attended and graduated from Hillwood High School in Nashville, Tennessee; Samford University (B.A. 1992); and the Mississippi College School of Law (J.D., cum laude, 1996). In college, Judge Dillard was a member of The Sigma Chi Fraternity and Omicron Delta Kappa. How do you empower a movement?   Aaron Freiwald, Managing Partner of Freiwald Law and host of the weekly podcast, Good Law | Bad Law, is joined by Law Professor Raymond Brescia, of Albany Law School, to discuss social movements, social change, and the impact of technology. The Hon. Harold R. Tyler Chair in Law and Technology at Albany, Ray is a student of today’s topic, having long been interested in the intersection between technology and community organizing.   In his most recent book, The Future of Change: How Technology Shapes Social Revolutions, Ray identifies a series of “social innovation moments” in American history. Today, Aaron and Ray explore the notions of “The Future of Change” and how these ideas relate to today’s technology, social media platforms, and cultural movements. In both his book and today’s episode, Ray explains that, almost without fail, developments in how we communicate shape social movements, just as those movements change the very technologies themselves. Aaron and Ray discuss these ideas using historical parallels and examples, such as the effects of the advent of the steam printing press on the Abolitionist movement, as well as contemporary instances and examples like Twitter and the #MeToo movement. Ray illuminates the complicated, dangerous, innovative, and exciting relationship between these technologies and social change. Aaron and Ray delve into how social movements have embraced communications technologies, touching on the topics of grass roots organizing, the duality of technology, shared destiny, group thinking and combating confirmation bias, deep fake videos and “fake news,” creativity in problem solving and advocacy, messaging and promotion, Ray’s notion of “the matrix,” and more.   Professor Brescia combines his experience as a public interest attorney in New York City with his scholarly interests to address economic and social inequality, the legal and policy implications of financial crises, how innovative legal and regulatory approaches can improve economic and community development efforts, and the need to expand access to justice for people of low and moderate income. Before his time at Albany, Professor Brescia was the Associate Director of the Urban Justice Center in New York, N.Y., where he coordinated legal representation for community-based institutions in areas such as housing, economic justice, workers’ rights, civil rights, and environmental justice. Prior to his work at the Urban Justice Center, Professor Brescia was a staff attorney at New Haven Legal Assistance and the Legal Aid Society of New York, where he was a recipient of a Skadden Fellowship after graduation from law school.   Professor Brescia also served as a Law Clerk to the pathbreaking Civil Rights attorney-turned-federal judge, the Honorable Constance Baker Motley, Senior U.S. District Court Judge for the Southern District of New York. To ensure that the family members and friends of a deceased love one are focused on processing their grief, the funeral home has professional conduct and dress codes. In 2007, the funeral home hired Stephens, a biological male, who agreed to abide by these codes, including the company’s sex-specific dress policy, in his work as a funeral home director. Six years later, Stephens approached the funeral home’s owner, said that he was actually a woman trapped in a man’s body, and expressed his intent to come to work wearing a dress. The owner was very concerned about Stephens and also about other employees and clients; he ultimately determined that it was best for everyone to part ways. The EEOC sued and claimed that this was “sex” discrimination under Title VII. The 6th Circuit agreed, but the Supreme Court has now agreed to hear the case. Although the federal government now concedes that it was wrong in the interpretation of Title VII that it persuaded the 6th Circuit to adopt, Stephens, represented by the ACLU, defends the 6th Circuit’s ruling. Marshall Rothstein served as a Justice on the Supreme Court of Canada from 2006 - 2015. He previously was a Judge on the Federal Court of Canada and the Federal Court of Appeal. Garth Barriere is a criminal defence attorney in Vancouver. He was counsel in Khosa v. Canada (Citizenship and Immigration, a major Supreme Court of Canada immigration decision in which Justice Rothstein wrote a concurring opinion. In this episode Justice Rothstein provides tips for written and oral advocacy. While the focus is on appellate litigation, anyone interesting in strengthening their advocacy skills will benefit from what he has to say. Alt is an attorney admitted to the bars of Ohio and the U.S. Courts of Appeals for the Sixth and D.C. Circuits, a member of the Mont Pelerin Society, the U.S. Supreme Court Historical Society, and a former Fellow in the Center for Constitutional Jurisprudence at the Claremont Institute where he was also a Publius Fellow in 1998. Alt earned his J.D. from The University of Chicago Law School, where he was Symposium Editor and the winner of the Mulroy Prize for Excellence in Appellate Advocacy as well as Research Assistant to renowned law professor Richard Epstein. Following law school, he clerked for Judge Alice Batchelder on the U.S. Court of Appeals for the Sixth Circuit. The 2017-2018 Constitution Revision Commission (CRC) is the third of its kind in Florida history. In this episode of The Florida Bar Podcast, host Christine Bilbrey talks to Mary Adkins, author of the book Making Modern Florida: How the Spirit of Reform Shaped a New Constitution (University Press of Florida, 2016). Professor Adkins has researched the history of the 1968 Florida Constitution and its revisions. Florida is the only state in the nation that offers a process for individuals to speak directly to Commissioners to propose constitutional amendments that could potentially be placed onto Florida's 2018 General Election ballot for voter consideration.  Mary Adkins is the director of Legal Writing and Appellate Advocacy and a Master Legal Skills Professor at the University of Florida Levin College of Law.
