This week on Trump's Trials, host Scott Detrow is joined by retired Supreme Court Justice Stephen Breyer. In Breyer's new book Reading the Constitution: Why I Chose Pragmatism, Not Textualism, Breyer explains why he finds textualism's popularity troublesome. Textualism is the legal theory that argues the correct way to interpret the Constitution and statutes is to read the text as it was understood at the time the documents were written. Pragmatism, the legal theory Breyer favors, takes current social and political context into consideration when formulating a legal opinion. In Breyer's view, textualism can weaken the public's faith in the rule of law and poses risks for the health of nation. However, Breyer was reluctant to comment on cases pending before the court, like former President Donald Trump's claim he is immune from criminal prosecution because of presidential immunity. Last month, Russell Brown announced he was stepping down as a justice of the Supreme Court of Canada. His resignation put a halt to the Canadian Judicial Council's probe of a claim of misconduct directed against Brown related to an incident in the United States. And it means there won't be a public report on the matter. Accounts of the incident differ but it has been established there was some kind of fight between Brown and a US Marine veteran at a resort in Scottsdale, Arizona. Editor David Horovitz and investigative reporter Inna Lazareva join host Amanda Borschel-Dan on today's episode. Former Supreme Court head Aharon Barak gave a series of television interviews over the weekend in which he stated unequivocably that he is worried about new Justice Minister Yariv Levin's proposed judicial reforms. What were some of Barak's statements? Three drivers employed by the Prime Minister's Office for roughly 30 years as part of the premier's motorcade were reportedly fired earlier this week, amid reports that Benjamin Netanyahu is clearing house of staff who served in the previous government. However, the drivers are set also to serve as prosecution witnesses in the ongoing trial against Netanyahu. Horovitz connects some dots. A team of Israeli archaeologists from the Universite of Haifa and the Hebrew University has discovered what it claims is the earliest evidence of silver being used as currency in the Levant, dating back more than 3,600 years. The analyzed silver hoards are found in strata that date to 500 years prior to previous estimates. Borschel-Dan gives some context. Finally, Lazereva shares some of the horrors she uncovered during her in-depth investigation into what many Ukrainian women who fled their homes for Israel face when they get here. Conservative leader Andrew Scheer says Liberal members of the House of Commons justice committee have an opportunity today to do the right thing and get the answers Canadians deserve on the SNC-Lavalin scandal. The Conservatives are putting forward a motion for the committee to investigate allegations that Prime Minister Justin Trudeau's aides pressured Jody Wilson-Raybould to help SNC-Lavalin avoid criminal prosecution. Scheer says voting against or watering down the motion down is an admission of guilt. The Liberal chairman of the committee says his biggest concern is that the committee may be too partisan a venue for a review of the matter. Wilson-Raybould has retained the counsel of Thomas Cromwell, who served on the Supreme Court of Canada from 2008 to 2016 - an unusual step for a departing cabinet minister. Marshall Rothstein served as a Justice on the Supreme Court of Canada from 2006 - 2015. He previously was a Judge on the Federal Court of Canada and the Federal Court of Appeal. Garth Barriere is a criminal defence attorney in Vancouver. He was counsel in Khosa v. Canada (Citizenship and Immigration, a major Supreme Court of Canada immigration decision in which Justice Rothstein wrote a concurring opinion. In this episode Justice Rothstein provides tips for written and oral advocacy. While the focus is on appellate litigation, anyone interesting in strengthening their advocacy skills will benefit from what he has to say.
